Provide a deed notice for the existing parcel notifying purchasers of the proximity of the airport and the potential for possible noise -related impacts in an ALUC-approved discl'nsure notice. 2. Airspace review by the Airport Land Use Commission required for objects greater than 70 feet tall. 3. All dwellings shall be designed and constructed to achieve a maximum interior noise level of 45 dB CNEL or below. 4. Prior to. the issuance of building permits, record an Avigation Easement *granting the right of continued use of the airspace above the proposed parcels by the Chico Muni:,ipal Airport, and acknowledging any and all existing or potential airport operational impacts. 5. Airport Land+Use Commission .- r v January 18, 2006, ALUC Meeting AGENDA ITEM — TO: Honorable Chair and Airport Land Use Commission FROM: Carl Durling, Associate Planner DATE: January 18, 2006 ITEM: ALUC File No. A06-05 — Marcon Inc., APN `015-440-015: A consistency review for the.proposed Zamora Tentative Subdivision Map, which would divide one parcel totaling 3.81 acres into 14 new single-family residential lots and one existing commercial- lot. The project site is located within Airport Compatibility. Zone C, .and is situated on the south side of East Avenue,. approximately 500 feet east of Mariposa, in the City'of Chico. . SUMMARY: r , Staff recommends that ALUC find the project'consistent with the 2000 Airport Land Use • Compatibility Plan for'the: Chico Municipal Airport. BACKGROUND: • This 3.81 acre property is, within the incorporated limits of the City of Chico. The project site is zoned by the City of Chico as OR (Office Residential) along the East Avenue frontage. This OR zoned portion will remain as a Nursery on ' a 0.73 acre parcel. The remaining portion (2.92 acres gross) will be developed with 14 single family lots and is zoned RI by the City _ The subject property is vacant except for the, existing nursery facilities. • The remaining portion of the property is to be developed with 14 single family lots averaging 9,085 gross square feet. This is a density of 5.72 units per gross acre. • Surrounding land uses include commercial uses to the north across East Avenue with a large parking lot area, single family on the south and: east, and a church- on the west also with a large parking lot area (see aerial photograph). ' • No open space is proposed on the project site. • The height of the tallest object on the project site is anticipated to be approximately 40 feet above ground level, which equates to approximately 260 feet above mean sea level. m Butte County Airport Land Use Commission ■ ALUC File No. A6-05 (Macron, Inc.) ■ • ■ January 18, 2006 ■ Page 1 of 1 ■ ANALYSIS: • This project is a major land use action as defined by Policy 1.5.3 of the 2000 Butte County Airport Land Use Compatibility Plan (ALUCP). • The project site lies within Airport Compatibility Zone C. • The .primary compatibility criteria . for the Airport Compatibility Zone C are shown on the following table: Compatibility Zone Criteria Maximum Densities Req'd Open -Prohibited Uses Other Development Zone Land Conditions Residential (du/ac)' (1) < 0.2 Children's schools, Deed notice required. (average day care center, Airspace review for parcel size > 10% libraries, hospitals, objects >100 feet tall. 5.0 acres) nursing homes, C Traffic Pattern (2) > 4.0 hazards to flight (average parcel size < 0.25 acres) Extract from Table 2A of the 2000 ALUCP *NLR - Noise Level Reduction Note 1. Residential development should not contain more than the indicated number of dwelling units (both primary and secondary) per gross acre. With clustering, some parcels may be much smaller than the others as long as the maximum overall density criterion is not exceeded. Clustering of units is encouraged in Compatibility Zones 132 and C — see Policy 4.2.6 for limitations. 9. Hazards to flight include physical (e.g., tall objects), visual, and electronic forms of interference with the safety of aircraft operations. Land use• development which may cause the attraction of birds to increase is also prohibited. See the supporting compatibility policies on airspace protection (Policies 4.32 and 4.3.6) for details. Note that under the Maximum Densities column the density must equal or exceed 4.00 units per acre or more. The project has a density of 5.72 units per gross acre for the residential portion of the project which exceeds the minimum density requirement. • There is no specific on-site provision for open space. However, lots 2 through 6 which back up to the west property line have an average depth of 142 feet. This is 42 feet more than required by the City's zoning code. A condition, that requires the dwellings on these lots to be no closer than 75 feet of the west (rear) property line would provide a 75 foot deep open space rear yard area on each lot. This is a strip of land measuring 75'x324', or 24,400 square feet, would exceed the 10% open space requirement. This would provide a strip of open space that is in line with the Chico Airport runway. • The project site is approximately 2.5 miles south of the runway of the Chico Municipal Airport, and in line with the extended centerline of Runway 31R/13L. • Section 4.1.3 of the 2000 Butte County Airport Land Use Compatibility Plan states that the maximum noise level for residential uses in the vicinity of an airport is 55 dB CNEL, except ■ Butte County Airport Land Use Commission ■ ALUC File No. A6-05 (Macron, Inc.) ■ ■ January 18, 2006 ■ Page 2 of 7 ■ for the area south of the Chico Municipal Airport, where a 60 dB CNEL noise maximum is acceptable. • The project site is not within the 55 dB CNEL noise contour as smon Exhibit 4E (Noise Impacts — Future Average Fire Season Day), nor is it within the 55dB CNEL noise contour as shown on Exhibits 4F (Noise Impacts — Expanded Forecast) and 40 (Noise Impacts — Peak Fire Attack Day) of the 2000 Butte County Airport Land Use Compaiibility Plan. . ENVIRONMENTAL DOCUMENTATION: No environmental documentation has been completed for this project by ALUC staff.. wThe City of Chico staff will make a determination per the California Environmenta- Quality Act as part of their processing of the application for development review. APN 015-440-015: The Airport Land Use Commission (ALUC) has prepared the following findings based on data contained in the 2000 Butte County Airport Land Use Compatibility Plan ,ALUCP) as amended, as well as site specific information submitted by the applicant and ALUC staff.. ` The following findings have been prepared at the direction of the ALUC and are for the consideration of the Lead Agency (City of Chico) when making a decision ,on the project. SECTION 1: ENVIRONMENTAL FINDINGS A. No environmental documentation has been completed for this project by ALUC staff. The City of Chico staff will make a determination per the California Environmental Quality Act as part of their processing of the commercial building. SECTION 2: CONSISTENCY FINDINGS FOR PROPOSED PROJECT A. The proposal for the Marcon, Inc. residential subdivision will add an additional 14 single family parcels and one commercial (existing) parcel; and B. The project has a density of 5.72 units per acre which exceeds the required, 4.00 units per acres; and C That the 10% open space requirement can be met by main-_aining a rear yard setback of 75 feet on lots 2 though 6.
