Butte County Department of Development Services Planning Division Airport Land Use Commission May 17, 2006, ALUC Meeting AGENDA ITEM — E.3 TO: Honorable Chair and Airport Land Use Commission FROM: Mark Michelena, Senior Planner DATE: May 4, 2006 ITEM: ALUC File No. A 06-17 — Coastal View Construction — Tentative Subdivision Map, APN 015-120-034: A consistency review for a proposed 16 lot residential subdivision. The parcel is located within Compatibility Zone B2 of the Chico Municipal Airport. The project site is located on the east side of Cohasset Road, approximately 150 feet north of Cameo Drive, in the City of Chico. SUMMARY: The project is a 16 lot residential subdivision on a 2.33 acre parcels. The project is divided up into 13 single-family lots and 3 multiple residences lots for a total of up to 23 residences. The project density would be up to 9.87 dwelling units per acre. The project parcel was identified as an infill parcel on the approved map for the City of Chico. Consistency determination is based upon the infill requirements of Section 2.4.4(a). Staff recommends that ALUC find the project consistent with the 2000 Airport Land Use Compatibility Plan for the Chico Municipal Airport. BACKGROUND: • The property is 2.33 acres in size and is developed a single family dwelling. • The property is within the- incorporated limits of the City of Chico. The project site is designated Office on the City of Chico General Plan Diagram and has a split -zone of OR (Office Residential) and R-1 (Low Density Residential). • Existing land uses within 500 feet of the project site include a church, a worship center, professional office uses, multi -family and single family residential dwellings. • Thirteen (13) single family dwelling units are proposed for the R-1 portion of the parcel and ten (10) units (maximum) are proposed on the OR portion of the property by Use Permit. • No open space is proposed on the project site. • The height of the tallest object on the project site is anticipated to be approximately 35 feet above ground level, which equates to approximately 235 feet.above mean sea level. ■ Butte County Airport Land Use Commission ■ ALUC File No. A 06-17 (Coastal View Construction) ■ ■ May 17, 2006 ■ Page 1 of 8 ■ C ANALYSIS: • This project is a major land use action as defined by Policy 1.5.3 of the 2000 Butte County Airport Land Use Compatibility Plan (ALUCP). • The project site lies within Airport Compatibility Zone B2 (Extended Approach/Departure Zone). • The primary compatibility criteria for the B2 Airport Compatibility Zone are shown on the . following table: Compatibility Zoie Criteria Maximum Densities Req'd Other Development Zone Open .Prohibited Uses Conditions Residential Land (du/ac)' Children's schools, Minimum NLR* of 25 day care center, dB in residences < 0.2 (average libraries, hospitals, (including mobile B2 (Extended ^Approach/Departure — parcel size > 5.0 o 20% iursing homes, homes) and buildings. acres) highly noise- with noise sensitive Zone) sensitive uses, issues, airspace review Lazards to flight for objects >70 feet tall, deed notice required - Extract from Table 2A of the 2000 ALUCP *NLR - Noise Level Reduction • The project site is approximately 0.25 miles west of the extended centerline of Runway 31R/13L of the Chico Municipal Airport, at a distance of 1.36 miles southwest of this runway. • Section 4.1.3 of the 2000 Butte County Airport Land Use Compatibility Plan states that the maximum noise level for residential uses in the vicinity of an airport is 55 dB CNEL, except for the area south of the Chico Municipal Airport, where a'60 dB CNEL noise maximum is acceptable. • The project site is not within the 55 dB CNEL noise contour as shown on Exhibit 4E (Noise Impacts — Future Average Fire Season Day) but is within the 55dB CNEL noise contour as shown on Exhibits 4F (Noise Impacts — Expanded Forecast) and 4G (Noise Impacts — Peak Fire Attack Day) of the 2000 Butte County Airport Land Use Compatibility Plan. • Pursuant to Section 4.1.5(a) of the 2000 Butte County Airport Land Use Compatibility Plan, staff recommends that all dwellings on the project site be designed and constructed to achieve a maximum interior noise level of 45 dB CNEL. • ' The project would result in up to 10 multi -family dwellings and 13 single-family dwellings on 2.33 acres, which will result in a density of up to 9.87 dwelling units per acre. This density is not consistent with the B2 Airport Compatibility Zone, which requires 0.2 dwelling units or less per acre (minimum parcel size of 5 acres or larger). ■ Butte County Airport Land Use Commission ■ ALUC File No A 06-17 (Coastal View Construction) ■ ■ May 17, 2006 ■ Page 2 of 8 ■ , • The proposed project density (9.87 du/ac) is consistent with the infill requirement based on ' the highest surrounding density within 500 feet is'a four -plea located on APN 007-290-039. The parcel size is 0.20 acres and has a density of 20.0 du/ac (4 du/0.2 ac). it • The project site meets the criteria for infill development of Section 2.4.4(a)(3) of the 2000 Butte County Airport Land Use Compatibility Plari because it is 5 acres or less in size (2.33 acres), qualifies as infill development pursuant to Section 15332 of the California Environmental Quality Act, and the density of the project (9.87 du/ac) would be less than higher density (10+ dwelling units per acre) of the existing residential developments within 500'feet of the project site, which include triplexes'and duplexes on parcels sizes of 0.2 acres (10.0 du/ac). ENVIRONMENTAL DOCUMENTATION: No environmental documentation has been completed for this project by ALUC staff. Your Commission's review of the proposed project and determination of consistency is not a "project" under the California Environmental Quality Act. Determination of environmental review will be completed during the process of the Tentative Subdi'vision Map by the City of Chico. It is expected that a Class 32 categorical exemption for in -fill development (Section 15332 of the CEQA Guidelines) will be the environmental determination for the proposed project. RECOMMENDATION: Staff recommends that the Butte County Airport Land Use Commission find ALUC File No. A 06-17 (Coastal View Construction) is consistent with the infill development policy of Section 2.4.4 of the 2000 Butte County Airport Land Use Compatibility Plan. EXHIBIT A BUTTE COUNTY AIRPORT LAND USE COMMISSION CONSISTENCY FINDINGS FOR ALUC File No. A 06-17 —Coastal View Construction — Tentative Subdivision, APN 007-120-034: The Airport Land Use Commission (ALUC) has prepared the following findings based on data contained in the 2000 Butte County Airport Land Use Compatibility Plan (ALUCP), as well as site specific information submitted by the applicant and ALUC staff. The following findings have been prepared at the direction of the ALUC and are for the consideration of the Lead Agency (City of Chico) when making a decision on the project. SECTION 1: ENVIRONMENTAL FINDINGS A. No environmental documentation has been completed for this project by ALUC staff. Your Commission's review of the proposed project and determination of consistency is not a "project" under the California Environmental Quality Act. Determination of environmental review' will be completed during the process of the Tentative Subdivision Map by the City of Chico. It is expected that a Class 32 categorical exemption for in -fill development (Section 15332 of the CEQA Guidelines) will be the environmental determination for the proposed project. SECTION 2: CONSISTENCY FINDINGS FOR PROPOSED PROJECT A. The proposal for the Coastal View Construction Tentative Subdivision with 13 single-family lots and 3 multiple residential lots 2.33 acres, which will result in a density of 9.87 dwelling units per acre, which is consistent with the infill development criteria of Section 2.4.4(a)(3) of the 2000 Butte County Airport Land Use Compatibility Plan. B. The project site meets the criteria for infill development of Section 2.4.4(a)(3) because: 1. The project site is 5 acres or less in size 2. The Multi -Family project qualifies as infill development pursuant to the California Environmental Quality' Act 3. The density of the project, at 9.87 units per acre, would be less than the density of the highest existing residential development within 500 feet of the project site, which is 20.0 units per acre (APN 007-290-039). 4. The project site is shown on the City of Chico's infill development map, as approved by the Butte County Airport Land Use Commission on March 16, 2005. C. No structures on the project site would extend into protected airspace. D. All dwellings on the project are required to be designed and constructed to have a maximum interior noise level of 45 dB CNEL or less in order to prevent significant aircraft -related noise impacts.' ■ Butte County Airport Land Use Commission ■ ALUC File No. A 06-17 (Coastal View Construction) ■ ■ May 17, 2006 ■ Page 4 of 8 ■ SECTION 4: PROJECT CONDITIONS.: 1. City of Chico Planning Division 411 Main Street Chico, CA 95928 Re': Modification of projects A 06-17 Harold P. Cramer Subdivision (APN 015-120-034) and A•06-21 'Phomas -Hawes Subdivision (APN 015-_20-033). Greg, On May 17, 2006, the Airport Land Use Commission (ALUC) found project A 06-17 to be consistent and on July 19, 2006, the Airport Land Use Commission (ALUC) found project A 06-21 to be consistent. Both of the projects were subject to the same five conditions which would still apply to the modified subdivision. 1. Provide a deed notice for the sale of all resulting lots notifying purchasers of the. proximity of the airport and the potential for possible noise -related impacts in an ALUC-approved disclosure notice. 2. Prior to the recordation of the Final Map record as a separate instrument an Avigation Easement granting the right of continued use of the airspace above the proposed parcels by the Chico Municipal Airport and acknowledging any and all existing or potential airport operational impacts. 3. Place a note on a separate document which. is to be recorded concurrently with the final map or on an additional map sheet that states:- "An Avigation Easement is recorded above the parcels for the Chico Municipal Airport and acknowledging any and all existing or potential airport operational in -pacts." 4. Place a note on a separate document which is to be recorded concurrently with the final map or on an additional map sheet that states: "Airspace review by the Airport Land Use Commission is required for all objects over 100 feet in height in the C1 Compatibility Zone and 70 feet in height in the B2 Compatibility Zone." 5. Place a note on a separate document which is to be recorded concurrently with the final map or on an additional map sheet that states: "As a condition for the issuance of any Building Permit, a minimum interior noise level of 45 decibel (dB) or less is required for all residences." Based on the information provided to staff, the two applicants have proposed to modify their individual subdivisions and combine the projects. The revised map shows the total number of lots reducing from 33 to 24. The modified density (5.36 du/ac) would be less than what was proposed for the two individual projects,A 06-17 (9.87 du/ac) and A 06-21 (7.29 du/ac).'', Based on the modified project parcel(s) size (4.6 acres), the project will .still be consistent with the infill requirements of the Butte County Airport . Land Use Compatibility Plan on parcels of 5.0 acres or less. Staff determines thatthe modified project does not need to go before ALUC for consistency review. Should you have any questions regarding this matter, please contact Mark Michelena of this office at 538-7376, between 8:00 a.m. and 4:00 p.m., Monday through Friday. The project is divided'up into 13 single-family lots and 3 multiple residences lots for a total of up to 23 residences. • The property is within the incorporated limits of f -ie City of Chico. The project site is designated Office on the City of Chico General Pla--i Diagram and has a split -zone of OR (Office Residential) and R-1 (Low Density Residential). • Existing land uses within 500 feet of the project si`:e include a church, a worship center, professional office uses, multi -family and single family residential dwellings. • Thirteen (13) single family dwelling units are proposed for the R-1 portion of the parcel and ten (10) units (maximum) are proposed on the OR porion of the property by Use Permit. • No open space is proposed on the project site. • The height of the tallest object on the project site is anticipated to be approximately 35 feet above ground level, which equates to approximately 22.5 feet above mean sea level. ■ Butte County Airport Land Use Commission ■ ALUC File No. A 06-17 (Coastal View Construction) ■ ■ May 17, 2006 ■ Page i of S ■ ANALYSIS: • This project is.a major land use action as defined'by Policy 1.5.3 of the 2000 Butte County Airport Land Use Compatibility Plan (ALUCP). • The project site lies within Airport Compatibility. Zone B2 (Extended Approach/Departure Zone). • The primary compatibility criteria for the B2 Airport Compatibility Zone are shown on the following table: Compatibility Zane Criteria Maximum Densities Req'd Other Development Zone Open Prohibited Uses Conditions Residential Land (du/ac' Children's schools, Minimum NLR* of 25 day care center, dB in residences < 0.2 (average libraries, hospitals, (including mobile B2 (Extended — parcel size > 5.0 o 20% nursing homes, homes) and buildings Approach/Departure acres) highly noise- with noise sensitive . Zone) sensitive uses, issues, airspace review hazards to flight for objects >70 feet tall, deed notice required Extract from Table 2A of the 2000 ALUCP *NLR - Nose Level Reduction • The project site is approximately 0.25 miles we3t of the extended centerline of Runway 31R/13L of the Chico Municipal Airport, at a distance of 1.36 miles southwest of this runway. • Section 4.1.3 of the 2000 Butte County Airport Land Use Compatibility Plan states that the maximum noise level for residential uses in the vicinity of an airport is 55 dB CNEL, except for the area south of the Chico Municipal Airport, where a 60 dB CNEL noise maximum is acceptable. • The project site is not within the 55 dB CNEL noise contour as shown on Exhibit 4E (Noise Impacts — Future Average Fire Season Day) but is within the 55dB CNEL, noise contour as shown on Exhibits 4F (Noise Impacts - Expander Forecast) and 4G (Noise Impacts — Peak Fire Attack Day) of the 2000 Butte County Airport Land Use Compatibility Plan. • Pursuant to Section 4.1.5(a) of the 2000 Butte CoLnty Airport Land Use Compatibility Plan, staff recommends that all dwellings on the pro-ect site be designed and constructed to achieve a maximum interior noise level of 45 dB CNEL. • The project would result in up to 10 multi -family dwellings and 13 single-family dwellings on 2.33 acres, which will result in a density of up to 9.87 dwelling units per acre. This density is not consistent with the, B2 Airport Compatibility Zone, which requires 0.2 dwelling units or less per acre (minimum parcel size of 5 acres or larger). ■ Butte County Airport Land Use Commission ■ ALUC File No. A 06-17 (Coastal View Construction) ■ ■ May 17, 2006 ■ Page of 8 ■ . • The proposed project density (9.87 du/ac) is cons stent with the infill requirement based on the highest surrounding density within 500 feet is :a four-plex `located on APN 007-290-039. The parcel size is 0.20 acres and has a density of 20.0 du/ac (4 du/0.2 ac). • The project site meets the criteria for infill development of Section 2.4.4(a)(3) of the 2000 Butte County Airport Land Use Compatibility Plan because it is 5 acres or less in size (2.33 acres), qualifies as infill development pursuant to Section 15332 of the California Environmental Quality Act, and the density of the project (9.87 du/ac) would be less than higher density (10+ dwelling units per acre) of th,- existing residential developments within 500 feet of the project site, which include triplexes and duplexes on parcels sizes of 0.2. acres (10.0 du/ac). ENVIRONMENTAL DOCUMENTATION: No environmental documentation has been completed for this project by ALUC staff. Your Commission's review of the proposed project and determination of consistency is not a "project" under the California Environmental Quality Act. Determination of environmental review will be completed during the process of the Tentative Subcfivision Map by the City of Chico. It is expected that a Class 32 categorical exemption for in -fill development (Section 15332 of the CEQA Guidelines) will be the environmental determir-ation for the proposed project. The .following findings have been prepared at the 'direction of the ALUC and are for the consideration of the Lead Agency (City of Chico) when making a decision on the project. SECTION 1: ENVIRONMENTAL FINDINGS A. No environmental documentation has been completed for this project by ALUC staff. Your Commission's review of the proposed project and determination of consistency is not a "project" under the California Environmental Quality Act. Determination of environmental review will be completed during the process of the Tentative Subdivision Map by the City of Chico. It is expected that a Class 32 categorical exemption for in -fill development (Section 15332 of the CEQA Guidelines) will be the environmental determination for the proposed project. SECTION 2: CONSISTENCY FINDINGS FOR PROPOSED PROJECT A. The proposal for the Coastal. View Construction Tentative Subdivision with '13 single-family lots and 3 multiple residential lots 2.33 acres, which will result in a density of 9.87 dwelling units per acre, which is consistent with the infill development criteria of Section 2.4.4(a)(3) of the 2000 Butte County Airport Land Use Compatibility Plan. B. The project site meets the criteria for infill development of Section 2.4.4(a)(3) because: 1. The project site is 5 acres or less in size 2. The Multi -Family project qualifies as infill development pursuant to the California Environmental Quality Act 3. D. Agenda Item E.3 ALUC File No. A 06-17 — Coastal View Construction — Tentative Subdivision u Map, APN 015-120-034-, A consistency review for a proposed. 16 lot residential subdivision. The parcel is located within Compatibility Zone B2. of the Chico Municipal Airport. The project site is located on the east side of Cohasset Road, approximately 150 feet north of Cameo Drive, in the City of Chico. r `' $ "Mr. Michelena gave a brief summary of tfie project. Commissioner Crabb had a correction on,Page 5, Condition 2, of the report to change "Oroville Municipal Airport" to "Chico Municipal Airport." r Commissioner Rosene-asked regarding the 45 dB standard, what type of construction is that. -Mr. Michelena said it was his understanding that this is a standard inside level that is required on , normal on houses per the building code. Commissioner Rosene said at -the density proposed he sees the buildings as 2 x 4 slab construction ` and he questioned if they will be able to meet the 45 dB requirement.' He said the area was noisy. He said he wanted to know that the building code can be met. _ Mr. Michelena said he would look into the code section to make sure. He discussed making this a finding instead of a condition if it is covered in the Building Code. The hearing was opened to the public. <, Doug Starr said he was there to answer questions. He said houses today are built almost air tight. , Chairman Hennigan suggested changing the condition to say noise reduction to 45 dB. He said most , complaints are a perception of noise. ? Mr. Starr said the airport location will be disclosed at the time the property sells. He said he believes in full disclosure. The hearing was closed and comments confined.to the Commission and staff. It was moved by Commissioner Crabb, seconded by Commissioner Harp, and unanimously carried to find ALUC File No. A06-17 for Coastal View Construction. consistent with the infill development policy of Section 2.4.4 of the 2000 Butte County Airport Land Use Compatibility Plan subject to the following findings and conditions, changing Condition 2 to say "Chico" instead of "Oroville": EXHIBIT A BUTTE' COUNTY AIRPORT LAND USE COMMISSION CONSISTENCY FINDINGS FOR ALUC File No. A 06-17 —Coastal View Construction — Tentative Subdivision, APN 007-120-034: .. _ ■`Airport' M1Use=Coo m sion`■*Minute of Mating of;lVlay,17200 Page 8 ■ "= •".'.rt¢ - " r- . -y . n Lr n. . `-' '+;-.rr.rt `--Y".'K"'r1" "..,,.t,.i': •.i+ti •r•.e4-+^v,'..tl-r'"\ " r .1• .. ,R f .. r 3 ,,""..:f•,'.r,a, ,.p+..-- y„ ,..f r •a. -f...., .f.":.,s,C-•,.ti,,,, I The Airport Land Use Commission (ALUC) has prepared the following findings based'on data contained in the 2000 Butte County Airport Land Use Compatibility Plan (ALUCP), as well as site specific information submitted by the applicant and ALUC staff. The following findings have been prepared at the direction of the ALUC and are for the consideration' : of the.Lead Agency (City of Chico) when making a decision on iheproject. ' SECTION 1':- ENVIRONMENTAL FINDINGS , A. No environmental documentation has been completed for, this project by ALUC staff. , Your Commission's review of the proposed project and determination`of consistency: is not a "project" under the California Environmental Quality Act. Determination of environmental review will be completed during the process of 'the Tentative Subdivision Map by the City'of Chico.. It is expected that a Class 732 categorical " exemption for in -fill development (Section 15332 of the CEQA Guidelines) will be the environmental determination for the proposed project. .t . SECTION 2: CONSISTENCY FINDINGS FOR PROPOSED PROJECT ' A. The proposal for the Coastal View Construction Tentative Subdivision with 13 single- r - - family lots and 3 multiple residential lots 2.33 acres, which will result in a density of, - 9.87 dwelling units per acre, which is consistent with the infill development criteria of t Section 2.4.4(a)(3) of the 2000 Butte County Airport Land Use Compatibility Plan. B. The project site meets the criteria for infill development of Section 2.4.4(a)(3) because: 1. The project site is 5 acres or less in size 2.• The Multi -Family project •qualifies as infill development pursuant to -the ' - t California Environmental Quality Act - •3. The density of the project, at 9.87 units per acre, would be less than the density of the highest existing residential development within 500 feet of the project site, which is 20.0 units per acre (APN 007-290-039). ' y -4. The project site is shown on the City of Chico's in development map,`as. • approved by the Butte County Airport Land Use Commission jon March 16,, 2005. r C. No structures on the project site would extend into protected airspace. D. All dwellings on the project are required to be designed and constructed to have a maximum interior noise level of 45 dB CNEL, or less in order to prevent significant ' aircraft -related noise impacts.
