I have reviewed the smell mining operation for this.subject permit. and'
reclamation plan and due;to its size feel that there will be no problems
that would not be in keeping with the requirements of -the county and..
state Surface Mining Act.
It appears to be a small family operation and is being.conducted in a
reasonable and safe manner. I.would recommend you hold the required
hearings'and issue the permit. I am -attaching a copy of the applicant's..
plans,'however,.due to the small size of the operation, I will send only,
the reclamation plan form to the'state geologist.

The Department of•Fish.and Game has reviewed the mining permit
and reclamatioiL plan AP No. (81-135) 41-08727 and has the
following -:'comments -
1. The channel.of Dry.Creek;"should'-not be disturbed during
the mining operations. Any alteration .of the streambed
will require, a. written agreement with 'the Department in
accordance -with Fish .and Game.Code Section 1603.
2. Settling' ponds s:zould bei located abovethe I00 -dear flocu

water. :without:discha.rg11.1 to surface drainages.
3. Reclamation shoul.d.be.'accomplished concurrently with the

proceed to send copiesof the initial study to the State Clearing-
house for a 30 day review period pirkor to. the Planning Commission
hearing.' Otherwise, without adequate mitigation of ' the significant
impacts, an environmental-irwpact report (EIR) is. -required..
We will continue processing your project -upon receiving your written
reply to this matter. An early response to this notification,
sent to this department, will expedite the scheduling of your
project. We will also need IO.copies*of your plot plan for the
mining Operation phases to send to the State Clearinghouse; the plans
should be folded to 8�1.1 by 11"...s*ize.
