3. ALUC File No. A 06-21 — Thomas -Hawes, LLC Tentative, Subdivision Map,
- APN 015-120-033: A consistency review for a proposed 17 lot residential infill
.. t subdivision. The parcel is located within Compatibility Zone B2 of the Chico
y. Municipal Airport. The project site is located on the east side of Cohasset Road,
directly across from Cameo Drive, in the City of Chico.
Mr. Michelena gave a brief summary of the project. '
Commissioner Lundy said when the Commission was discussing the infill, he did not think what the ,
Commission had in mind is what actually came out in the policy. He said staff compared the infill 'on
this project to a,project that is not similar at all. He said they have taken a density of one lot 500 feet
down the street; multiply that by five and come up with 20 lots for a density for this project. He said
you look -at all the lots 'around. this subdivision and they are quite a bit larger. He thought the
Commission's intention was to come up with similar adjacent to the properties. He was concerned '
comparing the'subject property to something that is not close and come up with a high density that
was not the intent. ` He said under the conditions set for the infill it states "The site is at least 60
percent bounded' by existing uses similar to or more intensive than." He said if you look at the
neighboring lots to the south, following the policy is not what is being done in this case. 'He said
there are 50 percent of the lots that are larger than this one. He said he went back to the discussion
that the .City of. Chico gave them, and the stats that they used for this property said the maximum
allowable density is 13 lots. The General Plan is 8 lots and technically with the written policy this
property qualifies as consistent, but he did not think that was what the Commission had in mind. `
The hearing was opened to the public. '.

The hearing wa`s closed and comments confined to the Commission and staff. .
• Chairman Hennigan said the City of Chico got what they wanted. He said in this instance the
property is outside of the accident scatter area. He said small lots'and high density are better ,when'
dealing with nuisances from'noise. He�said if safety is not a factor, the over fight and annoyances are,
the most important factors. He said the liability is to.the City of Chico by putting residential in, an
accident scatter area.
Commissioner Teitelman asked what would be the basis for law suits against the City of Chico.
Chairman. Hennigan said the concern is people writing the Commission on not following 'good
`practices as in regard to 'safety.areas and he felt the City has accepted a substantial liability.
Commissioner, Teitelman said that it appears that poor decisions have been made by the City of Chico
regarding protecting,the airport on the south side. `

It was moved by Commissioner Wheeler, seconded by Commissioner Rothe, and unanimously
carried to find ALUC File No. A06-21 for Thomas -Hawes, LLC consistent with the infill
development policy of Section 2.4.4 of the 2000 Butte County Airport Land Use Compatibility Plan,
subject to the findings and conditions listed below:

CONSISTENCY FINDINGS FOR ALUC File No. A 06-21— Thomas -Hawes, LLC — Tentative
Subdivision, APN 015-120-033:
The Airport Land Use Commission (ALUC) has prepared the following findings based on data
contained in the 2000 Butte County Airport Land Use Compatibility Plan (ALUCP), as well as site
specific information submitted by the applicant and ALUC staff.
The following findings have been prepared at the direction of the ALUC and are for the consideration
of the Lead Agency (City of Chico) when making a decision on the project.
SECTION 1: ENVIRONMENTAL FINDINGS
A. No environmental documentation has been completed for this project by ALUC staff.
Your Commission's review of the proposed project and determination of consistency
is not a "project" under the California Environmental Quality Act. Determination of
environmental review will be completed during the process of the Tentative
Subdivision Map by the City of Chico. It is expected that a Class 32 categorical
exemption for in -fill development (Section 15332 of the CEQA Guidelines) will be
the environmental determination for the proposed project.
SECTION 2: CONSISTENCY FINDINGS FOR PROPOSED PROJECT
A. The proposal for the Thomas -Hawes, LLC Tentative Subdivision with 17 single-
family lots on 2.33 acres, which will result in a density of 7.29 dwelling units per acre,
which is consistent with the infill development criteria of Section 2.4.4(a)(3) of the
2000 Butte County Airport Land Use Compatibility Plan.
B. The project site meets the criteria for infill development of Section 2.4.4(a)(3)
because:
1.. The project site is 5 acres or less in size
2. The Multi -Family project qualifies as infill development pursuant to the
California Environmental Quality Act
3. The density of the project, at 7.29 dwelling units per acre, would be less than
the density of the highest existing residential development within 500 feet of
the project site, which is 20.0 units per acre (APN 007-2907039).

On May 17, 2006, the Airport Land Use Commission (ALUC) found project A 06-17to be consistent and
on July 19, 2006, the Airport Land Use Commission (ALUC) found project A 06-21 to be consisteni.,
Both of the projects were subject to the same five conditions which would still apply to the modified
subdivision.
Provide a deed notice for the sale of all resulting lots notifying purchasers of the
proximity of the airport and the potential for possible noise -related impacts in an
ALUC-approved disclosure notice.
2. Prior to the recordation of the Final Map record as a separate instrument ar- Avigation
Easement granting the right of continued use of the airspace above the proposed
parcels by the Chico Municipal Airport and acknowledging any and all -xisting or
potential airport operational impacts.
3. Place a note on a separate document which is to be recorded concurrenty with the
final map or on an additional map sheet that states: "An Avigation Easement is
recorded above the parcels for the Chico Municipal Airport and acknowledging any
and all existing or potential airport operational impacts."

Based on the information provided to staff, the two applicants have proposed to modify their individual
subdivisions and combine the projects. The revised map shows the total number of lots reducing from 33
to 24. The modified density (536 du/ac) would be less than what was proposed for the two individual
projects, A 06-17 (9.87 du/ac) and A 06-21 (7.29 du/ac). Based on the modified project parcel(s) size
(4.6 acres), the project will still be consistent with the infill requirements of the Butte County Airport
Land Use Compatibility Plan on parcels of 5.0 acres or less. Staff determines that the modified project
does not need. to go before ALUC for consistency review.

With this letter, the City of Chico Planning Division forwards a Butte County Airport Land Use
Commission (ALUC) application for consistency findings for the captioned prcject. Enclosed
with the application are a check in the amount of $1,531.00, 24 -location maps and one copy of
the subdivision map.
The applicant proposes to create 17 lots on 2.33 acres located on the east side of Cohasset Road,
approximately 150 feet north of Lupin Avenue and directly opposite Cameo Drive. The
applicant is requesting several modifications to design criteria. The site is developed with a
single-family home addressed as 2926 Cohasset Road. The property is identifi: d as Assessor's
Parcel Numbers 015-120-033. The site is in the Airport Compatibility B2 zone and requires
Airport Land Use Commission review and action.
The project site is split zoned. For a depth of 140 feet from Cohasset Road the property is
designated Office and is located in an OR Office Residential zoning district. The remaining back
portion of the lot is designated Low Density Residential and is located in an R l Low Density
Residential zoning district. A use permit (UP 06-17) to allow residential development of the OR
zoned portion has also been submitted for concurrent'processing with the subdivision map.
Please note, there is a second subdivision being discussed immediately to the north and staff will
be working with both applicants regarding connectivity issues.

subdivision. The parcel is located within Compatibility Zone B2 of the Chico
Municipal Airport. The project site is located on the east side of Cohasset Road, '
directly across from Cameo Drive, in the City of Chico.
SUMMARY:
The project is a 17 lot residential infill subdivision on a 2.33 acre parcel. The project density
would be 7.29 dwelling units per acre. The project parcel was identified as an infill parcel on the
approved map for the City of Chico. Consistency determination is based upon the infill
requirements of Section 2.4.4(a) of the Butte County Airport Land Use Compatibility Plan
(CLUP). Staff recommends that ALUC find the project consistent with the 2000 CLUP for the
Chico Municipal Airport.
BACKGROUND:
• The property is 2.33 acres in size and is developed with an existing building ("abandoned).
• The property is within the incorporated limits of the City of Chico. The project site is
designated Office on the City of Chico General Plan Diagram and has a split -zone of OR
(Office Residential) and R-1 (Low Density Residential).
• Existing land uses within 500 feet of the project site include a church, a worship center, .
professional office uses, multi -family and single family residential dwellings.
• Seventeen (17) single-family dwelling units are proposed.
• No open space is proposed on the project site.
• The height of the tallest object on the project site is anticipated to be approximately 40 feet..
above ground level, which equates to approximately 239 feet above mean sea level.

• The project site is approximately 0.25 miles west of the extended centerline of Runway
31R/13L of the .Chico Municipal Airport, at a distance of 1.37 miles southwest of this
runway.
• Section 4.1:3 of the 2000 Butte County Airport Land Use Compatibility Plan states that the
maximum noise level for residential uses in the vicinity of an airport is 55 dB CNEL, except
for the area south of the Chico Municipal Airport, where a 60 dB CNEL noise maximum is
acceptable.
• The project site is not within the 55 dB CNEL noise contour as shown on Exhibit 4E (Noise ,
Impacts — Future Average Fire Season Day) but is within the 55dB CNEL noise contour as
shown on Exhibits 4F (Noise Impacts — Expanded Forecast) and 4G (Noise Impacts — Peak
Fire Attack Day) of the 2000 Butte County Airport Land Use Compatibility Plan.
• Pursuant to* Section 4.1.5(a) of the 2000 Butte County Airport Land Use Compatibility Plan,
staff recommends that all dwellings on the project site be designed and constructed to
achieve a maximum interior noise level of 45 dB CNEL.
• The project would result in 17 single-family dwellings on 2.33 acres, which will result in a
density of 7.29 dwelling units per acre. This density is not consistent with the B2 Airport
Compatibility Zone, which requires 0.2 dwelling units or less per acre (minimum parcel size
of 5 acres or larger).

• The proposed project density (7.29 du/ac) is consistent with the infill requirement based on
the highest surrounding density within 500 feet is a four-plex located on APN 007-290-039.
The parcel size is 0.20 acres and has a density of 20.0 du/ac (4 du/0.2 ac).
• The project site meets the criteria for infill development of Section 2.4.4(a)(3) of the 2000
Butte County Airport Land Use Compatibility Plan because it is 5 acres or less in size (2.33
acres), qualifies as infill development pursuant to Section 15332 of the California
Environmental Quality Act, and the density of the project (7.29 du/ac) would be less than
higher density (20+ dwelling units per acre) of the existing residential developments within
500 feet of the project site, which include triplexes and duplexes on parcels sizes of 0.2 acres.
ENVIRONMENTAL DOCUMENTATION:
No environmental documentation has been completed for this project by ALUC staff. Your
Commission's review of the proposed project and determination of consistency is not a "project"
under the California Environmental Quality Act. Determination of environmental review will be
completed during the process of the Tentative Subdivision Map by the City of Chico. It is
expected that a Class 32 categorical exemption for in -fill development (Section 15332 of the
CEQA Guidelines) will be the environmental determination for the proposed project.
RECOMMENDATION:
Staff recommends that the Butte County Airport Land Use Commission find ALUC File No.
A 06-21 (Thomas -Hawes, LLC) is consistent with the infill development policy of Section 2.4.4
of the 2000 Butte County Airport Land Use Compatibility Plan, subject to the recommended,
conditions.

Tentative Subdivision, APN 015-120-033:
The Airport Land Use Commission (ALUC) has prepared the following findings based on data
contained in the 2000 Butte County Airport Land Use Compatibility Plan (ALUCP), as well as
site specific information submitted by the applicant and ALUC staff.
The following findings have been prepared at the direction of the ALUC and are for the
consideration of the Lead Agency (City of Chico) when making a decision on the project.
SECTION 1: ENVIRONMENTAL FINDINGS
A. No environmental documentation has been completed for this project by ALUC
staff. Your Commission's review of the proposed project and determination of
consistency is not a "project" under the California Environmental Quality Act.
Determination of environmental review will be completed during the process of
the Tentative Subdivision Map by the City of Chico. It is expected that a Class 32
categorical exemption for in -fill development (Section 15332 of the CEQA
Guidelines) will be the environmental determination for the proposed project.. -
SECTION 2: CONSISTENCY FINDINGS FOR PROPOSED PROJECT
' A. The proposal for the Thomas -Hawes, LLC Tentative Subdivision with 17 single-
family lots on 2.33 acres, which will result in a density of 7.29 dwelling units per
acre, which ig consistent with the infill development criteria of Section 2.4.4(a)(3)
of the 2000 Butte County Airport Land Use Compatibility Plan.
B. i,The project site meets the criteria for infill development of Section 2.4.4(a)(3)
because:
1. The project site is 5 acres or less in size
2. The -Multi -Family project qualifies as infill development pursuant to the
California Environmental Quality Act
3. The density of the project, at 7.29 dwelling units per acre, -would be less
than the density of the highest existing residential development within 500
feet of the project site, which is 20.0 units per acre (APN 007-290-039).

4. The project site is shown on the City of Chico's infill development map,
as approved by the Butte County Airport Land Use Commission on March
16, 2005.

C. No structures on the project site would extend into protected airspace.
D. All dwellings on the project are required to be designed and constructed to have�a
maximum interior noise level of 45 dB CNEL or less in order to prevent
significant aircraft -related noise impacts.

SECTION 4: PROJECT CONDITIONS:
1. Provide a deed notice for the sale of all resulting lots notifying purchasers of the
proximity of the airport and the potential for possible noise -related impacts in an
ALUC-approved disclosure notice.
2. Prior to the recordation of the Final Map record as a separate instrument an
Avigation Easement granting the right of continued use of the airspace above the
proposed parcels by the Chico Municipal Airport and acknowledging any and all
existing or potential airport operational impacts.
3. Place a note on a separate document which is to be recorded concurrently with the
final map or on an additional map sheet that states: "An Avigation Easement is
recorded above the parcels for the Chico Municipal Airport and acknowledging
any and all existing or potential airport operational impacts."
4. Place a note on a separate document which is to be recorded concurrently with the
final map or on an additional map sheet that states: "Airspace review by the
Airport Land Use Commission is required for all objects over 100 feet in height in,
the C1 Compatibility Zone and 70 feet in height in the B2 Compatibility Zone."
5. Place a note on a separate document which is to be recorded concurrently with the
final map or on an additional map sheet that states: "As a condition for the
issuance of any Building Permit, a minimum interior noise level of 45 decibel
(dB) or less is required for all residences."

• The property is within the incorporated limits of the City of Chico. The project site is
designated Office on the City of Chico General Plan Diagram and has a split -zone of OR
(Office Residential) and R-1 (Low Density Residential).
• Existing land uses within 500 feet of the project site include a church, a worship center,
professional office uses, multi -family and single family residential dwellings.
• Seventeen (17) single-family dwelling units are proposed.
• No open space is proposed on the project site.
• The height of the tallest object on the project site is anticipated to be approximately 40 feet
above ground level, which equates to approximately 239 feet above mean sea level.

Extract from Table 2A of the 2000 ALUCP *NLR - Noise Level Reduction
• The project site is approximately 0.25 miles west of the extended centerline of Runway
31R/13L of the Chico Municipal Airport, at a distance of 1.37 miles southwest of this
runway.
• Section 4.1.3 of the 2000 Butte County Airport Land Use Compatibility Plan states that the
maximum noise level for residential uses in the vicinity of an airport is 55 dB CNEL, except
for the area south of the Chico Municipal Airport, where a 60 dB CNEL noise maximum is
acceptable.
• The project site is not within the 55 dB CNEL noise contour as shown on Exhibit 4E (Noise
Impacts — Future Average Fire Season Day) but is within the 55dB CNEL noise contour as
shown on Exhibits 4F (Noise Impacts — Expanded Forecast) and 4G (Noise Impacts — Peak
Fire Attack Day) of the 2000 Butte County Airport Land Use Compatibility Plan.
• Pursuant to Section 4.1.5(a) of the 2000 Butte County Airport Land Use Compatibility Plan,
staff recommends that all dwellings on the project site be designed and constructed to
achieve a maximum interior noise level of 45 dB CNEL.
• The project would result in 17 single-family dwellings on 2.33 acres, which will result in a
density of 7.29 dwelling units per acre. This density is not consistent with the B2 Airport
Compatibility Zone, which requires 0.2 dwelling units or less per acre (minimum parcel size
of 5 acres or larger).

• The proposed project density (7.29 du/ac) is consistent with the infill requirement based on
the highest surrounding density within 500 feet is a four-plex located on APN 007-290-039.
The parcel size is 0.20 acres and has a density of 20.0 du/ac (4 du/0.2 ac).
• The project site meets the criteria for infill development of Section 2.4.4(a)(3) of the 2000
Butte County Airport Land Use Compatibility Plan because it is 5 acres or less in size (2.33
acres), qualifies as infill development pursuant to Section 15332 of the California
Environmental Quality Act, and the density of the project (7.29 du/ac) would be less than
higher density (20+ dwelling units per acre) of the existing residential developments within
500 feet of the project site, which include triplexes,and duplexes on parcels sizes of 0.2 acres.
ENVIRONMENTAL DOCUMENTATION:
No environmental documentation has been completed for this project by ALUC staff. Your
Commission's review of the proposed project and determination of consistency is not a "project"
under the California Environmental Quality Act. Determination of environmental review will be
completed during the process of the Tentative Subdivision Map by the City of Chico. It is
expected that a Class 32 categorical exemption for in -fill development (Section 15332 of the

CONSISTENCY FINDINGS FOR ALUC File No. A 06-21— Thomas -Hawes, LLC —
Tentative Subdivision, APN 015-120-033:
The Airport Land Use Commission (ALUC) has prepared the following findings based on data
contained in the 2000 Butte County Airport Land Use Compatibility Plan (ALUCP), as well as
site specific information submitted by the applicant and ALUC staff.
The following findings have been prepared at the direction of the ALUC and are for the
consideration of the Lead Agency (City of Chico) when making a decision on the project.
SECTION 1: ENVIRONMENTAL FINDINGS
A. No environmental documentation has been completed for this project by ALUC
staff. Your Commission's review of the proposed project and determination of
consistency is not a "project" under the California Environmental Quality Act.
Determination of environmental review will be completed during the process of
the Tentative Subdivision Map by the City of Chico. It is expected that a Class 32
categorical exemption for in -fill development (Section 15332 of the CEQA
Guidelines) will be the environmental determination for the proposed project.
SECTION 2: CONSISTENCY FINDINGS FOR PROPOSED PROJECT
A. The proposal for the Thomas -Hawes, LLC Tentative Subdivision with 17 single-
family lots on 2.33 acres, which will result in a density of 7.29 dwelling units per
acre, which is consistent with the infill development criteria of Section 2.4.4(a)(3)
of the 2000 Butte County Airport Land Use Compatibility Plan.
B. The project site meets the criteria for infill development of Section 2.4.4(a)(3)
because:
1. The project site is 5 acres or less in size
2. The Multi -Family project qualifies as infill development pursuant to the
California Environmental Quality Act
3. The density of the project, at 7.29 dwelling units per acre, would be less
than the density of the highest existing residential development within 500
feet of the project site, which is 20.0 units per acre (APN 007-290-039).
4. The project site is shown on the City of Chico's infill development map,
as approved by the Butte County Airport Land Use Commission on March
16, 2005.
C. No structures on the project site would extend into protected airspace.
D. All dwellings on the project are required to be designed and constructed to have a
maximum interior noise level of 45 dB CNEL or less in order to prevent
significant aircraft -related noise impacts.

SECTION 4: PROJECT CONDITIONS:
1. Provide a deed notice for the sale of all resulting lots notifying purchasers of the
proximity of the airport and the potential for possible noise -related impacts in an
ALUC-approved disclosure notice.
2. Prior to the recordation of the Final Map record as a separate instrument an
Avigation Easement granting the right of continued use of the airspace above the
proposed parcels by the Chico Municipal Airport and acknowledging any and all
existing or potential airport operational impacts.
3. Place a note on a separate document which is to be recorded concurrently with the
final map or on an additional map sheet that states: "An Avigation Easement is
recorded above the parcels for the Chico Municipal Airport and acknowledging
any and all existing or potential airport operational impacts."
4. Place a note on a separate document which is to be recorded concurrently with the
final map or on an additional map sheet that states: "Airspace review by the
Airport Land Use Commission is required for all objects over 100 feet in height in
the C 1 Compatibility Zone and 70 feet in height in the B2 Compatibility Zone."
5. Place a note on a separate document which is to be recorded concurrently with the
final map or on an additional map sheet that states: "As a condition for the
issuance of any Building Permit, a minimum interior noise level of 45 decibel
(dB) or less is required for all residences."
