Prior to issuance of the use permit, record as a separate instrument an Avigation Easement granting the right of continued use of the airspace above the proposed parcel by the Chico Municipal Airport and acknowledging any and all existing or potenifial airport operational impacts. 2. Airspace review by the Airport Land Use Commission is required for all objects, including trees, over 100 feet in height." The proposed facility is approximately 31,500 square feet. The project site is located on the southwest corner of Amber Grove Drive and Esplanade, in the City of Chico. SUMMARY: Staff recommends that ALUC find the project consistent with the 2000 Airport Land Use Compatibility Plan for the Chico Municipal Airport. BACKGROUND: • The .project site is approximately 2.58 acres. • The site is currently developed with two single-family dwellings and' accessory improvements. All existing improvements will be removed. • The property is located in the City of Chico and is zoned OR (Office Residential). • The proposed use permit would allow a 50 -bed Alzheimer (& other dementia related conditions) Residential Care Facility in a 31,500 square foot building. ANALYSIS: • The project site is approximately 1.82 miles southwest of the runway (13L — 31R) for the Chico Municipal Airport and is 1.67 miles southwest of the extended runway centerline. • The project site is within Airport Compatibility Zone D (Other Aim -port Environs) for the Chico Municipal Airport. • This project is a major land use action as defined by Policy 1.5.3(a)(4) of the 2000 Butte County Airport Land, Use Compatibility Plan (ALUCP). ■ Butte County Airport Land Use Commission ■ ALUC File No. A09-0003 (Peterson — Amber Grove) ■ ■ June 17, 2009 ■ Page 1 of 7 ■ • The primary compatibility criteria for the D Compatibility Zone is shown on the following table: Zone Maximum Intensity Other Uses ( eo le/ac Req'd Open Land Prohibited Uses Other Development Conditions Average. The project site is located outside the 55 CNEL for the noise impacts for the Expanded Forecast, Future Average Fire Season Day and Peak Fire Attack Day. ENVIRONMENTAL DOCUMENTATION: No environmental documentation has been completed for this project by ALUC staff. The Butte County or City of Chico planning staff will complete an environmental initial study and make a determination per the California Environmental Quality Act as part of their processing of the vesting tentative subdivision map. RECOMMENDATION: Staff recommends that the Butte County Airport Land Use Commission find ALUC File No. A09-0003 (Peterson — Amber Grove) consistent with the 2000 Airport Land Use Compatibility Plan for the Chico Municipal Airport. The following findings have been prepared at the direction of the ALUC and are for the consideration of the Lead Agency (Butte County) when making a decisiom on the project.
