AUC File No: A01-02 Consistency" Finding for Kimberly Jensen — Rez a APN 41-080-049:, A consistency review of an application to rezone approximately 209 acres from Foothill Recreation — 40 -acre minimum (FR -40) to Foothill Recreation — 20 -acre minimum (FR -20). The property is located approximately 1,000 feet east of Clark Road on Out Of The Way Road, about 1 mile south of the Paradise town limits. Mr. Sanders presented the application for a rezone stating that the subject property is located in compatibility Zone D which has no restrictions on density or intensity. He further commented that the site is located on the east side of Clark Road actually at a lower elevation than the airportrunway; this site is a large odd -shaped parcel configured like a peninsula which extends southward into the canyon: In addition, he said that the parcel is assigned the land use designation Agricultural Residential which can accommodate a range of parcel size from f to 40 acres. Although the Jensen's application requests a rezone from -40 -acre parcels to 20 -acre parcels, Mr. Sanders' believes -the layout of the land would likely produce fewer than 10 parcels, perhaps only 4 to 6. Commissioner Grierson questioned whether consideration should be -given to possible lighting restrictions. Mr. Sanders responded that typical rural residential lighting will be used. He added that the terrain is of a lower elevation than the airport; the location is on the east side of Clark Road as opposed to the airport approach which is on the west side of Clark Road. Chair Rosene seemed satisfied that no lighting restriction_ would be needed. Commissioner Lambert asked whether an avigation easement might be warranted; it was determined that there is no need for such easement. Chair Rosene opened the hearing to the public. There were no public comments and the hearing was closed.: . Alternate Commissioner Greenwood made a motion, seconded by Commissioner Grierson, and unanimously carried to find the ALUC File #A01-02, Kimberly Jensen, consistent: The project was approved with the following findings: SECTION 1: ENVIRONMENTAL FINDINGS A. The property is located approximately :1,000 feet east of Clark Road on Out Of The Way Road, about 1 mile south of the Paradise town limits. FOR: Airport Land Use Commission Meeting on May 16, 2001 SUMMARY: Staff recommends ALUC find the project consistent with the Airport Land Use Compatibility Plan for the Paradise Skypark Airport, adopted on December 20, 2000. BACKGROUND: The site is located approximately 2,000 feet due east of the Paradise Skypark airport. The property is in the unincorporated County area and under County jurisdiction. The current General Plan land use designation is Agricultural Residential and the zoning is Foothill Recreation (FR) - 40 acre minimum parcels size. The property owner is seeking to rezone the property to FR -20 with a 20 acre minimum parcel size. If approved, the property could potentially be divided into ten 20+ acre parcels, however, it is unlikely this full development potential will be realized due to topography constraints of the site. The uses permitted in the FR -20 zone include one dwelling per parcel, agricultural uses, small family daycare facilities, group homes for 6 or fewer residents. ANALYSIS: According to the 2000 Airport Land Use Compatibility Plan (ALUCP) for the Paradise Skypark Airport, the property is located in a Traffic Pattern Compatibility Zone D, Other Airport Environs. Within the D zone residential uses and densities are deemed to be compatible with airport operations, without limitation to density or intensity. In Zone D, airspace review is only required for objects that will be 100 feet or taller. The entire site is. at or below 1,100 feet elevation, lower than the Paradise Airport runway which is at approximately 1,300 feet elevation. None of the uses permitted in the FR -20 zone will result in structures greater than 100 feet in height. Due to the elevation differences, structure height will not be an issue on this property. Environmental Documentation: No environmental documentation has been prepared for this project.
