On Wednesday, May 20, 2005, the Airport Land Use Commission (ALUC) found the referenced
project to be consistent subject to Conditions 1, 2, and 3, adding new Conditions 4 and 5 to read as
follows:
4. Prior to the recordation of the Final Map record as a separate instrument an Avigation
easement granting the right of continued use of the airspace above the proposed parcels.by the .
Chico Municipal Airport and acknowledging any and all existing or potential airport
operational impacts.

multi -family dwellings. The project site is located on the south site of East Lassen
Avenue, approximately 250 feet southwest of the intersection of -East Lassen
Avenue and Burnap Avenue, in the City of Chico.
SUMMARY:
Staff recommends that Airport Land Use Commission (ALUC) find the project consistent with
the 2000 Airport Land Use Compatibility Plan for the Chico Municipal Airport Consistency is
based upon the recently -approved amendment to Section 2.4.4 of the 2000 Butte County Airport
Land Use Compatibility Plan and ALUC approval of the City of Chico infill dev,lopment map at
the March 16, 2005 meeting.
BACKGROUND:
e;r-- The project is comprised of three parcels totaling 1.66 acres in size (1. 16, 0.25 & 0.25 acres).
Twenty-one (2 1) multi -family dwelling units are proposed.
The property is within the incorporated limits of the City of Chico The project site is
designated Medium Density Residential (4.01 to 14.0 du/ac) on the City of Chico General
Plan Diagram and is zoned R-2 (Medium Density Residential).
;�•"'rExisting land uses within 500 feet of the project site include a church, a mini storage facility,
a mobile home park, and multi -family and single family residential dwellings.
• No open space on the project site is proposed.
,•'''The height of the tallest object on the project site is anticipated to be approximately 28 feet
above ground level, which equates to approximately 220.20 feet above mean s -,a level.

31R/13L of the Chico Municipal Airport, at a distance of 1.19 miles. southwest of this.

• Section 4.1.3 of the 2000 Butte County Airport Land Use Compatibility Plan states that the
maximum noise level for residential uses in the vicinity of an airport is 55 dB CNEL, except
for the area south of the Chico Municipal Airport, where a 60 dB CNEL noise maximum is
acceptable.
�,•O'The project site is not within the 55 dB CNEL noise contour as shown on Exhibit 4E (Noise
Impacts — Future Average Fire Season Day), Exhibit 4F (Noise Impacts — Expanded
Forecast) and Exhibit 4G (Noise Impacts — Peak Fire Attack Day) of the 2000 Butte County
Airport Land Use Compatibility Plan.
• Pursuant to Section 4.1.5(a) of the 2000 Butte County Airport Land Use Compatibility Plan,
staff recommends that all dwellings on the project site be designed and constructed to
achieve a maximum interior noise level of 45 dB CNEL.
G The project would result in 21 multi -family dwellings on 1.66 acres, which will result in a
density of 12.65 dwelling. units per acre. This density is not consistent with the B2 Airport
Compatibility Zone, which requires 0.2 dwelling units or less per acre (minimum parcel size
of 5 acres or larger).

• The proposed multi -family development qualifies as infill development pursuant to Section
15332 of the California Environmental Quality Act.

,, �The project site meets the criteria for infill development of Section 2.4.4-_a)(3) of the 2000
Butte County Airport Land Use Compatibility Plan because it is 5 acres or, less in size (1.66
acres), qualifies as infill development pursuant to Section 15332 of the California
Environmental Quality Act, and the density of the project (12.65 du/ac) would be less than
the highest density of the existing residential developments within 500 feet of the project site,
which is a fourplex on a 0.23 acre parcel (17.4 du/ac), located at 2718 White Avenue, Chico
(APN 007-180-075)..
Amendment to Policy 2.4.4 of the 2000 Butte County Airport Land Use Compatibility Plan
• At the February 16, 2005, ALUC meeting the Commission approved an amendment to
Section 2.4.4 (Special Conditions) of the 2000 Butte County Airport Land Use Compatibility
Plan. The amendment allows infill development that would otherwise be inconsistent with
the B2 Airport Consistency Zone.
• Section 2.4.4 now allows infill development on parcels that are 5 acres or less in size. If the
proposed infill development meets the infill development requirements of Section 15332 (In -
Fill Development Projects) of the California Environmental Quality Act the infill
development density may be equal to, but no greater than, the density that edists on the most
densely developed property that is located within 500 feet of the perimeter of the parcel.
• The City of Chico provided a map to the ALUC that showed those parcels eligible for infill
development in the B2 Airport Compatibility Zone south of the Chico MLnicipal Airport.
ALUC adopted the infill development map, including the project parcel, a� the March 16,
2005 meeting.
ENVIRONMENTAL DOCUMENTATION:
GNo environmental documentation has been completed for this project by ALUC staff. The City
of Chico staff will make a determination per the California Environmental Quality Act as part of
their processing of the multi -family development project.
RECOMMENDATION:
Staff recommends that the Butte County Airport Land Use Commission find ALUC File No
A 05-20 (Platt/Pemble — Multi -Family Dwellings) is consistent with the infi_1 development
policy of Section 2.4.4 of the 2000 Butte County Airport Land Use Compatibility ?lan.

BUTTE COUNTY AIRPORT LAND USE COMMISSION
CONSISTENCY FINDINGS FOR ALUC File No. A 05-20 — Platt/Pemble — Multi -Family
Dwellings, APN 007-570-002, 007-570-003 & 007-570-008::
The Airport Land Use Commission (ALUC) has prepared the following findings based on data
contained in the 2000 Butte County Airport Land Use Compatibility Plan (ALLrCP), as well as
site specific information submitted by the applicant and ALUC staff.
The following findings have been prepared at the direction of the ALUC and are for the
consideration of the Lead Agency (City of Chico) when making a decision on the project.
SECTION 1: ENVIRONMENTAL FINDINGS
A. No environmental documentation has been completed for this project by ALUC
staff. The City of Chico staff will make a determination per the California
Environmental Quality Act as part of their processing of -he multi -family
development project.
SECTION 2: CONSISTENCY FINDINGS FOR PROPOSED PROJECT
A. The proposal for the Platt-Pemble project is for 21 multi -family dwellings on 1.66
acres. The density of 12.65 dwelling units per acre is consistent with the infill
development criteria of Section 2.4.4(a) (3) of the 2000 Butte. County Airport .
Land Use Compatibility Plan.
SECTION 3: PROJECT FINDINGS:
A. The project site meets the criteria for infill development of Section 2.4.4(a)(3)
because:
1. The project site is 5 acres or less in size
2. The Multi -Family project qualifies as infill development pursuant to the
California Environmental Quality Act
3. The density of the project, at approximately'12.65 units per acre, would be
less than the density of the highest existing residential development within
500 feet of the project site, which is 17.4 dwelling units per -acre.
4. The project site is shown on the City of Chico's infill development map,
as approved by the Butte County Airport Land Use Commission on March
16, 2005.
B. The height of the tallest object on the project site is anticipated to be
approximately 28 feet above ground level. Therefore, no structures on the project
site would extend into protected airspace.
C. All dwellings on the project are required to be designed and constructed to have a
- maximum interior noise level of 45 dB CNEL or less in order to prevent
significant aircraft -related noise impacts.

SECTION 4: PROJECT CONDITIONS:
1. Provide a deed notice for the sale of all resulting lots notifying purchasers of the
proximity of the airport and the potential for possible noise -related impacts in an
ALUC-approved disclosure notice.
2. Airspace review by the Airport Land Use Commission required for objects greater
than 70 feet tall.
3. All dwellings shall be designed and constructed to achieve a maximum interior
noise level of 45 dB CNEL or below.

Commissioner Rosene said his concern was the parcels that the density is based on to meet our infill
requiremeni'are olderrthan 2000. He said there was a project that went through in this area that did _
not come before ALUC and was interested if that's being used for the infill requirement!"

C. All dwellings on.the project are required to be designed and constru:ted to have a4maximum
interior noise level of 45 dB CNEL or less in order to prevent significant aircraft -related noise
impacts.
SECTION 4: " PROJECT"CONDITIONS:
1. Provide a deed notice for.the sale of all resulting lots notifying purchasers of the proximity of
' the airport and the `potential for possible . noise -related impacts in an ALUC-approved `
disclosure notice.
