The property is within the "B2" zone of the 2000 Airport Land Use Compatibility Plan for the Chico Municipal Airport. The project site is located on the east side of Burnap Avenue, approximately a fifth of a mile northwest of East Lassen Avenue, in the City of Chico. SUMMARY: Staff recommends that ALUC find the project consistent with the 2000 Airport Land Use Compatibility Plan for the Chico Municipal Airport. Consistency is based upon the recently - approved amendment to Section 2.4.4 of the 2000 Butte County Airport Land Use Compatibility. Plan and ALUC's approval of the City of Chico infill development map ai the March 16, 2005 meeting. BACKGROUND:. • The property is approximately 2.95 acres in size and is developed with one single-family residence and accessory structures. . • The property is within the incorporated limits of the City of Chico. The project site. is designated Low Density. Residential on the City of Chico General Plan Diagram and is zoned R-2 (Medium Density Residential). r - • Existing land uses within 500 feet of the project site include multi-farmly. dwellings, single family residential dwellings and vacant parcels. • Twenty -Five (25) lots for single-family dwellings are proposed. The project site is not within the 55 dB CNEL noise contour as shown on Exhibit 4E (Noise Impacts — Future Average Fire Season Day), Exhibit 4F (Noise Impacts — Expanded Forecast) and Exhibit 4G (Noise Impacts — Peak Fire Attack Day) of the 2000 Butte County Airport Land Use Compatibility Plan. • Pursuant to Section 4.1.5(a) of the 2000 Butte County Airport Land Use Compatibility Plan, staff recommends that all dwellings on the project site be designed and constructed to achieve a maximum interior noise level of 45 dB CNEL. ■ Butte County Airport Land Use Commission ■ ALUC File No. A 06-03. This density is not consistent with the B2 Airport Compatibility Zone, which requires 0.2 dwelling units or less per acre (minimum parcel size of 5 acres or larger). • Although the project does not comply with the B2 Compatibility Zone, the project site meets the criteria for infill development of Section 2.4.4(a)(3) of the 2000 Butte County Airport: Land Use Compatibility Plan. • The parcel is 5 acres or less in size (2.95 acres). • Density of the project (8.47 du/ac) would be less than the highest. denrity of the existing residential developments within 500 feet of the project site, which is a condominium complex (60 units) on a 3.21 acre parcel (18-69 du/ac), located off of Burnap Drive, Chico (APN 007-480-099). • At .the February 16, 2005, ALUC meeting the Commission approved an amendment to' Section 2.4.4 (Special Conditions) of the 2000 Butte County Airport Land Use Compatibility Plan. The amendment allows infill development that would otherwise be inconsistent with the B2 Airport Compatibility Zone. . Section 2.4.4 now allows infill development on parcels that are 5 acres or less in size: If the proposed infill development meets the infill development requirements of Section 15332 (In - Fill Development Projects) of the California Environmental Quality Act-(CEQA) the .infill development density may be equal to, but no greater than, the density that exists on the most densely developed property that is located within 500 feet of the perimeter A the parcel. • The City of Chico provided a map to the ALUC that showed those parceh eligible for infill development in the B2 Airport Compatibility Zone south of the Chico :'Municipal Airport which ALUC formally adopted on March 16, 2005 as the official infill development map. This project parcel is identified on the City of Chico infill development map and is therefore eligible to be idled at the proposed density. ENVIRONMENTAL DOCUMENTATION: No environmental documentation has been completed for this project by ALUC staff. The City of Chico staff will make a determination per the California Environmental Quality Act as part of their processing of the apartment complex expansion. It is expected that a Class 32 categorical exemption for infill development (Section 15332 of the CEQA Guidelines) will be the environmental determination for the new apartments. RECONIlVIENDATION:. Lassen Village Tentative Subdivision Map, APN 007-150-917: The Airport Land Use Commission (ALUC) has prepared the following findings based on data contained in the 2000 Butte County Airport Land Use Compatibility Plan (ALUCP), as well as site specific information submitted by the applicant and ALUC staff. The following findings have been prepared at the direction of the ALUC and are for the consideration of the Lead Agency (City.of Chico) when making a decision on the project. SECTION 1: ENVIRONMENTAL FINDINGS A. No environmental documentation has been completed for this project by ALUC_ staff. The City of Chico staff will make a determination per the California Environmental Quality Act as part of their processing of the apartment complex expansion. SECTION 2: CONSISTENCY FINDINGS FOR PROPOSED PROJECT A. -The proposal for the Ironstone Development Corp — Lassen Village Subdivision Map, will divide a 2.95 -acre parcel into 25 single-family lots, which will result in a density of 8.47 dwelling units per acre, which is consistent with the infill development criteria of Section 2.4.4(a)(3) of the 2000 Bette County Airport Land Use Compatibility Plan. SECTION 3: PROJECT FINDINGS: A. The project site meets the criteria for infill development of Section 2.4.4(a)(3) because: 1. The project site is 5 acres or less in size 2. The subdivision project qualifies as an infill development project as defined by the California Environmental Quality Act 3. The density of the project, at approximately 8.47 units per acre, would be less than the density of the highest existing residential development within 500 feet of the project site, which is 18.69 units per acre. 4. The project site is shown on the City of Chico's infill development map, as approved by the "Butte County Airport Land Use Commission on March - 16, 2005. B. No structures on the project site would extend into protected airspace. C. Mr., Michelena said this was for a major land use and would still come before the Commission for consistency Commissioner Harp' asked if the parcel is part of the infill sites, does it still come before this Commission. Mr. Michelena said yes if it is more than 4 parcels, it is a major land use action. SECTION 3: PROJECT FINDINGS A. The project site meets the criteria for infill development of Section 2.4.4(a)(3) because: 1. The project site is 5 acres or less in size • 2. The subdivision project qualifies as an infill development project as defined by the California Environmental Quality Act 3. The density of the project, at approximately 8.47 uni-s per acre, would be less than the density of the highest existing residential development within 500 feet of the project site, which is 18.69 units per acre. 4. No structures on the project site would extend into protected airspace. C. The project site is not within the 55 dB CNEL noise contour as shown on Exhibit 4E (Noise Impacts - Future Average Fire Season Day), Exhibit 4F (Noise Impacts - Expanded Forecast) and Exhibit 4G (Noise Impacts - Peak_ Fire Attack Day) of the 2000 Butte County Airport Land Use Compatibility Plan. D. All dwellings on the project are required to be designed and constructed to have a maximum interior noise level of 45 dB. CNEL or less in older to prevent significant aircraft -related noise impacts. SECTION 4: PROJECT CONDITIONS: 1: Provide a deed notice for the existing parcel notifying" purchasers of the proximity of the airport and the potential for possible noise -related impa•,ts in an ALUC-approved disclosure notice. 2. Airspace review by the Airport Land Use Commission required for objects greater. than 70 feet tall. 3. All dwellings shall be designed and constructed to achieve a maximum interior noise level of 45 dB CNEL or below. 4.
