ITEM: ALUC File No. A05-08 Marie Anne Alexander, Elexus GroUn Inc. (Emerald
Oaks TSM), APN 030-132-005, 030-160-005 and 030-560-020: A consistency
review for a proposed Tentative Subdivision Map (TSM 05-08), which would
create 98 residential lots and four open space lots from three existing parcels
totaling approximately 24 acres. The project site is located on the'east side of 12`h
Street, approximately 1,650 feet north of Oro Dam Boulevard, and on the east and
west side -of 10`h Street, approximately 1,450 feet north or Oro Dam Boulevard, in
the Thermalito area of Oroville.
SUMMARY:
Staff recommends that ALUC find the project consistent with the 2000 Airport Land Use
Compatibility Plan for the Oroville Airport.
BACKGROUND:
• The three parcels total approximately 24 acres in size and one of the parcels is currently
developed with an existing dwelling and accessory structures, both to be removed.
Surrounding uses include mostly residential uses, except for commercial uses to south.
• The property is within the unincorporated area of Butte County. It is located in the urban
area and sphere of influence area for the City of Oroville.
• The project area is designated Low Density Residential by the Land Use Element of the
General Plan and is zoned Agricultural Residential.
• Residential lot sizes range in size from 6,500 square feet (0.15 ac) to 15,485 square feet (0.35
ac). Proposed uses are single family dwellings.
• The height of the tallest object on the project site (including antennas and trees) is not
anticipated to be higher than 100 feet above ground level. Butte County Codes do not have
height restrictions in the Agricultural Residential zone.

• The project site is located approximately 1.4 miles east of runway 12/30 of the Oroville
Airport and is located approximately 4,800 feet (0.9 miles) east of runway centerline.
• The project site is within both the Airport Compatibility Zones C and D (Traffic Pattern).
• The project site is outside the 55 dB CNEL noise contour.
ANALYSIS:
• This project is a major land use action as defined by Policy 1.5.3 of the 2000 Butte County
Airport Land Use Compatibility Plan (ALUCP).
• . The primary criteria for Compatibility Zones C and D are shown on the following table:

Note 1. Residential development should not contain more than the indicated number of dwelling units (both
primary and secondary) per gross acre. With clustering, some parcels may be much smaller than the
others as long as the maximum overall density criterion is not exceeded. Clustering of units is
encouraged in Compatibility Zones 132 and C — see Policy 4.2.6 for limitations.
9. Hazards to flight include physical (e.g., tall objects), visual, and electronic forms of interference with
the safety of aircraft operations. Land use development which may cause the attraction .of birds to
increase is also prohibited. See the supporting compatibility policies on airspace protection (Policies
4.32 and 4.3.6) for details.
• The project would result in 98 residential lots, which is a density of 4.08 dwelling units per
acre (with an average parcel size of 0.24 acres).
• Requirements in the "C" Compatibility Zone require that 10 percent of the zone remain open
space. More than 50 percent of the "C" Compatibility Zone around the Oroville Municipal
Airport is zoned Resource Conservation and designated open space, Open space areas
include the Thermalito Forebay and Afterbay and the Oroville State Wildlife Area.

BUTTE COUNTY AIRPORT LAND USE COMMISSION
CONSISTENCY FINDINGS FOR ALUC File No. 05-06 (Marie Anne. Alexander),
APN 030-132-005, 030-160-005 and 030-560-020
The Airport Land Use Commission (ALUC) has prepared the following findings based on data
contained in the 2000 Airport Land Use Compatibility Plan (ALUCP) for Ilse Chico Municipal
Airport, as well as site specific information submitted by the applicant and ALUC staff.
The following findings have been prepared at the direction of the ALUC and are for the
consideration of the Lead Agency (County of Butte) when making a decision on the project.
SECTION 1: ENVIRONMENTAL FINDINGS
A. No environmental documentation was submitted at the time of project review.
SECTION 2: CONSISTENCY FINDINGS FOR PROPOSED PROJECT
A. The proposal for, the Emerald Oaks Tentative Subdivision Map (TSM 05-08),
which would create 98 residential lots on 24.0 acre., is consistent with
Compatibility Zones "C" and "D" as found in the 20C-0 Airport Land Use
Compatibility Plan for the Oroville Airport.
SECTION 3: PROJECT FINDINGS:
A. The project site is located in Airport Compatibility Zone B as listed in the 2000
Airport Land Use Compatibility Plan for the Oroville Airport.
B. The'project is consistent with Compatibility Zone C based on the dwelling units
per acre exceeds the minimum of 4 dwelling units per acre and that there is more
than 10 percent of Compatibility Zone C zoned Resource Conservation and
dedicated as open space. '
C. The project is consistent with Compatibility Zone D because there are no parcel
size or density limitations.
D.' No structures on the project site would extend into protected airspace.
E. The project site is outside of the 55 dB CNEL noise contour.
SECTION 4: PROJECT CONDITIONS:
1. Provide a deed notice for the sale of all resulting lots notify -ng purchasers of the
proximity of the airport and the potential for possible noise -:-elated impacts in an
ALUC-approved disclosure notice.
2. Airspace review by the Airport Land Use Commission required for objects more
than 100 feet tall.
