oof Chico General Plan/Specific Plan Amendment and Re -zone 08-01 (Discovery Builders)
Lcated on the north side of Nord Highway, approximately one half -mile west of the
Esplanade, APN 006-170-034
Information regarding proposed revisions to the Northwest Chico Specific Plan, previously
found to be consistent with the 2000 Butte County Airport Land Use Compatibility Plan
(ALUCP) for the Chico Municipal Airport on July 19, 2006. The proposal would retain the
residential designation but increase the allowable residential density of a 12.63 -acre
parcel (7.2 -acres net developable), located in D Compatibility Zone of the Chico Municipal
Airport. The existing Low Density Residential designation would permitnits per acre,
and the request would re -designate the site Medium Density Residential'(? -1 units per
acre) or Me TM-v�Jti ncncit= Residential (14-22 units per acre). Any subsequent
development or subdivision proposals would require a discretionary entitlement from the
City of Chico, and be subject to project conditions to ensure consistency with the ALUCP.
The following ALUC consistency findings from the Northwest Chico Specific Plan review
apply to the subject proposal:
1. The residential density and commercial intensity of the project is consistent with
Airport Compatibility Zone D because there are no density, intensity or open space
requirements.
2. The Specific Plan area is outside of the 55 dB CNEL noise contour for the Chico
Municipal Airport.
3. The Specific Plan area is outside the Accident Risk Intensity area for the Chico
Municipal Airport.

Map 07-11 (Montecito Place Investment Group)
A request to modify the Northwest Chico Specific Plan designations of Medium -High Density
Residential and Mixed Use Commercial, Chico General Plan designations of Medium -High
Density Residential and Mixed -Use Neighborhood Core, and Zoning districts of Medium -High
Density Residential and Neighborhood Commercial with a PD overlay and PD Permit.
The proposal would affect the 6.14 acres on the northwest corner of Esplanade and the
future DeGarmo Drive. The PD overlay and PD permit will allow development of the site with
approximately 23 fewer residential units than would be required by the minimum density
standards of the sites existing acreage of R-3 zoned land. A 47 lot Tentative Subdivision
Map for the site is being processed concurrently.
The following consistency findings from the Northwest Chico Specific Plan review apply to
the subject proposal:
1. The residential density and commercial intensity of the project is consistent with
Airport Compatibility Zone D because there are no density, intensity or open space
requirements.
2. The Specific Plan area is outside of the 55 dB CNEL noise contour for the Chico
Municipal Airport.
3. The Specific Plan area is outside the Accident Risk Intensity area for the Chico
Municipal Airport.
The following conditions from the Northwest Chico Specific Plan review will be required as
condition of approval for this development project:
A. Provide a deed notice for the sale of all resulting lots notifying purchasers of the
proximity of the airport and the potential for possible noise related impacts in an ALUC-
approved disclosure notice.
B. Prior to the recordation of the Final Map record as a separate instrument an Avigation
Easement granting the right of continued use of the airspace above the proposed parcels by
the Chico Municipal Airport and acknowledging any and all existing or potential airport
operational impacts.

I've written this e-mail 2 times already and it keeps getting lost in cyber world •(argh!)..
Honestly, I''m a little confused. I thought we agreed that the two GPA/rezones would not
result in any any changes to the standard NWCSP ALUC conditions that the City would apply
to the projects, and therefore it would be impractical to require the applicants to go
through the whole ALUC application/fee process. City staff was to provide you project
descriptions, a CLUP consistency analysis, and assurances of meeting the previously
provided ALUC conditions for projects in the NWCSP area. You would use that language to
provide a brief update to the ALUC.
We don't want to circumvent County processes. Please advise via e-mail at your earliest
convenience (I'm at conference) as I'm certain City staff would shoot to provide you
complete applications/fees to make the May ALUC meeting.

Thank you for the,,information on the proposed projects.
I want to apologize about thedelay in getting back to you. I misunderstood what was
happening. I'thought the City was making changes to the NWCSP, not individual
landowners/developers were proposing projects. Even though both projects are in the "D"
Compatibility Zone, and will be found consistent, still need applications, with fees,.
before the projects can�be processed.
The difficulty would be getting the projects on this month's agenda (5/21/08). I would
need the application completed and the fees submitted by Monday, 5/12%08. If that is not
possible, the projects will probably need to go on the July agenda. It is unlikely that
there will be a June meeting, unless I can get Chuck, or another planner, to cover the
meeting.
Please let me know what you to do.

ITEM: Northwest Chico Specific Plan Amendment (ALUC08-0003): A consistency
review for an amendment to City of Chico's Northwest Chico Specific Plan. The
Specific Plan is located within the "C2" and "D" Compatibility Zones of the 2000
Butte County Airport Land Use Compatibility. Plan for the Chico Municipal
Airport. The amendment proposes to modify the land use designations on four
parcels (APN 006-170-034; and APN 006-690-013, 006-690-049 and 006-690-
050).
SUMMARY:
The Northwest Chico Specific Plan (NWCSP) is comprised of approximately 700 acres that
includes areas of existing and future single-family residential dwellings, multi -family dwellings,
mixed-use neighborhood core, commercial, manufacturing/warehousing, parks, public facilities
& services.and creekside greenway. The specific plan area is located within the "C2" and "D"
Compatibility Zones of the Chico Municipal Airport. The amendments to NWCSP will include ,
a change of the land use designations on APN 006-170-034 from Low Density Residential to
Medium Density Residential and allowing a Planned Development overlay on APN 006-690
013, 006-690-049 and 006-690-050). Staff recommends that ALUC find the amendments to the
Northwest Chico Specific Plan consistent with 2000 Butte County Airport Land Use
Compatibility Plan for the Chico Municipal Airport.
BACKGROUND: '
• The Northwest Chico Specific Plan was found consistent by the Airport Land Use
Commission on July 19, 2006.
• Approximately 3% of the specific plan area is within the C2 Compatibility Zone, while the .
remaining 97% is within the D Compatibility Zone.
• The amended areas are located approximately. 1.64 miles and 1.98 west of runway 13R/31L'
and approximately 1.77 miles and 2.11 west of runway 31R/13L of the Chico Municipal
Airport. h

ANALYSIS:
• This project was required for review by the Airport Land Use Commission as defined by
Policy 1.5.1(a) of the 2000 Butte County Airport Land Use Compatibility Plan (ALUCP) for
the approval of any amendment of a specific plan.
• The proposed amendment on APN 006-170-034 is to change the land use designation from
Low Density Residential (2.01 — 6 du/ac) to Medium Density Residential (6.01 to 14 du/ac).
• The proposed amendment on APN 006-690-013, 006-690-049 and 006-690-050 is to allow a
Planned Development overlay on the existing land use designations of Medium -High Density
Residential and Mixed -Use Neighborhood Core.
• The proposed amendments to the Northwest Chico Specific Plan are located within the D
Compatibility Zone.
• The primary compatibility criteria for the D Compatibility Zone is shown on the following

Note 1. Residential development should not contain more than the indicated number of dwelling units (both
primary and secondary) per gross acre. With clustering, some parcels may be much smaller than the
others as long as the maximum overall density criterion is not exceeded. Clustering of units is
encouraged in Compatibility Zones B2 and C — see Policy 4.2.6 for limitations.
2. Usage Calculations shall include all people who may be on the property (e.g., employees,
customers/visitors, etc) both indoors and outside. These criteria are intended as general planning
guidelines to aid in determining the acceptability of proposed land uses. Additional guidance is
provided by Appendix D.
9. Hazards to flight include physical (e.g., tall objects), visual, and electronic forms of interference with
the safety of aircraft operations. Land use development which may cause the attraction of birds to
increase is also prohibited. See the supporting compatibility policies on airspace protection (Policies
4.3.2 and 4.3.6) for details.
• There are no limits on dwelling units per acre (density) for residential uses or people per acre
(intensity) for commercial uses in the D Compatibility zone.

• The ALUCP identifies the amendment areas as outside the 55 dB CNEL level for the Future
Average Fire Season Day (Exhibit 4E), the Expanded Forecast (Exhibit 4F), and the Peak
Fire Attack ,Day Noise Impacts (Exhibit 4G).
• There are no open space requirements within the D Compatibility Zone.
ENVIRONMENTAL DOCUMENTATION:
Environmental documentation has not been completed for this project. Commission's review of
the proposed project and determination of consistency is not a "project" under the California
Environmental Quality Act.'
RECOMMENDATION:
Staff recommends that ALUC find the amendments to the Northwest Chico Specific Plan'
consistent with 2000 Butte County Airport Land Use Compatibility Plan for the Chico Municipal
Airport.

The Airport Land Use Commission (ALUC) has prepared the following findings based on data
contained in the 2000 Butte County Airport Land Use Compatibility Plan (ALUCP) for the
Chico Municipal Airport, as well as site-specific information submitted by the applicant and
ALUC staff.
The following findings have been prepared at the direction of the ALUC and are for, the
consideration of the Lead Agency (City of Chico) when making a decision on the project. . -
. SECTION 1: ENVIRONMENTAL FINDINGS
A. Environmental documentation has not been completed fir this project.
Commission's review of the proposed project and determination of consistency is
not a "project" under the California Environmental Quality Act.
