1. WELCOME NEW COMMISSIONER
Chair Wallrich welcomed former Alternate Commissioner Greenwood as Commissioner,
appointed by the City Selection Committee for a term to expire the first meeting in May,
2003.
D. APPROVAL OF THE DRAFT MINUTES FOR THE DECEMBER 18,20 02 MEETING
Vice Chair Harp requested a correction on page 5, line 9 to change "...include a definition,
the criteria, and how the Cities and County would meet the requirements." to "...include a
definition and the criteria used to evaluate the open space requirements."
It was moved by Vice Chair Harp, seconded by Commissioner Grierson, and unanimously
carried to adopt the minutes of the December 18, 2002 as corrected.
E. ACCEPTANCE OF THE AGENDA
A motion was made by Vice Chair Harp, seconded by Commissioner Grierson, and
unanimously carried to accept the Agenda.
F. BUSINESS ITEMS
ITEMS WITH PUBLIC HEARING
1. ALUC File No. A02-12 Butte Countv Deuartment of Develoument Services. APN
007-240-078: A consistency review for a proposed General Plan Amendment from
Commercial to Public and a Rezone from C-2 (General Commercial) to PQ
(Public/Quasi-Public) on 1.62 acres located at the northeast corner of Hicks Lane and
Eaton Avenue, Chico. The property is proposed to be developed with a County Fire
Station.
Mr. Craig Sanders presented the staff report. He added that this request was to
facilitate the relocation of Fire Station #42 currently located at Frontier Circle and
Cohasset to the northeast corner of Hicks Lane and Eaton Avenue in Chico.
Mr. Sanders concluded his comments by recommending that the Commission find the
project consistent with the 2000 Airport Land Use Compatibility Plan with no special
conditions and based on the following findings:
SECTION 1: ENVIRONMENTAL FINDINGS
A.. No environmental documentation was submitted at the time of project review.
• SECTION 2: CONSISTENCY FINDINGS FOR PROPOSED PROJECT
A. The proposal to amend the General Plan from Commercial to Public and a
Rezone from C-2 (General Commercial) to PQ (Public/Quasi-Public) on 1.62
acres is compatible with the 2000 Airport Land Use Compatibility Plan for the
Chico Municipal Airport
SECTION 3: PROJECT FINDINGS:
A. The project site is located in Airport Compatibility Zone "C-2" as listed in the
2000 Airport Land Use Compatibility Plan (ALUCP) for the Chico Municipal
Airport.
B. The resulting intensity of use will be approximately 3 people per acre which is
consistent with the recommended allowable intensity of 100 people per acre
for Compatibility Zone "C."
SECTION 4: PROJECT CONDITIONS:
1. The proposed PQ zoning allows uses that would not be compatible with airport
operations, specifically a children's school, library, or hospital. A method for
preventing these uses from being established in the future should be
• incorporated into approval for this project.

It was requested that on page -3 of Exhibit A that the name Agasy Inc. should be
changed to "Butte County."
Alternate Commissioner Dilley asked Mr. Sanders about Exhibit A, Section 4, Project
Condition Rezoning for clarification on the wording that stated, "The proposed PQ
zoning allows uses that would not be compatible with airport operations, specifically a
children's school, library, or hospital. A method for preventing these uses from being
established in the future should be incorporated into approval for this project." He also
asked what if anything would ALUC have to decide at this meeting regarding the
method.
Mr. Sanders replied that the normal method is that the Planning Department would do
some type of conditional zoning stating the certain range of uses that would not be
allowed should the fire department move away such as children schools, libraries, or
hospitals.
Mr.' Sanders stated this project condition would move forward to the Planning
Department and would be considered by the Planning Commission.
Chair Wallrich opened the hearing to public comments. There being no comments,
the hearing was closed.
A motion was made by Vice Chair Harp, seconded by Alternate Commissioner Dilley
and passed unanimously to find ALUC Application A02-012 (Butte County
Department of Development Services) consistent with the 2000 Airport Land use
Compatibility Plan based on the staff report as presented.
2. ALUC File No. A03-01 Marshall and Conrov — Orchard Commons TSM. APN
043-280-002 & 013: A consistency review for a proposed Tentative Subdivision Map
to divide a 5.88 acre parcel into 28 single family residential parcels. The property is
located on the north side of West Sacramento Avenue approximately 1,950 feet west
of Nord Avenue, Chico.
Mr. Craig Sanders presented the staff report. He added that the project is located
within incorporated limits of the City of Chico and the City is currently processing it.
Mr. Sanders also stated that the site is located within the Airport Compatibility Zone
"D" for the Ranchaero Airport. He also stated that Compatibility Zone "D" has no
restrictions with respect to what density but prohibits land uses that represent hazards
to flight, for example tall objects. Mr. Sanders added that single-family residential
homes would not create any of these identified hazards to flight.
Mr. Sanders concluded his comments by recommending that the Commission find the
project consistent with the 2000 Airport Land Use Compatibility Plan subject to the
• findings on Exhibit A, and based on the following findings:

single family dwelling lots is consistent with the Airport Land Use
Compatibility Plan for the Ranchaero Airport and is consistent with airport
operations
SECTION 3: PROJECT FINDINGS:
A. The project is in the "D" Airport Compatibility Zone as listed in the 2000
Airport Land Use Compatibility Plan (ALUCP) for the Ranchaero Airport.
B. The proposed project will allow for 28' single family dwellings to be
constructed at a resulting average gross density of 4.76 lots per acre. This
density is consistent with Primary Compatibility Criteria listed in Table 2A of
the 2000 Airport Land Use Compatibility Plan for the "D" Airport
Compatibility Zone.
• Chair Walhich opened the hearing to public comments. There being no comments,
the hearing was closed.
A motion was made by Commissioner Grierson, seconded by Commissioner
Greenwood, and unanimously passed to approve ALUC Application A03-01
(Marshall and Conroy -Orchard Commons) consistent with the 2000 Airport Land Use
Compatibility Plan based on the staff report. -
ITEMS WITHOUT PUBLIC HEARING
3. Disclosure Document
Mr. Sanders stated that he had determined that from the November 2001 meeting
minutes ALUC unanimously adopted the Disclosure. Document. Mr. Sanders
provided a copy of this six-page document to. the Commission members to review.
Chair Wallrich stated that from the meeting minutes of December 2002 there were
additional changes requested by Commissioner Rosene. He added that it was unclear
on what this meant since it had been previously stated the document was adopted in
2001.

Commissioner Grierson and Barbara Hennigan recalled that the Disclosure Document
• was indeed adopted but Commissioner Rosene wished to rewrite the document to
make the wording more user-friendly for the non -aviation person.
Craig Sanders added that currently it is not being distributed to realtors and stated that
now would be a good time to make updates. .
Mr. Sanders asked the Commission if the Disclosure Document and Deed Notice
should continue to remain as two separate documents or do they now serve the same
function. He also asked if the Disclosure Document should be recorded.
The Commission briefly discussed this issue and concluded that the documents should
remain as two separate documents. It was determined that the Disclosure Document
does not require recordation but that the Deed Notice does.
Chair Wallrich asked the Commission what action it would like to take on this item
and reiterated the need to finalize it quickly so that it is ready for immediate
distribution.
Commissioner Greenwood requested that Table 2-A from the CLUP be included with
the Disclosure Document. He added that it would be a good reference document for
individuals to use versus researching the matter on their own.
• Commissioner Grierson requested that it be reflected in the meeting minutes that the
modification and adoption of the Disclosure Document should not, in anyway, be
construed as a change to the CLUP.

Mr. Sanders stated that he would like to research the affect of the new state legislation
with respect to the Disclosure Document. He added that he did not know if ALUC
could compel individuals to use this document over a one -paragraph disclosure
statement that the legislation requires.
Bob Hennigan stated that it was ALUC's intent at the start of the process to provide
the real estate community a document to help them meet the statutory requirement at
that time instead of having to extract the information from the CLUP document on
their own. He added that ALUC could not require them to use the document but
added that they have a legal obligation to disclose the information.
Chair Wallrich summarized the discussion by stating that it would be necessary to
check with Commissioner Rosene for his input on this matter. He added that Mr.
Sanders would research the new legislation to ensure the Disclosure Document is in
compliance and also add Table 2-A per Commissioner Greenwood's recommendation.
Chair Wallrich also requested that this item be moved to the February ALUC meeting
to have it formally approved and ready for immediate distribution.

• 4. CLUP Document Amendments
Chair Wallnch stated that there were no amendments for the year of 2002 but there.
would be an opportunity to do so in the year 2003.
Mr. Sanders stated that he spoke with Kim Seidler, Planning Director from the City of
Chico and he would welcome the opportunity to speak with ALUC at the February
meeting regarding their General Plan.
The Commission also discussed the Town of Paradise and the County. It was agreed
that a letter should be sent to both agencies to request a Compatibility Update
regarding the status of bringing their General Plan into compliance with the CLUP.
Mr. Sanders concurred and stated that he would send a memo to the Town of Paradise
and Butte County for an update on this matter. Mr. Sanders stated that the Town of
Paradise had some issues to address with ALUC and how they would adopt a policy to
take these issues into account. Mr. Sanders added that there are concerns regarding
potential hazards to flight and ALUC would want to ensure they address these in
either their zoning or General Plan.
Chair Wallrich requested that .Mr. Seidler from the City of Chico be placed on the
agenda for the February meeting.
is 5. Discussion of Open Space Areas Around Chico and Oroville Airports

Mr. Sanders stated that after the discussion of open space at the last meeting, he had
prepared two additional maps for the Oroville and City of Chico airports. He also
referred to a one-page report distributed to the Commission members on his findings.
Mr. Sanders stated that he plotted all of the previously identified vacant land and land
owned by the state, county, cities, and federal government. He also stated that he
plotted additional properties around the Chico Airport that he had knowledge of as
being open space designations or land planned to remain undeveloped.
Mr. Sanders stated his results also showed that the open space requirements had been
met within the public lands surrounding the Oroville Airport. He also added that the
State has done an excellent job of buying up those lands and providing the required
open space that is called for in the CLUP. Mr. Sanders also stated that the ten percent
requirement in Zone C has more than been met.
Mr. Sanders stated that much of land within the B1 Zone of the Chico Airport is
currently owned by the City and does not necessarily mean it will remain open or that
it is totally open now. He added that the acreage figure on his report might not be
exact.

Mr. Sanders stated that C Zone has no significant public land; he added that there is
only about 98 acres. He added that the ten percent open space requirement would
have to be met and it could not be done solely on current public ownership.
(There was a brief discussion from the audience regarding the how to best define open
space.)
Mr. Joe Baker responded that a definition of open space is very difficult. -He added
that from his previous work experience he had seen various definitions of open space.
Mr..Baker stated that perhaps there is a need to define tighter classes of open space.
Chair Wallrich stated that depending on whether or not. ALUC reviews land uses or
not, depending on when the various governments' come into compliance, it could
quickly be out of compliance.
Mr. Sanders replied that he had a different view on this matter. He stated that as long
as the County keeps the same land use designation/zoning they would meet that
requirement. Mr. Sanders added that only when General Pan amendments or rezone
requests come forward for review to ALUC would there be a potential problem.
Mr. Sanders directed the Commission's attention to his handout from the California
Airport Land Use Planning Handbook (January 2002) explaining the characteristics of
open land.
• The Commission brieflydiscussed the need to address the definition and purpose of
open space.

Chair Walhich suggested appointing a sub -committee to work on this issue. He
requested that this remain an open item and agendized for the February ALUC
meeting. Chair Wallrich proposed that this committee might be comprised of
interested members from the public and ALUC.
Alternate Commissioner Dilley responded that he would like to participate in this
proj ect.
6. Verizon Wireless Tower
Chair Wallrich stated that a letter was received from Kim Seidler with a response to
the tower lighting issue recommending ALUC bring this issue before the Chico City
Council for reconsideration.
Commissioner Baldridge stated that another letter had been drafted to the Chico City
Council to place Verizon Wireless on their agenda for the next meeting to help work
towards resolving this issue.

Commissioner Grierson requested that condition number three be deleted from the
• letter stating, "The amendment would apply to new towers or tower extensions within
the Highway 99 Corridor only, and reviewable on a case by case basis."
Commissioner Grierson expressed that the wording may be too limiting.

Chair Wallrich requested that this issue of when lighting is required on towers remain
on the agenda for the next meeting.
Commissioner Grierson requested that Tony Baptiste, Community Development
Director, from the City of Chico be added to the distribution list.
Commissioner Grierson suggested that the word "emergency" should be removed
from the subject line so that it would read, "Safety concerns for air operations." He
added it would be less confusing to the non -aviation person.
7. Stevens Property Lawsuit
Mr. Sanders stated that there is no additional information at this time.
Chair Wallrich requested that it remain as an open item.
F. MONTHLY STATUS REPORT

G. COMMITTEE APPOINTMENTS
Chair Wallrich stated that this item would be discussed further at next month's meeting. He
discussed with the Commission on how to best recruit applicants to fill Nina Lambert's
vacancy.
Mr. Sanders stated that he could not find any information in the ALUC Bylaws that stipulated
how the Commission would have to appoint its At -large Member. He added that it would be
the Commission's decision on how fill this vacancy by advertising in the newspaper and
allow for a 30 -day recruitment process.
Chair Wallrich asked if ALUC had a requirement to advertise in the newspaper.
Mr. Sanders responded that it is not a requirement but added that there may be some interest
in the general public for those that would like to serve.
Chair Wallrich responded than there are two alternate ALUC commissioners interested in the
position.

• Commissioner Grierson replied that advertising would be a good idea in order to maintain a
pool of viable candidates.
Mr. Sanders responded that an ad would be placed in the newspapers as soon as possible. Mr.
Sanders added that a decision ' could be made to fill Nina Lambert's vacant position at the
March meeting since February would be too soon.
H. ALUC ADMINISTRATIVE LOG
Mr. Sanders stated that a project named "Hayes" would be available for ALUC review at the
February meeting. He added that this is one of the large projects left in the North Chico
Specific Plan, and he is waiting for the ALUC application to be submitted next week.
I. CORRESPONDENCE AND COMMISSION ANNOUNCEMENTS
Chair Wallrich noted that the Deed Notice had been sent out for Agasy, Inc. and that this
notification process is in place.

• Commissioner Grierson mentioned that Shutt Moen Associates, the vendorreviousl hired

to work on the CLUP, had been acquired by the Mead & Hunt consulting firm. He added that
the name would remain along with staff members and location.
Commissioner Grierson added that he had received the Governor's proposed budget; it
showed Caltrans' Division of Aeronautics with a 1.7 million -dollar reduction from this year.
He added that this reduction will significantly affect their ability to give loans to small
airports for construction projects and local management assistance; it would adversely affect
them but they would remain in existence.
Commissioner Grierson announced that he now reports to Craig Sanders. Mr. Sanders has
accepted the position of City of Chico Airport Commissioner replacing Steve Lucas.

SUMMARY: Staff recommends that ALUC find the project consistent with.the 2000 Airport Land
Use Compatibility Plan for the Chico Municipal Airport.
BACKGROUND:
The property is within the unincorporated area around Chico and is within the North Chico Specific
Plan area. The current General Plan land use designation is Commercial and the zoning is C-2
(General Commercial). The site is currently developed with several storage buildings and was
historically used as a boat repair and sales operation. The C-2 zone allows for a wide variety of
commercial uses including offices, restaurants, churches, motels, and retail services. The site is
located approximately 7,000 feet westerly and perpendicular to the south end of runway 13L -31R
and approximately 7,700 feet from the south end of runway 13R -31L of the Chico Municipal Airport.
The Butte County Fire Department has submitted this General Plan and Rezone. application to the
Department of Development Services with the intent of developing the site with a new County Fire
Station.
ANALYSIS:
According to the 2000 Airport Land Use Compatibility Plan (ALUCP) for the Chico Municipal
Airport, the property is located in a Traffic Pattern Compatibility Zone "C-2" - Traffic Pattern Zone.
Compatible non-residential uses in the C-2 compatibility are limited based on the concentration of
people expected on the site. Concentrations of 100 people per acre or less are generally compatible.
Incompatible uses regardless of the concentration threshold include Children's schools, libraries,
daycare facilities, nursing homes, hospitals and convalescent hospitals:
The proposed PQ zoning would allow the development of public schools, public libraries, and public
hospitals, which would be conflict with the airport compatibility zone. In this particular instance the
County plans to develop a fire station on the site. The station would house up to 5 employees on the

per acre maximum called out in the C-2 Compatibility Zone. The change in land use and zoning along
with the proposed. development would, therefore be consistent with the 2000 ALUCP provided the
site is developed as proposed.
No height limitations are expected to be exceeded by a fire station and outdoor lighting should not
interfere with airport operations. The radio frequencies used by emergency response personnel do
not conflict with airport frequencies.
Compatibility Zone "C" normally calls for a disclosure notice regarding airport noise, annoyance, and
discomfort. This generally pertains to residential uses and would not be required in this case.
Environmental Documentation: No environmental documentation has been completed for this
project.
RECOMMENDA'T'ION:
Staff recommends that the Butte County Airport Land Use Commission find ALUC File No. A02-12
(Butte County Department of Development Services) consistent with the 2000 Airport Land Use
Compatibility Plan for the Chico Municipal Airport.
