consistency review of a proposed Tentative Subdivision Map (TSM 05-12), which
would create 18 residential lots on 4.4 acres. The project site is located on the east
side of on the east side of 10"' Street, approximately 1,800 feet north or Oro Dam
Boulevard, in the Thermalito area of Oroville.
SUMMARY:
Staff recommends that ALUC find the project consistent with the 2000 Airport Land Use
Compatibility Plan for the Oroville Airport.
BACKGROUND:.
• The existing parcel is approximately 4.4 acres in size. The project site is vacant. Surrounding
uses include mostly residential uses, except for commercial uses to south.
• The property is within the unincorporated area Butte County. It is located in the urban area
and sphere of influence area for the City of Oroville.
• The project area is designated Low Density Residential by the Land Use Element of the
General Plan and is zoned Agricultural Residential.
• Residential lot sizes range in size from approximately 7,800 square feet (0.18 ac) to 11,900
square feet (0.27 ac). Proposed uses are single family dwellings.
• The height of the tallest object on the project site (including antennas and trees) is not
anticipated to be higher than 100 feet above ground level. Current Butte County does not
have a height requirement in the Agricultural Residential zone.
• The project site is located approximately 1.7 miles east of runway 12/3 J `of the Oroville
Airport and is located approximately 1.1 miles southeast of runway centerline.

• The project site is outside the 55 dB CNEL noise contour.
ANALYSIS:
• This project is a major land use action as defined by Policy 1.5.3 of the 2000 Butte County
Airport Land Use Compatibility Plan (ALUCP).
• The primary criteria for Compatibility Zones C and D are shown on the following table:

Note 1. Residential development should not contain more than the indicated number of dwelling units (both
primary and secondary) per gross acre. With clustering, some parcels may 3e much smaller than the
others as long as the maximum overall density criterion is not exceededl Clustering of units is
encouraged in Compatibility Zones 132 and C — see Policy 4.2.6 for limitations.
9. Hazards to flight include physical (e.g., tall objects), visual, and electronic firms of interference with
the safety of aircraft operations. Land use development which may cause the attraction of birds to
increase is also prohibited. See the supporting compatibility policies on airspace protection (Policies
4.32 and 4.3.6) for details.
• The project would result in 18 residential lots, which is a density of 4.09 dwelling units per
acre (with an average parcel size of 0.24 acres).
ENVIRONMENTAL DOCUMENTATION:
No environmental documentation has been completed for this project.
RECOMMENDATION:
Staff recommends that the Butte County Airport Land Use Commission End ALUC File No.
A05-12 William Baker, consistent with the 2000 Airport Land Use Compatibility Plan for the
Oroville Airport.

CONSISTENCY FINDINGS FOR ALUC File No. 05-12 (William Baker),
APN 030-160-006
The Airport Land Use Commission (ALUC) has prepared the following findings based on data
contained in the 2000 Airport Land Use Compatibility Plan (ALUCP) for the Oroville Municipal
Airport, as well as site specific information submitted by the applicant and ALUC staff.
The following findings have been prepared at the direction of the ALUC and are for the
consideration of the Lead Agency (County of Butte) when making a decision on the project.
SECTION 1: ENVIRONMENTAL FINDINGS
A. No environmental documentation was submitted at the time c project review.
SECTION 2: CONSISTENCY FINDINGS FOR PROPOSED PROJECT
A. The proposal for the Del Amo Estates Tentative Subdivision Map (TSM 05-12),
which would create 18 residential lots on 4.40 acres, is consistent with
Compatibility Zone D as found in the 2000 Airport Land Us,- Compatibility Plan '
for the Oroville Airport.
SECTION 3: PROJECT FINDINGS:
A.- The project site is located in Airport Compatibility Zone D as listed in the 2000
Airport Land Use Compatibility Plan for the Oroville Airport.
B. The project is consistent with Compatibility Zone D because there are no parcel
size or density limitations.
C. ' . No structures on the project site would extend into protected airspace.
E. The project site is outside of the 55 dB CNEL'noise contour.
SECTION 4:. PROJECT CONDITIONS:
1. Airspace review by the Airport Land Use Commission required for objects more
than 100 feet tall.

Dear Mr. Wood,
On January 5, 2005, the Butte County Inter -Departmental Review Committee (IDR)
reviewed the above referenced project for compliance with County regr-lations. It was
determined that the project is incomplete for the following reason:
L' . The project site is located within Airport Compatibility Zone "D" of the Oroville
Municipal Airport. Please refer the attached map that shows the location of the
project site relative to the Airport Compatibility Zones. Because t1 -.e project site is
located within an Airport Compatibility Zone and determined to be a major land
use action per Section 1.5.3(d) of the Butte County Airport Land Use
Compatibility Plan, a consistency review of the project by the Butte County
Airport Land Use Commission (ALUC) is required.
An application for a consistency review by the ALUC is attached. The current fee
for an ALUC consistency review is $1,531.00.

There were a couple of other issues that will need to be addressed prio- to taking the
project to hearing.
The proposed cul-de-sac is longer than the allowed maximum length of 50C feet per Butte
County Code (BCC) 20-133. The proposed cul-de-sac currently measures 527 feet. You
can either reduce the length to 500 feet or less, or ask for an exception per QCC 20-4).

Project Description for Del Amo Estates
an 18 Lot Public Street Residential Subdivision
Del Amo Estates is proposing 18 lots which are to vary from 7773 sf to 11805 sf. The
sewer and water services for these lots are to be provided by Thermalito Irrigation
District. The first flush created by storm water runoff will be mitigated on site via an
underground storage system. The 10 year storm drainage event will be detained on site
allowing the pre -development 10 year equivalent storm event to be conveyed to the
existing drainage along Tenth Street. The public right of way is to be built to Butte
County improvement standards and dedicated to the County of Butte.
