At its meeting of June 10, 1985, the Butte County Airport Land -
Use Commission found that the proposed airport, located on the
south side of Marybill Ranch Road approximately 3/4 mile south
of The Midway, south of Chico; California, does not conflict
with the Chico Municipal Airport Environs Plan, and approved
the proposed privately -owned, private -use airport subject to
the following conditions:
1. All flights.to be conducted in such a manner -that.
aircraft do not pass within.a minimum of 500 feet.
(measured horizontally) of the Little' League park
property.
2. Applicant must comply with all applicable state,.
federal and local statutes, ordinances and regulations.
Additionally, it was recommended that the applicant obtain an
avigation easement limiting the height of buildings to 35 feet
from the property owners immediately to the north and -south of
the proposed runway, to include at least that property within
1000 feet of the end of the runway and within 125 feet of. the
-extended centerline of the runway.

The meeting of the Airport Land Use Commission (ALUC) was called to
order at 1:36'p.m. on June 10, 1985 in the Board of Supervisors' Room,
County Administration Center,.25.County Center Drive, Oroville,
California.

III. APPROVAL OF'MINUTES
On a motion by Commissioner Feiler, seconded by Commissioner Lambert
and unanimously carried, the minutes of the May 13, 1985 meeting were
approved as written.
I V . BUS -I NESS
1. Status Report - Paradise Airport Land -Use Pla
Commissioner Feiler reported that their plan is nearly complete; Dave
Hironimus is having it typed There are some minor changes to be made
to the charts, which Tom Lando is having done.
Commissioner Feiler said that one thing that is as yetunresolved is
the question of whether a clear zone can "bend." He has been trying
to get an answer from".CalTrans in Sacramento. Chairman Behunin
remarked that he didn't see howa clear zone could bend, since a pilot
needs room in case he runs off the end of the runway. Commissioner
Feiler said perhaps the departure path could be changed. Dave
Hironimus said it would have to be followed up with.CalTrans,'and
there might be some difficulty in that ALUC, as a public .agency, in
removing any reasonable use from that land off the end of the runway,
would be benefitting a third party, the owner of the Paradise Airport.

Chairman Behunin said that either airports require clear zones off the
runways or.they don't. That block.of.land, then, has to be acquired..
Dave Hironimus pointed out that the Public Utilities Code very
specifically states that ALUC does not have jurisdiction over existing
uses. Chairman Behunin said -"We either step up to the task of
acquiring that land, or then we've made the decision that the airport
is eventually going to be closed down.
2. Status Report - Ranchaero Airport Land Use Plan
Commissioner Lambert reported that her committee is also waiting for
Some revisions to be made., and for the typing of their rough draft.
Dave Hironimus said answers are still needed from CalTrans on the
density questions.
3. Status Report _ Oroville Airport Land Use Plan
Dave Hironimus said the draft EIR is just about ready for typing.
Chairman Behunin asked if copies of it could be made available by the
first of next week (June 17); Dave Hironimus said he hoped so.

airport consisting of a 1600 -foot grass runway on property
located on the south side of Marybill Ranch Road, approximately
3/4 mile east of The Midway, identified as AP 040-02-0-135-0,
south of Chico.
Dave Hironimus stated that the previous time this Commission reviewed
this project was to determine whether it was compatible with the Chico
Airport Environs Plan. Since that time, it has come to our attention
through CalTrans that, a private airport, whether the zoning allows it
or not, is required to be approved by the City Council of the city
it's located in, or the Board of Supervisors of the county it's
located in, or by the Airport Land Use Commission, if there is one.
It is subject to the California Environmental Quality Act (CEQA), and
ALUC hears it very much as if it were a Use Permit, but it's strictly
an airport permit from the standpoint of protecting the public health,
safety and welfare as per the Public Utilities Code (PUC).
The hearing was opened to the public.
Cliff Johnsen stated that he just wants an airstrip for private,
personal use. The mitigation measures originally attached to his
project pertain to a commercial strip, so they aren't needed now.

Commissioner Lando asked about the recommendation that avigation
easements be obtained. Dave Hironimus said the applicant would be
required to obtain easements from the neighboring properties regarding
height limits for buildings and noise impacts off either end of the
runway. Mr. Johnsen said this.is the first he'd heard about it.
Commissioner Lando said that,. per County Counsel, it might be
impossible to obtain these easements.
Mr. Johnsen said, "Nobody asked me for an easement before spraying
their properties. Commissioner Hunter -observed that there's court
precedent wherein property owners have tried to gain relief from
spraying, also from overflights, if the farm was there before the
airport.
Mr. Johnsen asked what an avigation easement is; Dave Hironimus
replied that it limits the height of buildings to 35 feet from the
property owners immediately to the north and south of the proposed
runway, to include at least that property within 1000 feet of the end
of the runway and.within 125 feet of the extended centerline of the
runway.
Mr. Johnsen said he thought the Use Permit was going to prevent this;
Chairman Behunin pointed out that this is to protect him, and them,
and that he should obtain the easements. Mr. Johnsen remarked that it
clouds the title on your property, and people don't want to do it
without compensation. -
Commissioner Lando asked if there was a height limit in A-2 zones;
Dave Hironimus said no. Commissioner Lando asked if all of the clear
zone is 1-ocated on Mr. Johnsen's property; Dave Hironimus said no, it
goes onto other properties both north and south of Mr. Johnsen's.
Commissioner Lando said he would have trouble with asking that
conditions be imposed upon the applicant without helping him to meet
them. Commissioner Hunter suggested that this Commission could
recommend, not require the.conditions. Commi--sioner Lambert asked if
County Counsel had said that avigation easements were voluntary; Dave
Hironimus said the offering of avigation easements is .a way to
mitigate potential. impacts.
Commissioner Lambert asked about the riparian habitat with trees at
the north end of,the clear zone and the removal of 4 acres,of orchard
at -the south end. Dave Hironimus said this wouldn't be required now,
with a private airport.Commissioner Lambert asked if .this could ever
be -anything -but a private airport; Mr. Johnsen said it would be
impossible to get a commercial permit there and still have a house on
it.

A discussion ensued relative to avigation easements. Mr. Johnsen said
he felt it shouldn't be a requirement of the permit. Commissioner
Cawthra said the easements should be obtained. Chairman Behunin
wondered what leverage you'd have without them. Commissioner Hunter
remarked that this Commission had done its best to make it clear that
easements are a good idea, so "let the buyer beware."
Commissioner Lando said the same things could be accomplished without
having avigation easements. There could be a height overlay.zone;
also required.n otice on adjoining properties so it'd show up on title
reports.
Commissioner Lambert wondered about the location of Marybili Road,
with a 60' right of way, relative to the possibility of future
development. Mr. Johnsen stated that the 60' road "is my road, and
the part that crosses the clear zone is a dead end."
The hearing was closed to the public.
Commissioner Lando said he felt uncomfortable approving it without.the
avigation easements, and made a motion to approve the project,
seconded by Commissioner Lambert, with the condition that avigation
easements be obtained. Commissioner Lambert stated that she would
want avigation easements as a condition but has reservations about an
airstrip in that area, knowing its development_ potential.
Commissioner Feiler used the analogy of driving a car for your own
personal use versus driving it for hire, and wondered if it's right to
require the easements. Commissioner Lambert pointed out that if Mr.
Johnsen had planes for hire, that would make his airport a commercial
airport. Commissioner Hunter stated that this Commission can't take
into account "ifs" and "maybes" and that later on, when.something is .
built on the adjoining lands, "then we may see it again." The motion
was withdrawn.
It was moved by Commissioner Cawthra, and seconded by Commissioner
Hunter, as follows:
A. Find that the requirements of CEQA have been completed and
considered in making this decision, and adopt a Negative
Declaration; and
B. Find that the proposed airport does not conflict with the Chico
Municipal Airport Environs Plan; and
C. Grant an airport permit to allow a privately -owned, private -use
airport on AP 40-02-135 (Cliff Johnsen) as shown on the site plan

adopted as yet, this Commission must determine if these projects would
be compatible with operations at Ranchaero Airport.
Chairman Behunin asked"what the.density of the proposed development'
Is; Dave Hironimus said there's one .parcel of slightly over half an
acre and one that's just over an acre'. --....Commissioner Hunter asked if
the County requ,.-red property,owners to have avigation easements, as
this -is under/the Map Act and the County tas some very specific
capabilities. Chairman Behunin observed that this project 'is not
under the approach zone.. Dave Hironimus said this Commission could
determiine'that this project would or would not have an effect on the
operations of the airport. Commissioner Hunter asked if it were

Dear Sirs:
Regarding your recent letter discussing the possibility of expanding and/or rezoning the
airport property, please be advised that a search of our records indicates that the airport
has been permitted as an agricultural airport only. A search of our records failed to
indicate any approval of permits necessary for other forms of airport use. In order to
expand the usage of the airport to either a "special use" airport (as defined by the Division
of Aeronautics) or to a "public access" airport will require rezoning of the property.
Attached for your convenience are copies of the County's new A -Z (Airport Zone)
regulations and an application form for rezoning.
If you make application for a rezone to the A -Z zone, please be aware that the process,
including public hearings, will take approximately 5 to 6 months. Also, reclassification of
the airport to either a "public access" airport or a "special use" airport will require that an
Airport Land Use. Plan be adopted pursuant to the requirements of the Public Utilities
Code. While it will be up to the operator of the airport or the applicant to prepare the
Airport Land Use Plan, our staff will be happy to assist you in preparing the plan. It is
possible that we will be able to modify an existing Airport Land Use Plan prepared for
another airport without too much time or trouble. If you should wish to make application,
it is suggested that you contact the Planning Department regarding requirements for clear
zones, application fees, site plans, etc.. prior to making the final application.
Reclassifying the airport to a "public access" airportor a "special use" airport and preparing
an Airport Land Use Plan would put County Planners on notice that a commercial airport
exists in the area. State law requires that future planning decisions in the vicinity must be
found in conformance with the adopted Airport Land Use Plan. In this manner some
degree of protection could be afforded.
If you have any questions regarding this matter, please contact this office any weekday
between 10:00 a.m. and 3:00 p.m.

SUBJECT: Correspondence from William H. Coats, Coats Orchard Regarding the Cliff
Johnson Airport
DATE: February 22, 1991 " -
In August of 1990 the. Board of Supervisors received correspondence from William H. Coats
regarding the Airport owned by Cliff Johnson located north of the Coats' property and
south of the Mary Bill Ranch Road, just west of Butte Creek. This department's initial
review of the airport indicated that an airport permit was granted by the Board of
-- Supervisors in July of 1985. The airport was for a privately -owned,-private use airport..'. -The
zoning on the property at that time was A-2 (General) which permitted"private -airports of
that kind. The Board of Supervisors' action was the result of a requirement by the .
California Department of Transportation, Division of Aeronautics, that airport permits be
approved by the. local legislative authority. The Airport Land Use Commission became the
lead agency, prepared an initial study, and recommended approval to the Board of
_ . Supervisors. .
While checking the status of the airport permit issued by the Division of Aeronautics, staff
was informed by CalTrans that some changes were taking place on the Cliff Johnson airport
permit. Further study of the airport was put on hold until definitive information was
available from CalTrans. In late January of 1991 the Division of Aeronautics informed
Butte County staff that Cliff Johnson had applied for a re-classification of his airport (Hog
Creek Ranch Airport) from a personal use airport to a special use airport which would be
available for use by purchasers of subdivision lots created by Mr. Johnson.
-,W Since the original -approval -of the -airport, -the zoning has -changed= -from -A=2 -(General)-to`
A-20 (Agricultural - 20 acre parcels). Since the A-20 zone carries no provisions for
_ personal use airports, the airport is now considered a pre-existing nonconforming use. ''As -
-- --=such, the use of the airport can continue as a personal use -airport until such -lime as its use --
__ _ _ _ceases for a_ one year period... Conversion of the airport. to a special use airport would be
an expansion or modification of a nonconforming use. Pursuant to Butte County Code
Section 24-37.4 a Use Permit is required in such cases. To date, no Use Permit application
has been received for -such a project. The Department 'of Transportation, Division of
Aeronautics has been notified of the situation and asked not to re-classify the airport until
such time as a Use Permit is approved by Butte County. - _
The activity reported by Mr. Coats in his letter of August 8, 1990, appears to be the result
of the airport being operated as a special use airport, contrary to Division of Aeronautics
regulations and the A-20 zone. The Butte County Code Enforcement Officers have been
notified of the activities reported by Mr. Coats, but have been unable to date to personally
witness use of the airport by anyone other than Mr. Johnson. The Division of Aeronautics
will notify Mr. Johnson of our requirement for a Use Permit as part of their permit
procedure.
Recommended Actions:
1. Continue monitoring of the airport by ,the Code 'Enforcement Officer.
2. Request Mr. Coats and other interested parties in the area, to report aircraft activity
to the Code Enforcement Officer.
The County Planning Department will continue to monitor the situation and will process
any application received for re-classification of the airport.

Dear Mr. Hironimus:
Conversation of 1-3-91: Personal- and Special -Use Airports
Asa result of the January 28, 1989 changes in California Aeronautics
Regulations, specifically in regard to personal- and special -use airports,
we have received.a request from Mr.' Cliff Johnson to reclassify the
Hog Creek Ranch Airport from a personal -use status to a special -use,
permitted airport.
The reclassification of the Hog Creek Ranch Airport to a special -'use airport
will continue to require the following conditions which were included in the
original permit:
1. Airport to be constructed'in accordance with plans approved'by.the
Department November 25, 1985.
2. Displaced thresholds will be established and maintained to provide
an unobstructed 20:1 approach surface to the runway. -
3. Traffic Patterns: Runway 14 right, Runway 32 left.
Additional conditions will be added stipulating:
4. No commercial activities are authorized.
5. Airport operations authorized are for personal use of the airport
property owners and their occasional invited guests.
Please review the land use permit and notify the Department of the current
status of the use permit. We can then proceed accordingly with the permit
process for Hog Ranch Airport.

The Richvalle Flying Farmers Airport is listed as a.private airport. We
will be reclassifying this airport to special=use with the original"condi
tions stillin effect. .Please advise the -Department of,the.current status
of the use permit for this airport.
We have had several complaints by phone and in.writing concerning the
Bill Crimm, Ranch Airport. Both'of the complainants, Mr. John.Simmons
[(916)-753-5638] and,Mr. Jim Walker [(916) 846-0951], own property.'and.homes
near-the airport., I'have recommended that they contact your office for
investigation into the'use permit or Mr.-Crimm's activities,` etc.
