Hogan, Planning Manager BY: Stephen Lucas, Planner DATE: September 14, 1994 REQUEST: Request for Consistency Findings Rezone for Foothill Park Unit #8 on APN 048-430-008: A request to rezone 19.5 acres of land located on the north side of East Lassen Avenue :and directly south of the Chico Municipal Aiport Clear Zone. FOR: Airport Land Use Commission Meeting of.IOctober 12, 1994 ABSTRACT: This request is for consistency findings in relation to the Foothill Park Unit #8 rezone. The request is to rezone 12.5 acres of land from N -C (Neighborhood Commercial) to R-2 (Medium Density Residential) to accommodate 72 lots for 144 attached single family homes. At the request of the City of Chico :Planning Department, ALUC is asked to consider the projects consistency with the goals and policies of the Chico Municipal Airport Environs Land Use Plan (CMAELUP). Staff recommends the ALUC find that the proposed project is inconsistent with the CMAELUP: ..,ANALYSIS: This proposal was first reviewed by ALUC at its regular meeting on July 8, 1992. The ALUC consensus at that time was that the project was considered to incompatible with the operation of the Chico Municipal Airport, but no action would be taken until the anticipated revision of the 1978 Airport Environs Plan is adopted. ALUC again reviewed the proposal at the ctobe Or 14 1992 meeting and found that the proposed rezone site is in area that is known to be subject to overflights of both arriving and departing aircraft and related noise and safety hazards and found that the project does not conform to the Policies -of the Chico Municipal Airport Environs Plan. ALUC revisited the issue again at the May 12, 1993 meeting, concluding that the previous comments and minutes remain the position of ALUC_ The present issues remain the same as in past actions. RECOMMENDATION: Staff recommends that the Butte County Airport Land Use Commission not support the proposed.rezone of the land known as Foothill Park #8, from N -C (Neighborhood Commercial) to R-2 (Medium Density Residential) subject to the following findings. Section 1: Consistency Findings A. Find that the proposed rezone site is in an area that is known to be subject to overflights of both arriving and departing aircraft and related noise .and safety hazards and does not conform to the Policies of the Chico Municipal Airport Environs Plan. .
