ALUC File No. A00-04 Consistency Finding for Renee Jenett - Tentative Parcel Map 99- 11, APN 0307160-058 & 059. Mr. Sanders, summarized the project proposal and staff report and stated that the recommendation is -to find the project consistent with one condition requiring an avigation easement, with standard wording. Chairman Rosene asked for questions from the Commission. There were none. The hearing was opened to the public. No one was present. The hearing was closed to the public. Alternate Commissioner Hennigan pointed out a minor correction on Page 2, second paragraph from the bottom of the page of the staff report. The sentence should read "The horizontal surface is at 340 feet above sea level, significantly higher than the airport." It was moved by Commissioner Grierson, seconded by Commissioner Causey, to find that ALUC File No. A00-04 -Consistency Finding for Renee Jenett - Tentative Parcel Map 99-11, AP#030-160-058,059 is'consistent with the 1985 Comprehensive Land Use Plan (CLUP) for the Oroville Municipal `Aii-port,'as amended on December 29; 1999, if the requirements in Section 3, as modified by the Commission, are applied to the final map as noted in the findings presented in Exhibit "A", and that the specific findings of consistency meet the intent of Government Code Section 21670. Exhibit A ' The following findings have been prepared at the direction of the ALUC and are for the consideration of the Lead Agency (County of Butte) when making a decision ori the project. Section 1: ENVIRONMENTAL FINDINGS A. No environmental documentation was submitted at the time of project review. Section 2: PROJECT REQUIREMENTS FOR CONSISTENCY: A. The proposed_ project will be consistent with the 1985 Comprehensive Land .Use Plan (CLUP) for the Oroville Municipal Airport, as amended on December 29, 1999, if the requirements in Section 3 are applied to the final map. - B. Approval of the project without implementation of the requirements in Section 3 would necessitate the' adoption of Overriding Findings by a 2/3 vote of the governing body. Overriding Findings by the governing body can only be made- based on substantiated facts and must be supported by new substantial, factual evidence introduced into the public record that the proposed action is consistent with the State Aeronautics Act as stated in Section 21670. Overriding findings 0 0 cannot be adopted as matters of opinion, heresay, or upon the unsubstantiated fears and desires of the governing body. Section 3: PROJECT FINDINGS: A. According to the newly adopted Oroville Municipal Airport Environs Plan, Safety Zone Map "7-1 ", the project is located in Safety Zone 7 - "Airport Area of Influence". The criterion of item "C" allows caretaker residences provided that interior noise levels do not exceed 45 CNEL with windows closed, is not applicable to this project. .The criterion of item "D" requires measures .to achieve an interior noise level of 45 CNEL within portions of buildings where the public is received, office areas, and other areas where people work or congregate. The language of criterion item "D" applies to commercial and industrial structures, not single family dwellings. The criterion of item "H" for communication towers is not applicable to this project which would require ALUC review of a Use Permit. The criterion of item "I" which prohibits churches, nursing care facilities, hospitals, colleges and universities, elementary and secondary schools, child ,care facilities, and similar aggregations of people is not applicable to this project. Use Permit requests for these types of projects will be reviewed by ALUC. I A note shall be placed on the Final Map stating that: "Prior to the issuance of a Building Permit for a single family dwelling, the property owner shall sign an avigation easement grating the right of continued use of the Oroville Municipal Airport in the airspace above the proposed parcels and acknowledging any and all existing or potential airport operational impacts." B. Airspace Protection: The Commission finds that due to the topography of the project, there are no transitional surface problems. The subject property is located at approximately the same elevation as the airport. Approach surfaces will not be affected due to topography or development. C. Safety: Accident scatter information presented in Figure 8C, Exhibit 8D (Hodges and Shutt - 1993) and Figure 9E (UC Berkeley, Institute of Transportation Studies - 1993) Chapters 8 and 9 of The 1993 Airport Land Use Planning Handbook, indicate that the highest concentration of both departure- and arrival -related aircraft accidents takes place within the Runway Protection Zone and Approach Surface off the ends, and on either side of -the runway. ITEM: ALUC File No. A00-04 Consistency Finding for Renee'Jenett - Tentative Parcel Map 99-11, APN 030-160-058 & 059: A Tentative Parcel Map creating four parcels and a remainder parcel from two parcels of 0.53 and 4.7 acres in size. The proposal includes two parcels at 0.63 (+/-) acre, two parcels at 0.27 (+/-) acre, and a remainder parcel of 3.43 (+/-) acres. The property is zoned AR (Agricultural Residential) and is'designated as Low Density Residential. by the General Plan. FOR: Airport Land Use Commission Meeting of July 19, 2000 SUMMARY: Staff recommends ALUC find the project consistent with the Oroville Municipal Airport CLUP as amended December 29, 1999. ANALYSIS: According to` the newly adopted Oroville Airport Land Use Plan, Safety Zone Map "7-1," the project is located in Safety Zone 7, "Airport Area of Influence": The newly adopted 1999 CLUP Density Table shows the criteria of the affected airport safety zones, as follows: • MAXIMUM ACCEPTABLE DENSITY• 1985 Oroville Municipal Airport CLUP as amended on December 29, 1999 No. Safety Zone People per Acre/Criteria Dwelling Units per Acre 7 Airport Area of Influence No limit / CDHI 4. 1* *The minimum parcel size is 8,000 square feet. Development in zone 7 is also subject to a number of conditions`and criteria as follows: Criterion "C" : Caretaker residences are a compatibleuse within all CNEL ranges, provided that they are ancillary to the primary use of a property, intended for the purpose of property protection or maintenance, and subject to the condition that all residential units be designed to limit intruding noise such that interior noise levels do not exceed 45 CNEL, with windows closed, in any habitable room. • Butte County • Airport Land Use Commission • N Criterion "D": Measures to achieve an interior noise level of 45 CNEL must be incorporated into the design and construction of portions of buildings where the public is received, office areas, &rid other areas where people work or congregate. Criterion "H": Communication Towers (Excluding airport related facilities): 1. Prohibited in all safety zones except Zone 7. Free Standing Towers: ` 1. Alternative orange and white paint starting at 30 feet above the ground. 2. Strobe lighting at the top of the tower and shielded from striking the ground for one mile. Towers with Guy Wires: Starting at 30 feet above the ground: a. Blinking lights along length of tower and guy wires at 20 foot intervals. b. Three feet in diameter orange safety markers attached at 20 foot intervals on tower and guy wires. Criterion "I": Public and Quasi -Public: Prohibited Uses: Churches, nursing care facilities, hospitals, colleges and universities, elementary and secondary schools, child care facilities and similar aggregations of people. As the proposed project is a single family residential land division, the above criteria are not applicable. The zoning for the project. site is AR - Agricultural Residential. This zone allows for development of single family residential lots as small as 6,500 square feet. The smallest parcel proposed by this project is 11,400 square feet which exceeds the 8,000 square foot minimum called for in the Airport Area of Influence. Other uses allowed in the zone subject to a Use Permit are multiple family dwellings; care homes, and schools. All of these uses are subject to a Use Permit; until the County brings their General Plan into conformity with the airport land use plan or overrides the plan, these Use Permits must be forwarded to the ALUC for review. The 1999 CLUP amendment requires an avigation easement for all projects within the airport area of influence. This is a condition in which the easement is made a requirement of the parcel map in the findings below. Airspace Protection and Safety: The topography of the project indicates that there are no transitional surface problems. The subject property is located in a relation a down slope, with a topographic elevation that is approximately the same elevation of the airport. The horizontal surface is at 340 feet above sea level, significantly lower than the airport. Approach surfaces would not be affected by any residential construction on this property. The existing CLUP recommends that an avigation easement be obtained to protect future airport operations and that light and glare restrictions are also required. The 1985 CLUP for the Oroville Municipal Airport, as amended on December 29, 1999, does not contain diagrams which depict the locations of potential aircraft related accidents for the facility. • Butte County • Airport Land Use Commission • 2 Therefore, staff consulted general accident scatter information presented within The 1993 Airport Land Use Planning Handbook. Figure 8C on page 8-10 of the Handbook shows accident location data collected by Hodges and Shutt for 14 general aviation airports. The figure indicates that the highest concentration of both departure- and arrival -related aircraft accidents takes place within the Runway'Protection Zone and Approach Surface. Exhibit 8F on page 8-32 of the Handbook.shows accident sites for runways,less than 6,000 or more feet in length. This information is also based on data collected by Hodges 'and: Shutt. Again, a majority of departure- and arrival -related accidents are shown to be concentrated offthe ends and on either side of the runway. Figure 9E on page, 9-13 of the Airport Land Use Planning Handbook is based on accident scatter data collected: (by the University of California, Berkeley, Institute of Transportation Studies, 1993) which demonstrate similar findings. Due to the project site's location approximately 10,000 feet away and more than 5,000 feet off center of the main runway, the accident potential is very low based on the above data. Environmental Documentation: No environmental documentation was submitted with the project materials. RECOMMENDATION: Staff recommends that the Butte County Airport Land Use Commission find that ALUC File No. A00-04 (Renee Jenett - Tentative Parcel Map 99-11, APN 030-160-058 & 059): is consitent.with the 1985 Comprehensive Land Use Plan (CLUP) for the Oroville Municipal Airport, as amended on December 29, 1999, contingent upon the requirements in Section 3 related to the final map and as noted in the findings presented in Exhibit "A".
