Durling, Associate Planner DATE: April 20, 2005 ITEM: • ALUC File No. A05-11 (Lewis-Duuen TSM 05-09. 131-011: A consistency review for the proposed Ashley Place Tentative Subdivision ' Map, which would divide one parcel totaling 5.26 acres into 22 single-family residential lots. The project site is located on the west side of 12`" Street, approximately 500 feet south of Feather Avenue, in the Thermalito area of Oroville. SUMMARY: Staff recommends that ALUC find the project consistent with "C" zone of the 2000 Airport Land Use Compatibility Plan, as amended, for the Oroville Municipal Airport. BACKGROUND: • The project is comprised of one 5.26 acre parcel which is currently undeveloped. • The property is within the sphere of influence of the City of Oroville and is zoned A -R (Agricultural Residential) and has a General Plan Land Use Designation of Low Density Residential. • The proposed subdivision map would create 22 single-family residential lots with a density of approximately 4.2 dwelling units per gross acre. • Parcel sizes range from 6,561 square feet to 13,803 square feet. The average parcel size is 8,058 square feet. • The project site is located approximately 1.32 miles northeast of extended runway 1:19 of the Oroville Municipal Airport, and approximately 1.98 miles west of the flight path center line. • The project site is within Airport Compatibility Zone C (Traffic Pattern). Residential development should not contain more than the indicated number of dwelling units (both primary and secondary) per gross acre. With clustering, some parcels may be much smaller than the others as long as the maximum oveltall density criterion is not exceeded. Clustering of units is encouraged in Compatibility Zones 132 and C — see Policy 4.2.6 for limitations. Note 1. Residential development should not contain more than the indicated number of dwelling units (both primary and secondary) per gross acre. With clustering, some parcels may be much smaller than the others as long as the maximum overall density criterion is not exceeded. Clustering of units is encouraged in Compatibility Zones 132 and C - see Policy 4.2.6 for limitations. 9.1 Hazards to flight include physical (e.g., tall objects), visual, and electronic forms of interference with the safety of aircraft operations. Land use development which may cause the attraction of birds to increase is also prohibited. See the supporting compatibility policies on airspace protection (Policies 4.32 and 4.3.6) for details. • The project residential density is 4.2 units per gross acre. The residential density of the project is therefore consistent with Airport Compatibility Zone C. • The 10%open space requirement of the project is 22,900 square feet. This requirement is met by the State lands comprising the Thermalito Afterbay and Forebay. In addition, a nearby emergency access road can be counted as open space; it contains 37,80 square feet. ENVIRONMENTAL DOCUMENTATION: No environmental documentation has been completed for this project by ALUC staff. The Butte County planning staff will complete an environmental initial study and make a determination per the California Environmental Quality Act as part of their processing of the tenta.--ive subdivision map. RECOMMENDATION: Staff recommends that the Butte County Airport Land Use Commission find ALUC File No. A05-11 (Lewis -Duggan, LLC) consistent with the 2000 Airport Land Use Compatibility Plan for the Oroville Municipal Airport. APN 0310-131-011 The Airport Land Use Commission (ALUC) has prepared the following findir_gs based on data contained in the 2000 Airport Land Use Compatibility Plan (ALUCP) for the Oroville Municipal Airport, as well as site specific information submitted by the applicant and ALUC staff. The following findings have been prepared at the direction of the ALUC and are for the consideration of the Lead Agency (Butte County) when making a decision on the project. SECTION 1: ENVIRONMENTAL FINDINGS A. I No environmental documentation has been completed for this project by ALUC staff. The Butte County or City of Chico planning staff will complete an environmental initial study and make a determination per the California Environmental Quality Act as part, of their processing of the vesting tentative subdivision map. SECTION 2: CONSISTENCY FINDINGS FOR PROPOSED PROJECT A. The proposal for the Lewis -Duggan, LLC, (Ashley Place) Subdivision, to divide one parcel totaling 5.26 acres into 22 single-family residential lots, is consistent with Compatibility Zone C as found in the 2000 Airport Land Use Compatibility Plan for the Oroville Municipal Airport. SECTION 3: PROJECT FINDINGS: A. The project site is located in Airport Compatibility Zones C as listed in the 2000 Airport Land.Use Compatibility Plan for the Oroville Municipal Airport. . B. The residential density of the project is consistent with Airport Compatibility Zone C because the project exceeds the required 4.0 minimum units per acre. C. The 10% open space requirement of the project is 22,900 square feet. This requirement is met by the State lands comprising the Thermalito Afterbay and Forbay. In addition, an emergency access road can be counted as open space, and contains 37,800 square feet SECTION 4: PROJECT CONDITIONS: 1. Provide a deed notice for the sale of all resulting lots notifying pu-chasers of the proximity of the airport and the potential for possible noise related impacts in an ALUC-approved disclosure notice. 2. Airspace review for objects/structures over 100 feet tall is required.
