Communities Apartments that would add an additional 13 multi -family dwellings
to the existing 8 multi -family dwellings. The project site is located at the end of
Cameo Drive, on the northeast side, approximately 1,000 feet northwest of
Cohasset Road, in the City of Chico.
SUMMARY:
Staff recommends that ALUC find the project consistent with the 2000 Airport Land Use
Compatibility Plan for the Chico Municipal Airport. Consistency is based upon the recently -
approved amendment to Section 2.4.4 of the 2000 Butte County Airport Land Use Compatibility
Plan and ALUC's approval of the City of Chico infill development map at the March 16, 2005
meeting.
BACKGROUND:

)The property is 1.4 acres in size and is developed with 8 multi -family dwellings.
•:' The property is within the 'incorporated limits of the City of Chico The project site is
designated Medium High Density Residential (14.01 to 22.0 du/ac) 'on the City of Chico
General Plan Diagram and is zoned R-3 (Medium -High Density Residential).
Existing land uses within 500 feet of the project site include a church a worship center, a
mini storage facility, professional office uses, a fire station and multi -family and single
family residential dwellings.

• No open space is proposed on the project site.
f% The height of the tallest object on the project site is anticipated to be approximately 24 feet 4
inches above ground level, which equates to approximately 225 feet above mean sea level.

This project is a major land use action as defined by Policy 1.5.3 of the 2000 Butte County
Airport Land Use Compatibility Plan (ALUCP).

Extract from Table 2A of the 2000 ALUUF *NLR - Noise Level Reduction
• = The project site is approximately 0.4 miles west of the extended centerline of Runway
< r 31R/13L of the Chico Municipal Airport, at a distance of 1.18 miles SDuthwest of this
runway.
• Section 4.1.3 of the 2000 Butte County Airport Land Use Compatibility Plan states that the
maximum noise level for residential uses in the vicinity of an airport is 55 dB CNEL, except,
for the area south of the Chico Municipal Airport, where a 60 dB CNEL noise maximum is
acceptable.
,•;. The project site is not within the 55 dB CNEL noise contour as shown on Exhibit 4E (Noise
Impacts — Future Average Fire Season Day) but is within the 55dB CNEL noise contour as
shown on Exhibits 4F (Noise Impacts — Expanded Forecast) and 4G (Noise Impacts — Peak
Fire Attack Day) of the 2000 Butte County Airport Land Use Compatibility Plan.
•. Pursuant to Section 4.1.5(a) of the 2000 Butte County Airport Land Use Compatibility Plan,
staff recommends that all dwellings on the project site be designed and constructed to
achieve a maximum interior noise level of 45 dB CNEL.
The project would result in 21 multi -family dwellings (13 new and 8 existir_.g) on 1.4 acres,
which will result in a density of 15 dwelling units per acre. This density is not consistent
with the B2 Airport Compatibility Zone, which requires 0.2 dwelling units or less per acre
(minimum parcel size of 5 acres or larger).

*_;,The proposed multi -family development qualifies as infill development pursuant to Section
15332 of the California Environmental Quality Act.
• ~'The project site meets the criteria for infill development of Section 2.4.4(a)(3) of the 2000
Butte County Airport Land Use Compatibility Plan because it is 5 acres or less in size (1.4
acres), qualifies as infill development pursuant to Section 15332 of the California
Environmental Quality Act, and the density of the project (15.0 du/ac) would be less than the
highest density of the existing residential developments within 500 feet of the project site,
which is a multi -family complex (28 units) on a 1.31 acre parcel (21.37 du/ac), located at 13
Cameo Drive, Chico (APN 007-290-042).
Amendment to Policy 2.4.4 of the 2000 Butte County Airport Land Use Compatibility Plan
• At the February 16, 2005, ALUC meeting the Commission approved an amendment to
Section 2.4.4 (Special Conditions) of the 2000 Butte County Airport Land Use Compatibility
Plan. The amendment allows infill development that would otherwise be inconsistent with
the B2 Airport Consistency Zone.
• Section 2.4.4 now allows infill development on parcels that are 5 acres or less in size. If the
proposed infill development meets the infill development requirements of Section 15332 (In -
Fill Development Projects) of the California Environmental Quality Act the infill
development density may be equal to, but no greater than, the density that exists on the most
densely developed property that is located within 500 feet of the perimeter of the parcel.
• The City of Chico provided a map to the ALUC that showed those parcels eligible for infill
development in the B2 Airport Compatibility Zone south of the Chico Municipal Airport
which ALUC has formally adopted on March 16, 2005 as the infill development map. The
project parcel is identified on the City of Chico infill development map.
ENVIRONMENTAL DOCUMENTATION.:
- No -environmental documentation has been completed for this project by ALUC staff. The. City
of Chico staff will make a determination per the California Environmental Quality Act as part of
their processing of the apartment complex expansion. It is expected that a Class 32 categorical
exemption for in -fill development (Section 15332 of the. CEQA Guidelines) will be the
environmental determination for the new apartments.
RECOMMENDATION:
Staff recommends that the Butte County Airport Land Use Commission find ALUC File No
A 05-18 (Cameo Community, LLC - Apartments) is consistent with the infill development policy
of Section 2.4.4 of the 2000 Butte County Airport Land Use Compatibility Plan.

BUTTE COUNTY AIRPORT LAND USE COMMISSION
CONSISTENCY FINDINGS FOR ALUC File No. A 05-18 — Cameo Communities, LLC —
Multi -Family Dwellings, APN 007-290-031:
The Airport Land Use Commission (ALUC) has prepared the following findings based on data
contained in the 2000 Butte County Airport Land Use Compatibility Plan (ALL -CP), as well as
site specific information submitted by the applicant and ALUC staff.
The following findings have been prepared at the direction of the ALUC and are for the
consideration of the Lead Agency (City of Chico) when making a decision on the project.
SECTION 1: ENVIRONMENTAL FINDINGS
A. No environmental documentation has been completed for this project by ALUC
staff. The City of Chico staff will make a determination p, -r the California
Environmental Quality Act as part of their processing of the apartment complex
expansion.
SECTION 2: CONSISTENCY FINDINGS FOR PROPOSED PROJECT
A. The proposal for the Cameo Community LLC — Apartmer._ts, will add an
additional 13 multi -family dwellings to an existing 8 multi -family. dwellings on
1.4 acres, which will result in a density of 15 dwelling units p. -r acre, which is
consistent with the infill development criteria of Section 2.4.4(a)(3) of the 2000
Butte County Airport Land Use Compatibility Plan.
SECTION 3: PROJECT FINDINGS:
A. The project site meets the criteria for infill development of Section 2.4.4(a)(3)
because:
1. The project site is 5 acres or less in size
2. The Multi -Family project qualifies as infill development pursuant to the
California Environmental Quality Act
3. The density of the project, at approximately 15 units pet acre, would be
less than the density of the highest existing residential development within
500 feet of the project site, which is 21.37 units per acre.
4. The project site is shown on the City of Chico's infill development map,
as approved by the Butte County Airport Land Use Commission on March
16, 2005
B. No structures on the project site would extend into protected airspzce.
C. All dwellings on the project are required to be designed and const-ucted to have a
maximum interior noise level .of 45 dB CNEL or less in older to prevent
significant aircraft -related noise impacts.

SECTION 4: PROJECT CONDITIONS:
1. Provide a deed notice for the sale of all resulting lots notifying purchasers of the
proximity of the airport and the potential for possible noise -related impacts in an
ALUC-approved disclosure notice.
2. Airspace review by the Airport Land Use Commission required for objects greater
than 70 feet tall.
3. All dwellings shall be designed and constructed to achieve a=-naximum interior
noise level of 45 dB CNEL or below.

With this letter, the City of Chico Planning Division is forwarding a Butte County Airport Land Use
Commission (ALUC) application for consistency findings for the above -noted project: Enclosed with the
application are a check in the amount of $1.,531.00, 24 copies of a location map, the subdivision map, and
the compatibility zone map that identifies the project site as within the boundaries of Zone B(2).
The application consists of an application for architectural review associated with the proposed
construction of 13 additional multi -family residential dwelling units at 54 Cameo Drive, Assessor's
Parcel No. 007-290-031. The project site presently contains a multi -family development project
consisting of 8 existing units. The proposed project density is 15 units per acre. The property is
designated Medium -High Density Residential in the General Plan, and is located in an R3 Medium -High
Density Residential zoning district. The General Plan designation and zoning district zllow multi -family
residential development at densities between 14.01 and 22 units per acre. The project .s Categorically
Exempt from environmental review pursuant to Section 15332 (In -Fill Development Projects) of the
California Environmental Quality Act (CEQA). The project is also consistent with the General Plan
designation and zoning for the area. The project may also qualify as exempt from ALUC review under
the proposed new in -fill regulations, due to the fact the site is largely developed with existing uses and is
surrounded by similar developed residential uses at similar densities.
Pending the outcome of the new ALUC in -fill exemption review criteria, we would appreciate a
staff determination that it need not proceed to ALUC. In the event that staff determines otherwise,
please schedule this item for the March 2005 ALUC meeting.
