' Commissioner Lundy asked staff to explain the deed notice condition and where it shows up later or;. Mr. Baker said it would appear on the land record and would show up,during a title search. He said A •as part of the review before issuing a building permit, staff is going back and researching mitigations, conditions, and encumbrances, and to include any avigation easement that is on file or is supposed to be filed. He said the deed will not appear on the title report. j Commissioner Lundy said a recorded easement would show up on the deed, and this is where he' is. r not seeing the note. n , 'Commissioner Hennigan said that•only about one percent of the land in Butte County is affected by ' the airports. He said they have only been putting avigation easement on projects for a few years. He •. - said only a small percentage of the one percent has changed hands while this has been a requirement. He stated that the County has not been good about recording these easements. - Commissioner Sherman discussed jurisdictions, stating that ALUC may find a project consistent, but ; the building permits are issued by the City. . `Chairman Harp asked if the applicant has to change their zoning to a PUD. a Mr. Breedon said it ,is his understanding that the applicant has,to apply for a PUD' zoning to go: �., beyond what the General Plan allows., Commissioner Hennigan commented 'that if there is, a substantial change to the project, it should come back before ALUC for further review. Mr. Baker suggested changing "Substantial' to "Any changes need to be submitted to staff to make the determination whether the change is substantial or not." Commissioner Sherman understood the change and agreed. She said she would like to see this as a standard condition and maybe this should be a separate motion for future projects. The motion was made subject to the findings and conditions listed below. SECTION 1: ENVIRONMENTAL FINDINGS A. No environmental documentation was submitted at the time of project review. SECTION 2: CONSISTENCY FINDINGS FOR PROPOSED PROJECT A. The proposal for the Monarch Park Vesting Tentative Subdivision Map, to divide a 2.52 -acre parcel into 18 single-family residential lots, is consistent with Compatibility Zone C as found in the 2000 Airport Land Use Compatibility Plan for the Chico Municipal Airport. SECTION 3: PROJECT FINDINGS: A. The project site is located in Airport Compatibility Zones C as listed in the 2000 Airport Land Use Compatibility Plan for the Chico Municipal Airport. B. The residential density of the project is consistent with Airport Compatibility Zone C because the density of the project would be greater than 4 dwelling,units per acre. SECTION 4: PROJECT CONDITIONS: 1. Provide a deed notice for the sale of all resulting lots notifying purchasers of the proximity of the airport and the potential for possible noise related impacts in an ALUC approved disclosure notice. 2. Any change in the project must be submitted to the ALUC staff for determination whether additional ALUC review is required based on the criteria that the change be substantial. A consistency review for the proposed Monarch Park Vesting Tentative Subdivision Map, which would divide a 2.52 -acre parcel into 18 single- family residential lots. SUMMARY: Staff recommends that ALUC find the project consistent with the 2000 Airport Land Use Compatibility Plan for the Chico Municipal Airport. BACKGROUND: 1. The property is developed with several existing single family residences, which will be removed for development of the subdivision. 2. The property is within the incorporated limits of the City of Chico and is zoned R-1 (Low Density Residential). 3. The City General Plan designation of Low Density Residential allows for residential densities up to 6 dwelling units per acre. 4. According to City staff, the applicant has applied for a Planned Unit Development and Development Agreement to allow for the additional density proposed under this subdivision. 5. The proposed subdivision map would create 18 single-family residential lots with a density of approximately 7.14 dwelling units per acre. - With the addition of the duplex unit on Lot #1 the density increases to 7.5 dwelling units per acre. 8. The average lot size for the proposed single-family lots is 5,752 square feet (gross) and 4,134 (net). 9. The project site is located approximately 2.3 miles southeast of runway 13L/31R of the Chico Municipal Airport, and is east of the extended runway centerline. 10. The project site is within Airport Compatibility Zone C (Traffic Pattern Zone). 11.
