PHONE: 538-2167 DEPARTMENT SUMMARY AND REQUESTED BOARD ACTION: SUMMARY OF REQUEST: Appeal of the Planning Commission's February 22, 2007 certification of the Final EIR and approval of the M&T Chico Ranch Mine. The project consists of a long-term, off -channel gravel mining operation proposal by Baldwin Contracting. The mining would take place on 193 -acres of a 235 -acre site over a 20 to 30—year period. Reclamation would occur incrementally and would consist of the creation of open -water wetland wildlife habitat and agricultural uses. The aggregate would be processed (washed and screened) on a 40 -acre area at the site. The project is located on a portion of the M&T Chico Ranch approximately 1.5 miles east of the Sacramento River and approximately 5 -miles southwest of the City of Chico in an area north of and adjacent to Ord Ferry Road, east of and partially adjacent to River Road. Access to the site would be provided by River Road. Assessor Parcel Numbers: 039-530-023 and 039-530-025 (formerly 039-530-019, 039-530-020). ACTION REQUESTED: 1. It will desecrate prime farm land and does not comply with the Williamson Act rules. 2) Durham cannot withstand exponentially more gravel trucks parading through its heart and directly in front of the only access to all three school sites; there are already numerous gravel trucks traveling through there now. WHY IS THAT?? WHERE ARE THEY MINING, AND HOW MUCH WILL THOSE MINES GROW ALONG WITH M&T??? HAVE THE SITES THAT ARE CURRENTLY BEING MINED BEEN RESEARCHED 1/2/2008 Page 2 of 5 TO LEARN HOW THE GRAVEL TRUCKS FROM THERE WILL ADD TO THE IMPACT OF M&T/BALDWIN'S MINE ON THE TOWN OF DURHAM ?? . The two-lane Durham-Dayton/Durham-Pentz Highway is extremely congested at the beginning of the school day, lunch time, and mid-afternoon. Gravel trucks. using this highway are not compatible with children walking to and from school, vehicles dropping off or picking up children, high school drivers, high school athletes jogging along the roadway, band students practicing for parades, Butte College students driving to and from campus, and school buses transporting children. Gravel trucks CANNOT stop as quickly as other vehicles when young children may cross the road or even the crosswalk, thinking they have enough time to pass. In addition, these trucks kick up rocks which can easily put children's eyes out and in other ways seriously harm them. We all know the damage to a windshield of a pebble 1/2/2008 Page 3 of 5 kicked up by a truck; in no way should our children be exposed to this danger numerous times,a day. Even children playing on the school grounds could easily be hit by rocks kicked up from the highway by these trucks, which, may I remind you, will be the ones spilling gravel on the roadways. Gravel trucks parading through this area are akin to them driving through a neighborhood in Chico , Oroville, or Paradise. In no way would anyone consider that appropriate, yet this is what will happen if this sand and gravel mine is allowed to go forward. This highway is in the heart of Durham's "neighborhood." In addition to the three schools, many of Durham's businesses are in the same area, businesses which school children frequent before school, at lunch, and after school. There is entirely too much foot traffic in this area to allow gravel trucks; to regularly drive through. Tragedy will, inevitably strike, and you will 1/2/2008 Page 4 of 5 have to live with that if you vote to allow this project to proceed. 3) Roads will be destroyed by the trucks, and the county will be responsible for constant maintenance. It is clear that many of our roads in Butte County are currently in disrepair, and this will only add to the burden. 4) It's not right that so many people will be adversely affected for the financial gain of a few. Gravel is not "gold;" it can be mined in other areas of California away from populated areas. It also does not appear to be a resource difficult to find. 5) When families learn of the number of gravel trucks that will pass within a few feet of their children numerous times a day, they will not want their children to attend this `district, ESPECIALLY after the first child is hurt or killed, which is inevitable. Property values will decrease. Our district is already losing children each year; we can't afford to have families quit moving here. Those homes in front of the school and all along Durham -Dayton will be WORTHL 1/2/2008 Page 5 of 5 gravel trucks literally in their front yard all day?? Children and pets will be at risk in their own yards; I certainly woul playing there or visiting after school. And think of the noise!! 6) The mine will foster West Nile virus with its stagnant water. It will also impact the aquifer in dry years such as what we're experiencing now. For the above reasons, we are adamantly opposed to this project and strongly encourage all Butte County Supervisors to deny its establishment. The Planning Commission approved the permit with a statement of conditions after 1 I years of work. To me, the statement of conditions acknowledges that the overriding benefits of the project and the economic need outweigh the negatives. Clearly it was a hard decision for them to come to (hard - haha._ How many puns can we insert into this discussion?!). Rocks are the key material to' roads and other infrastructure. Our rock is valuable and should be allowed to be mined. The issue of trucking rocks is the same as trucking beer or fruit or rice. No one likes trucks, but if you've got it a truck brought it. We have to accept trucks are a necessary element of economic development and are heavily regulated. They pay fees for every mile driven. The mitigation measures Baldwin will perform will benefit the County and Chico. Road improvements, wildlife area, road fees and more. The economic benefit to the county will be unique - it's not every day a company is willing to invest this much money as a condition for use.
