The proposed land division project, Harmony Park Circle, subdivides 3.99 acres into 18 single
family residential lots ranging between 0.14 and 0.24 acres. Harmony Park Circle Subdivision is
located at 39945'53" N and 121°48'39"W in the State of California, County of Butte and City of
Chico—Project address, 2655 Cactus Ave., Chico, CA 95926. The residential =ots are arranged-
facing
rrangedfacing a "circular drive also connecting Cactus Avenue and Sedona Avenue. The project will be
completed in a single phase development and construction activities are expected to begin in the
summer of 2007, with anticipated completion in the fall of 2007.
Currently, and for the last 17 years the property has been used for horse grazing with one single
family residence occupying approximately 0.25 ac of the total. The pasture Ian& - contain various
non-native grasses. The existing residential services consist of phone, cable and power all being
served via overhead lines along Cactus Avenue. Water is provided by and on-site well. There is
an old agricultural well that was abandoned prior to the current owners of the prcperty. Sanitary
sewer is handled via an on-site septic tank and leach field.
The property to the south is currently being developed as a planned development, R-1, SD -7
overlay zoning single family residential subdivision. The properties to the north and west and
are R-1, SD -7 overlay zoning currently developed single family residential houses. The property
to the east is zoned R-1, SD -7 overlay and currently un -subdivided with one single family
residence occupying approximately 0.24 ac of the total.

The subdivision proposed to create 18 single family lots with the existing residence to occupy lot
1. The existing wells and septic system shall be abandoned per state, county and local regulation
and be connected to the proposed water and sewer systems. The proposed water system will be
constructed and dedicated to cal -water. The sanitary sewer system will be constructed and
connected to the existing system located along Cactus Avenue—Also to be dedicated to the City
of Chico. The storm drain system will consist of on-site quantity and quality facilities and will
connect to the existing system located along Sedona Avenue. Other facilities, power, phone and
cable will be provided within the joint trench located within the P.U.E. of the proposed
subdivision—PG&E plans to be provided. All roadways will be constructed within the proposed
ROW and dedicated to the City of Chico.

Linda Myers and Cecilia Davenport:
On May 16, 2007, the Airport Land Use Commission (ALUC) heard the referenced project and a motion was
made to find the project acceptable. The vote on the motion was unanimous. No other motion was made.
According to the BCALUCP, the Airport Commission must take action within 60 days of project being
deemed complete.
Please include the following conditions as part of the tentative parcel map:
SECTION 1: ENVIRONMENTAL FINDINGS
A. No environmental documentation has been completed for this project by ALUC staff. Your
Commission's review of the proposed project and determination of consistency is not a
"project" under the California Environmental Quality Act. Determination of environmental
review will be completed during the process of the Vesting Tentative Subdivision Map by
the City of Chico.
SECTION 2: CONSISTENCY FINDINGS FOR PROPOSED PROJECT
A. The proposed 18 residential dwellings, at a density of 4.5 dwelling units per acre, are
consistent with Compatibility Zone C.
B. Approximately 1,490 acres (26%) of the 5,560 acres in the C Compatibility Zone are zoned
as Agricultural 20 -acre minimum parcel size or larger and used mostly as grazing land.
C. Based on the surrounding residential development the project site is not conducive to meet
the minimum open space requirement.
D. The project site is outside of the 55 dB CNEL noise contour. The project site isnot within
the 55 dB CNEL noise contour as shown on Exhibit 4E (Noise Impacts — Future Average
Fire Season Day), Exhibit 4F (Noise Impacts — Expanded Forecast) and Exhibit 4G (Noise
Impacts — Peak Fire Attack Day) of the 2000 Butte County Airport Land Use Compatibility
Plan.
SECTION 3: PROJECT CONDITIONS:
1. Record an Airport Proximity of Acknowledgement notice notifying purchasers of the
proximity of the airport and the potential for possible noise related impacts in an ALUC-
approved disclosure notice.
2. Place a note on a separate document which is to be recorded concurrently with the final map
or on an additional map sheet that states: "Airspace review by the Airport Land Use
Commission is required for all objects over 100 feet in height."
3. Prior to the recordation of the Final Map record as a separate instrument.an Avigation
Easement granting the right of continued use of the airspace above the proposed parcels by
the Chico Municipal Airport and acknowledging any and all existing or potential airport
operational impacts.
4. Place a note on a separate document which is to be recorded concurrently with the final map
or on an additional map sheet that states: "An Avigation Easement is recorded above the
parcels for the Chico Municipal Airport and acknowledging any and all existing or potential
airport operational impacts."

A consistency review for a proposed Tentative Subdivision Map, which would
divide two parcels with a total of approximately 4.0 acres into 18 single-family
residential lots. The project parcels are located on the west side of Cactus Avenue,
approximately 1,275 feet north of East Avenue, at 2655 Cactus Avenue, Chico
SUMMARY:
The project proposes a tentative subdivision map and planned development permit to divide two
parcels totaling approximately 4.0 acres into 18 single-family lots. The majority of project
parcel is located. within the C Compatibility Zone of the Chico Municipal Airport. A small
portion of the southeast corner is outside of airport compatibility zones. Staff recommends that
ALUC.find the proposed subdivision consistent with the 2000 Butte County Airport Land Use
Compatibility Plan for the Chico Municipal Airport.
BACKGROUND:
• The project parcels total approximately 4.0 acres. One of the parcels is developed with a
single-family dwelling and accessory structures.
• The property is located in the City of Chico and is zoned R-1.
•. The proposed subdivision map would create 18 single-family residential lots with a density
of approximately 4.5 dwelling units per acre.
• Parcel sizes range from 6,016 square feet to 10,514 square feet.
• The height of the tallest object on the project site is anticipated to be approximately 30 feet
above ground level, which equates to approximately 279 feet above mean sea level.
ANALYSIS:
• The project site is located approximately 2.29 miles southeast and 0.40 miles to the east of
the extended centerline of runway 13L -31R.

• This project is a major land use action as defined by Policy 1.5.3 of the 2000 Butte County

The Airport Land Use Commission (ALUC) has prepared the following findings based on data
contained in the 2000 Airport Land Use Compatibility Plan (ALUCP) for the Chico Municipal
Airport, as well as site specific information submitted by the applicant and ALUC staff.
The following findings have been prepared at the direction of the ALUC and are for the
consideration of the Lead Agency (Butte County) when making a decision on the project.
SECTION 1: ENVIRONMENTAL FINDINGS
A. No environmental documentation has been completed for this project by ALUC
staff. Your Commission's review of the proposed project and determination of
consistency is not a "project" under the California Environmental Quality Act.
Determination of environmental review will be completed during the process of
the Vesting Tentative Subdivision Map by the City of Chico.
SECTION 2: CONSISTENCY FINDINGS FOR PROPOSED PROJECT
A. The proposed 18 residential dwellings, at a density of 4.5 dwelling units per acre,
are consistent with Compatibility Zone C.
B. Approximately 1,490 acres (26%) of the 5,560 acres in the C Compatibility Zone
are zoned as Agricultural 20 -acre minimum parcel size or larger and used mostly
as grazing land.
C. Based on the surrounding residential development the project site is not
conducive to meet the minimum open space requirement.
D. The project site is outside of the 55 dB CNEL noise contour. The project site is
not within the 55 dB CNEL noise contour as shown on Exhibit 4E (Noise Impacts
— Future Average Fire Season Day), Exhibit 4F (Noise Impacts — Expanded
Forecast) and Exhibit 4G (Noise Impacts — Peak Fire Attack Day) of the 2000
Butte County Airport Land Use Compatibility Plan.
SECTION 3: PROJECT CONDITIONS:
Record an Airport Proximity of Acknowledgement notice notifying purchasers of
the proximity of the airport and the potential for possible noise related impacts in
an ALUC-approved disclosure notice.
2. Place a note on a separate document which is to be recorded concurrently with the
final map or on an additional map sheet that states: "Airspace review by the

Airport Land Use Commission is required for all objects over 100 feet in height."
3. Prior to the recordation of the Final Map record as a separate instrument an
Avigation Easement granting the right of continued use of the airspace above the
proposed parcels by the Chico Municipal Airport and acknowledging any and all
existing or potential airport operational impacts.
4. Place a note on a separate document which is to be recorded concurrently with the
final map or on an additional map sheet that states: "An Avigation Easement is
recorded above the parcels for the Chico Municipal Airport and acknowledging
any and all existing or potential airport operational impacts."
