Forrester/Kevin Haves, 031-281-030, -031 - 136: A consistency review of a proposed Tentative Subdivision Map, which would create 18 residential lots on 3.6 acres. The project site is located on Thermalito Avenue, between 7`h and 10`h Street, in the Thermalito area of Oroville. SUMMARY: Staff recommends that ALUC find the project consistent with the 2000 Airport Land Use ; Compatibility Plan for the, Oroville Municipal Airport. BACKGROUND: • The existing parcel is approximately 3.6 acres in size. The project site is vacar_.t. Surrounding uses include mostly residential uses and vacant land. • The property is within the unincorporated area Butte County. It is located in the urban area and sphere of influence for the City of Oroville. • The project area is designated Low Density Residential on the Land Use Map. of the Butte County General Plan and is zoned A -R (Agricultural Residential). • The average parcel size is 0.2 acres. Proposed uses are single family dwellings. • The height of the tallest object on the project site (including antennas and trees) is not anticipated to be higher than 100 feet above ground level. Current Butte County does not have a height requirement in the Agricultural Residential zone. • The project site is located approximately 2 miles northeast of runway 1-19 of the Oroville Municipal Airport and is located approximately 0.9 miles southeast of the ex tended runway centerline. • The project site is within the Airport Compatibility Zone D (Traffic Pattern). ` • The project site is outside the 55 dB CNEL noise contour. ■ Butte County Airport Land Use Commission ■ ALUC File No. A 05-14 (Forrester) ■ ■ February 16, 2005 ■ Page 1 of 5 ■ ANALYSIS: • This project is a major, land use. action as defined by Policy 1.5.3 of the 2000 Butte County Airport Land Use Compatibility Plan (ALUCP). • The project site is locaied within Compatibility Zone D, which has no limit for required densities or land uses. • The primary criteria for Compatibility Zone D is shown on the following table: Zone Maximum Densities Req'd Open Prohibited Uses Other Development Residential (du/ac)' Land Conditions Airspace review D . Residential development should not contain more than the indicated number of dwelling units (both primary and secondary) per gross acre. With clustering, some parcels may be muaz smaller than the others as long as the maximum overall density criterion is not exceeded. Clustering of units is encouraged in Compatibility Zones 132 and C — see Policy 4.2.6 for limitations. 9. Hazards to flight include physical (e.g., tall objects), visual, and electronic forms of interference with the safety of aircraft operations. Land use development which may cause the attraction of birds to increase is also prohibited. See the supporting compatibility policies on airspace protection (Policies 4.32 and 4.3.6) for details. • The project would result in 18 residential lots on 3.6 acres, which is a density of 5 dwelling units per acre (with an average parcel size of 0.2 acres). ENVIRONMENTAL DOCUMENTATION: No environmental. documentation has been completed for this project. The applicznt has applied for an ALUC consistency determination prior to filing a Tentative Subdivision Map application with the County. , RECOMMENDATION: Staff recommends that the Butte. The following findings have. been prepared at the direction of the ALUC and. are for the consideration of the Lead Agency (County of Butte) when making a decision on the project. SECTION 1: ENVIRONMENTAL FINDINGS A. No environmental documentation was submitted at the time of project review. SECTION 2: CONSISTENCY FINDINGS FOR PROPOSED PROJECT A. The proposal for the proposed Tentative Subdivision Map for Forrester/Hayes, which would create '18 residential lots on 3.6 acres, is consistent with Compatibility Zone D as found in the 2000 Airport Land Use Compatibility Plan for the Oroville Municipal Airport. SECTION 3: PROJECT FINDINGS: A. The project site is located in Airport Compatibility Zone D as listed in the 2000 Airport Land Use Compatibility Plan for the Oroville Airport. B. The project is consistent with Compatibility Zone D because there are no parcel size or density limitations. C. No structures on the project site would extend into protected airspace. E. The project site is outside of the 55 dB CNEL noise contour.. SECTION 4: PROJECT CONDITIONS: 1.
