The site is located on the east side of the Esplanade, approximately 1;000 feet south of the intersection of Esplanade and Highway 99 (north Chico). FOR: Airport Land Use Commission Meeting on�stl5,01 SUMMARY: Staff recommends that AL UC find the project consistent with the 2000 Airport Land Use Compatibility Plan for the Chico Municipal Airport. BACKGROUND: The site is located approximately 9,000 feet due west of runway 13R -31L of the Chico Municipal, Airport. The property is in the unincorporated County area and under County jurisdiction. The current General Plan land use designation is Commercial and the zoning is C-2 General Commercial. An existing 89 -foot lattice -type communications tower is presently located on site. With antennas and lightning rod the total height of the structure is 99 feet. The applicant is seeking to replace the existing tower with a 110 -foot monopole tower that will have a total height of 114 feet including antennas and lightning rod. The increased tower height will allow for additional antennas to be co -located on the tower. The original tower was installed in compliance with Use Permit 98-04, issued December 17, 1997. An avigation easement was granted to the City of Chico on December 24, 1997. The only other condition of approval related to aircraft safety was the requirement for a flashing red light atop the tower. ANALYSIS: According to the 2000 Airport Land Use Compatibility Plan (ALUCP) for the Chico Municipal Airport, the property is located in a Traffic Pattern Compatibility Zone D - Other Airport Environs. Within Zone D, airspace review is required for proposed objects greater than 100 feet in height. At an elevation of approximately 177 feet above mean sea level (amsl), the project site is about 63 feet below the runway elevation at Chico Municipal Airport. The project site is within the FAR Part 77 boundary for the Horizontal Surface which has -an elevation of 390 feet amsl. This puts the top of the tower approximately 99 feet below the Horizontal Surface.. At over 9,000 feet away from the runways, the tower location is not under any designated flight tracks and does not pose a hazard to flight traffic associated with operation of the airport. 9Butte County OAirport1 and Use Commission 9 4 Though not required by FAA regulations, for a tower of this height, it is recommended that the requirement for a flashing light be fetairied for visibility. Occasionally, emergency and law enforcement aircraft follow the highway corridor at lower flight elevations. A requirement to paint the tower alternating bands of red and white is not recommended as the site is not in a flight corridor and the treatment would have, a negative .aesthetic impact to two highly traveled transportation routes: The proposed' tower does. not pose a hazard to any private use airstrips as there are none in the immediate vicinity. . Environmental Documentation: No environmental documentation has been completed for this project. RECONEVIENDATION: Staff recommends that the Butte County Airport Land Use Commission find ALUC File No. A01-04 (Spectrasite Inc.) consistent with the 2000 Airport Land Use Compatibility Plan for the Chico Municipal Airport. APN 006-400-056 The Airport Land Use Commission has prepared the following findings based on data contained in the 2000 Airport Land Use Compatibility Plan (ALUCP) for the Chico Municipal Airport, as well as site specific information submitted by the applicant and the ALUC staff. The following findings have been prepared at the direction of the ALUC and are for the consideration of the Lead Agency (County of Butte) when making a decision on the project. SECTION 1: ENVIRONMENTAL FINDINGS A. No environmental documentation was submitted at the time of project review. SECTION 2: CONSISTENCY FINDINGS FOR PROPOSED PROJECT. A. The proposed project will be consistent with the 2000 Airport Land Use Compatibility Plan (ALUCP) for the Chico Municipal Airport if the requirements in Section'3 are applied as a condition to the Minor Use Permit. . B. Approval of the project without implementation of the requirements in Section 3 would necessitate the adoption of Overriding Findings by a 2/3 vote, of the governing. body. Overriding Findings by the governing body can only be made based .up substantiated facts and must be supported by new substantial factual 'evidence introduced into the public -record that the proposed action is consistent with the State •Aeronautics Act as stated in Section 21670. Overriding findings cannot be adopted as matters of opinion, here say, or upon the unsubstantiated fears and desires of the governing body. Section 3: PROJECT FINDINGS: A. According to the 2000 ALUCP for the Chico Municipal Airport, the project is listed in a Compatibility Zone "D" — Other Airport Environs. Communication 'towers are listed as a compatible use in this zone. B. An airspace. review. has been completed in accordance with the ALUCP for structures over 100 feet in height. C. The study was, to determine a proposed structure's effect, if any, on navigable airspace. ASAC's study is conducted in accordance with Part 77 of the Federal Aviation Regulations, FAR (14 C.F.R. Subchapter E, Part 77) and Part 17 of the Federal Communications Commission, FCC Rules and Regulations (47 C.F.R. Part 17). The proposed construction site is located near Chico, CA. The NAD 83 site coordinates are Latitude 39° 47' 26.70" North, Longitude 121° 53' 39.20" West. The site has a surface elevation of 177 feet above mean sea level (MSL). The structure has a proposed height of 114 feet above ground level (AGL), which includes the additional height of any antennas, etc. This gives an overall structure height above mean sea level of 291 feet AMSL. The site is located 9,221 feet or 1.52 nauticalmiles on a True Bearing of 252.43 degrees from the approach end of Runway 13R at Chico Municipal Airport, the nearest landing surface for regulatory compliance purposes,., The surface elevation' at this point is 224 feet AMSL. The site is located 10,201 feet' or 1.68 nautical miles on a True Bearing of 260.49 degrees from the airport reference point (ARP) of this public use, instrumented airport. FAR Part 77 prescribes various airspace surfaces and slopes established at and around airports. Part 77.13 prescribes slopes, and, surfaces, which, if exceeded, require the sponsor of the structure to provide the Federal Aviation Administration with Notice of Proposed Construction. FCC Rules Part 17 also specifies this requirement. Additionally,. Part 77 Subpart C prescribes various airspace surfaces and slope$' which, if any exceeded, require the FAA to provide public notice inviting comments prior to issuing a determination. Subpart C also prescribes surfaces and slopes which, if exceeded, would identify the proposed structure as a Hazard to navigable airspace. Private use airports or heliports do not meet FAR 77 criteria and the FAA does not consider them in its study of the proposed structure. -Howe ver, in the .interest of flight safety, ASAC considers private use airports and heliports in every study. ASAC found no evidence of private use airports or heliports which affect this site. The proposed 114' ' AGL (291' AMSL) structure located ' at the study' site would not adversely affect VFR flight operations or procedures at area airports or heliports. The proposed 114' AGL (291' AMSL) structure located at the study site is clear of all en route obstacle clearance areas and does not increase any.nummum obstruction clearance altitude. FCC rules protect existing AM Broadcast Stations from possible adverse affects caused by emissions from newly constructed cellular radio towers. Character of the Site The parcel is used by Port -A -Storage and is primarily commercial, although there is a single residential unit for an on-site attendant. The Parcel is. largely unimproved because portable storage containers, instead of buildings, are used at the facility. B. Access - Access is obtained by checking in at the attendant's office located at the front gate. Although the attendant is only on duty during normal business hours, there is an on-site attendant residence. Vehicles travel to the site by crossing the Parcel along a very wide path (at least 50' wide) that bisects the storage containers. The entire Parcel is covered with rock to facilitate vehicular travel. C. Ground Space The Site's current ground space will not likely accommodate additional co - location carriers. There is, however, sufficient space on the Parcel to -expand the site into the Parcel's interior. 33. ADJACENT AREA A. Character of the Locale A relatively high use two-lane highway (Highway 99) runs north and south approximately 500' feet to the east of the Parcel. A tractor and heavy. equipment facility is located on the adjacent parcel to the north. A mobile home dealer is located to the southeast (along Highway 99). The adjacent parcel to the south is used in a residential manner, and a golf course is located on the next parcel to the south. A church is located to the east of the Site on the opposite side of Highway 99, and agricultural land is located to the west. B. Residential Use The adjacent parcel to the south is entirely residential in use. The Site, however, abuts the, property line of this residentially used parcel at a point. approximately 300' from the dwelling unit. NOTE: there were adults and children riding all terrain vehicles in the rear yard within the tower's fall zone. . C. Church with Outdoor Children's Play Area There is a church on the eastern (opposite) side of Highway 99 approximately 600'-900' from the Site. The tower is clearly visible from the church. In addition, there is an outdoor children's play area behind the church, which lies primarily out of the line -of -sight of the tower's antennas. D. Mobile Home Dealer ,. "'McDonald's Travel N Fun" is located near the Site and the top of the tower is visible from its driveway/entry. In addition, RV's parked behind the dealership may lie within the fall zone. E. Flight Path There is a flight path in the vicinity. The parcel owner granted an Aviation Easement to the City of Chico in 1997. F. Setbacks . The Site is located at the. southeast corner of the Parcel. Two sided_ of the Site abut two adjacent, parcels.There is,,therefore, insufficient setback space to allow for a. "fall zone." The areas of the adjacent parcels that appear to lie within, the fall zone. are primarily undeveloped (raw) land.. G. NEAREST WIRELESS TELECOMMUNICATIONS SITE There is a lattice towerlocated approximately one mile to the south on the eastern (opposite) side of Highway 99 at 3415 Silverbell Road. This co-- location o-location tower appears to be approximately 90' tall: It is located in a ' commercial-office/industrial park on a street (Silverbell Road) that becomes entirely residential. There does not appear to be sufficient space on this tower to accommodate additional cairiers. COUNTY OF BUTTE COMMUNICATION FACILITY PROJECT SUMMARY Petitioner SpectraSite Communications, Inc., (SpectraSite) a North Carolina corporation, is one of the leading providers of outsourced antennae site and network services to the wireless communications and broadcast industries in the United States, Canada and Europe. SpectraSite's business includes the ownership and leasing of antennae sites on towers, managing rooftops and in -building telecommunications access on commercial real estate, network planning and deployment, and construction of towers and related wireless facilities. SpectraSite owns or manages more than 15,000 sites, in 98 of the top 100 markets in the United States. SpectraSite's customers are leading wireless communications providers and broadcasters, including Nextel, Sprint PCS, AT&T Wireless, Ameritech, VoiceStream Communications, Tritel Communications, Teligent, Winstar, Cox Broadcasting, Clear Channel Communications and Paxson Communications. Collocation Collocation is the sharing of a single wireless communications antenna site by multiple operators. SpectraSite's business goal is to build and maintain sites in strategic locations throughout the country. Industry sources anticipate that the number of antenna sites in the United States will grow from the current level of 22,000 to more than 100,000 sites by 2005. The recent FCC spectrum licensing to many new carriers has created an increasingly competitive wireless marketplace. With the inventory of existing towers that SpectraSite owns, the company intends to allow co -location by wireless carriers throughout the county.. Without collocation, the number of telecommunications towers could increase 600 percent or more. Build -To -Suit Build -to -Suit is a partnership between a wireless communications company and SpectraSite. The wireless company selects a site for its network and SpectraSite will fund, build, maintain and manage the tower. SpectraSite's Build -to -Suit strategies provide wireless companies opportunities to reduce network development costs while enjoying favorable lease rates. SpectraSite provides all aspects of site maintenance and management services for the communication sites. Nature of Request/Zoning Analysis SpectraSite is requesting a Minor Use Permit and any other permits necessary to allow the removal of the existing 89.5' lattice tower to replace it with a 114' monopole tower, expansion ofthe the compound and construction of an additional accompanying electronic equipment -shelter. Pursuant to the County of Butte Zoning Ordinance,, at Section 24-262, "Wireless' Communications Facilities," Paragraph "F', "Development Criteria for Wireless Communications Facilities", Subsection "3", Colocations on existing approved Facilities", allows the following: Additional Facilities attached below the topmost existing Facility array, either on the same pole or tower, or a replacement pole or, tower at the same height may be permitted subject to a Minor Use Permit or a Use Permit and shall be subject to the following criteria. In addition per discussion with Senior Planner, Stephen Betts, the process. we are applying for will require a Minor Use Permit: Therefore, SpectraSite's proposed telecommunications facility will require a Minor Use Permit. Further, all setbacks will be complied with and no streets, rights-of-way or easements will be encroached upon. Components and. Operations Each communication facility, consists of a tower or other support structure and various wireless installations, including base station equipment. Once, the rebuild .of the existing antenna tower is complete and the telephone switching equipment is fine-tuned, - visitation to the site by service personnel for routine maintenance will occur an average of once a month. The site is entirely self -monitored and connects directly to a central office where sophisticated computers alert personnel to any, equipment malfunction or breach of security. Because the antenna tower will be unstaffed, there will be no regular hours of operation and no impact to existing traffic patterns. No'water or sewer services will be required. Ingress and egress will be provided along with parking for service personnel who arrive infrequently to service the site. The only facilities necessary for this site are telephone and electric facilities which, will be provided if -currently inadequate. The only noise generated by the operation of a wireless communications facility willbe that from standard heating and cooling units.
