Chico Municipal Airport to divide two parcels totaling 9.4 acres irto four parcels (2 at
1.93 acres, 1 at 1.94 acres, and 1 at 3.6 acres). The project is: located in the B-1
compatibility zone for the Chico Municipal Airport. The property is located on the
south side of Eaton Road, roughly half way between Bumap Avenue and Cohasset
Road, Chico. (MM). (A 05-26)
Mr. Michelena gave a brief summary of the project.
The hearing was opened to the public.
Jim Stevens, NorthStar, said this was in an industrial zone and the proposa: is for a couple of
buildings with adequate open space.
The hearing was closed.
It was, moved by Commissioner Harp, seconded by Commissioner Baldridg+e, and unanimously
carried to find ALUC File No. A 05-26 for Brown and Dutra consistent with th& 2000 Airport Land
Use Compatibility Plan for the Chico Municipal Airport subject to the following findings and
conditions:
SECTION 1: ENVIRONMENTAL FINDINGS
A. No environmental documentation has been completed for this project by ALUC staff.
The Butte County or City of Chico planning staff will complete an environmental
initial study or make a determination for a categorical exemption der the California
Environmental Quality Act as part of their processing of the tentative parcel map
SECTION 2: CONSISTENCY FINDINGS FOR PROPOSED PROJECT
A. The proposal for the Brown and Dutra Tentative Parcel Map, to divide a 9.41 -acre
parcel into four parcels is consistent with Compatibility Zone Bl as found in the 2000
Butte Airport Land Use Compatibility Plan for the Chico Municipal Airport.
SECTION 3: PROJECT FINDINGS:
A. The project site is located in Airport Compatibility Zones B1 as listed in the 2000
,,- Airport Land Use Compatibility Plan for the Chico Municipal Airport.
F. The other use density (people/acre) of the project can not be determined at this time as
no uses are proposed.
G. The proposed project parcel sizes are consistent with County zoning of L -I (Limited
Industrial) and consistent with the County General Plan land use designation of
Industrial.
H. The proposed project parcel sizes are consistent with the City of Chico's pre -zoning of
ML (Light Manufacturing/Industrial) and consistent with the City's General Plan land
use designation of Manufacturing and Warehousing.

SECTION 4:, PROJECT CONDITIONS:
1. Provide a deed notice for the sale of all resulting. lots notifying purchasers of the
proximity of the airport and the potential for possible noise -related impacts in an
ALUC-approved disclosure notice.
2. Airspace review by the Airport Land Use Commission required for objects greater
than 35 feet tall.
3. A minimum Noise Level Reduction (NLR) of 25 dB in buildings with noise -sensitive
uses and caretaker building.
4. Locate structures the maximum distance form extended runway centerline.
5. No. parcel shall have an average of more than 25 people per acre with a maximum of
50 people per acre on site at any time (except for rare special events).
6. No residential dwellings, excluding caretaker facilities, are permitted on the. parcels.
7. Prior to recordation of the parcel map record as a separate instrument an Avigation
Easement granting the right of continued use of the airspace above the proposed
parcels by the Chico Municipal Airport and acknowledging any and all existing or
potential airport operational impacts.
8. Place a note on a separate document which is to be recorded concurrently with the
parcel map or an additional map sheet that states: "An Aviigation Easement is
recorded above the parcels for the Chico Municipal Airport anc acknowledging any
and all existing or potential airport operational impacts."

The project site is located on the south side of Eaton Road, approximately half way

SUMMARY:
Staff recommends that ALUC find the project consistent with the 2000 Airport Land Use
Compatibility Plan for the Chico Municipal Airport.
BACKGROUND:
• The project parcel is approximately 9.41 acres
o There are no structures on the project site.
• Approximately 0.6 acres on the proposed parcel 1 will be designated as Zabitat protection
area.
• The parcel .is currently in county jurisdiction and zoned L -I (Limited Industrial) and with a
General Plan Land Use Designation of Industrial.
• The parcel is within the City of Chico sphere of influence and designated urian area.
• . The parcel is proposed to be annexed into the City of Chico. The City's. pre -zoning of the
property is ML (Light Manufacturing/Industrial) and the City General Plan land use
designation is Manufacturing and Warehousing.
• The tentative parcel map would create 4 parcels (1 at 1.93 acres; 2 at 1.94 acres; and 1 at 3.6
acres).

• Based on no specific proposed use(s) for the parcels, it can not be determined whether this
project is a major land use action as defined by Policy 1.5.3 of the 2000 Butte County Airport
Land Use Compatibility Plan (ALUCP), and therefore, was brought forward to the Airport
Land Use Commission.

• The other uses density of the project can not be determined at this time. Proposed uses have
not been submitted. Conditions will be included that will limit the density (people/acre).
• The required residential parcel is a minimum of 10 acres. No proposed parcel meets the
minimum size requirement. A condition is included to restrict residential development on the
proposed parcels.
• The Butte County Airport Land Use Compatibility Plan (BCALUCP) open space requires
30% of the entire B1 zone be set aside as open space.
• The project parcel configuration is perpendicular to airport take -offs and landings. The
orientation does not make it feasible for open space use.
• Upon review of the current open space in the B-1 zone, approximately 70 percent of the zone
is open space. However, the majority of the zone is designated for manufacturing and
industrial uses.
• The project site is approximately 0.21 miles west of the extended centerline of Runway
31R/13L of the Chico Municipal Airport, at a distance of 0.83 miles southwest of this
runway.

The Airport Land Use Commission (ALUC) has prepared the following findings based on data
contained in the 2000 Airport Land Use Compatibility Plan (ALUCP) for the Chico Municipal
Airport, as well as site specific information submitted by the applicant and ALUC staff.
The following findings have been prepared at the direction of the ALUC and are . for the
consideration of the Lead Agency (Butte County) when making a decision on the project.
SECTION 1: ENVIRONMENTAL FINDINGS
A. No environmental documentation has been completed for this project by ALUC

Brown Parcel Map (PM 04-11) South side of Eaton Road, west of Cohasset Road
With this letter, the City of Chico Planning Division is forwarding a Butte County Airport Land Use
Commission (ALUC) application for consistency findings for the above -noted project. Enclosed with the
application are a check in the amount of $1:,531..00, 24 copies of a location map, a full-sized copy of the
Parcel, and 24 copies of the compatibility zone map that identifies the project site as within the
boundaries of Zone B(1.).,
The subject site is a 9.7 acre parcel located on the south side of Eaton Road, roughly half way between
Burnap Avenue and Cohasset Road. The Pleasant Valley drainage ditch runs along the west and south
boundaries of the site. The application is to subdivide the property into four lots with an average parcel
size of 2.4 acres. The General Plan's designation for the site is Manufacturing and Warehousing.
Prezoning is ML Light Manufacturing/Industrial. The site is currently in the County: however,
annexation to the city is proposed concurrent with the requested Parcel Map. The sit: contains wetlands,
elderberry shrubs, and oak woodlands. The map proposes to dedicate an open space areafor oak tree and
elderberry preservation to the City. The project is consistent with the General Plan designation and
zoning for the area. ,
We would appreciate it if ALUC staff could review the application to determination if it needs to
proceed to ALUC. In the event that staff determines ALUC review is necessary, please schedule
this item for the May 2005 ALUC meeting.
