At the February 18, 2004 Airport Land Use Commission Hearing, the Palomino Ridge
Tentative Subdivision Map 03-04 (A04-14) application was found consistent with the
Butte County Airport Land Use Compatibility Plan by the Airport Land Use Commission.
The project proposed 304 single-family residential lots and a detention pond/open
space lot (11.98 acres). The project parcels are located in Compatibility Zone D of the
Oroville Municipal Airport. Staffincluded as part of the consistency determination, a
condition of approval for the tentative subdivision map (TSM):
Provide a deed notice for the sale of all resulting lots notifying purchasers
of the proximity of the airport and the potential for possible noise related
impacts in an ALUC-approved disclosure notice.
The applicant during the process to record the map was unable to get their 404 permit
plan approved. The applicant has revised the map and has submitted in a new tentative
subdivision map application. The revised TSM meets the necessary requirements of
the 404 permit. The revised TSM proposes a total of 270 single-family residential lots
and open space area/drainage detention areas (17.96 acres). This is an increase of 6
-i 1
acres of open space. Staff is asking for the following conditions to be applied to the
new application:
1. Place a requirement on the project that a deed notice is provided for
the sale of all lots resulting from development within the zone, notifying
purchasers of the proximity of the airport and the potential for possible
noise -related impacts in an ALUC-approved disclosure notice.
2. Prior to the recordation of the Final Map record as a separate
instrument an Avigation Easement granting the right of continued use
of the airspace above the proposed parcels by the Oroville Municipal
Airport and acknowledging any and all existing or potential airport
operational impacts.
3. Place a note on a separate document which is to be recorded
concurrently with the final map or on an additional map sheet that
states: "Airspace review by the Airport Land, Use Commission is
required for all objects over 100 feet in height."
4. Place a note on a separate document which is to be recorded
concurrently with the final map or on an additional map sheet that
states: "An Avigation Easement is recorded above the parcels for the
Oroville Municipal Airport and acknowledging any and all existing or
potential airport operational impacts."
Staff has brought this. to the Airport Land Use Commission for informational purposes
on a change to an earlier consistency finding. Under current processing of proposed
projects and determination by the Commission, staff has not brought forward projects in
the D Compatibility Zone.
Action:
Staff is asking the Airport Land Use Commission for their determination on whether the
revised map should come before the Commission.

Ridge Subdivision Tentative Map, which would divide three parcels totaling 80.0
acres into 304 single-family residential lots. The project site is located on the
south side of Nelson Avenue, between 16th. Street and 20th Street, in the
Thermalito area of Oroville.
SUMMARY:
Staff recommends that ALUC find the project consistent with the .2000 Airport Land Use
Compatibility Plan for the Oroville Municipal Airport.
BACKGROUND:
• The project is comprised of three parcels which are currently undeveloped.
• The property is within the sphere of influence of the City of Oroville and is zoned A -R
(Agricultural Residential) and has a General Plan Land Use Designation of Low Density
Residential.
• The proposed subdivision map would create 304 single-family residential lots with a density
of approximately 3.88 dwelling units per acre.
• Parcel sizes range from 6,500 square feet to 17,580 square feet. Majority of parcels will be
6,500 square feet.
• The project site is located approximately 1.82 miles northeast of runway 12-30 of the
Oroville Municipal Airport, and is just to the west of the extended runway 1-19 centerline.
• The project site is within Airport Compatibility Zone D (Traffic Pattern).

• The project is proposing an 11.98 acre detention pond/open space area in the northeast corner
of the project. The open space area is being proposed to be dedicated to the Feather River
Recreation District.
ANALYSIS:
• This project is a major land use action as defined by Policy 1.5.3 of the 2000 Butte County
Airport Land Use Compatibility Plan (ALUCP).
• The primary compatibility criteria for the D Compatibility Zone is shown on the following
table:

The Airport Land Use Commission (ALUC) has prepared the following findings based on data
contained in the 2000 Airport Land Use Compatibility Plan (ALUCP) for the Chico Municipal
Airport, as well as site specific information submitted by the applicant and ALUC staff.
The following findings have been prepared at the direction of the ALUC and are for the
consideration of the Lead Agency (Butte County) when making a decision on the project.
SECTION 1: ENVIRONMENTAL FINDINGS
A. No environmental documentation was submitted at -the time of project review.
SECTION 2: CONSISTENCY FINDINGS FOR PROPOSED PROJECT
A. The proposal for the Palomino Ridge Subdivision Tentative Map, to divide three
parcels totaling 80 acres into 304 single-family residential lots, is consistent with
Compatibility Zone D as found in the 2000 Airport Land Use Compatibility Plan
for the Oroville Municipal Airport.

south side of Nelson Avenue, between 16th Street and 201h Street, in the
Thermalito area of Oroville.

Staff recommends that ALUC find the project consistent with the 2000 Airport Land Use
Compatibility Plan for the Oroville Municipal Airport.
BACKGROUND:
• The project is comprised of three parcels which are currently undeveloped.
• The property is within the . sphere of .influence of the City of. Oroville and is zoned A -R
(Agricultural Residential) and has a General Plan Land Use Designation of Low Density
Residential.
• The proposed subdivision map would create 304 single-family residential lots with a density
of approximately 3.88 dwelling units per acre.
• Parcel sizes range from 6,500 square feet to 17,580 square feet. Majority of parcels will be
6,500 square feet.
• The project site is located approximately 1.82 miles northeast of runway 12/30 of the Cecr"
Municipal Airport, and is just to the west of the extended runway 19/1 centerline.
• The project site is within Airport Compatibility Zone D (Traffic Pattern).
• The project is proposing an 11.98 acre detention pond/open space area in the northeast corner
of the project. The open space area is being proposed to be dedicated to the Feather River
Recreation District.

The Airport Land Use Commission (ALUC) has prepared the following findings based on data
contained in the 2000 Airport Land Use Compatibility Plan (ALUCP) for the Chico Municipal
Airport, as well as site specific information submitted by the applicant and ALUC staff.
The 'following findings have been prepared at the direction: of the ALUC and are for the
consideration of the Lead Agency (Butte County) when making a decision on the project.
SECTION 1: ENVIRONMENTAL FINDINGS
