Butte County Board of Supervisors - (Item determined to be a General Rule Exemption from
environmental review) Zoning Code Amendment to Section 24-90 (Agricultural Zones) to allow
feed stores subject to a Condition Use Permit in A-5 through A-160 (Agricultural - 5 acre parcels
through Agricultural - 160 acre parcels) zoning districts, and adding Section 24-3-5.148 defining
feed stores, County-wide. (ZCA 99-01) (CBS)
Mr. Sanders gave a brief summary of the project. He discussed the advantages and disadvantages of
granting this amendment.
Commissioner Cage asked if this use could, in the broad sense, be considered a home occupation?
Mr. Sanders said the use is allowed today, if the hay or grain is grown on-site. He said this amendment will
also add a definition of a feed store.
The hearing was opened to the public.
Vice Chairman Nelson noted the letters received from Mr. and Mrs. Thomas, and Mr. and Mrs. Little.
Mrs. Thomas read her letter. She said she was opposed to this amendment. She was concerned with the
possible loss.of agricultural land.
Wally Roney said he buys hay for his cattle and sells the excess, if there is any. He wanted to know if that
falls under the definition of a feed store?
Staff said no.
Fred Gerst said this is not his interpretation of the intent of the Agriculture Element. He said it is the intent
of the Agriculture Element to keep commercial industry out of the ag. zones. He said he would like to see
the decision on this postponed until after they finish the implementation of the Agriculture Element. He said
feed stores also sell dog food, for which a sales tax is collected. He said the State Board of Equalization has
determined that dogs are pets and not farm animals. He said that hay sold for horses is taxed and hay sold
for cows is not. He said the State Board of Equalization has determined that horses are not farm animals .
anymore.
Vice Chairman Nelson said it was not their intent to put feed stores all over the agricultural lands. He said
this would be an accessory use, i.e., for a stable that wants to sell equipment, supplies, feed, etc.
Mr. Gerst said this amendment will be abused and will open the door for large commercial uses in the
agricultural areas. He said this proposal does not address setbacks from other agricultural uses. He
discussed financing the store. He said most lending institutions will not finance the whole farm, so there
will be request to segregate the store. He_thought approval of this amendment was premature.
The-hearing was closed.
Commissioner Lambert said she has not come to the conclusion that stables should be allowed, never mind
a feed store, in the agricultural zones. She said she agrees with Mr. Gerst that this should wait until after
the implementation of the Agriculture Element.' She said she did not feel this use is directly related to
agricultural uses. She said this is a commercial use. She noted the increased vehicle trips on rural roads.

She said she could not support this amendment. She said they need a definition of agricultural uses. She
said stables are not appropriate in orchard and field crop designations.
Vice Chairman Nelson did not believe this would be a problem. He said the intent is to supplement a
business such as a stable.
Commissioner Cage said it seems like they are asking the agricultural people to allow a commercial use in
the agricultural zones. She discussed the impact to existing commercial stores. She was against the project.
Commissioner Mooney said this is a commercial use and he is against this amendment.
It was moved by Commissioner Lambert, seconded by Commissioner Cage, and carried to recommend the
Board of Supervisors not amend Section 24-90 C. 3 to allow feed stores in the A-5 through A-160 zones.

Commissioner Cage said if someone who grows fruits and vegetables sell'them,that is fine. She was against
a store taking business away from the existing stores.

The Board of Supervisors of the County of Butte, State of California,

4 under and pursuant to Section 24-25.40 of the Butte County Code of said County,
5 ORDAINS, as follows:
6 SECTION 1. Section 24-90, entitled "A=5 through A-160 (Agricultural)
7 zones", of the Butte County Code is hereby amended by amending subpart 3 of§C
8 thereof, entitled "Uses requiring Use Permits", to read as follows:

§24-90 C. 3. Kennels, feed stores, public or riding stables, and
10
academies.

12 SECTION 2. Section 24-305.148 of the Butte County Code is hereby
13 added to read as follows:
14 §24-305.148. Feed Store - A retail establishment limited to the sale
15 of hay, grain, and other food supplies for farm and domestic animals. Animal
16
maintenance products including medicines, vaccines and grooming supplies may
17
also be sold provided that the sale of these products is ancillary to the sale of feed
18
19 products. Outdoor storage of products other than feed or grain shall be prohibited
20 SECTION 3. This Ordinance shall be and it is hereby declared to be
21 in full force and effect from and after thirty (30)days after the date of its passage,
22
and before the expiration of fifteen (15) days after its passage, this Ordinance shall
23
be published once with the names of the members of the Board of Supervisors

SUMMARY: The proposed code amendment was initiated by the Board of Supervisors on August 25, 19983
in response to a Use Permit request to allow a feed store in conjunction with a horse boarding facility. Both the
Planning Commission and Board of Supervisors,at that time,denied the feed store request because the zoning
code did not have any provision for a feed store use in the Agricultural Zones.
ACTIONS FOR CONSIDERATION:
I. The Planning Commission recommends denial of the proposed code amendment,at this time. In doing
so, the Board may wish to direct that a comprehensive discussion of "agricultural support" and
"agricultural dependant"uses occur at the Planning Commission level with recommendations being
forwarded to the Board.
II. If the Board of Supervisors chooses to approve the proposed code amendment,the following findings
and motion are appropriate:
Section 1: Environmental Findings.
A. The proposed amendment has been reviewed and found to be exempt from review under the
California Environmental Quality Act.pursuant to Section 15061(b) (3). This section states
that,"CEQA only applies to projects which have the potential for causing a significant effect
on the environment. Where it can be seen with certainty that there is no possibility that the
activity in question may have a significant effect on the environment,the activity is not subject
to CEQA." This code amendment meets this CEQA exemption because:
1. This amendment to the zoning code will not result in any direct,physical changes to
the environment. Each application for a use permit will require individual CEQA
review where the characteristics of the site and features of the proposed development
can be evaluated for direct and physical changes.
Section 2: General Plan and Zoning Findings.
A. Find that the proposed changes to Chapter 24 of the Butte County Code adding feed stores as
a use requiring a Conditional Use Permit in the A-5,A-10,A-20,A-40, &A-160 zones and
adding a definition of feed stores, are consistent with the Land Use Element and all other
elements as a whole, because the use is consistent with the land use designations where
Agricultural zoning is used to implement the General Plan and is supported by Agricultural
Element Policies 3-5 and 6.1 and Land Use Element Policies 4.1 and 4.3a.
Section 3. Action.
A. Adopt an ordinance adding feed stores to Section 24-90 C. 3 and adding Section 24-305.148
defining feed stores as "A retail establishment limited to the sale of hay, grain, and other
food supplies for farm and domestic animals. Animal maintenance products including
medicines, vaccines and grooming supplies may also be sold provided that the sale of these
products is ancillary to the sale of feed products. Outdoor storage of products other than feed
or grain shall be prohibited."

3 under and pursuant to Section 24-25.40 of the Butte County Code of said County,
4 ORDAINS, as follows:
5 SECTION 1. Section 24-90 of the Butte County Code is hereby

amended to read as follows:

products including medicines, vaccines and grooming supplies may also be sold
15
16 provided that the sale of these products is ancillary to the sale of feed products.

STAFF COMMENT:
The proposed code amendment was initiated by the Board of Supervisors on August 25, 1998, in
response to a Use Permit request to allow a feed store in conjunction with a horse boarding facility.
Both the Planning Commission and Board of Supervisors, at that time, denied the feed store request
because the zoning code did not have any provision for a feed store use in the Agricultural Zones.
On January 28, 1999, the Planning Commission heard and discussed the proposed code amendment
and recommended on a 3 to 1 vote that the Board of Supervisors not approve the change. The major
reasons for the recommendation were concerns over the compatibility of commercial uses with
agricultural operations, traffic,the impact of allowing feed stores or similar businesses in commercial
zones, and concerns over whether the use is truly needed within the agricultural area to support
agricultural uses. -
ANALYSIS:
The addition of feed stores to Section 24-90 will allow any property owner with land zoned A-5,A-10,
A-20, A-40, or A-160, to submit a Use Permit application seeking approval for a feed store on their
property. As proposed, these feed stores will be limited to retail establishments only selling feed
supplies and animal maintenance products such as vaccines,medicines, food supplements, etc.
The Agricultural zones are intended to be applied to those areas of the County that are to be retained
for intense agricultural uses. Generally,uses that can be located on other,less productive lands should
be kept out of the agricultural areas. It was the general consensus of the Planning Commission that
the proposed use is more appropriate for a commercial zone and that persons wishing to establish a
feed store should obtain the appropriate commercial zoning. The motion approved by the Planning
Commission was based on this concept.

This request touches on the issue of what constitutes"agricultural support"or"agricultural dependant"
uses, as stated in the Agricultural Element. In their discussions, the Planning Commission noted that
the Agricultural Element has not been implemented and that an examination of the uses permitted in
the Agricultural Zones should be saved for the implementation process. This is an option on which the
Board of Supervisors may wish to provide additional direction.
If the Board of Supervisors wishes to approve the proposed code amendment,they should find that feed
stores,as described in the proposed definition,are an agricultural support use and as such are consistent
with the Butte County General Plan including the Agricultural Element. A more complete discussion
of policies to support this action are contained in the Planning Commission agenda report dated
January 28, 1999, included as attachment"A".
ACTIONS FOR CONSIDERATION:
I. The Planning Commission recommends denial of the proposed code amendment, at this time.
In doing so, the Board may wish to direct that a comprehensive discussion of"agricultural
support" and "agricultural dependant" uses occur at the Planning Commission level with
recommendations being forwarded to the Board.
II. If the Board of Supervisors chooses to approve the proposed code amendment, the following
findings and motion are appropriate:
Section 1: Environmental Findings.
A. The proposed amendment has been reviewed and found to be exempt from review
under the California Environmental Quality Act pursuant to Section 15061(b) (3).This
section states that, "CEQA only applies to projects which have the potential for causing
a significant effect on the environment. Where it can be seen with certainty that there
is no possibility that the activity in question may have a significant effect on the
environment, the activity is not subject to CEQA." This code amendment meets this
CEQA exemption because: .
1. This amendment to the zoning code will not result in any direct, physical
changes to the environment. Each application for a use permit will require
individual CEQA review where the characteristics of the site and features of
the proposed development can be evaluated for direct and physical changes.
Section 2: General Plan and Zoning Findings.
A. Find that the proposed changes to Chapter 24 of the Butte County Code adding feed
stores as a use requiring a Conditional Use Permit in the A-5, A-10, A-20, A-40, &
A-160 zones and adding a definition of feed stores, are consistent with the Land Use
Element and all other elements as a whole,because the use is consistent with the land
use designations where Agricultural zoning is used to implement the General Plan
and is supported by Agricultural Element Policies 3-5 and 6.1 and Land Use Element
Policies 4.1 and 4.3a.

property. Feed stores can take many forms, from simply providing alfalfa, hay, grain, and other feed
supplies to full service retail stores selling items from dog toys to parakeet seed.
There are pros and cons associated with allowing the use in a rural area. The advantages of allowing
feed stores in Agricultural Zones are as follows:

1. Provides a more convenient location for the agricultural community to obtain necessary
services directly related to agricultural uses.
2. Gives a farm or ranch another option to supplement their income.
3. Helps reduce time and costs associated with trips to urban areas to purchase feed.
4. Has the potential to reduce the cost of transporting locally grown feed supplies to urban areas.
There are also potential concerns with allowing this use in Agricultural Zones:
1. Potential increased traffic to and within the area.
2. Potential incompatibility with adjoining uses.
3. The use may expand beyond feed sales to include a variety of retail products that are not
directly related to agriculture.
4. Establishes a commercial retail use that, over time, may be used to justify a commercial land
use designation. Particular pressure to recognize a commercial use may arise if the original
operation is,either financially unsuccessful or-too successful.
The potential pitfalls can generally be addressed through the Use Permit process and hopefully few
land use conflicts will arise. However, if limitations are not placed on the types of retail items that
are offered, the potential for incompatibility with agriculture may be significant, affecting adjoining
lands. Staff recommends that a definition of feed stores accompany this code change to provide
appropriate limitations on these uses. The proposed definition for feed stores is as follows:
Section 24-305.148 Feed Store-A retail establishment limited to the sale of hay, grain, and other
food supplies for farm and domestic animals. Animal maintenance products including medicines,
vaccines and grooming supplies may also be sold provided that the sale of these products.is ancillary
to the sale of feed products. Outdoor storage of products other than feed or grain shall be prohibited.
When adding uses to a zoned district, the General Plan Land Use designations must be reviewed to
ensure that consistency is maintained between the General Plan and implementing Zone Districts.
Agricultural Zones are listed as a consistent zone in the following General Plan land use designations,
Orchard and Field Crops, Grazing and Open Lands, Agricultural Residential, Timber Mountain, and
Foothill Area Residential. A review of the primary and secondary uses allowed in these designations
is needed to ensure the intent of the General Plan is being implemented.
Orchard and Field Crons
Primary Uses: Cultivation, harvest, storage, processing, sale and distribution of all plant crops,
especially annual food crops.

Secondary Uses: Animal husbandry and intense animal uses, resource extraction and processing,
hunting and water-related recreation facilities, dwellings, airports, utilities, environmental
preservation activities,public and quasi-public uses,home occupations.
Grazilig and Open Lands
Primary Uses: Livestock grazing, animal husbandry, intense animal uses and animal matter
processing.
Secondary Uses: Resource extraction and processing, forestry, plant crops, agricultural support
services, outdoor recreation facilities, airports, dwellings, utilities, environmental preservation
activities, public and quasi-public uses and home occupations.
Agricultural Residential
Primary Uses: Agricultural uses and single-family dwellings at rural densities.
Secondary Uses: Animal husbandry, forestry, intense animal uses, home occupations, mining,
outdoor recreation facilities, environmental preservation activities, airports, utilities, public and
quasi-public uses, group quarters, care homes and transient lodging.
Timber Mountain
Primary Uses: Forest management and the harvesting and processing of forest products.
Secondary Uses: Animal husbandry,resource extraction and processing environmental preservation
activities; outdoor recreation facilities, dwellings, utilities, public and quasi-public uses, home
occupations, and airports.
Foothill Area Residential
Primary Uses: Single family dwellings at rural densities.
Secondary Uses: Agricultural uses, animal husbandry,home occupations,resource extraction and
processing, forestry, outdoor recreational facilities, environmental preservation activities, airports,
utilities,public and quasi-public uses, dwellings, group quarters, care homes, and other secondary
uses which are consistent with the Foothill Area Residential designation.
The Orchard and Field Crop and Grazing and Open Space designations listed above are also
supplemented by the Agricultural Element of the General Plan. Policies within the element that
address agricultural support uses are as follows:
AE Policy 3.5 The primary purpose of the Orchard and Field Crop and Grazing and Open Lands
land use categories shall be for agricultural production, related processing, and
services in support of agriculture. Residential uses, such as the farmer's home, in

these categories are secondary uses and are permitted on a limited basis to assist and
support agriculture.
AE Policy 6.1 Facilitate agricultural production by considering a limited range of ancillary or
support services/uses. These services/uses shall directly relate to agricultural
production occurring in the surrounding area or dependent upon an agricultural
location to function.
Of the five land use designations, only the Grazing and Open Lands designation specifically lists
agricultural support services as a secondary use. However, based upon the Agricultural Element
policies, the proposed zoning code amendment would also be compatible in the Orchard and Field
Crop designation.
The proposed use is not specifically compatible with the Agricultural Residential, Timber Mountain
and Foothill Area Residential designations. Future requests for use permits within these land use
designations may have to be denied due to General Plan consistency requirements. This does not
appear to be a problem in the Timber Mountain and Foothill Area Residential designations as no land
within these designations is currently in an Agricultural Zone District. The Agricultural Residential
designation is•implemented by Agricultural Zones in many locations in the County and is the only
designation where the question of land use consistency might arise. One remedy to this situation
would be to amend the general plan designation to either add agricultural support uses or remove
Agricultural Zones from the list of consistent zones. Ultimately, the direction on the issue of
General Plan consistency should come from the Planning Commission and Board of Supervisors.
Other policies in the Land Use Element that could be used to support this code change are:
LEE Policy 4.1 a- Provide sites and facilities to accommodate a variety of economic activities.
LEE policy 4.3a - Encourage a full range of commercial services at the regional, community and
neighborhood levels.
RECOMMENDATION: Staff recommends that the Planning Commission recommend that the
Board of Supervisors amend the Agricultural zones to add "feed stores" to Butte County Code
Section 24-90 C. 3. and add Section 24- 305.148 defining feed stores as: "A retail establishment
limited to the sale of hay, grain, and other food supplies for farm and domestic animals. Animal
maintenance products including medicines, vaccines and grooming supplies may also be sold
provided that the sale of these products is ancillary to the sale of feed products. Outdoor storage of
products other than feed or grain shall be prohibited." The issue of General Plan consistency in
the Agricultural Residential designation can be resolved in a future General Plan Amendment. In
the interim applicants will be cautioned and discouraged from making Use Permit requests where
the finding of General Plan conformity cannot be made.

Dear Members of the Planning Commission:
I was very disappointed to see our County Supervisors appealing for
an amendment to current zoning laws of Butte County. This being an
amendment to zoning code section 24-90, allowing feed stores to be. built
on agricultural land from parcel zones A-5 to A-160.
I feel that this request solely brought about do to an earlier request to
build and operate a feed and tack store on the agricultural land of Smith Ave
in Biggs. A request that was previously denied by the planning commission
some months ago, because.it was found to be.inconsistent use of
agricultural land. Living on Smith Ave. this would have a effect on myself
and my family two-fold .
The first effect, needless to say would be more development changes
to small rural agricultural communities such as ours. Having boarding
stables large enough to accommodate 30 horses (approx 4,000 sq ft.), and
a 250' x 150' roping and riding arena to allow 35 attendees / participants
already gaining approval to be built, a feed and tack store would only add to
the unfavorable impact on our small, rural community. Dust, lights, noise
and most importantly increase traffic congestion ( on our small one lane
country road) would just be some of the numerous burdens we will have to
live with in a daily basis. Also, the imposed feedstore, without size
limitations could possibly grow to a. much unwanted giant:
I, on the other hand do understand that feed/ tack stores are indeed
related to agriculture, but they are still commercial businesses. If this is
indeed approved who is to say what the limitations are, after all this county
is surrounded by agricultural related businesses : food processing plants, ;
fertilizer Co., and tractor sales establishments just to name a few, who is
to say that they won't some day be gobbling up our remaining agriculture
land. Once this unfortunate door is open, who is to say where the
development of our lands will end.
In the future as more and more agriculture land is consumed in the
south by development, more people are migrating north making it harder to
maintain .our devotion to agriculture. Butte County being mainly based on
agriculture as it is, we must be the watch dogs and protect our land from
misuse and over development. Land is one if the only finite things this
world has, so we cannot afford to waste it. I feel if this amendment was
allowed to pass it would not be in the best interest of preserving agriculture.

Being the members of the Planning Commission, I believe it is your
responsibility, and ours (the people) to protect the future of Butte County
and it's farming communities; .to look at facts and closely determine who in
fact is using the land for the betterment of agriculture and who is simply
using the land for nothing more then self-serving development purpose.
Agricultural land is not expendable, we only have what is left and cannot
afford to waste it on non-conforming issues such as this.
I urge you to look closely at what the proposed amendment really is,
the tip of a huge iceberg that when given time could do extreme damage to
Butte Counties Agricultural Communities.
As a life long (47+ yrs.) resident of Butte County I would like to
thank you for your time and urge you to vote no on this amendment
proposal'.
