On Wednesday, November 21, 2001 the Airport Land Use Commission (ALUC), upon
your request, reconsidered its previous consistency finding for the referenced project.
After considerable discussion and deliberation, a motion was made that reaffirmed the
Commission's previous decision. The consistency finding, therefore, is subject to
conditions as set forth in the enclosed adopted minutes of the hearing of October 17,
2001.

C. APPROVAL OF THE DRAFT MINUTES FOR THE OCTOBER 17, 2001 MEETING
Commissioner Lambert requested corrections on page 6, line 28, correcting the spelling of
"Hayes" to'"Hays," and changing the incorrect designation of "City Planner" to "Developer."
Former Commissioner Gerst noted a correction on page 5, line 24, changing [PUC 31676 (d)]
to [PUC 21676 (d)].
A motion was made by'Commissioner Grierson, seconded by Commissioner Wallrich, and
unanimously passed to adopt the minutes as corrected.
D. ACCEPTANCE OF THE•AGENDA
It was moved by Commissioner Grierson, seconded by Commissioner Wallrich, and carried to
accept the Agenda as presented.
E. BUSINESS ITEMS
ITEMS WITH PUBLIC HEARING
1. ALUC File - No. A01-05 Consistency Finding . for Verizon Wireless
Communications, APN 007-270-022: A consistency review to allow an 18 -foot
extension to ani existing .102.5 -foot wireless communications tower. The site is
located on the east side of State Highway 99, approximately 1,000_ feet just north of
the Cohasset interchange, Chico.

Mr. Sanders presented the staff report which recommended a consistency finding
subject to a flashing red light affixed on top of the tower for visibility.
Chair Rosene opened the hearing to the public. Mr. Seidler, commenting on the
requirement of a flashing red light atop the tower, proposed adding a cup to shield the
area below the level of the light. The Commission, generally agreed with a lighting
requirement and deliberated on the lighting options available. There being no further
public comment, the hearing was closed.
Commissioner Grierson made a motion, seconded by Commissioner Wallrich, and
unanimously carried to find the ALUC File #A01-05 consistent subject to the
condition of a solid red light affixed to ,the top of the monopole tower instead of a
flashing red light as recommended in the staff report and, in addition, the requirement
of notice to public/service helicopter operators servicing Chico (CHP, Enloe Hospital,
CDF, and Sheriffs Department).
The project was approved with the following findings:
SECTION 1: ENVIRONMENTAL FINDINGS
A. No environmental documentation was submitted at the time of project review.
SECTION 2: CONSISTENCY FINDINGS FOR PROPOSED PROJECT
A. The proposed project would be consistent with the 2000 Airport Land Use
Compatibility Plan (ALUCP) for the Chico Municipal Airport if the
requirements in Section 3 are applied as a condition to the Minor Use Permit.
B. Approval,of the project without implementation of the requirements in Section
3 would necessitate the adoption of Overriding Findings by a 2/3 vote of the
governing body. Overriding Findings by the governing body can only be made
based up substantiated facts and must be supported by new substantial factual
evidence introduced into the public. record that the proposed action is
consistent •with the State Aeronautics Act as stated in` Section 21670.
Overriding findings cannot be adopted as matters of opinion, here say, or upon
the unsubstantiated fears and desires of the governing body.
SECTION 3 PROJECT FINDINGS
A. According to the 2000 ALUCP for the'Chico Municipal Airport, the project is
listed in a Compatibility Zone "D" — Other Airport Environs. Communication
towers are listed as a compatible use in this zone.
B. An airspace review has been completed in accordance with the ALUCP for
structures over 100 feet in height.

C. The, proposed tower will not violate any protected airspace nor will it pose a
hazard -to aircraft because:
1. The site is -located approximately 10,000 feet from the runways of the
Chico Municipal Airport and is not under or within any flight track.
2. ` The tower would be approximately 69 feet below the horizontal. surface
specified in FAR Part 77, as applied to the Chico Municipal Airport.
D. Include, as a condition of the Use Permit that a solid red light be placed atop
the tower.
E. As a condition of the ;Use Permit, include a requirement that prior to the
issuance of a Building Permit for the tower extension, the property owner shall
sign an avigation easement granting the right of continued use of the Chico
Municipal Airport in the airspace above \the proposed_ parcel and
acknowledging any and all existing or potential airport operational impacts.
2. Bylaws: County Counsel's legal determination of the tie -vote issue, as well as
nomination of Alternates (Continued from August 15, 2001): The Commission will
take an action regarding the effect of an abstention vote on the outcome of a motion.
Mr. Meleka reviewed the contents of a. memo from County Counsel which affirmed
the designation of a single proxy per Commissioner.. He also referred to provision
made in the bylaws for a proxy to serve -two regular members, only acting as a regular
member for one at a time. The'Counsel's opinion states that it is not permissible for. a
regular member to authorize more than a single proxy under state law [PUC ,21670
(d)] or under the ALUC'bylaws. +
The Commission held considerable discussion regarding the effect of a tie -vote on the
outcome of such a vote.
-'Chair Rosene opened the hearing to the public. Mr. Gerst argued that an affirmative
vote by four of the Commissioners is required for a motion to pass, therefore, the tie -
vote issue -is not relevant to the outcome. Chair Rosene, responding to a question,
commented that a tie -vote would result in no action being taken and would defer to the
default provision of a consistency finding. There being no further public comment,
the hearing was closed.
The discussion turned to the effect of an abstention within the context of a vote.
County Counsel in its Opinion#01-1.07 dated July 5, 2001, offered alternatives for
interpreting an abstention. It was generally agreed that the definitions of quorum,
action, affirmative vote, and default had been clarified with the uncertainty of the
effect of an abstention still remaining to be defined. ,

Commissioner Harp made a motion to accept Proposal 3, Alternative B to clarify the
interpretation of the effect of an abstention in a vote, seconded by Commissioner
Lambert, and unanimously adopted to amend the ALUC bylaws as follows:
1.5.6. Voting. A vote of the Commission shall be taken on the motion..If the
motion receives an affirmative vote of the majority of the full'Commission, the
motion passes [§21671.5(e)]. If the'motion receives less than a majority, the
motion is defeated and the Chair may allow a subsequent motion(s) on the
matter. If there are no subsequent successful motions, the Chair shall declare
that no action has been taken on the matter.
Tie Votes. If there is a tie vote on a motion, the motion fails.
Abstentions. The abstention shall not be counted as an affirmative or a
negative vote.
Commissioner Harp made a motion, seconded by Commissioner Lambert, and
unanimously passed to amend the bylaws, to include the expanded definition of
"action" as documented in County Counsel Opinion #01-107 dated July 5, 2001 as
follows:
1.5.4. Action. An affirmative vote of a majority of the full Commission is
required to constitute an action of the Commission. [§21671.5(e)]. For
purposes of these. bylaws, -"Action" is defined as the passage of a motion duly
made and seconded. at a meeting of the Commission held in compliance with
the Brown Act (Chapter 9 of Part 1 of Division 2 of Title 5 of the Government
Code, commencing with §54950).
ITEMS WITHOUT PUBLIC HEARING
3. City of Chico / Kim Seidler letter: 2000 ALUCP-related issues:. A timed
discussion item scheduled for 10:00 a.m.; conducted at 9:45 a.m.-by agreement of the
ALUC and Mr. Seidler.
Mr. Seidler stated that the City of Chico is in the process of conforming its Ordinance
to the ALUCP. ' Upon completion of the City's Ordinance, it will be reviewed by the
City Attorney and then presented to the ALUC for review and comment prior to
scheduling a public hearing. Mr. Seidler related that the City's efforts in this regard
have been impeded due to the significant issue of overall Chico's growth. The
concern is whether there is sufficient in of vacant residentially -designated land
to accommodate the City's projected growth. He stated in light of this concern, his
letter addressed zoning/development issues which may influence the potential for
residential growth in Chico. Mr. Seidler first addressed the Ravenswood property,
land owned by "`Mr.. Webb north of Eaton Road. ' He voiced the City's concern
regarding land uses permitted by the 2000 ALUCP (Airport Land Use Compatibility
Plan) which would limit residential uses while encouraging commercial uses in the
airport area of influence. Mr. Seidler affirmed that the parcel is currently ' under

County jurisdiction and further stated that Chico's interest is in pre -planning for the
eventual annexation of the property to the City.
Chair Rosene opened the hearing to the public on this issue. There being no public
comment,' the hearing was closed.
Mr. Seidler addressed the City's concerns related to the 2000 ALUCP's infill policies,
citing Floral Commons as one infill property currently under review. He suggested
that consideration be given to amending the ALUCP infill policy to allow densities
consistent with ' the City's current General Plan. He said that while some of the
existing development should not have occurred, the concern now is "filling the holes"
and whether that in any way would affect the viability of the airport. He added that he
did not like encroachments on the airport and would like to keep the airport viable.
Chair Rosene thanked Mr. Seidler fo'r his comments. He responded that the
Commission would review its infill requirements in light of the accident scatter and
low-flying aircraft that may have some influence relative to this project. Chair Rosene
then asked Mr. Seidler how well the City has met its density requirements set forth in
its adopted General Plan. Mr. Seidler responded that it is unclear depending on how
the City views growth and further commented that a detailed report would be
presented at the City Council meeting on October 301H
Commissioner Grierson asserted that the Airport Commission and others have
indicated to him that the infill policy in the ALUCP is confusing. He stated that he
planned to address a series of procedural questions and concerns and make
recommendations to simplify the language of the 2000 ALUCP infill policy at the next
Commission meeting.
Mr. Seidler was asked about the status of the Bidwell Ranch project and he responded
that no further action has been taken at this point.
Commissioner Greenwood read section 2.4.4.(a)(4) in the 2000 ALUCP which states,
"To avoid the ripple effect of infill development on some parcels permitting additional
- parcels subsequently to qualify for infill, the ALUC's intent is that parcels eligible for
infill be determined just once. Thus, in order for the ALUC to consider the proposed
development under these infill criteria, the entity having land use authority (Butte
County or affected cities) must first identify the qualifying locations in its general plan
or other adopted planning document approved by the ALUC. This action may take
place in conjunction with the process of amending a general plan for consistency with
the ALUC plan or may be submitted by the local agency for consideration by the
ALUC at the time of adoption of this Compatibility Plan. In either case, the burden
for demonstrating that a proposed development qualifies as infill rests with the project
proponent and/or affected land use jurisdiction." Chair Rosene thanked him for
reviewing this relevant provision.

Chair Rosene opened the hearing to public comment. There being no public comment,
the hearing was closed..
4. Buying Property Near a Butte County Airport (Continued from AuPust 15, 2001):
A document prepared by the Disclosure Subcommittee.. A discussion item on the
disclosure of the airport's influence area to prospective buyers of all airport -vicinity
properties, prior to transfer of title. .This item will have to be set as a public hearing
item if further action is desired.
Ms. Hennigan reiterated prior comments stating that it is the ALUC's responsibility to
provide factual information available to the public related to areas within the airport
area of influence. She believes that the new disclosure document will effectively
serve that purpose.
Commissioner Wallrich voiced his concernabout real estate transactions handled
between buyers and sellers without the benefit of realtor involvement in which home
owners in the airport area of influence may not disclose relevant information.
Although state law mandates disclosure, he feared that there is no ,measure of
compliance and, therefore, questioned the effectiveness of ALUC's disclosure
document. Chair Rosene commented that in addition to the disclosure document, he is
also in favor of approaching the North Valley Pilots Association .to see whether they
would support a monthly box ad with a concise statement such as, "Please refer to the
disclosure document before purchasing your house." Chair Rosene believed that this
would assist in meeting the state mandate.
Chair Rosene commented that he was satisfied that the disclosure document met the
Commission's intended purpose. -However, it was generally agreed to continue this
item to the next meeting to permit time for Commissioners/Alternates to review the
most recent letter from Ken Duvall and attached real estate disclosure documents
distributed at this meeting.
F. MONTHLY STATUS REPORT
The Monthly Status Report was submitted for review with the October 17; 2001 mailing log.
G. COMMITTEE APPOINTMENTS
None.
H. ADMINISTRATIVE REFERRAL

I. CORRESPONDENCE AND COMMISSION ANNOUNCEMENTS
Chair Rosene reported "on conversation and letters (attached and/or distributed at the meeting)
between Tom Buford, Development Services' Interim Director, and himself regarding ALUC
issues.

Chair Rosene opened the hearing to the public. There being no public comments, the hearing

K. OTHER BUSINESS
Chair Rosene introduced newly appointed Alternate Glen Dilley who will serve as his
Alternate in the event of his absence.
Chair Rosene reported that cities in Butte County have not- yet completed the process of
bringing their general plans into compliance with the 2000 ALUCP (due for completion by
October 27, the end of the 180 -day compliance period). Mr. Meleka commented that he had
been in communication with Ms. Sherman, Planning Director for the City of Oroville, and
that�he would continue to be supportive of the City's continuing efforts to complete the work
on its General Plan. Chair Rosene added that a review of the various_ cities' progress would
be appropriate at this time.
Chair Rosene apprised members that it is the ALUC's prerogative to review its Plan annually
and he asked members to bring their suggestions for Plan changes or modifications to the
November meeting for discussion. He commented that the ALUCP annual review will be
conducted at the December meeting.
Chair Rosene apprised members that bylaws specify that a work program along with budget
needs, be identified in October for the upcoming year and subsequently submitted to the
Director of Development Services for budget -inclusion. Commissioner Grierson suggested an
economic impact study for each airport in Butte County. For implementation, he further
suggested that a contract be drawn through a third-pai-ty, BCAG, using Caltrans funds with a
report to the ALUC. Commissioner Grierson stated his interest in educating the public on the
significant edonomic contributions made by Butte County airports to the community
regarding jobs and overall safety and security. Commissioner Grierson's work program
recommendation was well-received.
Commissioner Grierson voiced some concerns over the Development Services' Interim
Director's intention to eliminate the application review fee set previously by the ALUC. He
advised members that airport land use commissions are authorized by the state to establish
their fee structures; otherwise, under state mandate, the County is charged with subsidizing
the related -costs associated with the ALUC. Chair Rosene acknowledged the concern and
added that Mr. Buford is open to continued dialog.

In response to a question of the status of the Chico Municipal Airport's expansion plans,
Commissioner Grierson reported that the U. S. Fish & Wildlife has reverted to original
discussions, requesting that- the airport provide proof that the species of Meadowfoam on the
airport is not genetically different than can be found elsewhere. He added that the airport has
provided, a DNA analysis by an independent source, as requested by the U. S. Fish & Wildlife
with no change in the status. Commissioner Grierson reported -that Congressman Herger's
office has been sought to assist in the impasse.
Chair Rosene, responding to a question in regard to the status of the review of the Landmark
Missionary Baptist Church, said that an internal review of the project by staff had resulted in
findings of inconsistency under the 2000 ALUCP: He added that while internal review is
permitted for projects under the 2000 ALUCP, the ALUC is open to review of such projects
by the full Commission, if desired by the applicant. Chair Rosene further added that in this
particular project application, the Interim Director of Development Services determined that
the timeline had been dropped and notified the applicant that the project .was found to be
consistent. Chair Rosene reported that he had since met with Mr. Buford to discuss the
interpretation of the ALUCP relative to this project and reiterated that the correct
interpretation is a finding of inconsistency, although he would be agreeable with any request
for reconsidering this application by the full Commission.
Chair Rosene opened the hearing to the public.. Pastor Tourville of the Landmark Missionary
Baptist Church briefly commented.
Mr. Lucas, Senior Planner-LAFCO, spoke on behalf of the Landmark Missionary Baptist
Church. He stated that the Airport Commission had authorized him to relay their concerns
about the process of this project and future projects working through the ALUCP. Chair
Rosene took the comments under advisement and further clarified the adopted Plan.
There being no further public comments, the hearing was closed.
L. CLOSED SESSION -None.

There being no further business, Chair Rosene adjourned the meeting at 10:50 a.m.

Communications, APN 007-270-022 A consistency review to allow an 18 -foot
extension to an existing 102.5 -foot wireless communications tower. The site is
located on the east side of State Highway 99, approximately 1,000 feet just north of
the Cohasset interchange, Chico.
FOR: Airport Land Use Commission Meeting on October 17, 2001
SUMMARY: Staff recommends that ALUC find the project consistent with the 2000 Airport Land
Use Compatibility Plan for the Chico Municipal Airport.
BACKGROUND: The site is located approximately 10,000 feet due south of the southerly end
of f runway 13L -31R of the Chico Municipal Airport. The property is in the incorporated limits of
the City of Chico. The current General Plan land use designation is Commercial and the zoning is
CC Community Commercial. An existing 102.5 -foot monopole -type communications tower is.
presently located on site. The applicant is seeking to add an 18 -foot extension to the tower to bring
the total height to 120.5 feet. The increased tower height would allow the applicant to co -locate on
this tower rather than erecting a new tower.
ANALYSIS: According to the 2000 Airport Land Use Compatibility Plan (ALUCP) for the Chico
Municipal Airport, the property is located in a Traffic Pattern Compatibility Zone D -Other Airport
Environs. Within Zone D, airspace review is required for proposed objects greater than 100 feet in
height.
At an elevation of approximately 203 feet above mean sea level (amsl), the project site is about 17
feet below the runway elevation at Chico Municipal Airport. The project site is within the FAR Part
77 boundary for the Horizontal Surface which has an elevation of 390 feet amsl. The top of the
proposed extension would be approximately 69 feet below the Horizontal Surface. At over 10,000
feet away from the runways, the tower location is not under any designated flight tracks and does
not pose a hazard to flight traffic associated with operation of the airport.
Though not required by FAA regulations for a tower of this height, it is recommended that the
requirement for a flashing light be applied for visibility. Occasionally, emergency and law
enforcement aircraft follow the highway corridor at lower flight elevations. The existing tower is
painted a neutral light gray/green color and the proposal is to paint the extension to match. A
requirement to paint the tower alternating bands of red and white is not recommended as the site is

not in a flight corridor and the treatment would have"a negative aesthetic impact to a highly traveled
transportation routes.
The proposed tower does not pose a hazard to any private use airstrips as there are none in the
immediate vicinity'
Environmental Documentation: No environmental documentation has been completed for this
project.
RECOMMENDATION: Staff recommends that the Butte County Airport Land Use Commission
find ALUC File No. A01-05 (Verizon Wireless Communications Inc.) would be consistent with the
2000 Airport Land Use Compatibility Plan for the Chico Municipal Airport.

The Airport Land Use Commission has prepared the following findings based on data contained in
the 2000 Airport Land Use Compatibility Plan (ALUCP) for the. Chico -Municipal Airport, as well
as site specific information submitted by the applicant and the ALUC staff.
The following findings" have been prepared at the direction of the ALUC and are for the
consideration of the Lead Agency (County of Butte) when making a decision on the project.
SECTION l: ENVIRONMENTAL FINDINGS
A. No environmental documentation was submitted at the time of project review.

approved our project with a condition that is prohibited by the City of
Chico. That is, Chico prohibits installing'lights on monopoles 'or tower
structures. Given that the project was approved with that condition, I
would like to request our `project be re -considered by ALUC at their
November meeting. Your staff report clearly states the project is not in a
flight path and the light is not required by the FAA. As such, we are
hopeful the Commission will eliminate the condition and allow our project to
move forward.

located on the east side of State Highway 99, approximately 1,000 feet just north of
the Cohasset interchange, Chico.
FOR: Airport Land Use Commission Meeting on October 17, 2001
SUMMARY: Staff recommends that AL UC find the project consistent with the 2000 Airport Land
Use Compatibility Plan for the Chico Municipal Airport.
BACKGROUND: The site is located approximately 10,000 feet due south of the southerly end
of f runway 13L -31R of the Chico Municipal Airport. The property is in the incorporated limits of
the City of Chico. The current General Plan land use designation is Commercial and the zoning is
CC Community Commercial. An existing 102.5 -foot monopole -type communications' tower is
presently located on site. The applicant is seeking to add an 18 -foot extension to the tower to bring
the total height to 120.5 feet. The increased tower height would allow the applicant to co -locate on
this tower rather than erecting a new tower.
ANALYSIS: According to the 2000 Airport Land Use Compatibility Plan (ALUCP) for the Chico
Municipal Airport, the property is located in a Traffic Pattern Compatibility Zone D - Other Airport
Environs. Within Zone D, airspace review is required for proposed objects greater than 100 feet in
height.
At an elevation of approximately 203 feet above mean sea level (amsl), the project site is about 17
feet below the runway elevation at Chico Municipal Airport. The project site is within the FAR Part
77 boundary for the Horizontal Surface which has an elevation of 390 feet amsl. The top of the
proposed extension would be approximately 69 feet below the Horizontal Surface. At over 10,000
feet away from the runways, the tower location is not under any designated flight -tracks and does
not pose a hazard to flight traffic associated with operation of the airport.
Though not required by FAA regulations for a tower of this height, it is recommended that the
requirement for a flashing light be applied for visibility. Occasionally,: emergency and law
enforcement aircraft follow the highway corridor at lower flight elevations. The existing tower is
painted a neutral light gray/green color and the proposal is to paint the extension to match. A
requirement to paint the tower alternating bands of red and white is not recommended as the site is

not in a flight corridor and the treatment would have a negative aesthetic impact to a highly traveled
transportation routes.
The proposed tower does not pose a hazard to any private use airstrips as there are none in the
immediate vicinity.

zone. The property is immediately adjacent to Highway 99 near the Cohasset Road exit.
The surrounding uses include commercial retail plazas, small office buildings, fast-food
restaurants and gas stations. The existing property is occupied by Bidwell Self -Storage, a
self -storage facility comprised of three -two story buildings. The monopole is located in
the rear yard, approximately 30 feet from the freeway right-of-way and is surrounded by
tall trees and shrubs. The pole is.owned and managed by AT&T Wireless Services.
Three additional wireless carriers are presently located on the structure, including AT&T
Wireless, Nextel SNIR and, Ubiquitel.
Proposed Land Use Description
The project involves the installation and operation of a telecommunications facility for
Verizon Wireless at 65 Heritage Lane, Bidwell Self -Storage in Chico. The proposed
facility is a co -location effort on an existing monopole that is 100 feet in height, and
presently accommodates three additional wireless carriers. The monopole will be
extended by approximately 18 feet to include three -six feet, flush mounted panel
antennas for Verizon. The pole extension and antennas will be painted and textured to
match the existing facilities. The associated equipment necessary to transmit the signals
will be installed inside two nearby storage units. The project is designed to be visually
unobtrusive and will blend in with the environment.

Creative and effective cellular site placement is key to Verizon, and individual site
locations are selected based on a number of considerations related to topography,
proximity to high traffic corridors, and other technical features. Verizon's goal is to co -
locate it's facilities whenever possible to avoid the construction of new monopoles and
towers. The facility at Heritage Lane will provide continuous coverage to Highway 99
and the surrounding area.

The project also includes. the placement of a two self -storage equipment units at the base of the tower
adjacent to the existing five equipment units serving three other telecommunication providers. The existing
tower is located in the Bidwell Self Storage facility, south of Albertson's and K Mart, and immediately north
of SHR 99. The Chico Municipal Airport Land Use Plan identifies the project site as being in Compatibility
Zone D and requires Airport Land Use Commission review of objects over 100 feet in height. The tower
extension will be painted and textured to match the existing facility.
Attached is the preliminary data regarding a project which as been submitted to the City of Chico for a .
discretionary action (Use Permit, Rezone, Subdivision, etc.). An assessment of the potential impacts of
the project is being made. Please review and submit comments within ten working days.
