The project site is located on the north side of East Lassen Avenue, at 476 East Lassen Avenue, and adjacent to the east side of SR -99 Freeway, in the C2 Compatibility Zone, north Chico area. SUMMARY: Staff recommends that ALUC find the project consistent with the C2 zone of the 2000 Airport Land Use Compatibility Plan for the Chico Municipal Airport. BACKGROUND: • The property is 9.84 acres in size and is currently developed with 27 buildings containing a total of 105 apartment units. Surrounding uses include a mobile home park south across East Lassen Avenue, apartments on the north, SR -99 Freeway adjacent on the west, and single family dwellings and a church across Joshua Tree Road to the east. A new single family. subdivision is under construction to the northeast. • The property is within the corporate limits of the City of Chico. The- project area is designated Medium Density Residential on the City of Chico General Plan Diagram at a density of 4.02 to 14 units per acre. The property is zoned R-2 — Medium Density Residential. ' • The applicant proposes to add ten new 4-plex buildings containing a total of 40 additional dwellings. The total units for the project site would be 145 dwellings in 37 buildings. This is a density of 14.7 units per acre. • The height of the tallest object on the project site (including antennas and trees) is not anticipated to be higher than 100 feet above ground level. Current City height maximum for a residential building is 35 feet in the R2 Zone. ANALYSIS: • The project is before ALUC because the Chico General Plan is not in conformance with the 2000 Butte County Airport Land Use Compatibility Plan (ALUCP). • The primary criteria for Compatibility Zone C2'are, shown in the following table: Zone . Residential development should not contain more than the indicated number of dwelling units (both primary and secondary) per gross acre. With clustering, some parcels may be much smaller than the others as long as the maximum overall density criterion is not exceeded. Clustering of units is encouraged in Compatibility Zones 132 and C — see Policy 4.2.6 for limitations. • The project would result in a density of 14.7 dwelling units per acre on a single 9.84'acre parcel. The density and parcel sizes are consistent with Compatibility Zone C2. • The project conforms to the 10% open space requirement by counting the freeway frontage of the property, and the Agricultural areas to the north in the C2 Compatibility Zone. • The C2 Zone limits the population per acre to 300, or an average not to exceed 100 per acre. The property has 9.84 acres with 145 units. At an average of 2 persons per bedroom (2000 Federal Census), the project will have 458 residents (61 one bedroom, and 168 two bedroom units). This is well within the 2,952 residents allowed. The following findings have been prepared at the direction of the ALUC and are for the consideration of the Lead Agency (City of Chico) when making a decision on the project. SECTION 1: ENVIRONMENTAL FINDINGS A. No environmental documentation was submitted at the time of project review. SECTION 2: CONSISTENCY FINDINGS FOR PROPOSED PROJECT A. The proposal for the expansion of the Joshua Tree Apartments from 105 units to 145 units, is consistent with Compatibility Zone C2 as found in the 2000 Airport Land Use Compatibility Plan for the Chico Municipal Airport. SECTION 3: PROJECT FINDINGS: A. The project site is located in Airport Compatibility Zone C2 as L-sted in the 2000 Airport Land Use Compatibility Plan for the Chico Municipal Airport. B. The project is consistent with Compatibility Zone C2 because the average number of units per acre is greater than four (4) per acre. C. No structures on the project site would extend into protected airspace. E. The project site is outside of the 55 dB CNEL noise contour. SECTION 4: PROJECT CONDITIONS: 1. The proposed project density is 13.5 units per acre. The property is designated Medium Density Residential in the General Plan, and is located in an R2 Medium Density Residential zoning district. The General Plan designation and zoning district allow multi -family residential development at densities between 4.01 and 14 units per acre. The project is Categorically Exempt from environmental review pursuant to Section 15332 (In -Fill Development='rojects) of the California Environmental Quality Act (CEQA). The project is also consistent with th-_ General Plan designation and zoning for the area. The project may also qualify as exempt from ALUC review under the proposed new in -fill regulations, due to the fact the site is largely developed with existing uses and is surrounded by similar developed residential uses at similar densities, including multi -family residential apartments and a mobile home park. Because of the project's consistency with the provisions of Zone C(2) which allows residential development at densities over four units per acre, we would appreciate a staff determination that it need not proceed to ALUC.
