On Wednesday, May 20, 2005, the Airport Land Use Commission (ALUC) found the referenced
project to be consistent subject to Conditions 1,2, and 3 as referenced in the staff report and the
following new Conditions 4 and 5:
4. Prior to the recordation of the map record as a separate instrument an Avigation Easement
granting the right of continued use of the airspace above the proposed parcels by the Chico
Municipal Airport and acknowledging any and all existing or potential airport operational
impacts.

consistency review to divide a 0.46 acre parcel into two lots (0.19 ac and 0.27 ac)
to allow for an additional dwelling. The project site is locatedon the northeast
corner of North Avenue and Verde Drive, east of Cohasset RoGd, in the City of
Chico.
SUMMARY:
Staff recommends that ALUC find the project consistent with the 2000 Airport Land Use
Compatibility Plan for the Chico Municipal Airport. Consistency is based upon the recently -
approved amendment to Section 2.4.4 of the 2000 Butte County Airport Land Use Compatibility
Plan for infill development criteria and approval of the City of Chico infill development map.
BACKGROUND:
The property is 0.46 acres in size with an existing dwelling.
. 'The property is within the incorporated limits of the City of Chico. The project site is
designated Low Density Residential on the City of Chico General Plan Diagra-m and is zoned
R-1 (Low Density Residential).
- Existing land uses within 500 feet of the project site includes single family dw?llings.
• The proposed project density (4.35 du/ac) does not exceed the highest densit- (6.25 du/ac —
Lupin Acres Subdivision, Unit #2) within 500 feet of the project site.
• One additional single family dwelling will be possible.
• No open space on the project site is proposed.
The height of the tallest object on the project site is anticipated to be approximately 18 feet
above ground level, which equates to approximately 218 feet above mean sea level.

ANALYSIS:
• This project is a major land use action as defined by Policy 1.5.3 of the 2000 Butte County
Airport Land Use Compatibility Plan (ALUCP).
• The project site lies within Airport Compatibility Zone B2 (Extended Approach/Departure
Zone).
• The primary compatibility criteria for the B2 Airport Compatibility Zone are shown on the
following table:

Extract from Table 2A of the 2000 ALUCP * NLR — Noise Level Reduction
The project would result in the division of a 0.46 acre parcel into two parcels (0.19 and 0.27
acres), which will result in an average parcel size of 0.23 acres and a density of 4.35 dwelling
units per acre. This density is not consistent with the B2 Airport Compatibility Zone, which
requires a residential density of < 0.2 dwelling units per acre (with an average parcel size of 5
acres or larger).
• The project site is approximately 0.25 miles west the extended centerline of Runway
31R/13L of the Chico Municipal Airport, at a distance of 1.62 miles southwest of this
runway.
r-4 Section 4.1.3 of the 2000 Butte County Airport Land Use Compatibility Plan states that the
maximum noise level for residential uses in the vicinity of an airport is 55 dB CNEL, except
for the area south of the Chico Municipal Airport, where a 60 dB CNEL noise maximum is
acceptable.
'e The project site is not within the 55 dB CNEL noise contour as shown on Exhibit 4E (Noise
Impacts — Future Average Fire Season Day) but is partially within the 55dB CNEL noise
contour as shown on Exhibit 4F (Noise Impacts — Expanded Forecast) and completely within
the 55 dB CNEL noise contour as shown on Exhibit 4G (Noise Impacts — Peak Fire Attack
Day) of the 2000 Butte County Airport Land Use Compatibility Plan.

• Pursuant to Section 4.1.5(a) of the 2000 Butte County Airport Land Use Compatibility Plan,
staff recommends that all dwellings on the project site be designed and constructed to
achieve a maximum interior noise level of 45 dB CNEL.
.� The proposed parcel split qualifies as infill development pursuant to Section 15332 of the
�1 California Environmental Quality Act.
The project site meets the criteria for infill development of Section 2.4.4(a)(3) of the 2000
Butte County Airport Land Use Compatibility Plan because it is 5 acres or less in size,
qualifies as infill development pursuant to Section 15332 of the California Environmental
Quality Act, and the density of the project (4.35 du/ac) would be less than the highest density
of the existing residential developments within 500 feet of the project site, which is the Lupin
Acres Subdivision - Unit #2, at approximately 6.25 dwelling units per acre.
Amendment to Policy 2.4.4 of the 2000 Butte County Airport Land Use Compatibility Plan
• At the February 16, 2005, ALUC meeting the Commission approved an amendment to
Section 2.4.4 (Special Conditions) of the 2000 Butte County Airport Lana Use Compatibility
Plan. The amendment allows infill development that would otherwise -:)e inconsistent with
the B2 Airport Consistency Zone.
• Section 2.4.4 now allows infill development on parcels that are 5 acres or less in size. If the
proposed infill development meets the infill development requirements of Section 15332 (In -
Fill Development Projects) of the California Environmental Quality Act the infill
development density may be equal to, but no greater than, the density that exists on the most
densely developed property that is located within 500 feet of the perimeter of the parcel.
• The City of Chico provided a map to the ALUC that showed those parc-,Is eligible for infill
development in the B2 Airport Compatibility Zone south of the Chicc- Municipal Airport
which ALUC has been formally adopted as the infill development. map. The infill
development map shows the project parcel.
ENVIRONMENTAL DOCUMENTATION:
CNo environmental documentation has been completed for this project by ALUC staff. The City
of Chico staff will complete an environmental initial study and make a determination per the
California Environmental Quality Act as part of their processing of the tentative parcel map.
RECOMMENDATION:
r`Staff recommends that the Butte County Airport Land Use Commission find ALUC File No.
A 05-21 (Hughes TPM 04-06) is consistent with the infill development polic- of Section 2.4.4 of
the 2000 Butte County Airport Land Use Compatibility Plan.

CONSISTENCY FINDINGS FOR ALUC File No. A 05-21 Hughes — Tentative Parcel Map,
APN 015-160-029:
The Airport Land Use Commission (ALUC) has prepared the following findings based on data
contained in the 2000 Butte County Airport Land Use Compatibility Plan (ALUCP), as well as
site specific information submitted by the applicant and ALUC staff.
The following findings have been prepared at the direction of the ALUC and are for the
consideration of the Lead Agency (City of Chico) when making a decision on the project.
SECTION 1: ENVIRONMENTAL FINDINGS
A. No environmental documentation has been completed for thi3 project by ALUC
staff. The City of Chico staff will complete an environmental initial study and
make a determination per the California Environmental Quzlity Act as part of
their processing of the tentative parcel map.
SECTION 2: CONSISTENCY FINDINGS FOR PROPOSED PROJECT
A. The proposal for the Hughes Tentative Parcel Map, will acid an additional an
single family dwelling parcel, which will result in an average parcel size of 0.23
acres and a density of 4.35 dwelling units per acre, which is consistent with the
infill development criteria of Section 2.4.4(a)(3) of the 2000 Butte County Airport
Land Use Compatibility Plan.
SECTION 3: PROJECT FINDINGS:
A. The project site meets the criteria for infill development of Section 2.4.4(a)(3)
.because:
1. The project site is 5 acres or less in size
2. The Tentative Parcel Map project qualifies as infill development pursuant
to the California Environmental Quality Act
3. The density of the project, at approximately 4.34 dwel-ing units per acre,
would be less than the density of the highest existing residential
development within 500 feet of the project site, which is approximately
6.25 dwelling units per acre. ,
4. The project site is shown on the City of Chico's infill development map,
as approved by the Butte County Airport Land Use Corr -mission on March
16, 2005.
B. No structures on the project site would extend into protected airspace.
C. All dwellings on the project are required to be designed and constructed to have a
maximum interior noise level of 45 dB CNEL or less in order to prevent
significant aircraft -related noise impacts.

SECTION 4: PROJECT CONDITIONS:
1. Provide a deed notice for the sale of all resulting lots notifyi.lg purchasers of the
proximity of the airport and the potential for possible noise-related impacts in an
ALUC-approved disclosure notice.
2. Airspace review by the Airport Land Use Commission required for objects greater
than 70 feet tall.
3. All dwellings shall be designed and constructed to achieve a maximum interior
noise level of 45 dB CNEL or below.

parcel into two lots (0.19 acre and 0.27 acre) to allow -for an adcitional dwelling. The
project site is•located on the northeast corner of North Avenue 3.nd Verde Drive, east

The Commission Panel was now Commissioners Lundy, Wheeler, Sherman, Rosene, Hennigan, `
Rothe, and Chairman Harp and remained this way for the 'remainder of the meeting.
Mr. Michelena gave a brief summary of the project.
The hearing was opened to the public.
Orvil Hughes said they have no objection with an avigation easement instead of a deed restriction.
Mr. Michelena suggested adding the new conditions as stated for the last projec� to read ""Prior to the
recordation of the map record as a separate instrument an Avigation Easemen-: granting the right of
continued use of the airspace above the proposed parcels by the Chico Municipal Airportand
acknowledging any and.all existing or potential airport operational impacts." and "Place a note on a
separate document which is to be recorded concurrently with the map or on an additional map sheet
that states: "An Avigation Easement is recorded above the parcels for the Chico Municipal Airport
and acknowledging any and all existing or potential airport operational impacts. '
It was moved by Commissioner Wheeler, seconded by Commissioner Hennigan, and unanimously
carried to find ALUC File A 05-21 for Elizabeth Hughes consistent with the infill development
policy of Section 2.4.4 of the2000 Butte County Airport Land Use Compatibility Plan subject to" the
findings and conditions listed below: Adding a new Conditions'4 & 5 to read "Prior to the recordation

SECTION l : ENVIRONMENTAL FINDINGS
A. No environmental documentation has been completed for this project :)y ALUC staff. The
City of Chico staff will complete an environmental initial study and make a determination per
the California Environmental Quality Act as part of their processing CT the tentative parcel
map.
SECTION 2: CONSISTENCY FINDINGS FOR PROPOSED PROJECT

A. - The proposal for the Hughes Tentative Parcel Map, will add an adcitional single family
dwelling parcel, which will result in an average parcel size of 0.23 acres and a density of 4.35
dwelling units per acre, which is consistent with the infill development criteria of Section -
2.4.4(a)(3) of the 2000 Butte County Airport Land Use Compatibility Plzn.
