(Linkside Place, LLC), APN 030-260-018, 030-260-019 - — V and 030-260-025: A consistency review for a proposed general plan amendment and rezone for three parcels totaling 115.4 acres within the C, B2, B1 & A Compatibility Zones of the Oroville Municipal Airport. The purpose of the application is annexation . a to the City of Oroville and a Planned Unit Development subdivision that includes 341 single -family parcels, a five acre park and designated open space. The project parcels are located on the south side of Oro Dam Boulevard, south of the Linkside Place Phase 1 and 2 subdivisions. Chairman Sherman asked if she should step down for hearing this item due to the fact that she works for the City of Oroville. Mr. Thistlethwaite felt that as Ms. Sherman is sitting as an individual member of the ALUC and that the Cityof Oroville has not taken any formal action, either at the Planning Commission or the Board of Supervisors' level with regards to this project, and that does not create any incompatibility of office. Commissioner Harp recused himself from this hearing. Mr. Michelena gave a brief summary of the project. Chairman Sherman said that annexation will be proposed and this is a pre-zoning change requested k 1, by the Cityof Oroville. She noticed with the third item on the agenda they are acknowledging the ' fact that the open space is supposed to be area wide within each one of the zones. She said Oroville did some calculations and Oroville is very fortunate that they have wildlife areas, the Forbay, the .r Afterbay, etc. as open space. She said they more than exceed the 10%, open space requirement. She,, noted that there is not much open space to the north and they are hoping to come up with more open r , space in that area. ► ' • +... y ° Commissioner Hennigan asked with regards to the B1 and B2 zones, how the area will remain open space. t Mr. Michelena said he believed the City of Oroville ,is' proposing a Resource Management General Plan and Open Space zoning. Chairman Sherman said he was correct and noted that there are additional wetlands on this property'` that will be subject to a core of engineer conservation easement, but they will be zoning the property , open space and it will remain in resource management and there will be no development allowed.. Commissioner Hennigan said in the B2 zone there could be certain industrial uses. Chairman Sherman said there should be a condition on LAFCo's finding of consistency, that the,. dedicated open space shall be made in perpetuity. She said the applicant has not done all of the engineering for the project. ` Commissioner Hennigan suggested a condition stating that the project is contingent upon its being consistent with the Oroville City General Plan. Mr. Michelena suggested adding Conditions 6 and 7 to state: "6. Proposed open space shall remain - in open space uses in perpetuity and protected by easement, zoning, or dedication. '7. Place a note on a separate document which is to be recorded concurrently with the final,map,or on. an additional map sheet that states: "Residential densities (dwelling units per acre) in Compatibility Zone C shall be consistent with the City of Oroville General Plan." BACKGROUND: ` • The project parcels are currently undeveloped. ry . • The project parcels are located adjacent, and to the west, of Table Mountain Golf Course and the Oroville Municipal Airport.
