1. Bonnie Lamb, determination of ,consistency with the 2000 CLUP for the Chico
Municipal Airport to review a proposed 4,696 square foot commercial building in the
B-2 zone of the Chico Airport Land Use compatibility plan, Chico. The project is
located at 968 East Avenue, on the north side of East Avenue, approximately 550 feet
east of Cohasset Road, Chico. (CD) A 05-28.
Mr. Durling gave a brief summary of the project and a power point presentation. He said this parcel
is part of the Chico infill area that was approved by this Commission in May.He said that
Chairperson Sherman made a suggestion to him before the meeting that the Commission might want
to consider a condition for noise attenuation if the building is converted or cor_structed as an office
building, the interior noise level should be 45 dBs or less.
Commissioner Wheeler asked how the property will be accessed from East Avenue. He asked if
people would cut through Chuck E. Cheese to get to this building.
Mr. Durling said it is all one lot with access agreements for both parking and the Jriveway.
The hearing was opened to the public.
Joe Acquistapace noted that they have to meet the City of Chico's landscaping requirements.
Commissioner Hennigan said if the building is converted to office space it would have to meet the
noise attenuation condition discussed earlier.
Mr. Acquistapace said that was fine.
The hearing was closed and comments confined to the Commission and staff.
Commissioner Hennigan pointed out that if the City of Chico had brought its General Plan into
conformity with the CLUP and followed State law, the applicant would not have to come before this
Commission or pay the fees to have them review this.
It was moved by Commissioner Hennigan, seconded by Commissioner Rosen, and unanimously
carried to find ALUC File A 05-28 for Bonnie Lamb is consistent with the infill development policy
of Section 2.4.4 of the 2000 Butte County Airport Land Use Compatibility Plan subject to the
findings and conditions listed below; adding a new Condition 3 to read "If the pnoposed commercial
building is converted or constructed as an office building, the interior sound attenuation shall be 45
dBs or less."
SECTION 1: ENVIRONMENTAL FINDINGS
A. No environmental documentation has been completed for this project by ALUC staff.
The City of Chico staff will make a determination per the California Environmental
Quality Act as part of their processing of the commercial building.
SECTION 2: CONSISTENCY FINDINGS FOR PROPOSED PROJECT
A. The proposal for the Bonnie Lamb commercial use will add an additional 4,696 square
feet of commercial use, which is consistent with the infill development criteria of
Section 2.4.4(a)(3) of the 2000 Butte County Airport Land Use Compatibility Plan.
SECTION 3: PROJECT FINDINGS:
A. The project site meets the criteria for infill development of Section 2.4.4(a)(3)
because:
.1.The project site is 5 acres or less in size
2. The Commercial project qualifies as infill development pursuant to the
California Environmental Quality Act
3. The size of the project, at approximately 4,696 square fee-, would be less than
the size of the highest density of existing commercial dev.;lopment within 500
feet of the project site, a 6,018 square foot commercial building.
4.. The project site is shown on the City of Chico's infill d--velopment map, as
approved by the Butte County Airport Land Use Commission on March 16,
2005.
B. No structures on the project site would extend into protected airspace.
C. Commercial uses are exempt from noise requirements of Section x.1.5 (a) of the Butte
County Airport Land Use Compatibility Plan..
SECTION 4: PROJECT CONDITIONS:
1. Airspace review by .the Airport Land Use Commission required for objects greater
than, 70 feet tall.
2. Prior to.the issuance of building permits, record an Avigation Easement granting the
right of continued use of the airspace above the proposed parcel by the Chico
Municipal Airport, and acknowledging any and all existing,or potential airport
operational impacts. `
3. If the proposed commercial building is converted or constructed a an office building,
the interior sound attenuation shall be 45 dBs or less.

SUMMARY:
Staff recommends that ALUC find the project consistent with the 2000 Airport Land Use
Compatibility Plan for the Chico Municipal Airport.,' Consistency is based upon the recently -
approved amendment to Section 2.4.4 of the 2000 Butte County Airport Land Use Compatibility
Plan and ALUC's approval of the City of Chico infill development map at the March 16, 2005
meeting.
BACKGROUND:.
• The property is within the incorporated limits of the City of Chico. The project site is
designated Community Commercial on the City of Chico General Plan Diagram and is zoned
CC (Community Commercial).
• The subject property is a vacant building pad with parking already established, and is a
portion of a 1.04 acre parcel. The development proposal is to build a 4,696 square foot
commercial building for use as a restaurant.
• The remaining portion of the 1.04 acre parcel is developed with an existing operating
restaurant of 6,018 square feet, and a parking area.
• Existing land uses within 500 feet of the project site include commercial uEes to the north
east, west and south across East Avenue, single family residential dwellings to the north and
south. across East Avenue, and an elementary school adjacent on the.east.
• No open space is proposed on the project site.
• The height of the tallest object on the project site is anticipated to be approximately 24 feet
above ground level, which equates to approximately 225 feet above mean sea level.

• The project site is approximately 0.6 miles west of the extended centerline of Runway
31R/13L of the Chico Municipal Airport, at a distance of 1.8 miles southwest of this runway.
• Section 4.1.3 of the 2000 Butte County Airport Land Use Compatibility Plan states that the
maximum noise level for residential uses in the vicinity of an airport is 55 dB CNEL, except
for the area south of the Chico Municipal Airport, where a 60 dB CNEL no=se maximum is
acceptable. I
• The project site is not within the 55 dB CNEL noise contour as shown on E>hibit 4E (Noise
Impacts — Future Average Fire Season Day) but is within the 55dB CNEL noise contour as
shown on Exhibits 4F (Noise Impacts — Expanded Forecast) and 4G (Noise Impacts — Peak
Fire Attack Day) of the 2000 Butte County Airport Land Use Compatibility P!an.
• Pursuant to Section 4.1.5(a) of the 2000 Butte County Airport Land Use Compatibility Plan,
staff - notes that commercial buildings and uses are excluded from the requirement of
achieving a maximum interior noise level of 45 dB CNEL.
• The proposed commercial restaurant development qualifies as infill development pursuant to
Section 15332 (Class 32) of the California Environmental Quality Act Categorically Exempt
status projects. In summary, a project qualifies if it is consistent with the G --,neral Plan and
zoning; is within the City Limits; not a habitat for rare or endangered species; would not
result in traffic, noise, air quality, or water quality impacts; and can be served by 'all required
utilities and public services.

o The project site also meets the criteria for infill development of Section 2.4.4(a)(3) of the
2000 Butte County Airport Land Use Compatibility Plan. It is 5 acres or less in size (1.04
acres), qualifies as infill development pursuant to Section 15332 of the California
Environmental Quality Act, and the density of the project (4,696 square feet) would be less
than the highest density of the existing developments within 500 feet of the project site. The
property already includes a 6,018 square foot commercial building.
Amendment to Policy 2.4.4 of the 2000 Butte County Airport Land Use Compatibility Plan
• At the February 16, 2005, ALUC meeting the Commission approved an amendment to
Section 2.4.4 (Special Conditions) of the 2000 Butte County Airport Land Use Compatibility
Plan. The amendment allows infill development that would otherwise be inconsistent with
the B2 Airport Consistency Zone.
• Section 2.4.4 now allows infill development on parcels that are 5 acres or less in size. If the
proposed infill development meets the infill development requirements of Section 15332 (In -
Fill Development Projects) of the California Environmental Quality Act, the infill
development density may be equal to, but no greater than, the density that exists on the most
densely developed property'that is located within 500 feet of the perimeter of the parcel.
• The City of Chico provided a map to the ALUC that showed those parcels eligible for infill
development in the B2 Airport Compatibility Zone south of the Chico Mlnicipal Airport:.
ALUC formally adopted this map on March 16, 2005 as the infill development map. The
project parcel is identified as parcel 13 on the City of Chico infill development map.
ENVIRONMENTAL DOCUMENTATION:
No environmental documentation has been completed for this project by ALUC staff. The City
of Chico staff will make a determination per the California Environmental Qual:_ty Act as part of
their processing of the application for development review. It is expected that a Class 32
categorical exemption for in -fill development (Section 15332 of the CEQA GLidelines) will be
the environmental determination for the new commercial use.
RECOMMENDATION:
Staff recommends that the Butte County Airport Land Use Commission find ALUC File No.
A 05-28 (Bonnie Lamb) is consistent with the infill development policy of Sec -tion 2.4.4 of the
2000 Butte County Airport Land Use Compatibility Plan.

The Airport Land Use Commission (ALUC) has prepared the. following findings: based on data
contained in the 2000 Butte County Airport Land Use Compatibility Plan (ALUCP), as well as
site specific information submitted by the applicant and ALUC staff.
The following findings have been prepared at the direction of the ALUC and are for the
consideration of the Lead Agency (City of Chico) when making a decision on the project.

The Airport Land Use Commission (ALUC) has prepared the following findings based on data
contained in the 2000 Butte County Airport Land Use Compatibility Plan (ALUCP), as well as
site specific information submitted by the applicant and ALUC staff.
The following findings have been prepared at the direction of the ALUC and are for the.
consideration of the Lead Agency (City of Chico), when making a decision on the project. "
SECTION 1: ENVIRONMENTAL FINDINGS
A. " No ,environmental documentation has been completed for this project by ALUC
staff. The City of Chico staff will make a. determination pe- the California
Environmental Quality Act as part of their processing of the commercial building.
SECTION`2: CONSISTENCY FINDINGS FOR PROPOSED PROJECT
A." The proposal for the Bonnie Lamb commercial use will add an additional 4,696 "
square feet of commercial use, which is consistent with the infill" development
criteria of Section 2.4.4(a)(3) of the 2000 Butte ,County Airport Land Use
Compatibility Plan.
SECTION 3: PROJECT FINDINGS:
A. The project site meets the criteria for infill 'development of Section 2.4.4(a)(3)
because:
1. The project site is 5 acres or less in size
2. The Commercial project qualifies as infill development pursuant to the
California Environmental Quality Act
3. The size of the project, at approximately 4,696 square feet, would be less
than the size of the highest density of existing commerc_al development
within 500 feet of the project site, a 6,018 square foot commercial
building: ".
4.; The project site is shown on the City of Chico'.s infill development map,
as approved by the Butte County Airport Land Use Commission on March
16, 2005.
B. No structures on the project site would extend into protected airspace.

With this letter, the City of Chico Planning Division forwards a Butte County A=rport Land Use
Commission (ALUC) application for consistency findings for the captioned proj--ct. Enclosed
with the application are a check in the amount of $1,531.00, a project`site plan, znd 24 copies of
a map showing the relationship of the project to the airport boundary and runways. The project
site is within the boundary of Zone'B2 (and immediately adjacent to Zone D) fon the Chico
Municipal Airport, and is one of the sites designated for infill development (Area. 13).
The project consists of a proposal to construct a 4,696 square foot commercial building on a 1.04
acre site located at 968 East Avenue, which is intended for use by a restaurant (2,696 square feet)
and office (2,000 square feet). The site is already developed with a commercial building 6,018
square feet in size, occupied by a restaurant and bar ("Quackers"). The property is identified as
Assessor's Parcel No. 015-230-026, is designated Community Commercial on the City of Chico
General Plan Diagram, and is located in a CC Community Commercial zoning d --strict. The
project is consistent with the General Plan designation and zoning for the area.
Pursuant to Table 2A of the 2000 ALUCP, a maximum density of 100 people/acre for a single
acre is allowed in the B2 Compatibility Zone. Based upon a, parking analysis using the method
described in Appendix D of the ALUCP, the calculated density for this project is. 98 people/acre.
(68 required parking spaces multiplied by 1.5 occupants per vehicle = 102 occupants, divided by
parcel size of 1.04 acres = 98 people/acre.) Please note that the density for this s_.te is less than
the density for the Chuck E. Cheese property located immediately to the west.
Because of the project's consistency with the provisions of Zone B2, we would appreciate a
staff determination that it should not proceed to ALUC. In the event that staff determines
otherwise, please schedule this item for the next available ALUC meeting.
