The project site is located on the west side of 18`h Street, approximately 360 feet north of Grand Avenue, in the Thermalito area of Oroville. SUMMARY: Staff recommends that ALUC find the project consistent with the 2000 Airport Land Use Compatibility Plan. BACKGROUND: • The existing parcel is 4.25 acres in size. The project site is vacant. Surrounding uses include mostly residential uses and some vacant land. • The property is within the unincorporated area Butte County. It is located in the urban area and sphere of influence for the City -of Oroville. The project area is designated as Low Density Residential by the Butte County General Plan and is zoned A -R (Agricultural Residential), which allows a minimum parcel size of 6,500 square feet. • Seventeen single family dwelling lots are proposed. The proposed parcels would range in size from 6,500 to 10,781 square feet. • Approximately 1.2 acres of the project site would consist of road easement, drainage area, or other open area. • The elevation of the project site is 210 feet above sea level. The height of the tallest object on the project site (including antennas and trees) is not anticipated to be higher than 100 feet above ground level. ■ Butte County Airport Land Use Commission ■ ALUC File No. A 05-15 (Bloom) ■ ■ March 16, 2005 ■ Page 1 of 5 ■ • The project: site is located approximately 1.35 miles northeast of Runway 1-19 of the Oroville Municipal Airport and is located approximately 282 feet northwest of the extended runway centerline. • The project site is within Airport Compatibility Zone C (Traffic Pa:tern). • The project site is outside of the 55 dB CNEL noise contour as shown on Exhibit 5E (Noise Impacts) of the 2000 Butte County Airport Land Use Compatibility Plan. Residential development should not contain more than the indicated number of dwellin€ units (both primary and secondary) per gross acre. With clustering, some parcels may be much smaller than the othe_s as long as the maximum overall density criterion is not exceeded. Clustering of units is encouraged in Compatibility Zones B2 and C — see Policy 4.2.6 for limitations. • Projects located within the C Airport Compatibility Zone have the option of having a residential density of 1 dwelling unit per five acres or greater, :)r a density of 4 dwelling units or greater per acre. The two -option criterion is based upon a determination that the intrusiveness of aircraft noise is the most significant compatibility factor in Zone C; safety is only a minor concern. The concept is that noise concerns can be minimized either by limiting the number of dwellings in the affected area or by allowing high densities which tend to have comparatively high ambient noise levels. • The project would result in 17 parcels on 4.25 acres, which is a density of 4 dwelling units per acre (with an average parcel size of 0.25 acres). Using the area outside of road easements and drainage area, the average parcel size would be 0.17 acres. The density of the proposed parcel would be consistent with the residential density requirements of the C(2) Airport Compatibility Zone. ■ Butte County Airport Land Use Commission ■ ALUC File No. A 05-15 (Bloom) ■ ■ March 16, 2005 ■ Page 2 of 5 ■ Open Space Requirements • Table 2A (Primary Compatibility Criteria) of the 2000 Airport Land Use Compatibility Plan requires a 10% open space in the C Airport Compatibility Zone. The notes for Table 2A and Section 4.2.5(c) of the 2000 AirportLand Use Compatibility Plan state that the open land requirements are intended to be applied with respect to an entire zone. Application of open space requirements to individual development proposals is at the discretion of the local jurisdicticn and is dependent upon the size of the development. • Ten percent of the project site would be 0.425 acres (18,513 square feet). The small size of the project site generally precludes any open space that woruld be usable in the event of an emergency landing. The site access road, which wou-d be approximately 490 feet in length, could possibly be utilized in the event of an eni: rgency landing but street trees and vehicles parked along the street may preclude such use. • The C Airport Compatibility Zone (in which the project site is located) is approximately 5,504 acres in size. Ten percent of that amount is 550.4 acres. 'Staff conducted a cursory analysis of the existing open areas within the C zone and found at least 1,900 acres of open space area. These open space areas are owned by the State of California and are expected to remain in open space. ENVIRONMENTAL DOCUMENTATION: No environmental documentation has been completed for this proj -Ict by ALUC staff. The County of Butte Planning Division staff will complete an environmental initial study and make a determination per the California Environmental Quality: Act as part of their processing of the tentative subdivision map. RECOMMENDATION: Staff recommends that the Butte County Airport Land Use Commission find ALUC File No. A 05-15 for Martin Bloom consistent with the 2000 Butte County Airport Land Use Compatibility Plan. The following findings have been prepared at the direction of the ALUC and are for the consideration of the Lead Agency (County of Butte) when making a decision on the proj ect. SECTION 1: ENVIRONMENTAL FINDINGS A. No environmental documentation has been completed for this project by ALUC staff. The County of Butte Planning Division staff will complete an environmental initial study and make a determination per the California Environmental Quality Act as part of their processing of the tentative subdivision map. SECTION 2: CONSISTENCY FINDINGS FOR PROPOSED PROJECT A. The proposal for the proposed Tentative Subdivision Map for Martin Bloom, which would create 17 residential lots on 4.25 acres, is consistent with Airport Compatibility Zone C as found in the. 2000 Butte County Airport Land Use Compatibility Plan. SECTION 3: PROJECT FINDINGS: A. The project site is located in Airport Compatibility Zone C as listed in the 2000 Butte County Airport Land Use Compatibility Pian. B. The project is consistent with Airport Compatibility Zone C because the density of the proposed parcels would be four dwellings per acre and would have an average parcel size of 0.17 acres. C., No structures on the project site would extend into protected airspace. D. The.project site is outside of the 55 dB CNEL noise contour. SECTION 4: PROJECT CONDITIONS: 1. Airspace review by the Airport Land Use Commiss_.on is required for all objects more than 100 feet tall. 2. WPD t FEB U i ?060 } BUTTE COUNTY PLING DIVISION sL'yN OROVILLE, CALIFORNIA I PROJECT DESCRIPTION FOR "Martin Bloom" Subdivision APN: 030-072-069 January 27, 2005 The project is to subdivide an existing 4.25 acre parcel into 17 single family residential lots served by a new street connecting to 180' Street, approx. 350 feet north of Grand Avenue in unincorporated Thermalito. Lot sizes will vary from a minimum 6500 square feet to more than 10,500 square feet. . The property is currently zoned AR with a General Plan designation of Low Density Residential and is located within the Oroville Airport Overlay "C" Zone. The required minimum open space area in the overlay zone is 10%, which the project design exceeds. The proposed subdivision design complies with the minimum overlay zone density of four units per acre. The site is currently vacant level grassland, formerly an orchard, with a few small bushes, some blackberries and some old debris piles. A hedge of eucalyptus trees is adjacent and westerly of the westerly boundary. Adjacent land uses are single family homes and mobile homes on varying smaller lot sizes. Poplar Avenue School is approx. 1000 feet westerly. Oroville Airport is approx. 1 mile southwesterly. Thermalito Irrigation District (TID) serves the area with sewer and public water and electricity, telephone, cable and natural gas are also adjacent to the site. Sewer and water mains will be extended into the site to TID standards. Underground electricity, telephone, cable and natural gas will also be extended to each lot as per utility purveyor requirements. Drainage facilities will include a landscaped retention basin and on site underground storm drain facilities to the off-site area drainage system funded by Thermalito Drainage Fees. The proposed subdivision will include a private street and cul de sac constructed to County Standards. The road is proposed to remain privately owned and maintained by a property owners association including a gated entry. Due to the existing shape and land area of the property, the subdivision design requires front yard setback modifications on some lots. The design proposed will allow for compliance with the overly zone requirements and not require any additional exceptions or variances that are known of.
