FOR: Airport Land Use Commission Meeting on March 20, 2002 SUMMARY: Staff recommends that ALUC find the project consistent with the 2000 Airport Land Use Compatibility Plan for the Oroville Municipal Airport. BACKGROUND: The site is located approximately 4,500 feet off of the north end of runway 12-30 of the Oroville Municipal Airport. The property is within the unincorporated area of Butte County. The current General Plan land use designation for the property is Commercial within 300 feet of Oro Dam Boulevard and Medium Density Residential on the remainder which is the area being requested for rezone. Zoning for the site is split with a C-2 designation on the front portion and R-3 designation on the rear. The site is developed with a single family dwelling located within the existing commercially zoned area. The parcel size is a total of 4.77 acres . The applicant proposes to change the General Plan designation so that the entire property is designated Commercial with a zoning of C-2. ANALYSIS: A rezone is a legislative act and is required by Section 21676 of the Public Utilities Code to be reviewed by ALUC prior to any action being taken by the legislative body. According to the 2000 Airport Land Use Compatibility Plan (ALUCP) for the Oroville Municipal Airport, the property is located in a Traffic Pattern Compatibility Zone "C" — Traffic Pattern Zone. The property is not under any approach surface nor is it within the 55 dB CNEL contour. The primary tool for evaluating compatibility of specific non-residential uses is "intensity of use" in terms of persons per acre, as listed in Table 2A of the ALUCP. Compatible non-residential development in the C zone allows an average concentration of 100 people per acre with a maximum concentration of 300 people on any single acre. With special building construction designed to provide greater protection in the event of an aircraft accident, up to 390 persons may be allowed on a single acre. As applied to this particular parcel, the intensity of use would be limited to an average of 400 people (4.0 acres X 100 people per acre). The applicant has stated that if the rezone i8utte County /Airport Land Use Commission i 1 is successful, she intend to develop the site with mini -storage units. The anticipated number of people on the property would average about 10 at any one time. The existing R-3 zone would allow up to 13 dwelling units per acre for a total of 52 dwelling units, which would be compatible with the C-2 Compatibility Zone. The C-2 zone would also be compatible in that the wide range of commercial uses permitted would not normally result in a concentration of people that would exceed the recommended intensity of use. Attached is a copy of the County's C-2 zoning regulations. Environmental Documentation: No environmental documentation has been completed for this project. RECOMMENDATION: Staff recommends that the Butte County Airport Land Use Commission find ALUC File No. A02-01 (Ellen Henn) would be consistent with the 2000 Airport Land Use Compatibility Plan for the Oroville Municipal Airport. The following findings have been prepared at the direction of the ALUC and are for the consideration of the Lead Agency (City of Oroville) when making a decision on the project. SECTION 1: ENVIRONMENTAL FINDINGS A. No environmental documentation was submitted at the time of project review. SECTION 2: CONSISTENCY FINDINGS FOR PROPOSED PROJECT A. (2) Manufacturing of clothing, handicraft products, printing, lithographing and other light manufacturing or industrial uses of similar character. (3) Public or quasi -public uses not specifically allowed in Section (a), above. (4) Shopping malls and shopping centers on sites of five (5) acres or greater, commercial recreation uses, kennels and small animal hospitals, and mortuaries. (5) Recycling facilities as per Section 24-275. (6) Residential uses not in conjunction with a permitted use, recreational vehicle parks, multi -family dwellings, and mobile home parks. (d) Uses requiring an Administrative Permit. The following uses may be permitted subject to the requirements of Section 24-40: (1) Temporary uses as listed in Section 24-300. (2) Reverse vending machine and small collection recycling facilities pursuant to Section 24-275. (e) Site requirements: The following site requirements shall apply: (1) Lot width required: Minimum lot width shall not be less than forty-five (45) feet for commercial uses.
