The property is located approximately 5 miles southwest of the City of Chico Urban Limits on River Road, approximately 2.6 miles south of the intersection of Chico River Road and River Road, Butte County, for the alternative mining use approved by MIN 96-03. Action requirescertification of the Final Environmental Impact Report ("Final EIR", SCH 97022080), prepared for the M&T Chico Ranch Mine Long -Term Off -Channel Mining Use Permit application MIN 96703. Land Conservation Act Advisory (LCA) Committee Recommendation Based on inability to make finding #5 of Government Code Section 51282 (a), the Land Conservation (Williamson) Act Committee recommends denial of the partial cancellation request. On April 17, 2006 the Williamson Act Advisory Committee (LCA Committee) unanimously agreed that, in light of the petition and supporting evidence presented by the applicant, the Board could make statutory "consistency" cancellation Findings 1-4 (Government Code Section 51282 (a)). However, the Committee recommended that there was inadequate supporting evidence for the Board to make Finding #5. In light of the petition and supporting evidence presented by the applicant, the LCA Committee recommended that the Board could make only four of the five statutory "consistency" cancellation findings (Government Code Section 51282 (a)). However, all five findings (as listedbelow) are required to approve a cancellation: (1) That the cancellation is for land on which a notice of nonrenewal has been served. (2) That cancellation is not likely to result in the removal of adjacent lands from • agricultural use. 4 0 �O 0 0 (3) That cancellation is for an alternative use which is consistent with the applicable provisions of the city or county general plan. (4) That cancellation will not result in discontiguous patterns of urban'development. (5) That there is no proximate, noncontracted land which is both available and suitable for the proposed use or that development of the contracted land would provide more contiguous patterns of urban development (GC §51282(b)). Cancellation Consistency Finding #5 The Williamson Act Advisory Committee recommended that there was inadequate supporting evidence for the Board to make Finding #5, as follows: "That there is no proximate noncontracted land which is both available and suitable for the use to which it is proposed the contracted land be put, or, that development of the contracted land would provide more. contiguous patterns of urban development than development of proximate noncontracted land". The Committee determined that the applicant's petition did not set forth adequate supporting factual information sufficient to bridge the analytic gap between the raw evidence and making this finding. In support of this finding, the applicant's petition contends that: • 1. Sand and gravel operations discourage urbanization on adjacent lands, thus reducing the threat of conversion of adjacent agricultural lands due to possible urban uses. 2. The project will be required by way of the Surface Mining and Reclamation Act (SMARA) to reclaim the area that is mined to reuse as open space land. Open space land is compatible with agricultural operations and are not likely to result in removal of adjacent lands from agricultural use. 3. The adjacent prime agricultural lands are not likely to be removed from agricultural production because those lands are all under Williamson Act contract. The 173 -acre parcel directly west of the cancellation property (Jones, APN 039-020-005) is not subject to the restrictions of a Williamson Act contract. Cancellation Consistency Finding #2 2 T •Subsequent to the April 18, 2006 Williamson Act Advisory Committee recommendation, the Butte County Agricultural Commissioner provided the attached April 6, 2007 memorandum to staff regarding regulation of agricultural sprays (Dormant Spray Water Quality Initiative). These regulations became effective on August 17, 2006 (EM 06-01 and ENF 06-26) on August 14, 2006. Williamson Act cancellation finding #2 of Government Code Section 51282 (b), requires that the Board of Supervisors must find that: (2) That cancellation is not likely to result in the removal of adjacent lands from agricultural use. This recent information on the Dormant Spray Water Quality Initiative suggests that approval of this project would likely result in some impacts on adjacent agricultural operations, related to use of pesticides adjacent to the mine's proposed diversion channel. As the diversion channel is currently configured, and based on these new spray regulations concern, the Board should consider the following analysis regarding of Section 51282 (b). Key Issue Regarding Finding #2 In testimony received during public hearing and by letter from Mr. Ron Jones on April 8, 2006 (attached to April 14, 2006 Supplemental Report to LCA Committee), the owner of land adjacent to and west of the cancellation parcel expressed concern regarding the location of the diversion channel proposed to be developed down the eastern edge of the cancellation/mining property. This diversion channel would be located 20' west of his property line, adjacent to his land. Please refer to Typical Section, diversion channel here • attached. Mr. Jones commented that his ability to spray pesticides on his crops would be inhibited due to State regulations prohibiting the use of pesticides within 100 feet of such a waterway. The Butte County Agricultural Commissioner has confirmed that any application of controlled insecticide materials must provide a 100 -foot buffer zone from any "sensitive aquatic site". Section 6000 of the Title 3, Div. 6 Chapter 1, Sub -chapter 1, Article 1, Section 6000 states that, "sensitive aquatic site" means: any irrigation or drainage ditch, canal, or other body of water in which the presence of dormant insecticides could adversely impact any of the beneficial uses of the waters of the state specified in Water Code section 13050(1). Staff believes that the proposed diversion channel along the eastern edge of the cancellation property meets the definition of "sensitive aquatic site". Please refer to the informational bulletin here attached from the Department of Pesticide Regulation regarding Rules for Dormant Season Insecticides. This analysis indicates that the mining operation, made possible by the proposed Williamson Act cancellation, is likely to inhibit pesticide spraying and thereby agricultural operations on an 80 foot -wide westerly edge (one -mile frontage, approximately 9.6 -acres total) of the of the following three parcels: APN Owner Acres 039-020-005 Jones +/-173 039-050-009 Prentice +/-198 039-050-002 Anderson /-157 3 • Given this likely impact on agricultural operations, the Board should consider if it is . possible to make Finding #2 of Section 51282 (b). { Environmental Review The cancellation of a Williamson Act contract is considered a project that requires review pursuant to the California Environmental Quality Act (CEQA). A Final Environmental Impact Report ("Final EIR", SCH 97022080), prepared for the M&T Chico Ranch Mine Long -Term Off -Channel Mining Use Permit application MIN 96-03, assesses the immediate cancellation of the Williamson Act contract for environmental impacts pursuant to CEQA. The Final EIR is here referenced and is included as an Attachment to the Agenda Report for the appeal of M&T Chico Ranch Mine Long -Term Off -Channel Mining Use Permit application MIN 96-03, being heard on April 24, 2007 by the Butte County Board of Supervisors in conjunction with this Williamson Act cancellation application. Possible Board Action Should the Board of Supervisors elect to approve this tentative immediate partial Williamson Act contract cancellation, staff recommends that Board make a motion of intent -to: a) Certify the Final Environmental Impact Report for this cancellation action (here referenced and incorporated as an attachment to the Agenda Report for the appeal of M&T Chico Ranch Mine Long -Term Off -Channel Mining Use • Permit application MIN 96-03, being heard on April 24, 2007 by the Butte County Board of Supervisors in conjunction with this Williamson Act cancellation application). b) Direct staff to prepare rationale and assessment in support of consistency 1 findings #2. and #5 (Government Code Section 51282 (b)), to be added to the resolution for cancellation, for action at a subsequent meeting.
