Staff recommends the Commission find the project consistent with the Paradise Airport Land Use Plan. FOR: Airport Land Use Commission Meeting of January 15, 9997. SUMMARY: The County of Butte is presently processing the above mentioned project and has submitted a comment sheet and map to ALUC for review and comment. Staff recommends the Commission find the project consistent with the Paradise Airport Land Use Plan. ANALYSIS: This Butte County project is a Tentative Parcel Map on a 43, acre parcel located on the Circle J Road at Clark Road, Paradise. The applicant wishes to create two lots, one at 20 acres and the,other at 23.4 acres. There are two existing dwelling units on the project site, one on each proposed parcel. The project description was referred ,to the Airport Land Use Commission staff on November 14, 1996 for comment as part of the routine Request for Comments, and the Commission must respond within 60 days. Staff review consisted of land use compatibility, noise sensitivity and a comparison with the draft Policy Plan guidelines as indicated below. Based on this data and that the land use is not a significant change from what is currently planned, staff informed the Butte County Planning Division that the project was tentatively found to be compatible with the adopted Land Use Plan and would receive a formal ALUC recommendation at its January 15, 1997 meeting. Land Use Compatibility Staff reviewed the request pursuant to the currently adopted Paradise Airport Land Use Plan (PALUP). The extreme northeast portion of the project site is located within the overflight area and the approach zone. No dwelling units are located within these areas. Per Table 2 (page 14) in the PALUP, single family dwelling units are allowed in the overflight zone (FAR Part 77 Horizontal Surface area). There are no identified restrictions in the PALUP against residential development within the overflight area as this area is primarily concerned with height restrictions. The PALUP allows single family dwelling units within the approach zone, provided that a density of greater than one dwelling unit per 5 acres is not exceeded. ■ Butte County ■ Airport Land Use Commission ■ This project willi have a Aity of one dwelling unit per 20 ac re&r above the minimum acreage recommended by the PALUP. With densities of one unit per 20 acres this project does not represent a significant safety concern'for persons on the ground or for aircraft experiencing difficulties because of the large amount of open space. Noise Sensitivity' The project site is located outside of the 55 dB CNEL noise contours as depicted in the PALUP. Based on this data the project site is not in an area where the proposed use would be incompatible with identified noise level contours. Draft Policy Plan The draft Policy Plan that is presently under consideration indicates that single family residential uses are compatible in the overflight zone provided they are outside the 55 dB CNEL contour and do not result in a concentration of more than 25 people per acre at any one time. The Land Use Compatibility Guidelines as presently accepted indicate that single family residential uses are acceptable in the overflight zone pursuant to the five criteria found in Section II of the Policy Plan. As the safety zones are currently configured, the site is located in the Overflight Zone and the Commission would consider; (1) Height Restrictions; (2) Noise Compatibility; (3) Safety of Persons on the Ground; (4) Overflight Considerations; and (5) Surface Transportation Considerations when reviewing a project. RECOMMENDATION:- Staff recommends that the Butte County Airport Land Use Commission find that the proposed Butte County Tentative Subdivision Map #97-10 (Campbell) on APN 041- 080-129 is consistent with the Paradise Airport Land Use Plan subject to the following findings and recommended conditions in attached Exhibit "A". If the ALUC would like to take additional action on this project it would be limited to a recommendation to the Butte County Development Review Committee that although the project is consistent with the currently adopted Paradise Airport Land Use Plan, the ALUC does have additional concerns. This recommendations would only be advisory and would not require any overriding findings to dismiss. Section 1: ENVIRONMENTAL FINDINGS A. No environmental documents submitted at time of review. Section 2: PROJECT CONSISTENCY FINDINGS A. The ALUC finds the project is consistent with the Paradise Airport Land Use' Plan, and that the project is compatible with the viable, responsible operation of the Paradise Airport subject to the following recommended conditions. Section 3: RECOMMENDED CONDITIONS A. Property owners shall sign an avigation easement granting the right of continued use of the Paradise Airport in the airspace above the subject parcel and acknowledging any and all existing or potential airport operational impacts.
