Street, in Thermalito. •`` , Mr. Michelena gave a brief summary of the project. Chairman Hennigan noted the fine job done by the City of Oroville by bringing their City General - `_ Plan into'conformity with the CLUP. i Commissioner Teitelman said there was a discrepancy between how the County handles opensspace requirements in the C zone and how it is handled by the City. He discussed the need for open space in the northeast area of Oroville. s i ! Mr..Michelena pointed out that the CLUP addresses open space in the entire C zone and nota A - particular area. He said staff is abiding by what is in the CLUP. Commissioner Teitelman.said the City zoning ordinance requires 10 percent open space. Chairman, Hennigan said he is part of a Committee working on the open 'spaces requirements and the u Committee is working with the-City of Chico. The hearing was opened to the public. No one was present to speak on this item. No structures of the project will extend into protected airspace. SECTION 3: PROJECT CONDITIONS 1. Provide a deed notice for the sale of all resulting lots notifying purchasers of the proximity of the airport and the potential for possible noise related impacts in an ALUC-approved disclosure notice. 2. Place a note on a separate document which is to be recorded concurrently with the final map or on an additional map sheet that states: "Airspace review by the Airport Land Use Commission is required for all objects over 100 feet in height." 3. Prior to the recordation of the Final Map record as a separate instrument an Avigation Easement granting the right of continued use of the airspace above the proposed parcels by the Oroville Municipal Airport and acknowledging any and all existing or potential airport operational impacts. 4. BACKGROUND: • The project parcels are currently developed with five single-family dwellings. • The property is within the sphere of influence of the City of Oroville and is zoned A -R (Agricultural Residential) and has a General Plan Land Use Designation of Low Density Residential. • The proposed subdivision map would create 40 single-family residential .lots with a density -„ of approximately 4.0 dwelling units per acre. ANALYSIS: • The project site is located approximately 1.36 miles northeast and 0.89 miles to the east of the extended centerline of runway 1:19. • . That's a hard question, particularly for small lots and for lots that may lie within more than one airport compatibility zone. And of course many of the provisions haven't been "put to the test" yet. The "open space" provision of our zoning ordinance is attached. We adopted the "project -by -project" requirement because it seemed the only way we could say our approvals were consistent with the CLUP until such time as we could provide a more regional solution. City staff has discussed acquiring one or more properties at the north end of the runways to preserve as open space, and then we could require pro -rata reimbursement from subdividers instead of allowing them to provide small, less useful open space areas on their own property. The time required to implement that proposal hasn't been available so far. And it's likely that developers who want to "avoid" wetlands on their own site will not want to have to pay a,fee, if the area they are.avoiding meets minimum airport open space requirement. So far, we've accepted unimproved wetland areas as -open space. I imagine we may propose to amend our ordinance to allow a property that lies within more than one zone to cluster all of the open space into one area rather than separate it between the various zones if the -result is a more useful open space area. But our ordinance does require that open space be provided on each developing site, until we have a "buy -in" fee alternative. There is no minimum parcel size exclusion, but the variance procedure is technically available if the requirement creates a hardship. We haven't had subdivisions proposed that are too small to provide the required area. Some of the non-residential properties may have a problem, but we haven't had to address that issue yet. The attached ordinance language indicates the City could require development of small contiguous sites to be located or even clustered in a manner that might reserve a useful open space area between all of them. I hope this information is "on point" so to speak. My reference at the last meeting was to the fact that there is already more than the required amount of open space for the Oroville Airport in each and all of the compatibility zones. However,'the permanent open space isn't spread uniformly around the zones, and City staff would like to see some permanent and useable open space within the B-2/C zone area at the north end of the runways. I'm asking this question of the Planning Manager for the City of Oroville. I have an ALUC project (and the actual Tentative Subdivision Map project) for a parcel in the "C" Compatibility Zone for the Oroville Municipal Airport. The parcel is not in the City of Oroville, nor is there any annexation proposed. I normally don't send ALUC projects to the other jurisdictions, but would send the TSM project for review. If I remember correctly, at the last ALUC meeting you mentioned that the City of Oroville is requiring open space 4/25/2006 • Page 2 of 2 for projects within the City so all the open space requirements (10% in the "C" Compatibility zone) are not in one or two locations. How at a City level are you meeting the open space requirement for the different airport compatibility zones for projects that are in areas of existing development and may not have enough area to meet the requirements? Is it an automatic requirement that they meet the 10% requirement in the "C zone? Is there a minimum project parcel size that triggers meeting the open space requirement?
