VALLEY REGION ORDER NO. 91-003 WASTE DISCHARGE REQUIREMENTS FOR 'RONALD LOGAN dba NEW ERA MINES BUTTE COUNTY The California Regional Water Quality Control Board, Central Valley Region. (hereafter So.erd) finds that: 1. Ronald Logan, dba New Era Mines, thereafter Discharger) submi-ted a Report of Waste Discharge, dated 14 August 1990. The property (Assessor's Parcel No. 41-08-27) is owned by Ronald Logan. 2. The Discharger utilizes hydraulic mining for gravity separation of gold from gravel in a former stream bed. The plant consists of a grizzly, trommel, screens, and sluice box. A maxima® of 20 tons of gravel will be mined daily at the site. No chemicals such as cyanide or mercury are used. Dry Creek, a tributary of the Sacramento River, runs through Mr. Logan's property adjacent to the mine operations. Three wash. water ponds are used in series to settle solids from the ore -washing wastewater and to recover �.• the water for reuse. These ponds are immediately adjacent to Dry Creek. 3. The Discharger is in Butte County in Section 1, T21N, R3E, MOB&M, as show on Attachment "A" which is incorporated herein and made part of this -Order. All surface water drainage from the property I$ to Dry. Creek, a tributary of the.Sacramento River. 4. The beneficial. uses of the Sacramento River are municipal, industrial, and agricultural supply; recreation; esthetic enjoyment; navigation; ground water recharge; freshwater replenishmht; hydroelectric power generation; and preservation and enhancement of fish, wildlife, and other aquatic resources. S. The beneficial uses of the ground water are aunicipal, industrial, and agricultural supply. 6. The Board has adopted a Water Quality Control Plan, 2nd Edition, for the Sacramento River Basin (SA) which contains water quality objectives for all waters of the Basin. These requirements are consistent with that Plan. Furthermore, this Order implements the prescriptive standards and performance goals of Chapter 15, Division 3, of the California Code of Regulations (CCR), effective 27 November 1984. 7. The action to adopt waste discharge requirements for this facility is exempt from the provisions of the California Environmental Quality Act, in accordance with Section 15302, Title 14, CCR. 265 WASTE DISCHARGE REQUIREMENTS RONALD LOGAN dba NEW ERA MINES BUTTE COUNTY eta B. This discharge is exempt from the requirements of Section 2511(b), Division 3, Chapter 15, of the LCR. The exemption is based on the following: .a. The Board has issued waste discharge requirements, b. The discharge -is in compliance with the applicable Water Quality Control Plan, and c. The wastewater does not need to be managed according.to Chapter 30 of Division 4, Title 22, CCR, as.i hazardous waste. 9. The Board has notified the Discharger and interested tgencies:and.:persons of its* intent to..prescribe waste dI's charge. requirement s for:this discharge. 10. The Board, in a public meeting., heard' and considered all comments pertaining to the discharge. IT IS HEREBY ORDERED that New .EraMines, in order 'to meet the provisions contained in Division 7 of the Cal:iforni& Water Code and regulations adopted �. • thereunder, shall comply with the following: A. Discharge Prohibitions 1. The direct discharge of wastes to surface waters -'or surface water drainage courses is prohibited'. 2. The by-pass' or overflow of untreated or partially treated waste is prohibited. 3. The direct discharge or deposition of petroleum products to the.ground surface, ground water, surface water, or surface water drainage courses -is prohibited. B. Discharge.Specifications 1. ._Neither the treatment nor the discharge shall cause a nuisance or condition of pollution as defined by,the California Water Code, Section 13050. 2. Collected screening, sludges, and 'other solids removed from liquid wastes shall be disposed of in a manner approved by the Executive Officer. S. A 1.0 -foot freeboard shall.-bellmaintained'in* all ponds at all times. 6. The dischargt of waste containing any carcinogen'or'reproductive toxin listed by the Governor pursuant 'to Health and Safety Code Sections 25249.5 -through 25,249.13, the Safe Drinking Water and Toxic Enforcement Act of 1986 (Proposition 6S;)., where such chemical -passes or probably will pass into any source of drinking water, is prohibited, 7. The dissolved oxygen content of holding ponds' shall not be less than 1.0 mg/1 for 16 hours in any ;24-hour period.. 8. The discharge by seepage or any other direct peans reaching Dry Creek or • any other surface water drainage course shall not cause: a. Visible oil,.grease,,-.scu0',,or foam in the receiving waters or any other drainage course; b. Concentrations.of any materials in the receiving waters whish are deleterious to human, animal., aquatic, or.plint life; c. Bottom deposits in thereceivingwaters; d. Floating or suspended materials in the receiving waters; e. An increase in the turbidity of the receiving waters by more - than 20 percent where upstream turbidity is between 0 and 50 NTUs, or an increase in the turbidity of the receiving waters of more.than 10 percent where the upstream turbidity Is greater than 50 KTUs; -f. The pH in the receiving waters to vary outside the range of 6.5 and 8.5; or g. The dissolved oxygen in the receiving waters to fall below 7 mg/l. C'. Provisions 1. The Discharger shall comply with the attached Monitoring and Reporting Program No. 91-003 -A*2. In accordance with Water Code Section 13260(1), by 1 April 1991 the Discharger shall submit a report addressing thephysical and chemical characteristics of both the liquid and solid wastes, their potential to cause pollution or contamination, and their potential to produce acid mine drainage, leach metals, or release other hazardous substances. The report shall.be based on, but not be limited to, the results of Acid Generating Potential (AGP) and Waste Extraction Tests (WET) on represen- tative samples of .solid wastes generated by ore processing, including tailings and settling pond sediment. The Discharger shall analyze for metals listed in CCR, Title 22, Division 4, Chapter 30, Section 66699, and the WET shall be performed in accordance with Section 66700. The Discharger shall conduct the AGP according to the U.S. Environmental Protection Agency publication 600/2-78-054, *Field and Laboratory Methods Applicable to Overburdens and Mines Soils', or equivalent methods approved by the Regional Board. • 4. By 1 October of each year, the Discharger shall submit for the approval of the Executive Officer plans describing annual procedures to stabilize the mine site for the approaching winter season. Plans shall address, but not be limited to, the contouring, seeding, and mulching of disturbed ground, pond berm strengthening and revegetating, and road stabilization. The plan shall ensure no stormwater'flows over the ground surface into the settling/recycling ponds, and shall rovide appropriately located sediment traps to ensure no eroded earthen materials enter surface waters. The plan shall describe and s cify the extent of the mining proposed for the following year and shall include a detailed scale drawing. S. By 15 November of each year, the Discharger shall complete stabi�ization of the site for the winter according to the approved annual plan required in accordance with Provision C,1. 6. Settling ponds shall be designed to accommodate all wash water plus rainfall expected from two sequential 3 -day, 100 -year storms. By 1 December of each year, the Discharger shall ensure the settling/. recycling ponds have adequate freeboard to capture this rainfall. 7. The Discharger shall report promptly to the Board any material change or proposed change in the character, location, or volume of the discharge. 8. Specifically, we are writing you to confirm our understanding of the scope of operations of the :New. Era Mine pursuant to Mining. and Reclamation Permit No: 81435- (the "Permit") at the time Order 92-200 was issued and that Order. 92-200<did not have any impact on the then -existing scope of the permitted mining operations. You have informed -us that: (i) you were personally involved in the. operation of the New Era Mine under the Permit at all times relevant to the content of this letter; (u) in 1990, you and certain third parties proposed to form a partnership that would assume the day-to-day operations of the New Era Mine; (iii) you believed that such third parties would be able to assist you in the expansion of the operations of the New -Era -Mine; (iv) } on July 17, 1990, "New Era Mines LP" was formed by you and such third parties as a California Limited Partnership to undertake such operations xhibit A ; (v)'the proposed expansion of the New Era Mine was determined. by New Era Mines. The limited partnership was dissolved -in 1990 and no mining has taken place since then. There are no current plans to resume mining, -2- h. Order No. 81-022, adopted 27 February 1981. prescribes requirements for the discharge of wastewater from the Liquid Chemical Corporation micro- nutrient'fertilizer manufacturing plant, in Kings County. The company terminated the discharge in 1984. i.. Order* No. 80-136, adopted 12 September 1980, prescribes requirements for Central Lease, Inc.. and governs the disposal of produced wastewater to, sumps at its New Hope oil lease in Section 29, T27S, R27E, MDB&N of the Poso Creek oil field, Kern County. This operation is currently owned by. 'Berry Petroleum Company. An inspection confirmed that all sumps used for the disposal of -wastewater have been removed. J. Resolution No. 60-099, adopted 21 April 1960, prescribes requirements for. Intex Oil Company and governs the disposal of produced wastewater to all sumps in the*Vallecitos oil field. San Benito County. These operations are now owned by D.D. McDonald, Operator. All sumps used for the disposal of wastewater have been removed. k. Resolution No 60-2339 adopted 23 June 1960 rescribes Texaco Inco p requirments for all s Incorporated and governs the disposal. of produced wastewater'to cps in the Mountain Vied oilfield, Kern County. These operations are now owned by Nordic Oil Company. An inspection confirmed that all sumps have been removed, and the land .is currently being farmed, I. Order No. 91-016', adopted 25 January 1991, prescribed requireents for the County of Glenn, Willows Airport, Closure of Surface Impoundment, Glenn County. The requirements for closure were developed as a result of . the Board's RCRA Interagency Agreement with the Department of Toxic Substances Control. A RCRA.Post-closure permit for.the site was subsequently issued by the US EPA in February 1992, providing adequate regulation for the protection of water.quality.
