The Airport Land Use Commission (ALUC) has prepared the following findings based on data ,
contained in the 2000 Airport Land Use Compatibility Plan (ALUCP) for the Oroville Municipal
Airport, as well as site specific information submitted by the applicant and ALUC staff. r •Y
The following findings have been prepared at the direction of the ALUC and are for the consideration
of the Lead Agency (Butte County) when making a decision on the project. -
SECTION 1: ENVIRONMENTAL FINDINGS, ,
A. No environmental documentation has been completed for this project by ALUC staff.
Your Commission's review of the proposed project and determination of consistency
is not a "project" under the California Environmental Quality Act. Determination of
environmental review will- be 'completed . during the process of the Tentative
Subdivision Map by the Bute County Planning Division. r

On May 17, 2006, the Airport Land Use Commission (ALUC) found the referenced project to be consistent
subject to the following conditions:
1. Provide a deed notice for the sale of all resulting lots notifying purchasers of the proximity of the
airport and the potential for possible noise related impacts in an ALUC-approved disclosure notice.
2. Place a note on a separate document which is to be recorded concurrently with the final map or on an
additional map sheet that states: "Airspace review by the Airport Land Use Commission is required
for all objects over 100 feet in height."
3. Prior to the recordation of the Final Map record as a separate instrument an Avigation Easement
granting the right of continued use of the airspace above the proposed parcels by the Oroville
Municipal Airport and acknowledging any and all existing or potential airport operational impacts.
4. .Place a note on a separate document which is to be recorded concurrently with the final map or on an

Tentative Subdivision Map, which would divide a 2.1 acre parcel into 8 single-
family residential lots. The project site is located on the east side of 12`" Street,
approximately 600 feet south of Nelson Avenue, at 2134 12`x' Street, in the
Thermalito area of Oroville.
SUMMARY: ,
Staff recommends that ALUC find the project consistent with "D" zone of the 2000 Airport Land
Use Compatibility Plan for the Oroville Municipal Airport.
BACKGROUND:
• The project parcel is 2.1 acres and is developed with a single family dwelling (to remain).
• The property is within the sphere of influence of the City of Oroville and is zoned A -R
(Agricultural Residential) and has a General Plan Land Use Designation of Low Density
Residential. .
• The proposed subdivision map would create 8 single-family residential lots with a density of
approximately 3.8 dwelling units per acre.
• Parcel sizes range from 6,800 square feet to 11,400 square feet.
ANALYSIS:
• The project site is located approximately 2.28 miles northeast and 0.15 miles to the east of
the extended centerline of runway 1:19.
• The project site is within Airport Compatibility Zone�D (Traffic Pattern).
