036, -035. A consistency review for the proposed Monarch Park Vesting Tentative
Subdivision Map, .which would divide -a 2.52 -acre parcel into 18 single-family
residential lots., The project site is located on the west side of Ceanothus Avenue,
approximately 1,000 feet north of East Avenue, in the northeast Chico area. y '
Mr. Breedon gave a brief summary of the project. '
Commissioner Lundy asked staff to explain the deed notice condition and where it shows up later or;.
Mr. Baker said it would appear on the land record and would show up,during a title search. He said A
•as part of the review before issuing a building permit, staff is going back and researching mitigations,
conditions, and encumbrances, and to include any avigation easement that is on file or is supposed to
be filed. He said the deed will not appear on the title report.
j Commissioner Lundy said a recorded easement would show up on the deed, and this is where he' is.

'Commissioner Hennigan said that•only about one percent of the land in Butte County is affected by
' the airports. He said they have only been putting avigation easement on projects for a few years. He •.
- said only a small percentage of the one percent has changed hands while this has been a requirement.
He stated that the County has not been good about recording these easements. -
Commissioner Sherman discussed jurisdictions, stating that ALUC may find a project consistent, but ;
the building permits are issued by the City. .
`Chairman Harp asked if the applicant has to change their zoning to a PUD.
a Mr. Breedon said it ,is his understanding that the applicant has,to apply for a PUD' zoning to go:
�., beyond what the General Plan allows.,
Commissioner Hennigan commented 'that if there is, a substantial change to the project, it should
come back before ALUC for further review.
The hearing was opened to the public.

It was moved by Commissioner Sherman, seconded by Commissioner Hennigan.'and unanimously
carried to find ALUC File No. A04N-19 for the Monarch Park Vesting Tentative Subdivision Map,

adding a condition to state "Substantial changes in the project as described and reviewed may require
additional review by the Commission."
Mr. Baker suggested changing "Substantial' to "Any changes need to be submitted to staff to make
the determination whether the change is substantial or not."
Commissioner Sherman understood the change and agreed. She said she would like to see this as a
standard condition and maybe this should be a separate motion for future projects.
The motion was made subject to the findings and conditions listed below.
SECTION 1: ENVIRONMENTAL FINDINGS
A. No environmental documentation was submitted at the time of project review.
SECTION 2: CONSISTENCY FINDINGS FOR PROPOSED PROJECT
A. The proposal for the Monarch Park Vesting Tentative Subdivision Map, to divide a
2.52 -acre parcel into 18 single-family residential lots, is consistent with Compatibility
Zone C as found in the 2000 Airport Land Use Compatibility Plan for the Chico
Municipal Airport.
SECTION 3: PROJECT FINDINGS:
A. The project site is located in Airport Compatibility Zones C as listed in the 2000
Airport Land Use Compatibility Plan for the Chico Municipal Airport.
B. The residential density of the project is consistent with Airport Compatibility Zone C
because the density of the project would be greater than 4 dwelling,units per acre.
SECTION 4: PROJECT CONDITIONS:
1. Provide a deed notice for the sale of all resulting lots notifying purchasers of the
proximity of the airport and the potential for possible noise related impacts in an
ALUC approved disclosure notice.
2. Any change in the project must be submitted to the ALUC staff for determination
whether additional ALUC review is required based on the criteria that the change be
substantial.
It was moved by Commissioner Sherman, seconded by Commissioner Hennigan, and unanimously
carried to have staff include for all projects a condition that "Any change in the project must be
submitted to the ALUC staff for determination whether additional ALUC review is required based on
the criteria that the change be substantial."

029, -036, -035. A consistency review for the proposed Monarch Park Vesting
Tentative Subdivision Map, which would divide a 2.52 -acre parcel into 18 single-
family residential lots. The project site is located on the west side of Ceanothus
Avenue, approximately 1;000 feet north of East Avenue, in the northeast Chico
area.
SUMMARY:
Staff recommends that ALUC find the project consistent with the 2000 Airport Land Use
Compatibility Plan for the Chico Municipal Airport.
BACKGROUND:
1. The property is developed with several existing single family residences, which will be
removed for development of the subdivision.
2. The property is within the incorporated limits of the City of Chico and is zoned R-1 (Low
Density Residential).
3. The City General Plan designation of Low Density Residential allows for residential
densities up to 6 dwelling units per acre.
4. According to City staff, the applicant has applied for a Planned Unit Development and
Development Agreement to allow for the additional density proposed under this subdivision.
5. City staff indicates that Lot #1 of the subdivision will be developed with a duplex thus ,
` providing for a total of 19 dwelling units.
6. After reviewing the proposed subdivision map, City staff recommended changes and a

revised layout was provided by the applicant, which is attached.
7. The proposed subdivision map would create 18 single-family residential lots with a density
of approximately 7.14 dwelling units per acre. - With the addition of the duplex unit on Lot #1
the density increases to 7.5 dwelling units per acre.
8. The average lot size for the proposed single-family lots is 5,752 square feet (gross) and 4,134
(net).
9. The project site is located approximately 2.3 miles southeast of runway 13L/31R of the
Chico Municipal Airport, and is east of the extended runway centerline.
10. The project site is within Airport Compatibility Zone C (Traffic Pattern Zone).
11. Two categories of compatible residential densities exist in Zone C:
o C-1 —very low density (1 dwelling unit per 5 or more acres)
o C-2 — higher density (4 or more dwelling units per acre)
ANALYSIS:
1. This project is a major land use action as defined by Policy 1.5.3 of the 2000 Butte County
Airport Land Use Compatibility Plan (ALUCP).
2. The primary compatibility criteria for the C Compatibility Zone is shown on the following
table:

3. Projects located within Compatibility Zone C have the option of complying with the
Residential Density criteria in either the C-1 or C-2 Compatibility Zones.
4. The two -option criterion is based upon a determination that the intrusiveness of aircraft noise
is the most significant compatibility factor in Zone C; safety is only a minor concern. The
concept is that noise concerns can be minimized either by limiting the number of dwellings
in the affected area or by allowing high densities which tend to have comparatively high
ambient noise levels.

5. The proposed project, with a residential density of 7.5 dwelling units per acre, is consistent
with Compatibility Zone C-2 because the project would have a density greater than 4
dwellings per acre.
ENVIRONMENTAL DOCUMENTATION:
No environmental documentation has been completed for this project.
RECOMMENDATION:
Staff recommends that the Butte County Airport Land Use Commission find ALUC File No. A
04N-19 for the Monarch Park Vesting Tentative Subdivision Map, consistent with the 2000
Airport Land Use Compatibility Plan for the Chico Municipal Airport.

The Airport Land Use Commission (ALUC) has prepared the following findings based on data
contained in the 2000 Airport"Land Use Compatibility Plan (ALUCP) for the Chico Municipal
Airport, as well as site specific information submitted by the applicant and ALUC staff.
The following fmdings have been prepared at the direction of the ALUC and are for the
consideration of the Lead Agency (City of Chico) when making a decision on the project.
SECTION 1: ENVIRONMENTAL FINDINGS
A. No environmental documentation was submitted at the time of project review.
SECTION 2: CONSISTENCY FINDINGS FOR PROPOSED PROJECT
A. The proposal for the Monarch Park Vesting Tentative Subdivision Map, to divide
a 2.52 -acre parcel into 18 single-family residential lots, is consistent with
Compatibility Zone C as found in the 2000 Airport Land Use Compatibility Plan
for the Chico Municipal Airport.
SECTION 3: PROJECT FINDINGS:
A. The project site is located in Airport Compatibility Zones C as listed in the 2000
Airport Land Use Compatibility Plan for the Chico Municipal Airport.
B. The residential density of the project is consistent with Airport Compatibility
Zone C because the density of the project would be greater than 4 dwelling units
per acre.
SECTION 4: PROJECT CONDITIONS:
1.. Provide a deed notice for the sale of all resulting lots notifying purchasers of the
- proximity of the airport and the potential for possible noise related impacts in an
ALUC-approved disclosure notice.

With this letter, the City of Chico Planning Division is forwarding a Butte County Airport Land Use
Commission (ALUC) application for consistency findings for the captioned project. Enclosed are the
application and a check for $1,530. Also enclosed for your review are a location map, 24 copies of the
subdivision map, and a copy of the compatibility zone map which identifies the project site as within the
boundaries of Zone C.
The project consists of a tentative subdivision map to create 18 single-family residential lots on
approximately 2.52 acres. Based on the total number of units proposed (18), the project would result in a
density of approximately 7.4 units per acre. The average lot size is 5,752 square feet (s.£), and the lot sizes
range from 3,213 s.f. to 11,468 s.f. The property is located on Straight and Narrow Drive, off Ceanothus
Avenue, approximately 850 feet north of East Avenue. The property is identified as Assessor's Parcel Nos.
016-060-004, 029, 030, 034, 035, and 036. The subject area is designated Low Density Residential (2.01
to 6 dwelling units per acre) on the City of Chico General Plan Diagram and is zoned R1 Low Density
Residential. The applicant is proposing a Development Agreement to allow a project density that exceeds
7 units per acre (the 19 units proposed on the 18 lots equates to 7.5 units per acre). The project is consistent
with the General Plan designation and zoning for the area.
We would appreciate staffs assistance in either determining that this project does not need to proceed
to ALUC due to its consistency with the provisions of Zone C (which allows either lots five acres or
larger or residential development at densities over four units per acre), or, should it be deemed
necessary, scheduling this item for the next available ALUC meeting.
