APPROVAL OF THE DRAFT MINUTES FOR THE MAY 14, 2002 MEETING It was moved by Commissioner Harp, seconded by Chair Wallrich and passed with two abstentions (Commissioners Rosene & Lambert, both absent from the meeting of May 14, 2002), with two corrections as noted. On page 3, line 29 change "Commission" to "position" and also on page 3, line 20 correct "Chair Harp" to "Chair Wallrich." D. ACCEPTANCE OF THE AGENDA A motion was made by Commissioner Harp, seconded by Commissioner Rosene, and unanimously carried to accept the Agenda as presented. E. BUSINESS ITEMS ITEMS WITH PUBLIC HEARING 1. ALUC File No. A02-06 Kerry and Valerie Gates APN 030-120-044: A consistency review for a proposed Tentative Subdivision dividing a 15.18 -acre parcel into 59 residential lots averaging 6,500 square feet in size. The project is located at the southeast corner of Grand Avenue and 20`h Street in the Thermalito area, Oroville. Mr. Sanders presented the staff report. He reported that the proposal is for a 59 -lot single-family residential subdivision on approximately 15.18 acres. He stated that the subject property is in the Oroville area just northwest of Oroville Municipal Airport in an area zoned AR (Agricultural -Residential) that allows single-family residential lots co, as small as 6,500 square feet. Mr. Sanders further reported that the project site, located in compatibility zone C, permits residential densities of either 1 dwelling unit per 5 acres or 4 or more dwelling units per acre. He reported that the proposed project density is approximately 3.9 dwelling units per acre. Mr. Sanders commented that while the project site is underneath the FAR Part 77 approach, the site is not within the 55 dB CNEL contour. Mr. Sanders concluded his comments by recommending that the Commission fmd the project consistent with the 2000 Airport Land Use Compatibility Plan subject to the following conditions: 1) the addition of 2 lots to the proposed 59 -lot single-family residential tentative subdivision to meet the 4-dwellirig units per acre requirement of the ALUCP and 2) a Deed Notice, and based on the following findings: SECTION l: ENVIRONMENTAL FINDINGS A. No environmental documentation was submitted at the time of project review. SECTION 2: CONSISTENCY FINDINGS FOR PROPOSED PROJECT A. The proposal to divide a 15.18 acre parcel into single-family residential lots is 9 compatible with the 2000 Airport Land Use Compatibility Plan for the Oroville Municipal Airport, provided the conditions contained in Section 3 are met. B. Approval of the project without implementation of the requirements in Section 3 would necessitate the adoption of Overriding Findings by a 2/3 vote of the governing body. Overriding Findings by the governing body can only be made based up substantiated facts and must be supported by new substantial factual evidence introduced into the public record that the proposed action is consistent with the State Aeronautics Act as stated in Section 21670. Overriding findings cannot be adopted as matters of opinion, here say, or upon the unsubstantiated fears and desires of the governing body. SECTION 3: PROJECT CONDITIONS: 1. The map shall be re -designed to provide a minimum of 61 lots. 2. Provide a deed notice for the sale of all resulting lots notifying purchasers of the proximity of the airport and the potential for possible noise related impacts in an ALUC-approved disclosure notice. Chair Wallrich opened the hearing to public comments. There being no comments, the hearing was closed. Alternate Commissioner Papadakis pointed out that Oroville Airport had established a new instrument approach since the adoption of the 2000 ALUCP and he also noted a correction to the staff report changing "Runway 12-30" to "Runway 1-19." He i provided an overview of the adoption process. He also reported that ALUC, according to the Public Utilities Code, must conduct a consistency review of the Master Plan within. 60 days of receipt following the City's adoption of the Master Plan. The project is located at the southeast corner of Grand Avenue and 201h Street in the Thermalito area, Oroville. FOR: Airport Land Use Commission Meeting on June 19, 2002 SUMMARY: Staffrecommends that ALUCfind the project consistent with the 2000 Airport Land Use Compatibility Plan for the Oroville Municipal Airport. BACKGROUND: The site is located approximately 5,400 feet off of the north end of runway 12-30 of the.Oroville Municipal Airport. The property is within the unincorporated area of Butte County. The current General Plan land use designation for the property is Low Density Residential. Zoning for the site is split with a Agricultural Residential (AR) which allows residential parcels as small as 6,500 square feet in size. The site is currently undeveloped. The parcel size is 15.18 acres which the applicant proposes to divide into 59 single-family residential lots. ANALYSIS: This project falls into the category of a Major Land Use Action as defined by the 2000 Airport Land Use Compatibility Plan (ALUCP). Because Butte County has not yet brought their General Plan into conformity with the ALUCP, a review of this project by the Commission is required pursuant to Section 21675.1 of the Public Utilities Code prior to any action being taken by the legislative body. According to the for the Oroville Municipal Airport, the property is located in a Traffic Pattern Compatibility Zone "C" — Traffic Pattern Zone. The property is predominantly under both the Federal Aviation Regulations (FAR) - Part 77 approach and transitional surfaces for the north end of runway 12-30. At 200 feet above mean sea level, the project site is approximately 10 feet higher than the Oroville Municipal Airport. The Approach Surface elevation above the project approximately ranges between 120 feet at the project's southwest corner and 166 feet at the northeast corner. The proposed development for single farnily dwellings will not result in any structures or vegetation penetrating FAR Part -77 surfaces. The project is not within the 55 dB CNEL noise contour. The primary tool for evaluating compatibility of residential land is density in terms of the number of dwelling units per acre. Two categories of compatible residential densities exist in Zone C. These are very low density (1 dwelling unit per 5 or more acres) and higher density (4 or more dwelling units per acre). This two -option criterion is based on a determination that the intrusiveness of aircraft noise is the most significant compatibility factor in Zone "C"; safety is only a minor concern. The concept is that noise concerns can be minimized either by limiting the number of dwellings in the affected area or by allowing high densities which tend to have comparatively high ambient noise levels. The resulting average density for the proposed project would be approximately 3.9 dwelling units per acre. Two additional parcels would be needed to make the project meet the 4 dwelling unit per acre density. It appears that adding two additional parcels to the lot layout could be achieved without significantly altering the layout design. However, there may be factors unknown to staff that dictate the current layout. Though the project does not strictly meet the 4.0 dwelling unit per acre requirement, Staff advises that the Commission could find the project consistent for the following reasons: The applicant has attempted to create minimum sized parcels and maximize the project density to meet the ALUCP density. 2. Due to the odd shape of the original parcel and the need for the road to match up with an existing road to the south, designing a lot layout to achieve more parcels may be difficult. Environmental Documentation: No environmental documentation has been completed for this project. RECOMMENDATION: Staff recommends that the Butte County Airport Land Use Commission find ALUC File No. A02-06 (Kerry and Valerie Gates) consistent with the 2000 Airport Land Use Compatibility Plan for the Oroville Municipal Airport provided the conditions in Section 3 of Exhibit "A." The following findings have been prepared at the direction of the ALUC and are for the consideration of the Lead Agency (County of Butte) when making a decision on the project. SECTION 1: ENVIRONMENTAL FINDINGS A. No environmental documentation was submitted at the time of project review. SECTION 2: CONSISTENCY FINDINGS FOR PROPOSED PROJECT A. The proposal to divide a 15.18 acre parcel into single-family residential lots is compatible with the 2000 Airport Land Use Compatibility Plan for the Oroville Municipal Airport, provided the conditions contained in Section 3 are met. B. Approval of the project without implementation of the requirements in Section 3 would necessitate the adoption of Overriding Findings by a 2/3 vote of the governing body. Overriding Findings by the governing body can only be made based up substantiated facts and must be supported by new substantial factual evidence introduced into the public record that the proposed action is consistent with the State _Aeronautics Act as stated in Section 21670. Overriding findings cannot be adopted as matters of opinion, here say, or upon the unsubstantiated fears and desires of the governing body. SECTION 3: PROJECT CONDITIONS: 1. The map shall be re -designed to provide a minimum of 61 lots. 2. Provide a deed notice for the sale of all resulting lots notifying purchasers of the proximity of the airport and the potential for possible noise related impacts in an ALUC-approved disclosure notice.
