The hearing was opened to the public.
No one was present to speak on this item.
The hearing was closed and comments confined to the Commission and staff.
It was moved by Commissioner Harp, seconded by Commissioner Wheeler, and unanimously carried

The Airport Land Use Commission (ALUC) has prepared the following findings based on data
contained in the 2000 Airport Land Use Compatibility Plan (ALUCP) for the Oroville Municipal
Airport, as well as site specific information submitted by the applicant and ALUC staff.
The following findings have been prepared at the direction of. the ALUC and a`e for the consideration
of the Lead Agency (Butte County) when making a decision on the project.
SECTION 1: ENVIRONMENTAL FINDINGS
A. No environmental documentation has been completed for this project by ALUC staff.
Your Commission's review of the proposed project and detenr_ination of consistency
is not a "project" under the California Environmental Quality acct. Determination of
environmental review will be completed during the proc�:ss of the Tentative
Subdivision Map by the Butte County Planning Division.
SECTION 2: CONSISTENCY FINDINGS FOR PROPOSED PROJECT
A. The proposal for Robert J. Van Zile, Family Trust Tentative Subdivision Map to
divide a 2.08 acre parcel into 8 single-family residential lcts is consistent with
Compatibility Zone D as found in the 2000 Airport Land Use Compatibility Plan for
the Oroville Municipal Airport.

B. The residential density of the project is consistent with Airport Compatibility Zone D
because there are no density or open space requirements.
SECTION 3: • PROJECT CONDITIONS:
1. Provide a deed notice for the sale of all resulting lots notifying purchasers of the
proximity of the airport and the potential for possible noise related impacts in an
ALUC-approved disclosure notice.
2. Place a note on a separate document which is to be recorded concurrently with the
final map or on an additional map sheet that states: "Airspace review by the Airport
Land Use Commission is required for all objects over 100 feel in height."
3. Prior to the recordation of the Final Map record as a separate instrument an Avigation
Easement granting the right of continued use of the airspace above the proposed
parcels by the Oroville Municipal Airport and acknowledgin; any and all existing or
potential airport operational impacts.
4. Place a note on a separate document which is to be recorded concurrently with the
final map or on an additional map sheet that states: "An Avigation Easement is
recorded above the parcels for the Oroville Municipal Airport and acknowledging any
and all existing or potential airport operational impacts."
Chairman Hennigan stated that had the County brought their General Plan ilto consistency with the
2000 AirportLand Use Compatibility Plan, the applicant would not have had to submit this
application or pay the fees.

SUMMARY:
Staff recommends that ALUC find the project consistent with "D" zone of the 2000 Airport Land
Use Compatibility Plan for the Oroville Municipal Airport.
BACKGROUND:
• The project parcel is 2.08 acres and is developed with a single family dwelling (to be
removed).
• .The property is within the sphere of influence of the City of OroviEe and is zoned A -R
(Agricultural Residential) and has a General Plan Land Use Designation of Low Density
Residential.
• The proposed subdivision map would create 8 single-family residential lots with a density of
approximately 3.8 dwelling units per acre. r
• Parcel sizes range from 6,800 square feet to 11,400 square feet.
ANALYSIS:
• The project site is located approximately 2.46 miles northeast and 0.30 miles to the west of
the extended centerline of runway 1:19.

CONSISTENCY FINDINGS FOR: ( '

The Airport Land Use Commission (ALUC) has prepared the following findings based on data
contained in the 2000 Airport Land Use Compatibility Plan (ALUCP) for the Oroville Municipal
Airport, as well as site specific information submitted by the applicant and ALUC staff.
The following findings have been prepared at the direction of the ALUC and are for the
consideration of the Lead Agency (Butte County) when making a decision on the project.
SECTION 1: ENVIRONMENTAL FINDINGS
y A. No environmental documentation has been completed for -his project by ALUC
staff. Your Commission's review of the proposed project and determination of
consistency is not a "project" under the California Environmental Quality Act.
Determination of environmental review will be completed during the process of
the Tentative Subdivision Map by the Butte County Planning Division.
SECTION 2: CONSISTENCY FINDINGS FOR PROPOSED PROJECT .
A. The proposal for Robert J. Van Zile, Family Trustto�divide a 2.08 acre parcel
into 10 single-family residential lots is consistent w h C6mpatibility-Z6ne D as
found in the 2000 Airport Land Use Compatibility Pl-in for the Oroville
Municipal Airport. r
B. The -residential density of the project is consistent with Airport *Compatibility
Zone D because there are no density or open space requirements.
SECTION 3: PROJECT CONDITIONS:
1. Provide a deed notice for the sale of all resulting lots notifying purchasers of the
proximity of the airport and the potential for possible noise related impacts in an
ALUC-approved disclosure notice.
2. Place a note on a separate document which is to be recorded concurrently with the
final map or on an additional map sheet that states: "Airspace review by the
Airport Land Use Commission is required for all objects over t00 feet in height."
3. Prior to the recordation of the Final Map record as a. separate instrument an
Avigation Easement granting the right of continued use of the airspace above the
proposed parcels by the Oroville Municipal Airport and acknowledging any and
all existing or potential airport operational impacts.
