"ALUC File No. ALUC08-0004; Montecito Place Investment Group - Tentative Subdivision Map, APN 006-170-
034: A consistency review for a proposed Tentative Subdivision Map, which would divide three parcels totaling
6.54 acres into 41 residential lots, 5 commercial lots (25,200 square feet) and 2 common area lots. The project
parcels are located within the "D" Compatibility Zone of the Chico Municipal Airport. The parcels are located at
the west side of Esplanade (approximately quarter of a mile south of Nord Highway), in the City of Chico."
The aforementioned project APN is incorrect -- the APN's for this project are 006-690-010, 013 and is.owned by
Montecito Place Investment Group, LLC. There are 2 parcels that total the approximately 6.54 acres.
Everything else is correct with the agenda item.
APN 006-170-034 is owned by Discovery Builders, Inc. AND THEIR GROSS ACREAGE IS 7.84 ACRES
AND THE PARCEL IS LOCATED ON NORD HIGHWAY CONTIGUOUS TO MUD CREEK.

Zach,
had Mike send over an electronic file (Powerpoint) of the landscape plan. It appears as it there are 41
residential dwellings and 5 commercial buildings. Could you confirm these numbers and provide the total
square footage of the commercial space? I will need this information for staff report for AWC. Thank you.

By way of following up on your conversion with Brendan Vieg several days ago, I am send
you the information below regarding two projects within the Northwest Chico Specific Plan

would like any changes to the way the information is presented to simplify your use of it.

found to be consistent with the 2000 Butte County Airport Land Use Compatibility Plan
(ALUCP) for the Chico Municipal Airport on July 19, 2006. The proposal would retain the
residential designation but increase the allowable residential density of a 12.63 -acre

RE: Projects in the Northwest Chico Specific Plan area
Mark:
I've written this e-mail 2 times already and it keeps getting lost in cyber world (argh!).
Honestly, I'm a little confused. I thought we agreed that the two GPA/rezones would not
result in any any changes to the standard NWCSP ALUC conditions that the City would apply
to the projects, and therefore it would be impractical to require the applicants to go
through the whole ALUC application/fee process. City staff was to provide you project
descriptions, a CLUP consistency analysis, and assurances of meeting the previously
provided ALUC conditions for projects in the NWCSP area. You would use that language to
provide a brief update to the ALUC.
We don't want to circumvent County processes. Please advise via e-mail at your earliest
convenience (I'm at conference) as I'm certain City staff would shoot to provide you
complete applications/fees to make the May ALUC meeting. -
Thanks -
Brendan

Mike,
Thank you for the information on the proposed projects.
I want to apologize about the delay in getting back to you. I misunderstood what was
happening. I thought the City was making changes to the NWCSP, not individual
landowners/developers were proposing projects. Even though both projects are in the "D"'
Compatibility Zone, and will be found consistent, still need applications,'with fees,
before the projects can be processed.
The difficulty would be getting the projects on this month's agenda (5/21/08). I'would
need the application completed and the fees submitted by Monday, 5/12/08. If that is not
possible, the projects will probably need to go on the July agenda. It is unlikely that
there will be a June meeting, unless I can get Chuck, or another planner, to cover the
meeting.
Please let me know what you to do.

AGENDA ITEM — E.2
TO: Honorable Chair and Airport Land Use Commission
FROM: Mark. Michelena, Senior Planner
DATE: July 16, 2008
ITEM: ALUC File No. ALUC08-0004: DeGarmo Plaza Tentative Subdivision Ma
APN 006-690-013, 006-690-049 & 006-690-050: A consistency review for a
proposed Tentative Subdivision Map, which would divide three parcels totaling,
* ' 6.54 acres into 41 residential lots, 5 commercial lots (25,200 square feet) and 2
common area lots. The project parcels are located within the "D" Compatibility
Zone of the Chico Municipal Airport. The parcels are located at the west side of
Esplanade (approximately quarter of a mile south of Nord Highway), in the City of
Chico.
SUMMARY:
The project proposes a tentative subdivision map to divide three parcels totaling 6.54 acres into
41 residential lots, 5 commercial lots (25,200 square feet) and 2 common area lots. The project
parcels are located within the "D" Compatibility Zone of the Chico Municipal Airport. Staff
recommends that ALUC find the proposed subdivision consistent with the 2000 Butte County
Airport Land Use Compatibility Plan for the Chico Municipal Airport.
BACKGROUND:
• The project parcels total approximately 6.54 acres and is developed with a single-family
dwelling and accessory building (to be removed).
• The property is located in the City of Chico's Northwest Chico Specific Plan Area.
• The proposed subdivision map would create 41 single-family residential lots, 5 commercial
lots (25,200 sq ft) and 2 common area lots.
ANALYSIS:
• The project site is located approximately 1.64 miles and 1.98 west of runway 13R/31L of the
Chico Municipal Airport.
• The project site is within "D" Compatibility Zone (Other Airport Environs).

CONSISTENCY FINDINGS FOR:
ALUC File No. ALUC07-0001: DeGarmo Plaza Subdivision
APN 006-690-013, 006-690-049 and 006-690-050
The Airport Land Use Commission (ALUC) has prepared the following findings based on data
contained in the. 2000 Airport Land Use Compatibility Plan (ALUCP) for the Chico Municipal
Airport, as well as site specific information submitted by the applicant and ALU: staff.
The following • findings have been prepared at the direction of the ALUC and are for the
consideration of the Lead Agency (Butte County) when making a decision on th,- project.
SECTION 1: ENVIRONMENTAL FINDINGS
A. No environmental documentation has been completed for this project by ALUC
staff. Your Commission's review of the proposed project and determination of
consistency' is not a "project" under the California Environmental Quality Act.
Determination of environmental review will be completed .during the process of
the Tentative Subdivision Map by the Butte County Planning Division.
SECTION 2: CONSISTENCY FINDINGS FOR PROPOSED PROJECT
A. The proposal for DeGarmo Plaza Subdivision to divide a 6.54 acre parcel into 41`
single-family residential lots, 5 commercial lots and 2 common lots is consistent.
with Compatibility Zone "D" as found in the 2000 Ai -port Land Use
Compatibility Plan for the Chico Municipal Airport.
B. The residential density and commercial intensity of the project a -e consistent with
Airport Compatibility Zone "D" because there is no density, intensity or open
space requirements.
C. The project site is outside of the 55 dB CNEL level for the Future Average Fire
Season Day (Exhibit 4E), the Expanded Forecast (Exhibit 4F), and the Peak Fire
Attack Day Noise Impacts (Exhibit 4G).
D. No objects of the project will extend into protected airspace.
SECTION 3: PROJECT CONDITIONS:
1. Prior to the recordation of the Final Map record as a separF-te instrument an
Avigation Easement granting the right of continued use of the afirspace above the
proposed parcels by the Chico Municipal Airport and acknowledging any and all
existing or potential airport operational impacts.
2. Place a note on a separate document which is to be recorded con: urrently with the
final map or on an additional map sheet that states: "An Avigation Easement is
