City of Chico Vesting Tentative Parcel Map # S-97-4 (Engelbert) on APN 048-063-028 The following, findings have been prepared at the direction of the ALUC and are for the consideration of the City of Chico(local agency) when making a decision on this project. Section 1: ENVIRONMENTAL FINDINGS A. The Initial Study prepared for the project does not adequately address impacts related to the aircraft operations of Chico Municipal 'Airport as identified below. 1. There is no discussion of the safety impacts related to the overflight of aircraft as shown on CIC -2 of the Chico Municipal Airport Environs Plan; and 2. There is no discussion of single event noise impacts of low-flying aircraft; and 3. There is no discussion of .the impact of residential noise complaints relating to the alteration, reduction or loss of unrestricted aircraft operations at a"public facility. Section 2: PROJECT CONSISTENCY FINDINGS A. The ALUC finds the project is inconsistent with the Chico Municipal AirportEnvirons Plan .as identified below. 1. The CMAEP indicates the project is located within the Study Area as depicted in Figure CIC -6 and in Compatible Land Use Zone IV (CLUZ IV) as depicted in CIC -13; and 2. The project density of 5.8 units per acre is inconsistent with the CMAEP Section 8.3.5, CLUZ Area IV, which recommends residential densities of one unit per acre; and 3. The project is located within the Flight Corridor and approximately 200 feet south of the generalized heavy aircraft departure pattern and VFR Approach pattern as shown on CIC -2 which increases the potential for elevated noise and safety concerns; and 4. The, project is inconsistent with the CMAEP Section 8.3.5, CLUZ Area IV, which recommends disclosures to be made to all home buyers that noise and safety are potential impacts in this area; and . 5. The project is inconsistent with the CMAEP,Section 8.3.5, CLUZ Area IV, which recommends conditions requiring new buildings to be constructed with noise attenuation features as a design criteria. APN 047-280-025 (Humphreys/AnchordoQuy): A Request for Consistency Findings for a use permit/mining permit to allow the removal of up to 80,000 yards of previously excavated stock piled rock, to be processed and sold on property zoned A-160 (Agricultural -160 acre min) located at 3485 Keefer Road, Chico. FOR: Airport Land Use Commission Meeting of September 17, 1997. PROJECT RECEIVED: The project description was referred to the Airport Land Use Commission staff on September 3, 1997 for comment as part of the routine Request for Comments and the Commission must respond within 60 days. SUMMARY: The County of Butte is presently processing the above mentioned project and has submitted a comment sheet and map to ALUC for review and comment. Staff recommends the Commission find the project consistent with the Chico Municipal Airport Environs Plan. ANALYSIS: This Butte County project is a Use Permit to allow the removal of up to 80,000 yards of previously excavated stock piled rock, to be processed and sold on property zoned A-160 (Agricultural -160 acre min) located at 3485 Keefer Road, Chico. The site is the former Titan Missile Base. The operation will not involve the development of any additional structures and will not create excessive dust that may interfere with aircraft operations. Staff review consisted of land use compatibility, noise sensitivity and a comparison with the draft Policy Plan guidelines as indicated below. Based on this data and that the land use is not a significant change from what currently exists, staff informed the Butte County Planning Division that the project was tentatively found to be compatible with the adopted Environs.Plan and would receive a formal ALUC recommendation at its September 17, 1997 meeting. Land Use Compatibility Staff reviewed the request pursuant to the currently adopted Chico Municipal Airport Environs Plan (CMAEP). The project site is located within the Chico Municipal Airport Study Area (CIC -6), but is not within any identified Compatible Land Use Zones as depicted on CIC -13. There are no identified restrictions against the proposed use in the CMEAP. Noise Sensitivity The project site is located outside of the 55 dB CNEL noise contour as depicted in Figure CIC -6. The project will be a noise generator and will not be impacted any noise generated by aircraft • Butte County • Airport Land Use Commission • for theoperations. Staff also review the FAR Part 150 Noise om atibi it Program prepared' 7City of Chico for additional noise impacts evaluation. While it is understood that this document has not been accepted or adopted by the ALUC as a recognized, noise study or environs plan, it does provide additional information to assist staff in the review of projects. The study supports the current CMAEP data and places the project site outside of any noise sensitive areas. Based on this data the project site is not in an,areawhere the proposed use would be incompatible with identified noise level contours. Draft Policy Plan The Land Use Compatibility Guidelines as presently accepted indicate that mining activity' is acceptable in the overflight zone provided a bird hazard is not created by any formation of water bodies. Backfilling There will be no backfilling at the spoils mound as when the manmade pile is removed. The finished grade will reflect the original profile of the land as it was before the contractor's of the US Air Force dumped their surplus materials there. Backfilling will occur at three pits inside the base compound. These three pits were dug some years back to remove the liquid oxygen tanks that were buried there. The soil in'the bottom of these pits have been tested by Woodward -Clyde Federal Services and found to contain no hazardous materials. We will remove any scrap, etc. from inside these pits prior to backfilling and dispose of it in a proper and legal fashion. By filling in these three pits we will remove a very dangerous safety hazard as people trespass on this property all of the time. Even though they must cross over one gate, one fence, and numerous no trespassing signs, the desire to see the Titan Missile Sites are overwhelming. In filling in these three pits we would be removing a major liability problem. Page 9 . D. Drainage Original drainage will be restored. Currently, the land's original drainage has been diverted to the south end of the spoils pile. However, it crosses over on the backside base of the - 5 spoils pile and flows into its original drainage at a point about 100' away from the base of the pile in approximately the middle of the field. We will return the drainage back to its original flow through the middle of the area the spoils pile currently rests upon. All rain water. that currently falls into the total work area now flows into the existing drainage. At ' completion of work there will be no added amount of drainage area. F. & G. Surface Runoff Surface runoff will be controlled with county approved sediment dams placed across the existing drainage atlas many locations as needed to prevent any sediment from flowing from the immediate work area. All roads into the work site are paved and in good overall condition. 2. The loading area is paved. 3. The materials to be transported off the site was previously shot rock, the rock is very clean. .4. There are no immediate residences in the area. 5. The processor -operator has two water trucks and a good water source for dust control. 6. If the permit process would allow, the processing of this material would/could be . completed during the spring of this year when the soil is still damp. This would further reduce the dust problem. Page 15 As stated throughout this application -this is a manmade spoils pile. Reclamation of the area after the manmade spoils pile is removed would simply consist of a final grading operation to reform the soil to its original contour. As the original contour is relatively flat with a small taper to the center to reclaim the original drainage. The size and depth of this drain will reflect the original drain that still remains on the back (west) side of the spoils pile now. (This drain was blocked off when the spoils pile was placed here). ' After this, as this area is pasture land, this area would have to be reseeded with pasture "grasses. If cattle are in the area at this time, then a cattle fence would have to be erected to prevent damage to i the seeded area.
