With this letter, the City of Chico Planning Services Department refers the captioned project to .
the Butte County Airport Land Use Commission (ALUC) for a consistency determination with
the ALUC Plan. Enclosed are the completed application, a check for $1689.00, a location map
showing the 2000 compatibility zones at the Chico Municipal Airport and identifying the project
site as within the boundaries of Zone C, and the 24 required site plans.
The project consists of a proposal to divide three -parcels totaling 2.27 acres into 14 parcels,
averaging a net of 4,779 square feet (sf), and ranging from 3,509 sf (Parcel 5) to 7,424 sf (Parcel
11). The project would result in a gross density of 6.17 units per acre and an average gross parcel
size of 0.16 acres. The project is located within the boundaries of Chico Municipal Airport
Compatibility Zone C.

consistency review for a proposed Vesting Tentative Subdivision Map (VTSM),
which would divide three parcels with a total of approximately 2.27 acres into 14
single-family residential lots. The project site is located on the southwest corner of
Ceanothus Avenue and Skywalker Court, at 2615 and 2631 Ceanothus Avenue,
Chico.
SUMMARY:
The project proposes a vesting tentative subdivision map to divide three parcels totaling
approximately 2.27 acres into 14 single-family lots. The project parcel is located within the C
Compatibility .Zone of the Chico Municipal Airport. Staff recommends that ALUC find the
proposed subdivision consistent with the 2000 Butte County Airport Land Use Compatibility
Plan for the Chico Municipal Airport.
BACKGROUND:
• A portion of this project was presented to Airport Commission back on January 17, 2007. It
was ALUC06-0003 on APN 016-060-058 and' 065. It was for 9 lots on 1.4 acres. The
Commission found it consistent. The previous agenda report is attached as Exhibit E and the
minutes of January 17, 2007 are attached as Exhibit F.
• The current project proposes to use the original VTSM lot configuration and add five
additional lots on APN 016-060-057.
• The project parcels total approximately 2.27 acres and are developed with five structures
(including four single-family dwellings), all of which are proposed for removal.
• The property is located in the City of Chico and is zoned R-1.
• The proposed subdivision map would create 14 single-family residential lots with a gross
density of approximately 6.17 dwelling units per acre.
• Parcel sizes range from 3,509 square feet to 7,424 square feet.

• The height of the tallest object on the project site is anticipated to be approximately 24 feet
above ground level, which equates to approximately 254 feet above mean sea level.
ANALYSIS:
• The project site is located approximately 2.29 miles southeast and 0.40 miles to the east of
the extended centerline of runway 13L -31R.
• The project site is within Airport Compatibility Zone C (Traffic Pattern).
• This project is a major land use action as defined by Policy 1.5.3 of the 2000 Butte County
Airport Land Use Compatibility Plan (ALUCP).
• The primary compatibility criteria for the C Compatibility Zone is shown on the following
table:

• The 10% open space requirement of the project, while not being set aside on the site, is met
by the 26%+ agriculturally zoned area discussed above. While not an ideal open space area,
Pleasant Valley High School open field area is located approximately 1,600 feet to the south.
ENVIRONMENTAL DOCUMENTATION:
No environmental documentation has been completed for this project by ALUC staff. Your
Commission's review of the proposed project and determination of consistency is not a "project"
under the California Environmental Quality Act. Determination of environmental review will be
completed during the process of the Vesting Tentative Subdivision Map by the City of Chico.
RECOMMENDATION:
Staff recommends that the Butte County Airport Land Use Commission find ALUC File No.
ALUC07-0005 (Mariposa Vista, Inc. — Martha's Vineyard Vesting Tentative Subdivision Map)
consistent with the 2000 Airport Land Use Compatibility Plan for the Chico Municipal Airport,
subject to the recommended conditions.

CONSISTENCY FINDINGS FOR:

The Airport Land Use Commission (ALUC) has prepared the following findings based on data
contained in the 2000 Airport Land Use Compatibility Plan (ALUCP) for the Chico Municipal
Airport, as well as site specific information submitted by the applicant and ALUC staff.
The following findings have been prepared at the direction of the ALUC and are for the
consideration of the Lead Agency (Butte County) when making a decision on the project.
SECTION 1: ENVIRONMENTAL FINDINGS
A. No environmental documentation has been completed for this project by ALUC
staff. Your Commission's review of the proposed project and determination of
consistency is not a "project" under the California Environmental Quality Act.
Determination of environmental review will be completed during the process of
the Vesting Tentative Subdivision Map by the City of Chico.
SECTION 2: CONSISTENCY FINDINGS FOR PROPOSED PROJECT
A. The proposed 9 residential dwellings, at a density of 6.17 dwelling units per acre,
are consistent with Compatibility Zone C.
B. Approximately 1,490 acres (26%) of the 5,560 acres in the C Compatibility Zone
are zoned as Agricultural 20 -acre minimum parcel size or larger and used mostly
as grazing land.
C. Based on the project size (2.27 acres), surrounding development density (single-
family dwellings, commercial uses, and existing structures and trees on the
project parcels, the site is not conducive to meet the minimum open space
requirement.
D. The project site is outside of the 55 dB CNEL noise contour. The project site is
not within the 55 dB CNEL noise contour as shown on Exhibit 4E (Noise Impacts
— Future Average Fire Season Day), Exhibit 4F (Noise Impacts — Expanded
Forecast) and Exhibit 4G (Noise Impacts — Peak Fire Attack Day) of the 2000
Butte County Airport Land Use Compatibility Plan.
SECTION 3: PROJECT CONDITIONS:
Record an Airport Proximity of Acknowledgement notice notifying purchasers of
the proximity of the airport and the potential for possible noise related impacts in
an ALUC-approved disclosure notice.

2. Place a note on a separate document which is to be recorded concurrently with the
final map or on an additional map sheet that states: "Airspace review by the
Airport Land Use Commission is required for all objects over 100 feet in height."
3. Prior to the recordation of the Final Map record as a separate instrument an
Avigation Easement granting the right of continued use of the airspace above the
proposed parcels by the Chico Municipal Airport and acknowledging any and all
existing or potential airport operational impacts.
4. Place a note on a separate document which is to be recorded concurrently with the
final map or on an additional map sheet that states: "An Avigation Easement is
recorded above the parcels for the Chico Municipal Airport and acknowledging
any and all existing or potential airport operational impacts."

ITEM: ALUC File No. ALUC06-0003, Martha Claudico (Martha's Vinyard Vesting
Tentative Subdivision Map), APN 016-060-058 and 016-060-065: A consistency
review for a proposed Vesting Tentative Subdivision Map, which would divide two
parcels with a total of approximately 1.4 acres into 9 single-family residential lots.
The project site is located on the southwest corner of Ceanothus Avenue and
Skywalker Court, at 2615 and 2631 Ceanothus Avenue, Chico.
SUMMARY:
The project proposes a vesting tentative subdivision map to divide two parcels; totaling
approximately 1.4 acres into 9 single-family lots. The project parcel is located within'the C
Compatibility Zone of the Chico Municipal Airport. Staff recommends that ALUC find the
proposed subdivision consistent with the 2000 Butte County Airport Land Use Compatibility
Plan for the Chico Municipal Airport.
BACKGROUND:
• The project parcels total approximately 1.4 acres and are developed with three structures
(including two single-family dwellings), which are all proposed for removal.
• The property is located in the City of Chico and is zoned R -l.
• The proposed subdivision map would create 9 single-family residential lots with a density of
approximately 6.4 dwelling units per acre.
• Parcel sizes range from 4,239 square feet to 9,150 square feet.
• The height of the tallest object on the project site is anticipated to be approximately 35 feet
above ground level, which equates to approximately 265 feet above mean sea level.
ANALYSIS:
• The project site is located approximately 2.29 miles southeast and 0.40 miles to the east of
the extended centerline of runway 13L -31R.

• The project site is within Airport Compatibility Zone C (Traffic Pattern).
This project is a major land use action as defined by Policy 1.5.3 of the 2000 Butte County
Airport Land Use Compatibility Plan (ALUCP).

• Proposed use:
• The residential density of 6.4 dwelling units per acre of the project is consistent with Airport
Compatibility Zone C.
• The project site is not within the 55 dB CNEL noise contour as shown on Exhibit 4E (Noise
Impacts — Future Average Fire Season Day), Exhibit 4F (Noise Impacts —' Expanded
Forecast) and Exhibit 4G (Noise Impacts — Peak Fire Attack Day) of the 2000 Butte County
Airport Land Use Compatibility Plan.
• Open space requirements are based on the ALUCP are for an entire Compatibility Zone. The
C Compatibility Zone requires 10% open space. There are approximately 5,560 acres in the
C Compatibility Zone. Of that area, over 26% (1,490 acres) is zoned as Agricultural 20 -acre
minimum parcel size or larger.
• Based on the project size (1.4 acres), surrounding development density (single-family
dwellings), commercial uses, and existing structures and trees on the project parcels, the site
is not conducive to meet the minimum open space requirement (0.14 acres — 6,098 square
feet).
• The 10% open space requirement of the project, while not being set aside on the site, is met
by the 26%+ agriculturally zoned area discussed above. While not an ideal open space area,
Pleasant Valley High School open field area is located approximately 1,600 feet to the south.

CONSISTENCY FINDINGS FOR:

The Airport Land Use Commission (ALUC) has prepared the following findings based on data
contained in the 2000 Airport Land Use Compatibility Plan (ALUCP) for the Chico Municipal
Airport, as well as site specific information submitted by the applicant and ALUC staff.
The following findings have been prepared at the direction of the ALUC and are for the
consideration of the Lead Agency (Butte County) when making a decision on the project.
SECTION 1: ENVIRONMENTAL FINDINGS
A. No environmental documentation has been completed for this project by ALUC
staff. Your Commission's review of the proposed project and determination of
consistency is not a "project" under the California Environmental Quality Act.
Determination of environmental review will be completed during the process of
the Vesting Tentative Subdivision Map by the City of Chico.
SECTION 2: CONSISTENCY FINDINGS FOR PROPOSED PROJECT
A. The proposed 9 residential dwellings, at a density of 6.4 dwelling units per acre,
are consistent with Compatibility Zone C.
B. Approximately 1,490 acres (26%) of the 5,560 acres in the C Compatibility Zone
are zoned as Agricultural 20 -acre minimum parcel size or larger and used mostly
as grazing land.
C. Based on the project size (1.4 acres), surrounding development density (single-
family dwellings, commercial uses, and existing structures and trees on the
project parcels, the site is not conducive to meet the minimum open space
requirement.
D. The project site is outside of the 55 dB CNEL noise contour. The project site is
not within the 55 dB CNEL noise contour as shown on Exhibit 4E (Noise Impacts
— Future Average Fire Season Day), Exhibit 4F (Noise Impacts — Expanded
Forecast) and Exhibit 4G (Noise Impacts — Peak Fire Attack Day) of the 2000
Butte County Airport Land Use Compatibility Plan.
SECTION 3: PROJECT CONDITIONS:
1. Provide a deed notice for the sale of all resulting lots notifying purchasers of the
proximity of the airport and the potential for possible noise related impacts in an
ALUC-approved disclosure notice.
2. Place a note on a separate document which is to be recorded concurrently with the

The June 21, 2006, and .July 19, 2006, minutes were continued to February 21, 2007, meeting due to
a lack of'a quorum of those needed to approve the minutes.
Staff said they are waiting to hear from County Counsel about amending the By -Laws to allow an
email vote or memo vote to approve the minutes in order to take an action.
The draft minutes are being proposed to be placed on the website.
Commissioner Teitelman was present at this time, 9:07 am.

Tentative Subdivision Man) APN 016-060-058 and 016-060-065: A consistency
review for a proposed Vesting Tentative Subdivision Map, which would divide two
parcels with a total of approximately 1.4 acres into 9 single-family residential lots..
The project site is located on the southwest corner of Ceanothus Avenue and
Skywalker Court, at 2615 and 2631 Ceanothus Avenue, Chico.
Mark Michelena gave a summary of the project.
Commissioner Teitelman asked for verification of the parcel size.

Mr. Michelena confirmed that the combined parcel size of both parcels is 1.4 acres.
Commissioner Teitehnan commented that he thought the project would be considered an infill.
Mr'. Michelena replied that it would be considered infill for the City, but for ALUC they did not
differentiate between infill and non -infill. The Open Space Committee may want to look into an
amendment to the CLUP that would provide exceptions to the open space due to existing parcel size
and surrounding uses.
Commissioner Teitelman stated that staff was not using the infill designation for 5 -acre or less
parcels..
Mr. Michelena responded that staff did not use the term infill for those small parcels. There was a
brief discussion on the infill designation and applicability of the open space requirement.

the City of Oroville pre -zoning for eight parcels totaling approximately 30.61 acres within
the C Compatibility Zone of the Oroville Municipal Airport. The purpose of the
application is future -annexation to the City of Oroville and development of residential
parcels. The project parcels are located east of 18`x' Street, north of Feather Avenue and
the south of Grand Avenue, Thernialito.
Mark Michelena corrected the Agenda Report as follows: the project size is 30.61 acres not 32.6 and
handed out a revised page 2. He then gave a summary of the project.
Acting Chairman Harp asked what `prezoning' meant.
Commissioner Teitehnan responded that since the subject property is in the County.jurisdiction and is
in the process of being annexed that it must come before the ALUC as a `prezone' application, and
once the property is annexed then the prezone will become the zone designation for the City of
Oroville.
There was a brief discussion on the prezone and how the City of Oroville accepts the annexation and
zoning after approval by the ALUC.
