(530) 538-7601 FAX (530) 538-7785'• Planning Division EXHIBIT A AUG 1 9 X99 BUTTE COUNTY AIRPORT LAND USE COMMISSION ®t'OVIH9, C&�Of1118 CONSISTENCY FINDINGS FOR: A99-08 (Butte County UP99-21 - First United Pentecostal Church) on APN 031-253-046 The Airport Land Use Commission has prepared the following findings based upon data contained within the 1985 Oroville Airport Comprehensive Land Use Plan. This data, in turn is based upon the findings of a number of studies, documents and reports generated by individuals, firms and agencies recognized as having expertise in the field of Airport Land Use Planning and land use compatibility. (See Exhibit Al, List of References). The following findings have been prepared at the direction of the ALUC and are for the consideration, of the County of Butte (local agency) when making a decision on the project. Section 1: ENVIRONMENTAL FINDINGS A. No environmental documentation was submitted at the time of review. Section 2: PROJECT CONSISTENCY FINDINGS A. Chapter 3 of the 1993 Airport Land Use Planning Handbook identifies- four functional categories that address airport land use compatibility concerns. These include: Land Use Compatibility/Overflight Protection, Safety, Airspace Protection and Noise., The applicant's proposal has been found to be consistent with protection measures in the 1985 Oroville Airport Comprehensive Land Use Plan designed to address all four categories: Land Use Com atibility/Overflight Protection 1. According to Butte County Building Department estimates the proposed facility could theoretically result in a concentration of 183 to 237 persons per acre depending upon whether or not fixed seating (pews) ' or folding chairs are utilized. This figure .would only be achieved during services or special events and not occur on a daily basis. The typical number of persons regularly occupying the site will be much lower. Since the property. is located within close proximity to the Traffic Pattern Zone,. a potential concentration which exceeds 150 persons per.acre is of concern. Therefore, the Airport Land Use Commission is recommending occupancy limitations as noted in Section 3. • Butte County • Airport Land Use Commission • 1 Safety 2. Accident scatter information is presented within Chapters 8 and 9.of the 1993 Airport Land Use Planning Handbook. Figure 8C on page 8-10 of the Handbook shows accident location data collected by Hodges and Shutt for 14 general aviation airports. The figure indicates that the highest concentration of both departure and 'arrival related aircraft accidents takes place within the Runway Protection Zone and. Approach Surface. Exhibit 8F on page 8-32 of the Handbook shows accident sites for runways of 6,000 feet or more in length. This information is also based upon data collected by Hodges and Shutt. Again, a majority of departure and arrival related accidents are shown to be concentrated, off the ends of the runway, and on either side of the runway. Most of the accident sites are located at distances less than 10,000 feet from the end of the runway. Figure 9E on page 9-13 of the Airport Land Use Planning Handbook is based upon accident scatter data collected, by the University of California, Berkeley, Institute of Transportation Studies (1993) and demonstrates similar findings. The project site is located approximately 11,000 feet north and east of the north end of runway 1-19. Based upon the data described above, the site is not considered to have an elevated likelihood for aircraft related accidents. Airspace Protection 3. The project site is located within'the Conical Surface for the Oroville Municipal Airport. The height of the Conical Surface at the proposed building site is estimated to be 390 feet above Mean Sea Level (MSL). According to USGS topographic information, the elevation of the property is approximately 225 feet MSL. The Butte County Zoning Code does not specify a height limitation for structures within the AR district. However, the site plan information indicates a single story structure. The maximum potential project elevation is estimated to be 260 feet MSL. Therefore, the project will not result in the penetration any Far Part 77 Surfaces. Noise 4. The project site is located outside of the projected (year 2000) 55 dB CNEL contour shown in Exhibit 1 of the 1985 Oroville Comprehensive Land Use Plan. The site is also located outside of the projected (year 2010) 55 dB CNEL contour shown on plates 7 and 9 in the 1990 Master Plan for the Oroville Municipal Airport. Appendices 7 and 8 of the Environmental Impact Report for the 1985 Oroville Airport Comprehensive Land Use Plan indicate that churches are normally acceptable in areas exposed to up to 60 dB CNEL. • Butte County • Airport Land Use Commission • 2 Section 3: RECOMMENDED CONDITIONS A. Although the project has been found to be consistent with the 1985 Oroville Airport Comprehensive Land Use IPlan, the following conditions are recommended by the ALUC to further improve the compatibility of the project with airport operations: _ 1) Maximum occupancy of the facility shall be limited to 700 persons (150 persons per acre). 2) The property owner shall record an avigation easement that will run with the land notifying future property owners, heirs and assigns of the Oroville Municipal Airport's, right of continued use of the airspace above theproject parcel and acknowledging any and all existing or potential airport operational impacts. 3) Alla project lighting shall be directed within the project site and shielded to prevent adverse impacts on adjacent properties and aircraft flight activities. 4) Building and roofing materials shall be selected which do not create significant reflection or glare. • Butte County • Airport Land Use Commission • . 3 +BUTTE COUNTY AIRPORT LAND USE COMMISSION + • 7 County Center Drive, Oroville, CA 95965 • (530) 538-7601 FAX (530) 538-7785 • EXHIBIT Al List of References Data supporting the ALUC's findings have been generated from studies and reports prepared by recognized professionals and agencies with expertise in Airport Land Use Planning and land use compatibility. FOR: Airport Land Use Commission Meeting of August 18, 1999 • SUMMARY: The County of Butte is presently processing the above mentioned project and has submitted a request for comments and project maps to the ALUC for its review. Staff recommends that the Commission find the project consistent with the 1985 Oroville AirportComprehensive Land Use Plan. Staff's review consisted of land use compatibility/overflight protection, safety, airspace protection and noise sensitivity. ANALYSIS: The applicant is proposing to construct a 14,400 square foot church building divided internally into the following interior spaces: 4 classrooms'. (containing 400 square feet "each); a seating area containing 4,550 square feet; a kitchen and dining area;. offices, restrooms, storage rooms and dressing rooms. Also included in the proposal is the construction of a 900 square foot. shop building and the installation of a 24. x 60' mobile home that will be utilized as a caretaker's residence. The .4.65 acre site is currently zoned AR (Agricultural Residential). Land Use Compatibili , /Overflight'Protection ' The project site is located within the Oroville Airport Area of Influence adopted by the Butte County Airport Land Use Commission on May 21, 1997, but outside of the Clear Zone (Safety Area 1), Approach Zone (Safety Area 2), and Overflight Zone (Safety Area 3),,depicted in Exhibit 1 of the 1985 Oroville Airport Comprehensive Land Use Plan (CLUP):, The site is also located outside of all safety zones identified in the 1993 Airport Land Use Planning Handbook. Since the project is located outside of these safety areas, there is no specific compatibility criteria noted in the Plan that applies to the property. As a general rule, uses which result in concentrations greater than 25 people per acre within the airport environment are typically subject to ALUC review: The safety zone located closest to the project site is the Traffic Pattern Zone. According to recommendations within the 1993 Airport Land Use Planning Handbook, only very large assemblies of people (in the 150 or more people per acre range) need to be avoided within that zone. According to Butte County Building Department estimates, the Church facility at -maximum occupancy could accommodate 850 to 1,100 persons depending upon whether or not fixed seating (pews) or folding chairs are utilized.in the sanctuary. Dividing this figure by the acreage of the property results in an estimated concentration of 183 to 237 persons per acre. This figure would only be achieved during services or special events and not occur on a daily basis. The typical number of persons regularly occupying the site will be much lower. Since the site is located within close proximity to the Traffic Pattern Zone, a potential concentration which exceeds 150 persons per acre could be of concern. The Commission may wish to recommend occupancy limitations for the facility consistent with those suggested in the 1993 Airport Land Use Planning Handbook. &fety The 1985 Oroville Airport Comprehensive Land Use Plan does not contain diagrams which depict the locations of potential aircraft related accidents for the facility. Therefore staff consulted general accident scatter information presented within the 1993 Airport Land Use Planning Handbook. This surface extends from the outer edge "of the Horizontal Surface at a ratio of 20 feet horizontally to 1 foot vertically. The estimated linear distance from the edge of the Horizontal Surface to the proposed church building is approximately 1,000 feet. Based upon this information, the height of the Conical Surface at the proposed building site is estimated to be 390 feet above Mean Sea Level (MSL). According to USGS topographic information, the elevation of the property is approximately 225 feet MSL. The Butte County Zoning Code does not specify a height limitation for structures within the AR district. However, the. site plan information indicates a single story structure. The maximum potential project elevation is:estimated to be 260 feet MSL. Therefore, the proposal will not result in the penetration any Far Part 77 Surfaces. Noise Sensitivity According to Exhibit 1 in the 1985 Oroville Airport Comprehensive Land Use Plan, the project site is located outside of the projected (year 2000) 55 dB CNEL contour for the airport. The property is also located outside of the projected (year 2010) 55 dB CNEL contour shown on plates 7 and 9 in the 1990 Master Plan for the Oroville Municipal Airport. Appendices 7 and 8 of the Environmental Impact Report for the 1985 Oroville Airport Comprehensive Land Use Plan indicate that churches are normally acceptable in areas exposed to up to 60 -dB CNEL. Although the noise contours discussed above suggest that projected exposure in the proj ect area will be below 55 dB CNEL, it should be noted that residents may be exposed to single event noise levels and other episodes which exceed those levels. This data, -in turn is based upon the findings of a number of studies, documents and reports generated by individuals; firms and agencies recognized as having expertise in the field of Airport Land Use Planning and land use ' compatibility. (See Exhibit Al, List of References). The following findings have been .prepared at the, direction of the ALUC and are for the ' consideration of the County of Butte (local agency) when making a decision on the project. Section 1: ENVIRONMENTAL FINDINGS , A.' No environmental documentation was submitted at the time of review. Section 2: PROJECT CONSISTENCY FINDINGS A. Chapter 3 of the 1993 Airport Land Use Planning Handbook' identifies four functional categories that address airport land use compatibility concerns. These include: Land Use Compatibility/Overflight Protection, Safety, Airspace Protection and Noise. The applicant's proposal has been found to be consistent with protection measures in the 1985 Oroville Airport, Comprehensive Land Use Plan designed to address all four categories: Land Use Compatibili , /Overflight Protection 1. According to Butte County Building Department estimates the proposed facility could theoretically result in.a concentration of 183 to 237 persons per acre depending upon whether or not fined seating (pews) or, folding chairs are utilized. This figure would only be achieved, during services or special events and not occur on a daily basis. The typical number of persons regularly occupying the site will be much lower. Since the property is located within close proximity to the Traffic Pattern Zone, a potential- concentration which exceeds 150 persons per acre is of concern.. The figure indicates that the highest concentration of both departure and amval related aircraft accidents takes place within the Runway Protection Zone and Approach Surface. Exhibit 8F on page .8-32 of the Handbook shows accident sites for runways of 6,000 feet or more in lengih..This information is also based upon data collected by Hodges and Shutt. Again, a majority of departure .and arrival related accidents are shown to be concentrated off the ends of the runway, and on either side of the runway. Most of the accident sites are located at distances less than 10,000 feet from the end of the runway. Figure 9E on page 9-13 of the Airport Land Use Planning Haridbook is based upon accident scatter data collected by the University of California;, Berkeley, Institute of Transportation Studies (1993) and , demonstrates similar findings. APN 031-253-046. The following informal comments and recommendations are provided by staff based upon a cursory review of the proposal: (1) The project site is located wi hin the following: • Oroville Airport Area of Influence adopted by the Butte County Airport Land Use Commission on May 21, 1997. • The Conical Surface for the Oroville Municipal Airport. The project site is located outside of the following: • The Clear Zone (Safety Area 1), Approach Zone (Safety Area 2), and Overflight Zone (Safety Area 3), depicted in Exhibit 1 of the 1985 Oroville Airport Comprehensive Land Use Plan (CLUP). • The projected 55 dB CNEL contour for the Oroville Municipal Airport depicted in Exhibit 1 of the CLUP. • All safety zones identified in the 1993 Airport Land Use Pkuming Handbook. However, it is near the outer edge of the Traffic Pattern Zone. • Butte County # Airport Land Use Commission 1 . w. (2) Land Use CompatibiliWSafetX Staff reviewed the request pursuant to the currently adopted Oroville Airport Comprehensive Land Use Plan (1985). The project site is located outside of the ALUC Planning Boundary and Overflight Zone identified within Exhibit 1. However, it is within the Oroville Airport Area of Influence adopted by the ALUC in May 1997. Exhibit 2 "Land Use Guidelines for Safety Compatibility Only" within the 1985 CLUP provides land use and safety compatibility information for uses which fall within Safety Areas 1, 2 and 3. Since the project is located outside of these safety areas, there is no specific compatibility criteria noted in the Plan that applies to the property. As a general rule, uses which result in concentrations greater.than 25 people per acre within the airport environment are typically subject to ALUC review. The safety zone located closest to the project site is the Traffic Pattern Zone. According to recommendations within the 1993 Airport Land Use Planning Handbook, only very large assemblies of people (in the 150 or more people per acre range) need to be avoided. According to Butte County Building Department estimates, the . Church facility at maximum occupancy could accommodate 850 to 1,100 persons depending upon whether or not fixed seating (pews) or folding chairs are utilized in the sanctuary.. Dividing this figure by the acreage of the property results in an estimated concentration of 183 to 237 persons per acre. Staff recognizes that this figure may only be achieved during services or special events and will not occur on a daily basis. The typical number of persons regularly occupying the site will be much lower. However, a potential concentration which exceeds 150 persons per acre is likely to be of concern to the Airport Land Use Commission. (3) Airspace Protection Since the 1985 Oroville Airport Comprehensive Land Use Plan does not contain diagrams depicting the location of the FAR Part 77 Surfaces for the airport, Staff consulted an exhibit within the 1992 Airport Facilities and Land Use Manual prepared by P & D Aviation to determine the location of those surfaces. According to that document, the project site is located within the Conical Surface for. the Oroville Municipal Airport. This surface extends from the outer edge of the Horizontal Surface at a ratio of 20 feet horizontally to 1 foot vertically. The estimated linear distance from the edge'ofthe Horizontal Surface to the proposed church building is approximately 1,000 feet. Based upon this information, the height of the Conical Surface at the proposed building site is estimated to be 390 feet above Mean Sea Level (MSL). According to USGS topographic information, the elevation of the property is approximately 225 feet MSL. The Butte County Zoning Code does not specify a height limitation for structures within the AR district. However, the site plan information indicates a single story structure. The maximum potential project elevation is estimated to be 260 feet MSL. Therefore, the project will not result in the penetration any Far Part 77 Surfaces. e Butte County • Airport Land Use Commission • 2 ," " . #w (4) Noise Compatibility According to Exhibit 1 in the 1985 Oroville Airport Comprehensive Land Use Plan, the project site is located outside of the projected (year 2000) 55 dB CNEL contour for the airport. The site is also located outside of the projected (year 20 10) 55 dB CNEL contour shown on'plates 7 and 9 within the 1990 Master Plan for the Oroville Municipal Airport. According to Appendices 7 and 8 of the Environmental Impact Report for the 1985 Oroville Airport Comprehensive Land Use Plan, churches are normally acceptable in areas exposed to up to 60 dB CNEL.' Summary (5) - Based upon the above it appears that the proposal is consistent with the 1985.Oroville Airport Land Use Plan. However, formal consistency findings must be made by the Airport Land Use Commission. The following conditions are likely to be recommended by the ALUC to improve the compatibility of the project with airport operations: A. The property owner shall record an avigation easement that will run with the land notifying future property owners, heirs and assigns of the Oroville Municipal Airport's right of continued use of the airspace above the project parcel and acknowledging any and all existing or potentialairport operational impacts. B. Maximum occupancy of the facility shall be limited'to 700 persons (150 persons per acre). C. All project lighting shall -be directed within the project site and shielded to prevent adverse impacts on adjacent properties and aircraft flight activities. D. Building and roofing materials shall be selected which do not create significant reflection or glare. The property is designated Medium Density Residential (1.3 units per gross acre) and zoned R-3 (Residential). The project site is located on the west side of Burnap Avenue, approximately 400 feet north of the intersection of Burnap and East Lassen Avenues, Chico. FOR: Airport Land Use Commission Meeting of July 21, 1999 SUMMARY: The County of Butte is presently processing the above mentioned project. and has submitted a request for comments and project maps to the ALUC for its review. Staff recommends that the Commission find the project consistent with the 1998 Chico Municipal Airport Environs Plan (CMAEP). Staffs review consisted of overflight protection/land use compatibility, safety, airspace protection and noise sensitivity. ANALYSIS: The applicant is proposing a Tentative Parcel Map to subdivide a 2.0 acre parcel into two 1.0 acre parcels. The site is presently developed with an existing single family residence and an existing child care facility. The purpose of the subdivision is to separate the uses onto individual parcels. The ALUC reviewed a use permit application for the child care facility in 1997. The Commission's recommendations included the recording of an avigation easement and a provision requiring that the parents of all child care clients read and sign disclosure documentation noting the proximity of the site to the airport and the potential for overflight activity. These recommendations were incorporated as conditions of the use permit. zThe Butte County Planning Division has verified the applicant's compliance with those items. Overflight Protection/Land Use Compatibility The project site is located within Zone Al of the Overflight Protection Zone (OPZ) depicted in Drawing CIC -14 and the Flight Tracks for light aircraft shown in Drawing CIC -2. The property is located outside of the Departure Clear Area identified in Drawing CIC -16 and the Flight Corridor shown on Drawings CIC -4 and CIC -6. , •Butte County •Airport Land Use Commission 0 Text adopted by the Airport Land Use Commission in conjunction with the OPZ indicates that only infill development will be permitted within Zone Al. Since a definition of "infill" was not specified by the Commission, ALUC staff consulted the 1993 Airport Land Use Planning Handbook and other planning agencies to obtain generally accepted definitions. According to Appendix G of the Airport Land Use Planning Handbook, "infill" is defined as "Development which takes place on a vacant property largely surrounded by existing development, especially development which is similar in nature." Staff from the Butte County Planning Division also noted that their agency typically considers infill to be "Development of property consistent with current zoning and general plan designations and in congruity with surrounding land uses." The General Plans for the cities of Chico and Oroville both define infill as, "The development of new housing or other buildings on scattered vacant lots in a built-up area or on new building parcels created by permitted land divisions." Development surrounding the project site consists primarily of residential uses at urban densities. The - proposed land division will not facilitate any additional development beyond what is already permitted under the current R-3 zoning district. Therefore, staff would recommend that the Commission consider the project to be consistent with its directive to allow infill development within Zone Al. Sa etv The 1993 Airport Land Use Planning Handbook contains maps depicting accident scatter characteristics based on information generated by Hodges and Shutt (1993) and the University of California Berkeley, Institute of Transportation Studies (1993). Drawing CIC -17 of the CMAEP depicts an overlay of the UC Berkeley Study onto a map of the Chico Municipal Airport and surrounding environment. Drawing CIC -18 of the CMAEP depicts an overlay of the Hodges and Shutt data onto a map of the Chico Municipal Airport and surrounding environment. The purpose of these exhibits is to identify areas with an elevated likelihood for aircraft related accidents. According to stalTs review of these documents, there is some potential for accidents to occur within the general vicinity. However, no potential accident sites actually fall within the parcel. Therefore, the statistical likelihood of an accident occurring at this location is only considered slightly higher than at any other random location. Airspace Protection Drawing CIC -5 of the CMAEP identifies the location of all FAR Part 77 Surfaces for the Chico Municipal Airport. According to Drawing CIC -5, the project site is located within the Horizontal Surface for the facility. USGS topographic information indicates that the elevation of the project site is approximately 188' feet above Mean Sea Level (MSL). The Butte County Zoning Code does not specify a height limit for structures within the R-3 zoning district, however, typical medium density residential construction rarely exceeds 35 feet in height. Although no construction is proposed as part of the project, staff estimates that any that future development would result in a total potential project elevation of 223 feet MSL. The elevation of the Horizontal Surface is 388 MSL. Therefore, the project will not result in the penetration of any FAR Par 77 Surfaces. Noise SensitivitX The project site is located between the projected 55-60 dB CNEL contour for the Chico Municipal Airport. Exhibit 4-4 of the CMAEP "Land Use Compatibility for Noise'Environments," indicates that • Butte County •Airport Land Use Commission • 2 J single family residential_ development is considered normally acceptablein areas exposed to.up to 55 dB CNEL and may be conditionally acceptable in areas exposed to between 55 dB and 70 dB CNEL. Multiple family residential development is considered normally acceptable in areas exposed to up to 60 dB CNEL and may be conditionally acceptable in areas exposed to between 60 dB CNEL and 70 dB CNEL. Although the noise contours discussed above indicate that projected exposure in the project area will be at or below 60 dB CNEL, it should be noted that residents may be exposed to single event noise levels and other episodes which exceed those levels. These events may include intensive CDF air tanker operations during campaign fires, occasional military activities, and other aircraft engine testing or maintenance procedures. Air tankers consisting of P -Ts, P -3's and S -2's with piston engines, may create the greatest impact because the weight of their load requires them to make extremely low altitude departures. The location of the projected noise contours may also change when the effects of the proposed extension of runway 13R/31L is more comprehensively analyzed. Execution of an avigation easement is typically recommended to protect future airport operations. However; such an easement has already been recorded to comply with conditions of the use permit for the child. care facility. Other Comments The City of Chico is currently. in the process of preparing an Updated Airport Master Plan for the Chico Municipal Airport which is expected to include plans for extending Runway 13R/ 31L approximately 1,300 feet to the south. These and other facility modifications directed by the Updated Airport Master Plan could affect the location of current airport safety zones, FAR Part 77 Surfaces, noise contours and flight track patterns associated with that runway. Although the full extent of these changes is not known at this time, the modifications are not expected to have a significant effect on the subject property since it is located both south and west of Runway 13R/3 1L. RECOMMENDATION: Staff recommends that the Butte County Airport Land Use Commission "find that the'proposed Butte County Tentative Parcel Map A99-08 (TPM99-16 - Lucas) on APN 007-150-109 is consistent with the 1998 Chico Municipal Airport Environs Plan as noted in the findings presented in the attached Exhibit "A". This data, in turn is based upon the findings of a number of studies, documents and reports generated by individuals, firms and agencies recognized as having expertise in the field of Airport Land Use Planning and land use compatibility. (See Exhibit Al, List of References) The following findings have been prepared at the direction of the ALUC and are for the consideration of the County of Butte (local agency) when making a decision on the project. Section 1: ENVIRONMENTAL FINDINGS A. No environmental documentation was submitted at the time of review. Section 2: PROJECT CONSISTENCY FINDINGS A. Chapter 3 of the 1993 Airport Land Use Planning Handbook identifies four functional categories that address airport land use compatibility concerns.
