041 (was 048-810-041): A consistency review for the proposed, Hannah's Court
Vesting Tentative Subdivision Map (S O4-18); which would crec-te five residential
parcels on 1.09 acres. The project site is located on the east :ide of Ceanothus
Avenue, approximately 115 feet south of Sale Avenue and 250 feet north of
Brenni Way, northeast Chico area.
SUMMARY:
Staff recommends that ALUC find the project consistent with the 2000 Airport . Land Use'
Compatibility Plan for the Chico Municipal Airport.
BACKGROUND:
• The property is 1.09 acres in size and is currently developed with an exis=ing dwelling and
accessory structure, both to be removed. Surrounding uses include commercial to the west
and south, and residential to the north and east. 4.
• The property is within the incorporated limits of the City of Chico. The project area is
designated Low Density Residential on the City of Chico General Plan Diagram and is zoned
R1 — Low Density Residential.
• Five parcels are proposed ranging in size from 5,226 square feet (0.12 ac) to 9,372 square
feet (0.21, ac). Proposed uses are single family dwellings.
• The height of the tallest object on the project site (including antennas and trees) is not
anticipated to be higher than 100 feet above ground level. Current City height maximum for
a residential dwelling is 35 feet in the R1 Zone
• The project site is located approximately 2.2 miles southeast of runway 31RJ13L of the
Chico Municipal Airport and is located approximately 2,900 feet (0.55 miles) east of the
' extended runway centerline.

• The project site is within Airport Compatibility Zone C (Traffic Pattern)
• The project site is outside the 55 dB CNEL noise contour.
ANALYSIS:
• This project is a major land use action as defined by Policy 1.5.3 of the 2D00 Butte County
Airport Land Use Compatibility Plan (ALUCP).
• The primary criteria for Compatibility Zone C are shown on the following table:

1. Residential development should not contain more than the indicated number of dwelling units (both primary and secondary) per gross
acre. With clustering, some parcels may be much smaller than the others as long as the maximum over0l density criterion is not
exceeded. Clustering of units is encouraged in Compatibility Zones B2 and C — see Policy 4.2.6 for limitations
• The project would result in five parcels, which is a density of 4.6 dwelling units per acre
(with an average parcel size of 0.22 acres). The density and parcel sizes are consistent with
Compatibility Zone C.
ENVIRONMENTAL DOCUMENTATION:
No environmental documentation has been completed for this project.
RECOMMENDATION:
Staff recommends that the Butte County Airport Land Use Commission find ALUC File No.
A05-06 Stephen and Tracy Clark (Agasy, Inc.) consistent with the 2000 Airport Land Use
Compatibility Plan for the Chico Municipal Airport.

CONSISTENCY FINDINGS FOR ALUC File No. 05-06 (STEPHEN AND TRACY
CLARK, APN 016-100-041 (was 048-810-041):
The Airport Land Use Commission (ALUC) has prepared the following findings based on data
contained in the 2000 Airport Land Use Compatibility Plan (ALUCP) for the Chico Municipal
Airport, as well as site specific information submitted by the applicant and ALUC staff.
The following findings have been prepared at the direction of the ALUC and are for the
consideration of the Lead Agency (City of Chico) when making a decision on the project.
SECTION 1: ENVIRONMENTAL FINDINGS
A. No environmental documentation was submitted at the time of project review
SECTION 2: CONSISTENCY FINDINGS FOR PROPOSED PROJECT
A. The proposal for the Hannah's Court Vesting Tentative Subdivision Map (S" 04-
07), which would create five residential parcels on 1.09 acres, is consistent with
Compatibility Zone C as found in the 2000 Airport Land Use Compatibility Plan
for the Chico Municipal Airport.
SECTION 3: PROJECT FINDINGS:
A. The project site is located in Airport Compatibility Zone C as listed in the 2000.
Airport Land Use Compatibility Plan for the Chico Municipal Airport.
B. The project is consistent with Compatibility Zone C because the average number
of parcels is greater than four (4) per acre.
C. No structures on the project site would extend into protected airspace.
E. The project site is outside of the 55 dB CNEL noise contour.
SECTION 4: PROJECT CONDITIONS:
1. Provide a deed notice for the sale of all resulting lots notifying purchasers of the ,
proximity of the airport and the potential for possible noise related impacts in an
ALUC-approved disclosure notice.
2. Airspace review by the Airport Land Use Commission required for objects more
than 100 feet tall.

With this letter, the City of Chico Planning Division is forwarding a Butte County Airport Land Use
Commission (ALUC) application for consistency findings for the above -noted project. Enclosed with the
application are a check in the amount of $1.,531..00, 24 copies of a.location map, the subdivision map, and
the compatibility zone map that identifies the project site as within the boundaries of Gone C.
The application consists of a.vesting tentative subdivision map to create 5 single-family residential
parcels on 1.09 acres located on the east side of Ceanothus Avenue, approximately 11 feet south of Sale
Avenue and 250 feet north of Brenni Way, Assessor's Parcel No. 016-100-041. The proposed project
density is 4.59 units per acre, and proposed lot sizes range from 5,226 to 9,372 square Meet. The property
is designated Low Density Residential in the General Plan, and is located in an R1 Low Density
Residential zoning district. The General Plan designation and zoning district allow single-family
residential development at densities between 2.01 and 6 units per acre. The project is Categorically
Exempt from environmental review pursuant to Section 15332 (In -Fill Development R-ojects) of the
California Environmental Quality Act (CEQA). The project is also consistent with the General .Plan
designation and zoning for the area.
Because of the project's consistency with the provisions of Zone C, which allows cither lots five
acres or larger or residential development at densities over four' units per acre, w+e would
appreciate a staff determination that it need not proceed to ALUC. In the event that staff
determines otherwise, please schedule this item for the January 2005 ALUC meei:ing.
