Chairperson Sherman asked if any applicants have ,come to ALUC because the City has not amended their CLUP. Mr. Michelena answered that it may not be required if the consistent sizes for that zone were being met, and if it wasn't considered major land use, i.e., 5 or more lots it would not be necessary to come before ALUC, and it was determined that they do not need to come before ALUC. In this case the City would still submit to Staff for review. There are no structures on the :ite that exceed over 25 feet. Staff did not do an environmental review for this expansion. If it was being annexed into the City, then there would have to be a proper ALUC review, however, it is required to go before LAFCo, and they may require an environmental review. Staff is recommending that the Butte County Airport Land Use Commission find ALUC file number A06-02 for Garner and Schultz consistent with the 2000 Airport Land Use Compatibility Plan for the Chico Municipal Airport with the provisions that the project is not considered a major land use action and undertaken within the sphere boundary would be reviewed by ALUC. Commissioner Harp inquired what the consistencies are according to the movement of the City's sphere of influence or the land within that area that is going to be within this sphere of influence. Mr. Michelena answered that staff had tried to figure out how they would address ALUC for consistency since the County's General Plan of zoning is not consistent with CLUP and the city is consistent. Staff then looked at the size of the parcels and the sizes appeared to be consistent in comparison to the 2 that were pre-existing prior to the adoption of CLUP. With this finding of consistency, there are conditions that are attached that would be required for any development on the parcels. The conditions would need to be followed and any lot splitting in the future would have to follow those conditions also. Since there were not any previous directions there was some difficulty in making these decisions. -- Commissioner Harp said that he was not sure the wording that is used today would change the fact that the 2 lots are inconsistent with the CLUP. If we decide today to make the 2 lots nonconforming parcels consistent, then we need to use caution on the language used. Mr. Michelena reiterated that this could be a more straightforward report if the sphere of influence of the City of Chico is consistent with the CLUP for future potential annexation, bringing it more into compliance with the CLUP and taking the County's inconsistencies out, but this is not the case. The parcels that are sub -standard in size have been pre-existing for several years, and staff would look at it with regards to the zoning as being nonconforming. Chairperson Sherman suggested that as soon as the ruling jurisdiction changes from County to City then it would be the city's zoning and designation of the properties that apply to the property. Focus should be on whether the city has designated these properties for some use that is inconsistent with the General Plan. It appears to be addressed indirectly in Mr. Michelena's report by showing the zoning and the general plan designation and what the density allowed is that we could safely make a finding that indeed the city's general plan and land use designation's for the properties to be annexed to the city is consistent with the CLUP. For all jurisdictions, non -conforming parcels that ■ Airport Land Use Commission ■Minutes of Meeting of October 19 005 Page 2 0 t� existed before adoption of the CLUP have that non -conforming status, and the Committee does'not make that determination. A pointed comment should be sent if any city was about to annex property -' giving it a general plan designation and a pre -zoning designation that waE inconsistent with our CLUP. Mr. Michelena mentioned that the difficulty is that there are no minimum parcel sizes within the County and there are no minimum parcel sizes for the zone that the county and the city are have designated. Chairperson Sherman reiterated manufacturing zones isn't what rules the regUations, but density. Mr. Michelena stated that there are still minimum parcel sizes that would pertain to the industrial and general planning zoning. Minimum parcel size would deal with either density or intensity. First step is to look at parcel sizes then the intensity or density of the use. Chairperson Sherman stated that in Oroville there is the density limitation and the need to explain to the property owner what that density is. Mr. Michelena explained that that would be a residential size parcel zoning Industrial size zoning of 1.5 acres can be deemed consistent with the CLUP as long as they do not exceed 8 or 12 people on the property. Mr. Michelena questioned whether open space can be met -_n that type of situation, and are there exceptions to parcel sizes in required open space, especial -.y in B-1. It 'could be - determined that the size parcels are all consistent with pre -zoning for the City of Chico. Chairperson Sherman commented that the focus would be on ,the Geleral Plan and zoning designation that is being applied, and asked if that will be consistent with the CLUP? Commissioner Hennigan verified the comment made by Mr. Michelena regarding a substantial area that currently cannot be developed because of environmental considerations, chiefly Meadowfoam and seasonal wetlands? Mr. Michelena answered in the affirmative explaining that the City of Chico has identified those areas and has designated them as open space areas and so has the County. Commissioner Hennigan suggested that it may be detrimental to rely exclu3ively on the mitigation, although the language seems to meet the need for protecting future changes. Conceivably this could be valuable enough to justify some trades. The City may do some of that sa that they can rationalize the lay -out, and to make the organization of construction logical and economically viable. The language needs to be precise to protect against excessive mitigation off -sigh=. Mr. Michelena said that staff was not comfortable putting in a concition that requires any development of these properties with regard to industrial use that will requ-_re applicants to come to - -- ALUC for review, however, conditions could be added regarding this. I. Commissioner Hennigan said that if the requirements have already been added to conditions, this should be adequately substantial. Mr. Michelena said there may be a need to strike the existing Conditions and add an open space requirement for these lots, i.e., where the intense use and required open space — 20% and 10% for --� ~ - Aiiport-L-and-U8e Commission•�'1Vlinutes of Meeting of October 19, 2005 Page 3 the B2 and CI and 30% for the Bl. Conditions for future development of these parcels would be subject to 30% of the parcel remaining usable open space. Commissioner Hennigan agreed with the content stating that there are 2 benefits: 1. it provides the City of Chico some flexibility so that they can rationalize the lay -out, and 2. it provides the airport protection that ALUC is interested in. Chairperson Sherman recommended adding to this the language, "or whatever standards are in effccr at the time development occurs ". She agrees with the idea of specifying what standards apply today, and reported that the City of Oroville sees the need for exercising caution in conditioning projects. Chairman Sherman also expressed that more stringent standards or less stringent standards may be eventually adopted. Commissioner Hennigan said he would be in favor of adding language that reflects the real requirements that would be appropriate, but at the same time it should allow the City to rationalize what they are doing. The City should not be frozen to the map that is being developed by the biologists because this could create some impossible corners and bottle -rocks. Commissioner Hennigan pointed that the regulations should not make it too inconvenient tD develop an industrial park in this area. Mr. Michelena asked whether to continue this item or move ahead with it. Chairperson Sherman stated that development in the compatibility zones "shall be consistent with the average number of people, the minimum parcel size, the location of development, the open space provision, the height provisions and any easements that are in affect at the tirr_e development occurs". Chairperson Sherman articulated that the topic where each restriction applies Should be identified and then a decision can be made whether a list is needed stating what htat currently is. ALUC is concerned about average density, minimum parcel size, the location of the development, noise mitigation, proper location of the development with respect to the runway, a:l of these features shall be consistent with the standards or with the requirements in effect at that time Mr. Michelena agreed that this would be a clearer and simpler way to look at A. Chairperson Sherman opened the discussion to the public. Cliff Sellers representing the City of Chico, read the report and state(. that Mr. Michelena's comments adequately addressed what is being done. The City is agreeable ro the suggestion for the Findings, but would like to include a caveat, "or the standard that is in effect at the time that development is proposed", which will provide more liberalized standards so that they will have the ability to use those even if they are made more restrictive; they still fall within the CLUP so that they will be consistent for whatever the ALUC Commission decides at some future time if there are changes. Mr. Sellers requested that the Commission take action at this time and add the amendments to the Conditions. - Commissioner Hennigan referred to the map the biologist has drawn and that mitigation measures may be taken to rationalize parcels and boundaries. - - -- ■ Airport Land Use Commission ..■ Minutes of Meeting of October19, 2005 ��a�e ■ _ .. , Mr. Sellers said it was . fairly speculative in the absence of any development proposal, and it is the City's intent to at some juncture and cooperation with the property owner to extend a road from Eaton across these properties to the west side of the airportto facilitate development. At ,that time -- " they will have utilities and access for development. The costs for development are very high and may be a detriment to development. Mr. Sellers again recommended the caveat. , . Commissioner.Hennigan reiterated that the proposal that is being considered would give developers .and landowners the ability to make changes as long as it still meets the formulas, i.e., "a plan for a plan" Commissioner. -Lundy asked Mr. Sellers what was'being done regarding grounJ water monitoring and whether that was a private situation or is the City taking charge of this. He a -ked why that particular provision regarding monitoring ground water was added? Mr. Sellers answered that historically on the east side of the airport Victor Industries, (approximately 50 years ago), operated a plant on the property, and their method of disposing of certain solvents was questionable, -and has caused the future possible contamination of ground, water. At this •time'there are 2 monitoring wells that show slight traces of contaminants and indicates t gat the contaminants are . moving in the direction of the these properties.' It is a Federal Court rulingtZat an extraction well is placed at the upper end of this area. The water should be removed, run through'carbon filters, and then discharge the clean water through Sycamore Creek; but to ensure th' t it is working -,and all contaminants are being captured, monitoring wells have to be installed further down the ground water system. The City of.Chico is, the property owner where the contamination occurred, -but- due to extensive litigation, -who is actually responsible for this dilemma is indefini'e. However, since the City of Chico is the local governing agency, they are taking the lead in taking action to remediate the problem., The City of Chico would like to develop the Westside of thl- airport fora business industrial park, and have reasonable access to that park. Commissioner Hennigan spoke for the Committee being in favor of the item, but stressed the'need for accuracy in development of this property and the idea of an industrial park at this location appears to be logical. - • Tit .•' - - 3. i •,- , Chairperson Sherman closed the public hearing and confined discussion to the Commissioners. Chairperson Sherman asked if a plan has been formulated regarding zoning designations; and is- rezoning srezoning compatible with the CLUP,' and parcel sizes. Should a statement be made in our' finding that the City's proposed General Plan and pre -zoning designations are consistent with the CWP? Is .,there a consensus for approval, as long as proposed General Plans are consistent with the►CLUP? Conditions would have to do with the density, the intensity, the location Df development, the open space, and shall be consistent with the formulas at the time development o -curs. Mr. Sellers asked for clarification on minimum parcel sizes applying to re3idential or across the board. Chairperson Sherman said that the matrix in the book says "residential" per acre. There is no minimum ALUC parcel size, but has to do with intensity. Reference to minimum parcel size is to be stricken given the fact that these properties are pre -zoned for manufacturing non-residential uses. Commissioner Hollis asked whether the deed notice should be added in this approval process at this time? Chairperson Sherman re -opened the hearing to the public and asked for clarification on this process if City of Chico would add the deed notice. Mr. Sellers answered that this would be done with any entitlement or permit, but there is no way to enforce this condition at this juncture. Chairperson Sherman referred to Mr. Michelena's report in that provision of casements shall occur at the time of development. She asked Mr. Michelena if this provision is clear on the rough proposal that is being formulated. Mr. Michelena stated that with regards to the Findings, changing the sphere of influence expansion is consistent and determine that the City of Chico's General Plan and Pre -Zoning of the included parcels are consistent with the Airport Compatibility Use Plan. Regarding the actual wording, Mr. Michelena would like to listen to the tape of the minutes to get the actual language for consistency. He asked if all the actual requirements be listed or simply state that all future development within the compatibility zone shall be in conformance. with those specific requirements at the time so that language would be general in content and if wording is added at a later date there should be consistency. Chairperson Sherman suggested listing all applicable requirements. Commissioner Hernigan asked Mr. Sellers whether a Motion of Intent would suffice, and adding specific wording next month would be acceptable. Mr. Sellers was agreeable to the measures mentioned regarding intensity_ parcel size, open space, population or density and adding the caveat to adopt additional regulation3.
