Provide a deed notice for the sale of all resulting lots notifying purchasers of the proximity of the airport and the potential for possible noise related impacts in an ALUC-approved disclosure notice. 2. Prior to the recordation of the Final Map record as a separate instrument an Avigation Easement granting the right of continued use of the airspace above the proposed parcels by the Oroville Municipal Airport and acknowledging any and all existing or potential airport operational impacts. 3. Place a note on a separate document which is to be recorded concurrently with the final map or on an additional map sheet that states: "An Avigation Easement is recorded above the parcels for the Oroville Municipal Airport and acknowledging any and all existing or potential airport operational impacts." 4. Exhibit A — Findings and Conditions n EXHIBIT A • BUTTE COUNTY AIRPORT LAND USE COMMISSION CONSISTENCY FINDINGS FOR ALUC File No. A06-0023 (Los Olivos Development, LLC), APN 030-110-029, 042, 058, 059, 060, 067, 068 and 073 The Airport Land Use Commission (ALUC) has prepared the following findings based on data contained in the 2000 Butte County Airport Land Use Compatibility Plan (ALUCP) for the Oroville Municipal Airport, as well as site specific information submitted by the applicant and ALUC staff. The following findings have been prepared at the direction of the ALUC and are for the ` consideration of the Lead Agency (City of Oroville) when making a decision on the project. SECTION 1: ENVIRONMENTAL FINDINGS A. No environmental documentation has been completed for this project by ALUC staff. Your Commission's review of the proposed project and determination of consistency is not a "project" under the California Environmental Quality Act. Determination of environmental review will be completed during the process of annexation and the subdivision map by the City of Oroville. SECTION 2: CONSISTENCY FINDINGS FOR PROPOSED PROJECT A. The City of Oroville's proposed pre -zoning designation of R-1 for the parcels is consistent with the 2000 Butte County Airport Land Use Compatibility Plan. B The project exceeds the 10 % open space requirement. C. The pre -zoning of R-1 is consistent with the minimum of 4 dwelling units per acre. D. No structures of the project will extend into protected airspace. E. The project parcels are outside of the 55 dB CNEL noise contour. SECTION 3: PROJECT CONDITIONS: 1. The project parcels are located east of 18`" Street, north of Feather Avenue and the south of Grand Avenue,, Thermalito. SUMMARY: The project proposes an amendment of the City of Oroville's pre -zoning for eight parcels totaling approximately 30.61 acres within the C Compatibility Zone of the Oroville Municipal Airport. The purpose of the application is for future annexation to the City of Oroville and development of residential uses. Staff recommends that ALUC find the proposed pre -zoning consistent with the 2000 Butte ,County Airport Land Use Compatibility Plan for the Oroville Municipal Airport. BACKGROUND: • The project parcels are currently undeveloped. • The project parcels are located approximately 4,800 feet northeast of the Oroville Municipal Airport. ANALYSIS: • The parcels are within Airport Compatibility Zones C (Traffic Pattern). • The nearest residential area is located approximately 4,800 feet north of Runway 1-19 and . approximately 300 feet from the extended runway centerline in the C Zone. , ■ Butte County Department of Development Services ■ Airport Land Use Commission ■ 0 Los Olivos Development, LLC A06-0023 ■ Page 1 of 9 ■ • The project is required to come before ALUC as a pre -zoning associated with a future annexation of land to a city as stated in Section 1.5.3 (a)(2). • The current pre -zoning of the parcels is RL -1 (8,000 sq ft minimum). The proposed pre - zoning is R-1 (6,000/7,000 sq foot minimum). Table 2B states that a 50-55 dB CNEL is clearly acceptable for residential uses. • The project site is outside the 55 dB CNEL noise contour as shown on Exhibit 5E (Noise Impacts) of the 2000 Butte County Airport Land Use Compatibility Plan.
