ITEM: ALUC File No. ALUC07-0001 M&T Tentative Subdivision Map, APN 030-
350-095 & 102: A consistency review for the proposed Tentative Subdivision
Map, which would divide two parcels totaling 7.5 acres into 29 single-family
residential lots and two dentition ponds. The parcels are located at the southwest
corner of Sierra Avenue and 12th Street and extending south to front on Feather
Avenue (approximately 300 feet west of 12th Street), in the Thermalito area of
Oroville. -
SUMMARY:
The project proposes a tentative subdivision map to divide two parcels totaling 7.5 acres into 29
single-family lots. The project parcels are located within the C Compatibility Zone of the
Oroville Municipal Airport. Staff recommends that ALUC find the proposed subdivision
consistent with the 2000 Butte County Airport Land Use Compatibility Plan for the Oroville
Municipal Airport.
BACKGROUND:
• The project parcel is 7.5 acres and is developed with two single family dwellings (to be
removed).
• The property is within the sphere of influence of the City of Oroville and is zoned by Butte
County as A -R (Agricultural Residential) and has a General Plan Land Use Designation of
Low Density Residential.
• The proposed subdivision map would create 29 single-family residential lots with a density
of approximately 3.8 (gross) dwelling units per acre and 5.4 (net) dwelling units per acre.
• The residential parcels size range in size from 6,534 square feet to 8,276 square feet.
• The project site is located approximately 1.37 miles northeast and 0.58 miles to the east of
the extended centerline of runway 1:19.

• The residential density of 4.4 dwelling units per acre (net) of the project is consistent with
Airport Compatibility Zone C.
• The 10% open space requirement of the project is 32,670 square feet. The project is not
proposing to provide open space; however, more than 50 percent of the C Compatibility
Zone is zoned Resource Conservation and dedicated as open space.
ENVIRONMENTAL DOCUMENTATION:
No environmental documentation has been completed for this project by ALUC staff. Your
Commission's review of the proposed project and determination of consistency is not a "project"
under the California Environmental Quality Act. Determination of environmental review will be
completed during the process of the Tentative Subdivision Map by the Butte County Planning
Division.
RECOMMENDATION:
Staff recommends that the Butte County Airport Land Use Commission find ALUC File No.
ALUC07-0001 (M&T Subdivision) consistent with the 2000 Airport Land Use Compatibility
Plan for the Oroville Municipal Airport.

CONSISTENCY FINDINGS FOR:
ALUC File No. ALUC07-0001: M&T Subdivision
APN 030-350-095 & 102
The Airport Land Use Commission (ALUC) has prepared the following findings based on data
contained in the 2000 Airport Land Use Compatibility Plan (ALUCP) for the Oroville Municipal
Airport, as well as site specific information submitted by the applicant and ALUC staff.
The following findings have been prepared at the direction of the ALUC and are for the
consideration of the Lead Agency (Butte County) when making a decision on the project.
SECTION 1: ENVIRONMENTAL FINDINGS
A. No environmental documentation has been completed for this project by ALUC
staff. Your Commission's review of the proposed project and determination of
consistency is not a "project" under the California Environmental Quality Act.
Determination of environmental review will be completed during the process of
the Tentative Subdivision Map by the Butte County Planning Division.
SECTION 2: CONSISTENCY FINDINGS FOR PROPOSED PROJECT
A. The proposed 29 residential dwellings, at a net density of 5.4 dwelling units per
acre, are consistent with Compatibility Zone C.
B. There is more than 50 percent of Compatibility Zone C zoned Resource
Conservation and dedicated as open space.
C. The project site is outside of the 55 dB CNEL noise contour.
D. No structures of the project will extend into protected airspace.
SECTION 3: PROJECT CONDITIONS:
1. Provide a deed notice for the sale of all resulting lots notifying purchasers of the
proximity of the airport and the potential for possible noise related impacts in an
ALUC-approved disclosure notice.
2. Place a note on a separate document which is to be recorded concurrently with the
final map or on an additional map sheet that states: "Airspace review by the
Airport Land Use Commission is required for all objects over 100 feet in height."
3. Prior to the recordation of the Final Map record as a separate instrument an
Avigation Easement granting the right of continued use of the airspace above the
proposed parcels by the Oroville Municipal Airport and acknowledging any and
all existing or potential airport operational impacts.

4. Place a note on a separate document which is to be recorded concurrently with the
