' Background The following is a summary of the Ranchaero Airport annual review conducted for 2004/2005. Land Use Review'and Evaluation • The following tasks were completed in an effort to evaluate land use compatibility with the Ranchaero Airport: A. No new development permits have been applied for or issued for the Ranchaero Airport (APN 0397550-095) from January 2004 to June 2005. ` B. Reviewed the City of Chico and County of Butte for Tentative Parcel/Subdivision Maps applications and only one application was submitted from January 2004 through June 2005 that was within the Ranchaero Airport compatibility zones. 1. Shastan Homes (APN 042-640-020 and 042-640-021) Tentative Subdivision Map for 57 lots on two parcels totaling 14.9 acres in the B-2 Compatibility Zone. The project was found inconsistent with the B-2 Compatibility Zone by the Airport Land Use Commission on May 18, 2005. Commissioner Harp said the Commission had started a discussion regarding the B-2 zone in this area and he was not•sure,the discussion -was concluded.. He asked if the'Commission concluded whether the B-2 zones were appropriate for this airport.at this time or whether the Commission wants to make changes. + Y* • r. '` Commissioner Grierson said he thought this was put on the "to do" list. Commissioner Harp said if we approve this report by staff are we approving the B-2 zone as is at this time, or are we leaving it open to be discussed later. r 'Chairman Wallrich-said under "CLUP'aimendments" it states "Look at the boundaries of the -B-2 zone—'-' -, +R' around the Chico Airport." Commissioner Sherman said all they were doing at this point is looking at_approvals'inade between the 2000 -2003 -and -making "a-determinationtwhether:the actions that have'been-approve&by.the"City. and County are consistent with the CLUP. Mr. Baker said this is correct. ' Chairman Wallrich asked staff to add the Ranchaero Airport to `the "things to do" "ori the B-2 along with the Chico Airport. Commissioner Hennigan said that he noticed the property on the corner of one and three-quarter acres 77 is also for sale. He said the three parcels•are a logical commercial development area, and questioned y why the County would allow someone to build houses on commercial property. w, ' It was moved by Commissioner Sherman,=seconded by Commissioner Harp; and unanimously carried ` G.` to adopt the following, changing the word "hanger" to "hangar": • 1. CLUP Review and Update Mr. Michelena gave a brief overview stating that this is the second hearing for review of the Ranchaero Airport. He made a power point presentation with a hard copy to the Commission. He said there was a question at the last meeting on whether the parcel to the south could be split or have a second dwelling. He said all parcels that fall in the B-2 protection runway area are all less than 20 acres. He said the zoning is A-10. He said the County does allow agricultural worker housing in the A zones. He said the A zones do not allow second dwellings. Vice Chairman Harp asked where the Pinkert property was located. Mr. Michelena said on the northwest portion of the map. He said it was a 3 -lot split. He said the project was shown on the last map as TPM 03-11. Vice Chairman Harp asked if the B-2 line is a line the Commission wants to keep and he questioned if the line was appropriately drawn. Mr. Michelena said that Floral Arrangement would not have met the density of the C zone either. Mr. Baker explained that the B-2 and C zone lines were developed as a result of the accident scatter overlay maps. Commissioner Grierson said he lives in area B-2 to the north. He said that probably 70% of the aircraft at Ranchaero confine themselves to the unofficial traffic pattern remaining south of the creek. He said, however, there is still about 30% of the aircraft that take off out of Chico and fly into the Ranchaero Airport. He said the aircraft flying over the B-2 area are flying approximately 300 feet above the ground.. He said there is not a lot of traffic along Oak Way near the C zone. He said the Commission may want to consider increasing the size of the C zone by taking the B-2 area and moving it closer to West Sacramento. Mr. Baker said they could explore the impacts. He said they could look at the zoning lines. Mr. Michelena said there are lots that are inconsistent with the zone now. He asked if the Commission would like to see these lots to help evaluate if the line should be moved. Commissioner Hennigan said he does not want to grandfather anything in because it would not deter people from future uses in the area. He said what is there now may be incompatible, but they want what is there to remain clearly incompatible. Commissioner Sherman said the Commission might want to look at the infill criteria rather than moving the zoning line. Commissioner Grierson said the Commission does need to have a discussion on infill properties and surrounding parcels. Commissioner Hennigan said the City of Chico has not brought their General Plan into conformity with the CLUP. He said there is an area on the City of Chico's General Plan that is not zoned commercial, but has commercial uses. He said a Master Plan was adopted by the Chico City Counsel and was well done. He passed out a hard copy of the power point presentation. He noted that two new hanger spaces have been added. He said growth in the area will be discussed at the next meeting.. Commissioner Hennigan said that pilots avoid the housing area. �Y Mr. Michelena said there are not a lot of noise complaints of flights over the houses. He said he has no, correspondence of any noise complaints. - Mr. Hennigan said that realtors have told people, that the planes will not fly over their houses. He said this is not true. Mr. Michelena said he talked to Gary Griggs,, airport owner, and was told there have not been a lot of complaints. ' • F'' , Commissioner Grierson said there could be a potential problem with the house shown on Photo 7, off the end of the runway, if the owner wants to split the property and add another house. He asked if staff thought putting another dwelling in the runwayprotection zone would be possible based on our ' current. standards. - Mr. Michelena said staff would need to look into this. ,a; F Mr. Baker also said the project would come before.ALUC to build another dwelling and the Planning' Commission would have to look at the project very carefully.' - Commissioner Grierson questioned if procedurally there was something that the Commission should' ,n- be addressing. He said he wondered how this would comply with -Part 77. He asked if there -was something the Commission should be doing to prevent a house from being built right next door to the - existing dwelling that would have'its' own 10 -acre parcel. I Chairman Wallrich asked if the Commission should include a comment making the point that upon • the completion of this review, as far as an open item, that this parcel should be identified in the file. .r t .t Commissioner Baldridge suggested the parcel be identified under existing incompatible uses. , Mi.- Baker said this parcel is dealt with in terms' of the policies of the B=1 zone. He said the property ' -is.identified in the CLUP as a potential problem spot.. ^ ' Commissioner Sherman asked if a request for a parcel split would come to ALUC for review. i • Mr. Baker said that the project would be a major land use change and with it being off the end of the . runway, it would warrant coming to ALUC for review. He quoted from Section 235 of the CLUP, A Item c, it states"Local jurisdiction concludes that further.review is warranted." He said as a Planning Department if a project off the end of a runway comes in, he would conclude that the project needs to `# .'come before ALUC. S' Commissioner Sherman noted that it would not automatically come before ALUC: j;- , . , '�.■.Airport-Land.Use,Commissiorri '1linutes�of.MeetingofJarivary'21;;2004■�Page:3k■ Mr. Baker said if this was a 10 -acre parcel that was 90% to the runway, somewhere mid section out, and a two -lot split; it may not warrant coming to ALUC for review; but something off the end of the runway clearly would warrant coming before -ALUC. _ Commissioner Hennigan said that on the contrary since Butte County has not brought its General Plan into compliance with the CLUP, all land use actions, are_ required to come before the Commission. r ' Mr. Baker read Section. 153 of the CLUP which states "Until such time as the Commission finds that the local agency's General Plan' or Specific Plan is consistent with the Airport Land Use Compatibility Plan, where two of the local agencies has overruled the Commission's determination of inconsistency, State law requires the local agency to refer all actions, regulations; and permits involving land, within the influence area to, the Commission for review." State Aeronautics Act Section 21676.5 (a) "Only actions which the 'ALUC elects not to review are exempt from this policy." He said Commission policy is that only major land use actions listed in Policy 153 shall be submitted for review. Commissioner Hennigan asked when the policy was made. He said the County has not brought their General Plan into compliance with the CLUP. - Mr. Baker said that the CLUP states that if the matter is not consistent, at that point staff will bring only the items that the Commission has asked for under Policy 153 which is action affecting land r uses in the Airport influence area, with'a list of things including buildings off of airport, non- „. - avigation issues within Compatibility Zone A, etc. He said he has forced projects in just because he has gone back and referred to Section 235 where a jurisdiction concludes that further review is warranted. He said he has always erred on the part of being more conservative rather than not, and has brought items before ALUC rather than let the project pass without review. , Commissioner Hennigan read Section 152 (a) which estates that "Until such time as 1); the Y Commission finds that a local agency's General Plan or Specific Plan is consistent with.the Airport Land Use Compatibility Plan or 2) the local agency has overruled the Commission's determination of inconsistency, the State Law requires that local agency to refer ALL actions, regulations, and permits` ,r involving land use with an airport influence area to the Commission for review." Commissioner Harp agreed if the project is not a major land use, it does not come to ALUC. y Mr. Baker said he tells applicants if it appears that the status is questionable, he will bring the item •. 'before ALUC. He said he also will tell applicants a project,is not consistent and if not brought into ". consistency, the project will be brought to ALUC for review. He said on the Steedmanproject all } °•may buildings were existing and Mr. Steedman was just splitting the parcel to put the homes on their own . parcels, so it did not come before ALUC. Commissioner Grierson asked about the Pinkertproject.that came to ALUC approximately 8 months 'k ff ago ; • , Mr. Baker said the Pinkert project had the potential of new vacant lots that could have been built on so it came to ALUC for review. Commissioner Harp said staff was not following the rules. Mr. Baker said that they were and again read the list of criteria for major land uses to be sent to ALUC for review listed under Policy 152. Commissioner Harp felt if a project was not consistent with the CLUP, the project should come to ALUC for review. Mr. Baker said on the Steedman project there were no new dwellings and he did not feel it had to come to ALUC even though it was not consistent. Chairman Wallridge explained that in the past the Commission used to be notified of projects like this one. Mr. Baker said he would, in the future, inform the Commission of projects that could be of concern. He explained what Mr. Michelena will be doing for the next meeting. Commissioner Harp said the Pinkert application needs to be put on the list of "Things to do." He said they need the Pinkert project as part of the discussion on the Ranchaero Airport. Commissioner Sherman said it would also be nice to know how large the parcel at the end of the runway is and what the zoning is. Mr. Michelena said he would get the information and according to the CLUP map the parcel did not look very big. Commissioner Grierson said in the past there has been some discussion on turning the Ranchaero Airport into a residential flying community. He said a former Commissioner, Nina Lambert, had some property around where #4 is on the aerial photo, and had talked about the ability of developing that property. He said on photo #6 he seems to remember that there was a move that was blocked either by ALUC or Gary Griggs to prevent residential development in that area. Mr. Baker said staff is consistent in applying the Agricultural Element for residential development. He discussed the buffer for development. Commissioner Grierson said there is an issue with the height of the trees in the runway protection zones. He said an airport was shut down in Siskyou County due to a dispute between the Airport and the neighbors who refused to cut down the height on their trees. He said the whole Ranchaero area is trees and he admitted that he did not know how high almond trees get. He asked if this was something the Commission should be looking at down the road -as an adjustment to the CLUP as far as height limits of trees. He said Parts 77 can handle, but Parts 77 is a federal action which is to be used for planning purposes for development. He said what the Commission needs at the local level is the ability to address the neighbor's inability to be a good neighbor. Commissioner Baldridge said the tree issue is on the north and south sides of the airport. He questioned who pays to cut the tops off the trees where they are on private land. He said on the south Airport Land Use � .. ': _ -a side is a large old oak tree that CalTrans is' concerned about. He wondered if the oak is considered an ` historical tree: He said there is also a tree issue on the east `side of the runway, the almond trees are. too tall and there needs to be about three rows of trees iiemoved. He noted that'there are some Sycamore's on the north side by the creek that are on private land -and asked who pays to cut the trees , y • down. rCommissioner Hennigan said that at one time Butte County had an ordinance addressing this issue and the ordinance was lost. He said past staff was going to come up with a new ordinance regarding w "the height of trees and never did. - Mr. Baker said'he would research the matter of an ordinance. - Commissioner Grierson said the Ranchaero Airport is a unique situation because it is surrounded by trees and there is a non-standard, traffic pattern which is voluntary. He said Part 77 does,not care T about non-standard patterns. ' Chairman Wallrich said to put the County Ordinance and Pinkert project under proposed'CLUP amendments on the "Things to do" file. ` ;Commissioner Harp said he: did not like 'the outcome 'of the rule .to decide density and the ' Commission might want to discuss changing the rule. fiMr. -Baker discussed the measurement used to decide density. Commissioner Harp said the measurement was probably ok, but he wants to, look at it one more time. ';Chairman Wallrich asked that this item be e put on the list of possible changes to the CLUP. He also asked that the list be sent in the packet. The Commission found this review to be complete and very comprehensive as it relates to the Airport and the surrounding area. We thank both of these gentlemen for a job well done! As indicated, the Commission found that land uses approved within the Airport Compatibility Zones surrounding the Airport, between the adoption of the CLUP in December 2000 and the present are consistent with the provisions of said document. We appreciate the ongoing support and cooperation of the County of Butte and City of Chico departments that work closely with the Commission to assure that its responsibilities are completed in an accurate and timely manner.
