Butte County requires a 300 foot buffer between residential development and neighboring agricultural. The
Agricultural Commissioner may identify unusual circumstances where the 300 foot buffer cannot be met on
existing parcels. This exception is not available for lots being created, divided or subdivided.

UNUSUAL CIRCUMSTANCES DEFINITION:
An exceptional or extraordinary condition where the existing lot size or shape or an existing improvement
(well, septic systems, structures etc.) does not allow for the standard condition of a 300 -foot buffer zone.
An attached site Plan annotated with proposed building locations infrastructure dimensions and setbacks
is required.

A Effective August 24, 2004, Butte County code section 3-61, k, 4, address the fee schedule for
agricultural related planning project review:
"All planning, applications that are referred to the Agricultural Commissioner for review or when
an individual or business requests review by the Agricultural Commissioner will be charged at an
hourly rate of ninety-six dollars and twenty cents ($ 96.25) per hour. Any additional or
subsequent review of planning matters by the Agricultural Commissioner shall also be charged at
this same rate."
