This data, iri turn is based upon the findings of a number of studies, documents and reports generated by individuals, firms and agencies recognized as having expertise in the field of Airport Land Use Planning and land use compatibility. (See Exhibit Al, List of References) The following findings have been prepared at the direction of the ALUC and are for the consideration of the County of Butte (local agency) when making a decision on the project. Section 1: ENVIRONMENTAL FINDINGS A. No environmental documentation was submitted at the time of review. Section 2: PROJECT CONSISTENCY FINDINGS A. Chapter 3 of the 1993 Airport Land Use Planning Handbook identifies four functional categories that address airport land use compatibility concerns. These include: Overflight Protection/Land Use Compatibility., Safety, Noise, and Airspace Protection. The applicant's proposal has been found to be consistent with protection measures and policies contained in the 1998 Chico Municipal Airport Environs Plan that are designed to address all of these items: Overflight Protection/Land Use Compatibility 1. The project site is located outside of the Overflight Protection Zone and Outer Safety Zone depicted in Drawing CIC -14 and the Departure Clear Area shown in Drawing CIC -16. It is also located outside of the Flight Corridor shown on Drawings CIC -4 and CIC -6, the flight tracks for light and heavy aircraft depicted in Drawing CIC -2, and the Compatible Land Use Zone (CLUZ) designations shown in Drawing CIC -13. No specific land use recommendations are given within the CMAEP for the project area. However, unihabited storage units and RV parking are considered by the Commission to be compatible uses at this location. o Butte County • Airport Land Use Commission • Safety 2. Accident scatter maps based upon data generated by the University of California. Berkeley, Institute of Transportation Studies (1993) and Hodges and Shutt, have been adopted as part of the CMAEP (Drawings CIC -17 and, CIC -18) and support the finding that the project site is not located in an area which has an elevated likelihood of being impacted by aircraft'accidents. Noise 3. The project site is located outside of the projected 55 dB CNEL contour for the Chico Municipal Airport (Drawings CIC -3 and CIC -15). Exhibit 4-4 of. the CMAEP "Land Use Compatibility for Noise Environments," shows that industrial uses (e.g., the closest category to storage type uses) are considered normally acceptable in areas exposed to up to between 65 and 7b dB CNEL. Airspace Protection 4. The project site is located within the Horizontal Surface of the Chico . Municipal Airport (Drawing CIC -S). The height of the storage units will be limited to a single story. Although a specific height limitation has not been established, the structures are not expected to exceed 15 feet in height. Based upon USGS topographic information provided by the Butte County Planning Division, the site elevation is approximately 190 feet above mean sea level (MSL). Therefore, the proposal'could result in a total project elevation of approximately 205 feet MSL. The height of the Horizontal Surface is 388 feet MSL. Therefore, the ALUC finds that project will not penetrate any FAR Part 77 Surfaces. Section 3: RECOMMENDED CONDITION A. FOR: Airport Land Use Commission Meeting of April, 21, 1999 SUMMARY: The County of Butte is presently processing the above mentioned project and has submitted a request for comments and project maps to the ALUC for its review. Staff recommends that the Commission find the project consistent with the 1998 Chico Municipal Airport Environs Plan. Staffs review consisted of overflight protection/land use compatibility, safety, airspace protection and noise sensitivity. ANALYSIS: The applicants are requesting a rezone to modify a Planned Unit Development (PUD) to convert a tennis court into storage units and RV"parking for the residents of the Eastwood Oaks PUD. The proposal will involve the construction of eight 22' x 22' storage units, eighteen 10'x 22' storage units and six RV parking spaces. The storage units will 'be limited to a single story in height. The maximum height of the units is not expected to exceed 15 feet. The RV parking spaces will be used for vehicle storage only, not overnight camping. Overflight Protection/Land Use Compatibility Staff reviewed the request for consistency with the 1998 Chico Municipal Airport Environs Plan. The project site is located outside of the Overflight Protection Zone and -Outer Safety Zone depicted in Drawing CIC -14 and the Departure Clear Area shown in Drawing CIC -16. It is also located outside of the Flight Corridor shown on Drawings CIC -4 and CIC -6, and the flight tracks for light and heavy aircraft depicted in Drawing CIC -2. In terms of land use compatibility, the site is located outside of the Compatible Land Use Zone (CLUZ) designations shown in Drawing CIC -13.. No specific land use recommendations are given within the CMAEP for the project area. However, staff recommends that unihabited storage units and RV parking be considered compatible uses at this location. I . • Butte County • Airport Land Use Commission • Safety The 1993 Airport Land Use Planning Handbook contains maps depicting accident scatter characteristics based on information generated by Hodges and Shutt (1993) and the University of Califomia Berkeley, Institute of Transportation Studies (1993). Drawing, CIC -17 of the CMAEP depicts an overlay of the UC Berkeley Study onto a map of the Chico Municipal Airport and surrounding environment. Drawing CIC -18 of the CMAEP depicts an overlay of the Hodges and Shutt data onto a map of the Chico Municipal Airport and surrounding environment. The purpose of these exhibits is to identify areas with an elevated likelihood for aircraft related accidents. According to staffs review of these documents, no potential accident sites are located in the vicinity of the project. Airspace Protection Drawing CIC -5 of the CMAEP identifies the location of all FAR Part 77 Surfaces for the Chico Municipal Airport. According to Drawing CIC -5, the project site is located within the Horizontal Surface. The elevation of the Horizontal Surface is 388 feet above Mean Sea Level (MSL). According to USGS topographic information provided by the Butte County Planning Division, the elevation of the project site is approximately 190 feet MSL. The maximum allowable height for the storage units is estimated to be 15 feet, resulting in a total potential project. elevation of 205 feet MSL. Therefore, the proposal will not penetrate any Far_ Part 77 Surfaces. Noise Sensitivity , As,indicated in Drawings CIC -3 and CIC -15 of the CMAEP, the project site is located outside of the projected 55 dB CNEL contour. Exhibit 4-4 of the CMAEP "Land Use Compatibility for Noise Environments," shows that industrial uses (e.g., the closest category to storage type .uses).are.considered normal ly,acceptable in areas ,exposed to up to between 65 and 70AB CNEL. Other Comments The City of Chico is currently in the process of preparing an Updated Airport Master Plan for the Chico Municipal Airport which is expected to include plans for extending Runway 13R-31 L approximately 1,500 feet to the south. These and other facility modifications directed by the Updated Airport Master Plan could affect the location of current airport safety zones, FAR Part 77 Surfaces, noise contours and flight track patterns. However, because the proposed. storage units and RV parking area will. not be inhabited and the height of the structures will not exceed a single story, the proposed development is not expected to have any impacts on anticipated airport improvements or future operations. - 17 RECOMMENDATION: Staff recommends that the Butte County Airport Land Use Commission find that the proposed Butte County Rezone A99-03 (REZ99-05 - Feeney Engineering/Wray) on APN 007-410-017 is consistent with the 1998 Chico Municipal Airport Environs Plan as noted in the findings presented in the attached Exhibit "A". Airport (CIC -6) and the Horizontal: Surface _(C1.C-5)_for- that- facility The project elevation including proposed storage structures is estimated to be not more than 205 feet above Mean Sea Level (MSL). The -elevation of the Horizontal- -Surface. is 388 MSL. Section 1: ENVIRONMENTAL FINDINGS A. No environmental documentation was submitted at the time of project review. Section 2: PROJECT REQUIREMENTS FOR CONSISTENCY: A. The proposed project will be consistent with the 1985 Comprehensive Land Use Plan (CLUP) for the Paradise Skypark Airport, as amended on December 29, 1999, if the requirements in Section 3 are applied to the final map. B. Approval of the project without implementation of the requirements in. Section 3 would necessitate the adoption of Overriding Findings by a 2/3 vote of the governing body. Overriding Findings by the governing body can only be made based up substantiated facts and must be supported by new substantial factual evidence introduced into the public record that the proposed action is consistent with the State Aeronautics Act as stated in Section 21670. Overriding findings cannot be adopted as.matters of opinion, here say, or upon the unsubstantiated fears and desires of the governing body. Section 3: PROJECT FINDINGS: A. According to the newly adopted Paradise Airport Environs Plan, Safety Zone Map "9-F% a number of safety zones are located within the eastern half of the project site, as follows: - Approximately 200+ feet of the eastern portions of Parcels 1, 2,3 and 4 are located within Runway Protection Zone - Approximately 1/3 of Parcel 1 and a minor portion of Parcel 2.are within Inner Turning Zone "3. " - Approximately 700'+- of the eastern portions of Parcels 1, 2 ,3 and 4 are located within Sideline Safety Zone "S. " - The remaining portions of Parcels 1 through 4 are located within Traffic Pattern Zone "6." 1. Runway Protection Zone "1": Approximately 200+- feet of the lands located west of the runway centerline are located within Runway Protection Zone "1. " A. The project would be consistent with the CLUP if this area -is depicted on the final map as a "No Development Zone." B. The project would be consistent with the CLUP if the criteria of "G" and "H" are included as a note on the final map. Criteria "G" and "H" prohibits buildings,, structures, above ground transmission lines, or storage of flammable or explosive material aboveground, and no uses resulting in a gathering of more than 10 persons at any time. Communication Towers (excluding airport related facilities) are also prohibited. 2. Inner Turning Zone "3": Approximately 1/3 of Parcel 1 and a minor portion of Parcel 2 are within Inner Turning Zone "3. Criteria "A" of the Inner Turning Zone only allows 20% coverage per acre (buildings and structures). This will be achieved due to the large parcel sizes. The Criteria of item "D" requires measures to achieve an interior noise level of 45 CNEL within portions of buildings where the public is received, office areas, and other areas where people work or congregate. The language of Criteria Item "D" applies to commercial and industrial -structures and not single family dwellings. The Criteria of items " H, I, J and L" are not applicable to this project because this project involves a land division for building future single family residences. The Criteria of item "E" states that residential development shall not occur in a noise level greater than 55 CNEL. This contour is estimated to pass through the eastern portion of Parcel 4 and the southeast corner of Parcel 3. These areas are already proposed to be "No Development Zones " pursuant to the criteria of Runway Protection Zone "I " discussed in Finding 1. Although the noise contour indicates that projected exposure within most of the project area will be at or below 55 dB Ldn, it should also be noted that residents may be exposed to single event noise levels and other noise episodes which exceed those levels. C. A note shall be placed on the Final Map stating that prior to the issuance of a Building Permit for a single family dwelling, the property owner shall sign an avigation easement granting the right of continued use of the Paradise Skypark Airport in the airspace above the proposed parcels and acknowledging any and all existing or potential airport operational impacts. 3. Sideline Safety Zone "5": The.easterly parcels located 500 feet from the runway centerline are within Sideline Safety Zone "5 ". The Commission finds this width consistent with the 1999 CLUP amendment for the Paradise Skypark Airport. The criteria of the 1999 CLUP Density Table does not allow any dwelling units per acre within the Sideline Safety Zone "5 ". D. The project would be consistent with the CLUP if the Sideline Safety Zone, being an area approximately 500' from the centerline of the runway and extending into the easterly portion of parcels 1, 2, 3, and 4 be depicted on the final map as a "No Development' Zone". The Commission found that the 1000' Sideline Safety Zone does not apply for this specific proposal due to the following: - The adopted Cal -Trans standard for the Sideline Safety Zone is 500' for airports with runways under 4000 feet in length and the Paradise airport runway is 3100 feet in length. - Testimony received from the owner of the Paradise Airport cites that the project is consistent with the use of his airport and will not cause any adverse impacts to the airport. - The topography surrounding the Paradise Airport is such that the reduced Sideline Safety Zone provides greater protection to, the airport by providing homesites outside the height restricted area. 4. Airspace Protection: The Commission finds that due to the topography of the project, that there are no transitional surface problems. The subject property is located on a down slope, with a topographic elevation that is significantly lower than the airport. Approach surfaces would not be affected due to topography. E. A note shall be placed on the Final Map stating that any project related lighting shall be directed within the project site and shielded to prevent adverse impacts on adjacent properties and aircraft flight activities. F. A note shall be placed on the Final Map stating that uses which have the potential to create visual,, electronic or physical flight hazards including the generation of dust, smoke, glare, electronic interference, or the attraction of birds to the project area shall be avoided. . 5. Safety Accident scatter information presented in Figure 8C, Exhibit 8D (Hodges and Shutt - 1993) and Figure 9E (UC Berkeley, Institute of Transportation Studies - 1993) within Chapters 8 and 9 of The 1993 Airport Land Use Planning Handbook, indicate that the highest concentration of both departure and arrival related aircraft accidents takes place . within the Runway Protection Zone and Approach Surface off the ends of the runway and on either side of the runway. Due to the project site's location in proximity to the north end of runway 17/35, there is an elevated likelihood for aircraft related accidents to occur within the eastern half of Parcels 1 through 4. Conditions required under Section 2, Items IA., 2A. and 2B. within the ALUC's findings will ensure that future residential development is directed to locations which are not considered to have an elevated likelihood for aircraft related accidents. Execution of an avigation easement is recommended to protect future airport operations. Sideline Safety Zone "5": The easterly % of parcels 1, 2, 3, and 4 are within Sideline Safety Zone'"5". There has been considerable debate between the applicant and staff regarding what should be the width of the Sideline Safety Zone. The map prepared by the GIS lab depicts a 1000' Sideline Safety Zone (please refer to map Attachment "J"). This is based upon the what was adopted by the Commission at the December 29, 1999, ALUC hearing. According to Commissioner Gerst, a 1000' wide safety zone was included in the CLUP because: a. It is consistent with the Sideline Safety Zone being proposed by Shutt Moen. The draft composite map prepared by Shutt Moen shows a 1000' foot Sideline Safety Zone (attached as Exhibit "C"). b. It is consistent with the direction of the Commission that airport planning should be done to take into account 20 years of growth and the possibility that runways will be extended and use will increase. The criteria of the' 1999 CLUP Density Table does not allow any dwelling units per acre within the Sideline Safety Zone "5". The project would be -consistent with the CLUP if this area is depicted on the final map as a "No Development Zone The following is an..analysis of the remaining criteria factors: Criteria "C" Does not apply because the proposed project does not involve the use of caretaker residences. Criteria "D" - Does not apply. The language of Criteria Item "D" appears to apply to commercial and industrial structures and not single family dwellings. I Criteria "H"- Does not apply because the proposed project does not involve the use of communication towers or facilities. Criteria "I"- Does not apply because the proposed project does'not involve public and quasi - public uses. Criteria 'T' The proposed project shall maintain 501/o'open space due to the large parcel sizes and 'the limitations of the FR -20 zone .which allows one single family residence per parcel.' • Butte County •Airport Land Use Commission • 3 Criteria "K"- Does not apply because the proposed project does not involve the use of density bonus. Criteria "L" Does not apply because the proposed project does not involve the .use of bulk petroleum products. No further restrictions are warranted. At the January 19, 2000, ALUC meeting the consensus of the Commission was that due to the topography of the project, that there are no transitional surface problems. The subject property is located on a down slope, with a topographic elevation that is significantly lower than the airport. Approach surfaces would not be affected due to topography. Execution of an avigation easement is recommended to protect future airport operations and light and glare restrictions are warranted as well. In addition to single family residences and utility facilities, The FR -20 zoning district permits a variety of agricultural and mining activities as uses that are permitted outright and/or subject to a conditional use permit. Some activities associated with particular agricultural and mining operations do have the potential to create flight hazards within an airport environment. Page 9-31 of the Airport Land Use Planning Handbook notes that flight hazards may be visual (in the form of distracting lights, glare, dust and smoke); electronic (which includes uses that could interfere -with aircraft instruments or radio communications); and physical (ranging from tall structures and objects, to water areas (ponds) which may generate ground fog, or other uses which involve or attract birds to the airport environment). These potential hazards should be considered and avoided as future development of the parcels occur. The 1.985 CLUP for the Paradise �Skypark Airport, as amended on December 29, 1999, does not contain diagrams which depict the locations of potential aircraft related accidents for the facility. Therefore, staff consulted general accident scatter information presented within The 1993 Airport Land Use Planning Handbook. Figure 8C on page 8-13 of the Handbook shows accident location data collected by Hodges and Shutt for 14 general aviation airports. The figure indicates that the highest concentration of both departure and arrival related aircraft accidents takes place within the Runway Protection Zone and Approach Surface. Exhibit 8D on page 8-30 of the Handbook shows accident sites for runways less than 4,000 feet in length. This information is also based upon data collected by Hodges and Shutt. Again, a majority of departure and arrival related accidents are shown to be concentrated off the ends of the runway, and on either side of the runway. Figure 9E on page 9-13 of the Airport Land Use Planning Handbook is based upon accident scatter data collected by the University of California, Berkeley, Institute of Transportation Studies (1993) and demonstrates similar findings. Due to the project site's location in proximity to the north end of o Butte County • Airport Land Use Commission • 4 runway 17/35, there is an elevated likelihood for aircraft related accidents to occur within the eastern half of Parcels 1 through 4. Environmental Documentation: No environmental documentation was submitted with the project materials. RECOMMENDATION: Staff recommends that the Butte County Airport Land Use Commission find that ALUC File No. A99-06 (County of Butte - Cuseo/Bird Tentative Parcel Map TPM 99-15) on APN 055-250-033, 035, 037 and 120 is consistent with the 1985 Comprehensive Land Use Plan (CLUP) for the Paradise Skypark Airport, as amended on December 29, 1999, if the requirements in Section 3 are applied to the final map as noted in the findings presented in Exhibit "A". This data, in turn, is based upon the findings of a number of studies, documents and reports generated by individuals, firms and agencies recognized as having expertise in the field of Airport Land Use Planning andland use compatibility. (See Exhibit Al, List of References) The following findings, have been prepared at the direction of the ALUC and are for the consideration of the Lead Agency (County of Butte) when.making a decision on the project. Section 1: ENVIRONMENTAL FINDINGS A. No environmental documentation was submitted at the time of project review. Section 2: PROJECT REQUIREMENTS FOR CONSISTENCY: A. The proposed project will be consistent with the 1985 Comprehensive Land Use Plan (CLUP) for the Paradise Skypark Airport, as amended on December 29; .1999, if the requirements in Section 3. are applied to the final map. B. Approval of the project without implementation of the requirements in Section 3 would necessitate the adoption of Overriding Findings by a 2/3 vote of the governing body. Overriding Findings by the governing body can only be made'based up substantiated facts and must be supported by new substantial factual evidence introduced into the public record that the proposed -action is consistent with the State Aeronautics. Act as stated in Section 21670. Overriding findings cannot be adopted asmatters of opinion, here say, or upon the unsubstantiated fears and desires of the governing body. Section 3: PROJECT FINDINGS: A. According to the newly adopted Paradise Airport Environs Plan, Safety Zone Map "9-1", a number of safety zones are located within the eastern half of the project site, as follows: , • Butte County *Airport Land Use Commission 0 6 - Approximately 200+- feet of the eastern portions of Parcels 1, 2 ,3 and 4 are located within Runway•Protection Zone "1. " - Approximately 1/3 of Parcel 1 and a minor portion of Parcel 2 are within Inner Turning Zone "3. " - Approximately 700'+- of the eastern portions of Parcels 1, 2 ,3 and 4 are located within Sideline Safety Zone -5. " - The remaining portions of Parcels 1 through 4 are located within Traffic Pattern Zone "6." Approximately 200+- feet of the eastern portions of Parcels 1, 2 ,3 and 4 are located within Runway Protection Zone "1. " A. The.project would be consistent with the CLUP if this area is depicted on the final map as a "No Development Zone." B. The project would be consistent with the CLUP if the criteria of "G" and "H" are included as a note on the final map. Criteria "G" and "H" prohibits buildings, structures, above ground transmission lines, or storage of flammable or explosive material above ground, and no uses resulting in a gathering of more than 10 persons at any time. Communication Towers (excluding airport related facilities) are also prohibited. I 2. Inner Turning Zone "T' Approximately. 1/3 of Parcel 1 and a minor portion of Parcel 2 are within Inner Turning Zone "3. " Criteria "A" of the Inner Turning Zone only allows 20% coverage per acre (buildings and structures). This will be achieved due to the large parcel sizes. The Criteria of item "D" requires measures to achieve an interior noise level of 45 CNEL within portions of buildings where the public is received, office areas, and other areas where people work or congregate. The language of Criteria Item "D" applies to commercial and industrial structures and not single family dwellings. The Criteria of items " H, I, J and L" are not applicable to this project because this project involves a land division for building future single family residences. The Criteria of item "E" states that residential development shall not occur in a noise level greater than 55 CNEL. This contour is estimated to pass i Butte County • Airport Land Use Commission • 7 through the eastern portion of Parcel 4 and the southeast corner of Parcel 3. These areas are already proposed to be "No Development Zones " pursuant to the criteria of Runway Protection Zone "1 " discussed in Finding 1. Although the noise contour indicates that projected exposure within most of the project area will be at or below 55 dB Ldn, it should also be noted that residents may be exposed to single event noise levels and other noise episodes which exceed those levels. C. A note shall be placed on the Final Map stating that prior to the issuance of a Building Permit for a single family -dwelling, the property owner shall sign an avigation easement granting the right of continued use -of the Paradise Skypark Airport in the airspace above the proposed parcels and acknowledging any and all existing or potential airport operational impacts. The easterly % of parcels 1, 2, 3, and 4 are within Sideline Safety Zone "5 ". The mapping data presented to the Commission show a 1000' Sideline Safety Zone. The Commission finds this width consistent with the 1999 CLUP amendment -for the Paradise Skypark Airport. The criteria of the 1999 CLUP Density Table does not allow any dwelling units per acre within the Sideline Safety Zone "5 ". D. The project would be consistent with the CLUP if the Sideline Safety Zone, being an area approximately 1000' from the centerline of the runway and extending into the easterly '/z of parcels 1, 2, 3, and 4 be depicted on the final map as a "No Development Zone". The Commission finds that due to the topography of the project, that there are no transitional surface problems. The subject property is located on a down slope, with a topographic elevation that is significantly lower than the airport. Approach surfaces would not be affected due to topography. E. A note shall be placed on the Final Map stating that any project related lighting shall be directed within the project site and shielded to prevent adverse impacts on adjacent properties and aircraft flight activities. F. A note shall be placed on the Final Map stating that uses which have the potential to create visual; electronic or physical flight hazards including the generation of dust, smoke, glare, electronic interference, or the attraction of birds to the project area shall be avoided. • Butte. Sam Accident scatter information presented in Figure 8C, Exhibit 8D (Hodges and Shutt -1993) and Figure 9E (UC Berkeley, Institute of Transportation Studies - 1993) within Chapters 8 and 9 of The 1993 Airport Land Use Planning Handbook, indicate that the highest concentration of both departure and arrival related aircraft accidents takes place within the Runway Protection Zone and Approach Surface off the ends of the runway and on either side of the runway. Due to the project site's location in proximity to the north end of runway 17/35, there is ,an elevated likelihood for aircraft -related accidents to occur.within the eastern half of Parcels 1 through 4.
